STATEMENT OF WORK
COMPUTER ASSISTED LEGAL RESEARCH
1.0 TITLE
Computer Assisted Legal Research II (“CALR-II”)
2.0 PURPOSE
The U.S. Department of Labor (DOL), Office of the Solicitor (SOL) (also referred to hereinafter as the Government) seeks to award a firm fixed price contract to a qualified Offeror to: (1) provide SOL personnel with cost effective on-line legal research services (“Computer Assisted Legal Research”, or “CALR”) in support of SOL's mission; and (2) provide a means for others at DOL to access these services as needed. The goal, throughout the life of the contract, is to obtain the most cost-effective, efficient, flexible, innovative, and productive blend of online legal research and public records services sufficient to meet DOL’s litigation, investigatory, and administrative needs. Vendors should include customizable access to legal research materials suitable for federal, state, local, tribal, and/or international litigation, as well as current and comprehensive financial, property, telecommunications, news, and other public records data. Although SOL will be the primary user of the on-line legal research capabilities, these services may be used DOL-wide to accomplish legal research needs. SOL seeks flexibility and economies of scale in licensing the number of CALR users on an annual basis.
This contract and Statement of Work (SOW) outlines the CALR services and support needed to provide services via the CALR II vehicle for an estimated 750-1,000 users.
The selected Contractor will provide all services and requirements identified in this contract, including any and all attachments thereto, in conformity with the terms stated therein.
3.0 INTRODUCTION
The Government seeks to award a cost-effective vehicle for unlimited access to commercially available CALR services that meet the basic research needs of SOL and, secondarily, DOL. The resulting contract will be the primary source for CALR services within SOL but not necessarily the only source for such services.
DOL is the executive branch agency of the federal government primarily responsible for fostering and promoting the welfare of the job seekers, wage earners, and retirees of the United States. DOL’s mission includes improving working conditions, advancing opportunities for profitable employment, protecting retirement and health care benefits, helping employers find workers, strengthening free collective bargaining and tracking changes in employment, prices, and other national economic measurements. In carrying out this mission, DOL administers and enforces more than 180 federal labor laws, including those that guarantee worker’s rights to safe and healthful working conditions, a minimum hourly wage and overtime pay, freedom from employment discrimination, unemployment insurance, and other income support. These mandates and the regulations that implement them cover many workplace activities for about 10 million employers and 125 million workers.
3.1 SOL Organization and Mission
SOL is the legal arm of DOL, and its mission is to provide high quality legal services to the Secretary of Labor and the agencies within DOL. Investigations and litigation enforcement actions are critical to the mission of the DOL, and SOL has an active role in many such matters. In addition, as the Secretary of Labor and other DOL officials seek to accomplish DOL's overall mission and to further specific priorities, SOL provides legal advice regarding how to achieve those goals.
SOL has independent litigating authority under numerous federal statutes. SOL litigates the great majority of its enforcement actions without support or oversight by the Department of Justice or other legal entities in the federal government. As a result of this unique authority, SOL attorneys regularly appear in federal court and administrative tribunals throughout the country, pursuing enforcement actions against employers and others who violate federal labor laws and worker rights. Outside the courtroom, SOL is regularly called upon to provide advice on varied and complex legal issues as well as to review and guide the development of regulations and interpretive material. SOL has over 500 attorneys and a total staff of over 700 to address the many complex legal issues that arise in administering and enforcing federal labor laws and their implementing regulations. These users will be located in SOL’s ten (10) divisions in its Washington, D.C. National Office, its fourteen (14) regional and sub-regional offices (Arlington (VA), Atlanta, Boston, Chicago, Cleveland, Dallas, Denver, Kansas City, Los Angeles, Nashville, New York City, Philadelphia, San Francisco, and Seattle) (see http://www.dol.gov/sol/contacts/main.htm for street addresses), and additional DOL office locations. The SOL National Office, located in Washington, D.C., includes ten (10) divisions that provide program advice and litigation services to specific DOL agencies. About half of all SOL attorneys are located in fourteen (14) regional and sub-regional offices across the country where they regularly engage in trial litigation in federal district courts and before administrative law judges. These regional and sub-regional offices are sometimes called “RSOLs,” meaning that they are Regional Solicitors of Labor (e.g., Boston RSOL, Philadelphia RSOL).
4.0 SCOPE OF CONTRACT
The CALR II contract will be used to obtain on-line computerized access to legal authority, news, financial, public record, dockets and related information databases, including but not limited to federal and state court cases, administrative decisions, statutes, regulations, legal treatises, legislative histories, and related support services for DOL on an unlimited access basis.
Required services to be provided under this contract include:
Computerized access to complete legal, news, financial, public record and other information databases as discussed further in Sections 4.5 and 4.7 of this document;
Full-text search and retrieval capability within individual databases and across databases as discussed further in Section 4.3 of this document; and Related support services, such as but not limited to conducting account maintenance (creating and disabling accounts), research librarian assistance with crafting search queries and pinpointing appropriate sources of authority to query, and conducting live and remote learning training sessions on CALR-related topics.
4.1 CALR Users
As noted previously, the majority of users of CALR services to be provided under this contract work within SOL. Of SOL’s current staff of approximately 560 attorneys nationwide, approximately 320 are located in the RSOLs outside Washington, D.C., where their responsibilities consist almost entirely of work related to litigation in federal district courts and before administrative law judges. In SOL’s National Office, a large number of the approximately remaining 240 attorneys are also involved in litigation, principally in the federal courts of appeals and before administrative tribunals. In addition to these attorneys, SOL offices include a smaller number of paralegals, litigation support specialists, and other CALR users.
The number of CALR users within DOL fluctuates depending on the needs of DOL. On a historical basis, over the past ten (10) years, there have been as few as 800 CALR users and as many as 1,200 CALR users, with the most significant http://www.dol.gov/sol/media/brochure/sol.pdf http://www.dol.gov/sol/contacts/main.htm fluctuation occurring in the number of non-SOL DOL users. Given the nature of the work performed and the types of matters that SOL handles, SOL cannot provide a specific guarantee of the patterns or volume of use under this contract.
Accordingly, SOL seeks flexibility in licensing the number of CALR users on an annual basis.
4.2 CALR Use Cases
CALR users shall be able to access the Offeror's online system using existing DOL equipment and telecommunications capabilities, where such equipment may include desktop and laptop computers, government-furnished “smartphones,” and government-furnished tablet and other mobile devices. DOL users shall access the Offeror's system via the Internet and via a standard browser capable of supporting http or https protocols, including but not limited to: Microsoft Internet Explorer: Microsoft Edge; Google Chrome; Mozilla Firefox; Apple Safari, and Opera. Most users will access the Internet through the DOL intranet firewall; some users will have dial-up or broadband access at work or from other remote locations, including for example, but not limited to their residences, hotels, and locations where legal proceedings are taking place (e.g., depositions, hearing rooms, etc.).
The Offeror shall provide all connection resources necessary (i.e., equipment, software, and telecommunications services) so that DOL users can access its CALR systems via an existing third-party Internet connection (i.e., an Internet connection not provided directly by Offeror).
In addition to offering CALR access via web browser, the Offeror may offer DOL users Offeror-supplied software for the following computing platforms that offers similar or additional features to the functionality available through Internet browser access to Offeror’s CALR platform:
(a) Desktop or laptop PCs that are on TCP/IP local area networks or connected to a wide area network via cellular modem/wifi card, where such computers may be used in a federal building, on travel, or at home by DOL users;
(b) Smartphones running Apple iOS, Windows Mobile, or Android operating systems, and
(c) Tablet and mobile computing devices running Apple iOS, Windows Mobile, or Android operating systems.
The possibility of optimized viewing and access for mobile devices is strongly encouraged, even if such optimized experience is provided via vendor-supplied application (“app”), rather than via standard browser.
4.3 CALR Functionality Requirements
4.3.1 Search and Retrieval Functions
The CALR system shall provide full text search and retrieval functions appropriate for accessing data repositories including those specified in Sections 4.5 and 4.7 of this Document.
At a minimum, the system shall provide the specified search and retrieval functions for all legal authority repositories. For the news, business and journal databases listed and the people and public record databases, the Offeror shall provide online, interactive search and retrieval functions that contain all the functions applicable to legal databases.
4.3.1.1 Database Selection
The system shall provide access to the content specified in Section 4.5 via multiple methodologies. The system shall incorporate a menu selection process that enables users, at a minimum, to access databases by database name or by retrieval of previously selected databases (e.g., a “favorites” list). Similar or related databases must be available in various useful combinations. For instance, opinions of the Supreme Court of the United States might be available as an individual database and as part of combined database of Federal District Court, Federal Circuit Court, and Federal Supreme Court opinions.
In addition to providing access to all users of all databases, the system shall allow:
(a) A DOL user to select a subset of content (e.g., a database) at initial logon and easily switch to different content sources (databases) during a research session.
(b) A DOL user to identify a client or matter for research queries performed and be able to switch to a different client or matter, if necessary, during a research session.
4.3.1.2 Retrieving Documents by Citation
Many of the legal databases specified herein contain documents with one or more standard forms of citation (e.g., 480 U.S. 102, Revenue Ruling 88-1, 5 United States Code 1). Where the document exists in one of Offeror’s information repositories, the system shall allow the user to directly access a document for browsing and/or retrieval by specifying the document in one of the following ways:
(a) According to the citation form therefore in the current edition of The Bluebook: A Uniform System of Citation (the “Bluebook”); or
(b) In the case of a document for which no citation form is prescribed in The Bluebook, according to another standard form of citation, or,
(c) According to any additional or different citation form required or recognized by the relevant court or jurisdiction (e.g., the Indigo Book, Maroonbook, and ALWD Citation Manual).
4.3.1.3 Text-Based Searching
The system shall provide the following minimum set of database search functionalities:
(a) Natural language searching, as described generally here:

(b) Boolean search operators equivalent to “AND”, “OR” and “AND_NOT”, whether these or alternate operators are used as part of the actual search query language;
(c) Proximity search operators that express both the nearness of two search terms and the requested word order of these terms, e.g., “THIS followed by THAT”, “but not THAT followed by THIS”);
(d) The ability to group or prioritize complex search results via parentheses and standard Order of Operation logic (e.g., “(This AND That) NOT Those” returns different search results from “This AND (That NOT Those”);
(e) Both infix (e.g., m*n is equivalent to man OR men) and postfix (e.g., litiga** is equivalent to litigant or litigate) wildcard characters in search terms. Prefix wildcard searching (e.g., *iterate to find both “literate” and “illiterate”) is helpful but not required, but Offeror must state whether prefix wildcard searching is available;

(f) The ability to restrict a search query to one or more specified document segment/fields (e.g., judge, opinion date, case name, or opinion in a database of court opinion documents);
(g) The ability to recall to the screen the previous search expression entered by the user, modify the expression and execute the modified search expression or base a search on the result of a prior search;
(h) The ability, during a single continuous research session, to view the history of search queries / databases used and to return to an earlier query; and
(i) The ability to direct a search query against multiple databases/libraries in a single search.
4.3.1.4 Alternate Search Tools
In addition to the citation and keyword querying described in Sections 4.3.1.2 and 4.3.1.3 of this SOW, Offeror’s CALR system shall also offer alternate methods of identifying potentially relevant legal authority and search results.
Offeror’s CALR system shall include a methodology for finding legal authority that pertains to a given topic, whether or not all items in the search result contain specific search terms (e.g., an ability to find legal opinions pertaining to “intentional torts committed on government property” or legal authority relating to “suspension and debarment of federal government contractors.”)
The system shall also include references to the most relevant areas of decisions or treatises that pertain to a given topic within the display of that decision or treatise.
4.3.2 On-Screen Document Review
In the context of a research session, the Offeror’s system shall provide the following minimum functionality:
(a) The ability to display, on screen, the full text of a single document retrieved by citation, including any footnotes or endnotes that are part of the document.
(b) The ability to display, on screen, the full text of a single document from the set of documents returned in response to a search request with each occurrence of each term used in the search request highlighted for easy identification, where such highlighting shall also extend to the text of any footnotes or endnotes that are part of the document
(c) The ability to page or scroll forward or backward through a single document displayed on screen, in a way that supports linear reading of the document.
(d) The ability to move forward or backward through a single document displayed on screen, viewing only those portions of the document that contain highlighted terms. If this facility is provided through an abbreviated keyword in context display, the system must display at least 20 words on either side of a highlighted term, and it is desirable if the size of this “before and after” context can be adjusted by the user within the framework of a research session.
(e) The ability to display only the document titles for the documents returned by a search query (i.e., display a citation list).
(f) The ability to display, after execution of a search query, highlighted search query terms, and a portion of the text surrounding the search words, without having to display the full text (i.e., key words in context).
4.3.3 Citators
The system shall provide at least two different types of citator functionality. At a minimum, both the case history citator and the general citator functionality described below shall be provided for all of the federal and state court opinion repositories / databases specified in Section 4.5 of this Document.
(a) A case history citator shall provide the outcome of a given case, through the various appellate levels, on a case-by-case basis. The case history citator shall be updated on no less than a daily basis so the most recent appellate and subsequent action for each active case is available. The case history citator shall be available to show the entire activity surrounding a given case, including appellate status, regardless of whether the search query returns a lower court opinion, the final appellate opinion, or any intermediate opinions.
(b) A general citator shall provide a more in-depth treatment of each case/opinion than the case history citator. The general citator shall include a comprehensive list of references made to a given case/decision in other court opinions, law reviews and other applicable publications. For referencing documents that are presented in a volume/page format (e.g., 315 U.S. 649), the page number on which the primary reference occurs must be presented (e.g., 315 U.S. 649 at page 656 or 315 U.S. at 656).
(c) The Offeror’s system shall allow the user to request a citator/case history display for a specific court decision displayed on screen or available for browsing in a citation list (see 1.5.1.4(e)). The system shall also permit a user or to enter the citation of desired given decision and obtain its history from that information. Within the display of a citator/case history, case citations shall serve as direct links (e.g., hyperlinks) to the full text of an individual referenced document, if that document is available in Offeror’s system.
(d) The system shall provide the citation history for any decision or appropriate primary source in a manner that allows the user to identify the historical treatment of that decision across various jurisdictions within the United States. Analytics about the treatment of decisions shall also be included in the offeror’s system.
(e) The Offeror shall provide software or functionality within Offeror’s CALR system that integrates with Microsoft Office (Office 2013, Office 2016, or Office 365) and provides at least the following functionality: (1) validates citations in documents against the online citators (see Section 4.3 of this Document); and (2) checks quotations from cited documents against the full text of these opinions stored in Offeror’s system. The Government does not require but prefers a solution that also offers this same functionality in connection with Google Docs and/or word processing/text editing software available on iOS, Windows Mobile, and Android OS mobile devices.
4.3.4 Printing and Downloading
The Offeror’s CALR solution shall provide the following printing and downloading facilities for browser and PC software access:
(a) The ability to download, e-mail, or print, as a single operation, one or more selected documents to a printer connected (either directly or as a shared network device) to the workstation of a user, where such printout shall include accurate page numbers (as part of the document text or reflect in the actual pagination of the printout) reflecting the pagination of legal authority as it appeared in a hardcopy reporter of record, or, if the document never appeared in hardcopy format, such alternate pagination (such as numbered paragraphs) as was used by the digital location where the document was made officially available.
(b) The ability to download one or more selected documents to the user's workstation, in either PDF format or in a formatted word processing format, and the ability to store the documents in a user-specified location for later printing or manipulation through a word processing program.
(c) Unlimited printing and downloading of retrieved documents, including all available PDF formats, subject to copyright and licensing restrictions in the final contract.
(d) Available download formats for documents shall include, at a minimum, searchable .PDF, formatted word processing (e.g., Microsoft Word), and ASCII or RTF text.
4.3.5 Automatic Search, Retrieval, and Alerts
The Offeror’s CALR system shall provide the ability for users to enter a query against selected databases, which will run automatically at specified intervals, including, at a minimum, once a day. For this functionality, the user will be notified online, or via e-mail or fax, of any new search results since the query was last run.
4.3.6 Search Functionality Through Case Summaries, Notes, and Finding Systems
The Offeror’s system shall provide the ability to allow users to locate legal authority and other related materials through use of finding systems, taxonomies, or other research aids (e.g., case summaries, head or lead notes, identification of key portions of cases, case notes, digests).
4.3.7 Hardcopy Page Citations
The Offeror’s system shall provide the ability to track legal authority content to the official/original source’s hardcopy page citations and official reporters.
4.4 Availability
The Offeror's web-based legal research system shall normally be available to all users authorized under this Document on a 24/7/365 basis. Extraordinary downtime for which the Government is given at least 48 hours advance notice, and which does not take place during weekday business hours (8AM to 10 PM Local Time), will not be counted as downtime.
"Available" is defined as the system allowing any DOL user to log onto the Offeror's CALR system, search any database file(s), and retrieve and download the requested information.
The system shall be available so that system downtime is no greater than four (4) hours per month. "System downtime" is that period of time when the system is not fully available to DOL CALR users due to a malfunction or limitations in the Offeror's equipment, software, or telecommunications connections.
System downtime will be measured on a monthly basis and included in the Offeror's usage reports (see Section 5.6.).
4.5 Databases
For each database category and subcategory, the Offeror shall provide the specific databases included in its offer for that category or subcategory, and the system shall provide sufficient identification information for the user to identify it by, for example, providing the trade name by which it identifies the repository scope, and dates of coverage for each database.
Offeror shall have a continuing obligation during the pendency of the CALR II contract to provide the specific databases referenced below for the period of time identified, including all coverage provided in the contract and related information.
The Offeror shall promptly identify to the Contracting Officer or the Contracting Officer’s Representative any changes in content within any of its databases available through the CALR II contract. If the Offeror needs to change or substitute its proposed solution to the database requirements listed below, which was previously available during this contract, Offeror shall identify an alternate means of obtaining this same content and shall bear any additional costs necessary for DOL users to access this content.
4.5.1 Legal Databases
The Offeror shall provide unrestricted access to full-text search and retrieval for all of the following legal databases and database categories, providing for each the information described previously. The Offeror shall continue to provide the authority listed below during the entirety of the contract. DOL considers the following databases material minimum requirements of the contract, as access to such repositories is critical for mission accomplishment.
(a) All federal case law, reported and unreported, from the following courts, from inception of the legal authority to the present.

4.5.2 News, Business and Journal Databases
The Offeror shall provide full-text, online news, business and journal databases in each of the following categories:
(a) News and newspapers covering each of the major metropolitan areas of the United States;
(b) Journals, newsletters, and directories covering major trades, professions, businesses, and corporate sectors;
(c) Medical journals or medical publications;
(d) Legal news, newsletters and magazines pertaining to the legal profession.
4.5.3 People and Public Record Databases
Offeror’s CALR system must provide access to online databases of current public records. The Offeror’s access to public records shall be of a manner and functionality that allows for ease of use, accuracy of data, consistency of access, availability, and coverage during the entire contract period.
The public records databases shall provide the ability for SOL users to search for: people and business locators, with coverage of the United States, including, but not limited to the following:
Real and personal property records Real and personal property tax records
Motor vehicle and driver’s license records Corporate registrations and records State and Federal civil and criminal court filings Bankruptcy filings Judgments, liens and UCC liens and filings Professional licenses People and business locators, finders and directories (such as nationwide telephone directories, reverse telephone directories, and databases that include credit header information).
In addition, DOL may request to access to “Investigator” and/or “Law Enforcement” type repositories for DOL investigations and/or queries stemming from various matters. For DOL access of “Investigator” and/or “Law Enforcement” type repositories, SOL seeks access in increments of 50 users.
4.6 Database Maintenance
The Offeror shall maintain the accuracy and currency of all database files (except private files as explained further in Section 4.7.3). All database corrections and updates shall be made available to DOL users at the same time they are made available to the Offeror's commercial users.
4.7 Optional System Capabilities
The Offeror may provide, as part of its offering, additional databases or capabilities.
