Performance Work Statement (PWS) for Government Documents Research Database

PART 1- GENERAL INFORMATION

1.1 Description of Services/Introduction:

The vendor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to deliver a government documents research database as defined in this Performance Work Statement. The vendor shall perform to the standards in this contract.

1.2 Background:

The Wirtz Labor Library requires online access to a collection of federal, congressional, and legal publications with historical through present-day coverage. Department of Labor (DOL) staff, particularly those in the Solicitor’s Office, rely on access to an extensive collection of these materials to conduct legal research. These materials are most frequently utilized for legislative histories, to answer legal reference questions, and to conduct federal regulatory research. These documents are also frequently referred to and cited by DOL staff to justify opinion letters, case work, and regulations.

The collection shall include complete historical through present-day coverage of publications such as the Congressional Record, the Federal Register, and the U.S. Code. Materials should be indexed, full-text searchable, and downloadable in PDF format. Department-wide online access through IP authentication is required to service DOL staff in national and regional offices.

1.3 Objectives:

The vendor shall provide electronic access to a diverse collection of historical and present-day government documents to DOL staff.

Generally, this goal will be fulfilled through the following objectives:

1.3.1 Access to a database of government documents via a centralized vendor-provided platform: All collections shall be indexed, full-text searchable, and downloadable in PDF format through a centralized platform. Access shall be via IP authentication to provide users with instantaneous access to the resources as long as staff are logged into the DOL network.

1.3.2 Access to specific collections of government documents: DOL staff require access to the complete collections government documents such as the Code of Federal Regulations (CFR), Federal Register (FR), U.S. Code, U.S. Statutes at Large, Congressional Record (Bound and Daily), Annals of Congress, Register of Debates, and Congressional Globe.

1.3.3 Access to an administrator account: Library staff needs to have the ability to review resource use level, to customize the appearance of the platform, and to access title lists.

1.4 Scope:

DOL employees require access to a collection of historical and present-day government documents and other legal research resources accessible via IP authentication.

1.5 Period of Performance:

The period of performance shall be for one (1) Base Period of 12 months and four (4) 12-month option periods. The period of performance reads as follows:

Base Period: June 15, 2023 through June 14, 2024 Option Period I: June 15, 2024 through June 14, 2025 Option Period II: June 15, 2025 through June 14, 2026 Option Period III: June 15, 2026 through June 14, 2027 Option Period IV: June 15, 2027 through June 14, 2028

The Government reserves the right to extend the term of this contract at the prices set forth in Section 1 in accordance with the terms and conditions contained in clause 52.217-9 entitled, “Option to Extend the Term of the Contract”.

1.6 General Information

1.6.1 Government Remedies:

The Contracting Officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items” or 52.246-4, “Inspection of Services-Fixed Price” for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

1.6.2 Hours of Operation/Place of Performance:

The vendor is responsible for providing 24/7 year-round access to its resources.

1.6.3 Type of Contract:

The government anticipates award of a firm fixed price contract.

1.6.4 Post Award Conference/Periodic Progress Meetings:

The vendor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.5 Contracting Officer Representative (COR):

A COR will be delegated separately.

1.6.6 Contract Manager:

The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer.

The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.

1.6.7 Identification of Contractor Employees:

All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

PART 2- DEFINITIONS & ACRONYMS

PWS. Performance Work Statement

Contracting Officer’s Representative (COR). A representative from the requiring activity assigned by the Contracting Officer to perform surveillance and to act as liaison to the contractor

Defective Service. A service output that does not meet the standard of performance associated with it in the Performance Work Statement.

DOL. Department of Labor

Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

Quality Control. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the

PWS.

Quality Assurance. Those actions taken by the government to assure services meet the requirements of the Performance Work Statement.

PART 3 - GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES

3.1 General:

The government shall not provide any facilities, equipment, or materials.

PART 4 - CONTRACTOR FURNISHED ITEMS AND SERVICES

4.1 General:

The contractor shall furnish everything required to perform this PWS.

PART 5 - SPECIFIC TASKS

5.1 Basic Services:

The vendor shall provide access to a database of historical and present-day government documents via a centralized vendor-provided platform. The platform shall allow:

1. Basic and advanced full-text search options across document collections;

2. Browsing by type of government document;

3. The ability to email, print, or save retrieved documents;

4. The ability to access content via IP authentication with no sign-ins required; and

5. The ability to access the database 24/7 from a secure web site.

The vendor shall provide access to the following collections of documents, at minimum:

1. Full-text of the Code of Federal Regulations (CFR), 1938-Present

2. Full-text of the Federal Register (FR), 1936-Present;

3. Full-text of the U.S. Code, 1925-Present;

4. Full-text of the U.S. Statutes at Large, 1789-Present;

5. Full-text of the Congressional Record, Complete Bound and Daily 1980-Present;

6. Full-text of the Annals of Congress, Register of Debates, and Congressional Globe;

7. General collection of congressional hearings;

8. General library of federal legislative histories;

9. General collection of federal agency documents, decisions, and appeals; and a

10. General collection of law journals.

The vendor shall provide an administrator account to library staff.

1. Library staff must have access to usage reports, title lists, and platform customization tools.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. (d) Comptroller General Examination of Record. (a) The Government may extend the term of this contract by written notice to the Contractor within five; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least five days before the contract expires. A. Applicability

Contracting Officers shall insert this clause in all solicitations and awards. For existing awards, the Contracting Officer will determine whether the contract action should be modified to incorporate the clause.

1. Electronic Invoice Submittal

Invoices for the services/goods provided under this award shall be submitted through the Department of Treasury's Invoice Processing Platform (IPP) or through the Department of Labor (DOL) Quickpay email system, as directed by the Contracting Officer. IPP is a Federal Government owned and operated website accessible to contractors free of charge. Information about IPP, including enrollment instructions, are available and should be obtained by the enrolled contractors directly from the Department of Treasury after award at, https:www.ipp.gov.

a. The following instructions apply to Invoices submitted through IPP.Gov or the DOLQuickpay email system:

IPP invoice attachments SHALL NOT exceed the size limit of 10 megabytes (MB) each. However, you may submit multiple attachments of less than 10MB each with the invoices.

(i) DO NOT submit an invoice or attachment that uses shading or color.

A) An emailed Portable Document Format (PDF) image cannot have any text that has a background with any color other than white. If the image has a shaded background, it will be converted to black, and the text will be illegible.

B) An emailed Tagged Image File Format (TIFF) image must be black and white.

DOL 2015-03 Internet Protocol Version 6 (IPv6) Clause (May 2015)

"In accordance with FAR Parts 11.002(g), 12.202(e), and 39.101(d), the contracting officer shall insert the following clause in all solicitations/awards when acquiring information technology products or services that are expected to exceed the micro-purchase threshold.

INTERNET PROTOCOL VERSION 6 (IPv6) Clause

(May 2015)

(a) Any system or product that includes: hardware, software, firmware, and/or networked components including but not limited to voice, video, or data that is developed, procured, or acquired in support and/or performance of this requirement shall be capable of transmitting, receiving, processing, or forwarding digital information across system boundaries that are formatted in accordance with commercial standards of Internet Protocol (IP) version 6 (IPv6) as set forth in the USGv6 Profile (NIST Special Publication 500-267) and corresponding declarations of conformance defined in the USGv6 Test Program.

(b) This IPv6 capable system or product shall maintain interoperability with IPv4 systems and provide the same level of performance and reliability capabilities of IPv4 systems.

(c) This IPv6 capable system or product shall have available IPv4 and IPv6 technical support for development, implementation, and troubleshooting of the system.

(d) This IPv6 capable system or product can be upgraded, or the vendor will provide an appropriate migration path for industry-required changes to IPv6 as the technology evolves, at no additional cost to the Government.

(e) This IPv6 capable system or product must be able to operate on networks supporting IPv4 & IPv6, as well as networks that support both.

(f) Any system or product whose IPv6 non-compliance is discovered and made known to the vendor/contractor within 12 months of the start of performance shall be upgraded, modified, replaced, or brought in to compliance at no additional cost to the Federal Government.

DOLAR 2952.201-70 CONTRACTING OFFICER'S REPRESENTATIVE (COR) CLAUSE

(a) A Contracting Officer's Representative (COR) will be delegated upon award. A copy of the delegation memorandum will be provided to the COR and a delegation letter sent to the vendor.

(b) The COR is responsible, as applicable, for receiving all deliverables; inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual scope of work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.

(c) The COR does not have the authority to alter the contractor's obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If, as a result of technical discussions, it is desirable to alter/change contractual obligations or the scope of work, the contracting officer must issue such changes.

DOL 2012-02 CONTRACTOR'S OBLIGATION TO NOTIFY THE CONTRACTING OFFICER OF A REQUEST TO

CHANGE THE CONTRACT SCOPE (CONTRACTOR'S OBLIGATION CLAUSE)

"(a) Except for changes identified in writing and signed by the Contracting Officer, the Contractor is required to notify, within five working days of receipt or knowledge, any request for changes to this contract (including actions, inactions, and written or oral communications) that the Contractor regards as exceeding the scope of the contract. On the basis of the most accurate information available to the Contractor, the notice shall state:

(1) The date, nature, and circumstances of the conduct regarded as a change in scope;

(2) The name, function, and activity of each Government individual and Contractor official or employee involved in, or knowledgeable about, such conduct;

(3) The identification of any documents and substance of any oral communication involved in such conduct;

(b) Following submission of this notice, the Contractor shall continue performance in accordance with the contract terms and conditions, unless notified otherwise by the Contracting Officer.

(c) The Contracting Officer shall promptly, within 5 business days after receipt of notice from the Contractor, respond to the notice in writing. In responding, the Contracting Officer shall either:

(1) Confirm that the Contractor’s notice identifies a change in the scope of the contract and directs the Contractor to stop work, completely or in part, in accordance with the Stop Work provisions of the contract;

(2) Deny that the Contractor’s notice identifies a change in scope and instruct the Contractor to continue performance under the contract; or

(3) In the event the Contractor’s notice does not provide sufficient information to make a decision, advise the Contractor what additional information is required, and establish the date by which it should be furnished and the date thereafter by which the Government will respond.

SUBMISSION OF QUOTE

Quotes must be submitted directly via email and not posted to www.Sam.gov ‘Contract Opportunities’. See the SF1449, block 08, for Request for Quote (RFQ) response date/time. The Government reserves the right to not consider quotes received after this date/time. Contractors are responsible for submitting quote, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. As the Contracting Officer intends to award without holding communications with Contractors. The Contractor shall agree to hold the prices in its quote firm for 120 days after receipt of submission. No pricing information is to be provided in the Technical Capability. The offeror shall provide a narrative addressing the proposed means for complying with all requirements contained in the PWS.

FACTOR II-PRICE

The Price Factor shall substantiate the price to complete the requirements identified in the PWS and shall contain sufficient information. The Price shall also be of constraint to establish reasonableness and completeness of the proposed price.

5 - Evaluation Factors for Award

FAR 52.212-2: EVALUATION—COMMERCIAL ITEMS (NOV 2022)

(a)The Government anticipates awarding a purchase order resulting from this solicitation to the responsible offeror whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

• Technical Capability o The contractor must demonstrate that they can provide all services outlined in the Performance Work Statement

(PWS)

• Price o The Government will evaluate price quotes to determine fair and reasonableness in accordance with FAR 13.106(a)(2).

The Government intends to use a Best Value analysis with Technical Capability and Price as the only evaluation Factors. The Government reserves the right to award without engaging in exchanges with vendors and/ or to award an order based upon initial quotations.

Once the Government determines the vendor that represents the best value (i.e., the apparent successful vendor), the Government reserves the right to communicate with only that vendor that to address any remaining issues, if necessary, and finalize a purchase order with that vendor. These issues may include technical and price. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Government, the Government reserves the right to communicate with the vendor next in-line representing best value based on the original analysis and address any remaining issues.

The vendors will be evaluated based on two factors in descending importance: Factor I - Technical Capability and Factor II Price.

Factor I, Technical Capability (non-price), is significantly more important than Factor II, Price. However, price will become significantly more important as nonprice factors approach equality. Vendors are cautioned that the award may not necessarily be made to the lowest price offered. The Government is more concerned with obtaining superior technical features than with making an award at the lowest overall price to the Government. To receive consideration for award, a rating of no less than "Acceptable" must be achieved for Factor I, Technical Capability. The Government intends to evaluate quotations and award without requesting additional information from vendors. Therefore, the vendor's initial offer should contain the vendor's best terms from a price and technical standpoint. However, the Government reserves the right to request additional information if later determined by the CO to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
