GENERAL INFORMATION

1.1 Description of Services/Introduction:

The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to provide meeting space and pertinent audiovisual equipment for the 2023 CES All State Training Conference as defined in this Performance Work Statement. The contractor shall perform to the standards in this contract.

1.2 Background:

The Office of Employment and Unemployment Statistics intends to conduct a national meeting with our state partners working on the Current Employment Statistics (CES) program. The CES All State Training Conference enables discussion of objectives, policies, systems, and changes within the employment and unemployment programs overseen by this body.

The CES All State Training Conference will be held August 15-16, 2023, in Washington, DC. These dates are fixed.

1.3 Objectives

- Offer of accommodations priced no higher than the August 2023 GSA lodging per diem rate for CES All State Training Conference participants from August 14, 2023, through August 17, 2023.

- Meeting space for CES All State Training Conference sessions from August 15, 2023, through August 16, 2023

- Audiovisual equipment to support the conferences.

1.4 Scope:

The requirement is for a full-service hotel in Washington, DC, to provide meeting space and pertinent audiovisual equipment for the 2023 CES All State Training Conference. Additionally, rooms must be offered to meeting participants for no more than the August 2023 GSA lodging per-diem rate for Washington, DC.

1.5 Period of Performance:

The period of performance for this contract is August 14, 2023, through August 17, 2023. These dates are fixed. There are no options for this contract.

1.6 General Information

1.6.1 Quality Control:

The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. As a minimum, the contractor shall develop quality control procedures that address the areas identified in Technical Exhibit 1, “Performance Requirements Summary”. After acceptance of the quality control plan, the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system. The QC plan should be delivered 14 days after contract award.

1.6.2 Quality Assurance:

The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.3 Government Remedies:

The contracting officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items” or 52.246-4, “Inspection of Services-Fixed Price” for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

1.6.4 Recognized Holidays:

This statement of work does not include work performed during recognized federal holidays.

1.6.5 Hours of Operation/Place of Performance:

The contractor is responsible for performing services between the regular business hours between August 14, 2023, and August 17, 2023. The Contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this statement of work.

1.6.6 Type of Contract:

The government anticipates award of a firm-fixed price contract.

1.6.7 Security Requirements:

1.6.7.1 Physical Security.

The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

1.6.7.2 Conservation of Utilities.

The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.

1.6.8 Special Qualifications:

There are no special qualifications for contractor personnel in this requirement.

1.6.9 Post Award Conference/Periodic Progress Meetings:

The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.10 Contracting Officer Representative (COR):

A COR will be delegated separately.

1.6.11 Contract Manager:

The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer.

The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.

1.6.12 Identification of Contractor Employees:

All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. Contractor personnel will not be required to obtain or wear any badges in addition to those already required by the Contractor.

DEFINITIONS & ACRONYMS

2.1 General:

This section includes all special terms and phrases used in the PWS:

PWS. Performance Work Statement

Contracting Officer’s Representative (COR). A representative from the requiring activity assigned by the Contracting Officer to perform surveillance and to act as liaison to the contractor

Defective Service. A service output that does not meet the standard of performance associated with it in the Performance Work Statement.

DOL. Department of Labor

Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

Quality Control. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the

PWS.

Quality Assurance. Those actions taken by the government to assure services meet the requirements of the Performance Work Statement.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3.1 General:

The government shall provide, the facilities, equipment, materials, and/or services listed below.

3.2 Equipment:

The Government will not provide equipment for the contractor’s use in performance of duties outlined in this PWS.

3.3 Facilities:

The contractor will furnish all necessary workspace required to support the effort(s) outlined in this PWS, to include desk space, telephones, computers, and other items necessary to maintain an office environment. If deemed necessary, the Government may issue, at its discretion, supplemental equipment (e.g. computing equipment).

CONTRACTOR FURNISHED ITEMS AND SERVICES

4.1 General:

Except for those items specifically stated to be government furnished in Part 3, the contractor shall furnish all items and services required to perform this PWS.

SPECIFIC TASKS

5.1 Basic Services:

The contractor shall provide the following services:

a. Contractor shall accommodate attendees within one hotel, which shall be equipped with conference facilities. The hotel shall be located in the Washington, DC Central Business District as defined by the District of Columbia Department of Transportation and within short walking distance of a variety of restaurants.

b. The hotel shall be compliant with American with Disabilities Act (ADA) standards and shall be registered on the System for Award Management (SAM) and the US Fire Administration. The hotel shall be a full-service property, which includes a restaurant serving breakfast, lunch, and dinner.

c. The following table displays the number of rooms required for each day:

The hotel shall not release any room that is booked by the individual attendee unless the individual attendee cancels the booking or does not arrive the day after his or her expected arrival day. The hotel shall specify a 48-hour normal commercial practice for late arrival/cancellations. The conference attendees will be required to make their individual room reservations with the hotel prior to a date agreed to by the hotel and the BLS. BLS requires the number of private sleeping rooms with private bathroom to be available at a cost no higher than the government per diem lodging rate for August 2023 of $172 per night.

d. The contractor shall provide an area for conference registration outside of the plenary session meeting room. This area should be equipped with one table and three chairs.

The contractor shall provide meeting space and A/V needs as outlined in the following table.

e. All meeting room space should be for the exclusive use of the BLS during the contracted days. The contractor shall provide a diagram of the meeting room space. Diagrams shall show flow of space with set-up required, dimensions of the room, visibility of the speaker, and acoustics.

f. The contractor shall provide the following audio/visual equipment and set-up services of this equipment as outlined in section 2d for the plenary session:

i. 1 linked video projector package (August 15 and 16), which should include projectors, table for the projectors, screens, and any necessary cords or cables to operate the projectors from the podium.

ii. Podium with wired microphone

iii. Two wireless microphones with floor stands.

iv. One wireless microphone with table stand.

v. Wireless internet

The contractor shall provide the following audio/visual equipment and set-up services of this equipment as outlined in section 2d for the breakout space:

i. 1 linked video projector package, which should include projectors, table for the projectors, screens, and any necessary cords or cables to operation the projectors from the podium.

ii. Podium with wired microphone

iii. Two wireless microphones with table stands.

iv. Wireless internet.

Proposal shall not contain any attrition and/or cancellation clauses.

I - Contract Clauses

52.204-3 Taxpayer identification. (OCT 1998)

(a) Definitions.

Common parent, as used in this provision, means that corporate entity that owns or controls an affiliated group of corporations that files its Federal income tax returns on a consolidated basis, and of which the offeror is a member.

Taxpayer Identification Number (TIN), as used in this provision, means the number required by the Internal Revenue Service (IRS) to be used by the offeror in reporting income tax and other returns. The TIN may be either a Social Security Number or an Employer Identification Number.

(b) All offerors must submit the information required in paragraphs (d) through (f) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26 U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the IRS. If the resulting contract is subject to the payment reporting requirements described in Federal Acquisition Regulation (FAR) 4.904, the failure or refusal by the offeror to furnish the information may result in a 31 percent reduction of payments otherwise due under the contract.

(c) The TIN may be used by the Government to collect and report on any delinquent amounts arising out of the offeror's relationship with the Government (31 U.S.C. 7701(c)(3)). (a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to-

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. (C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
