C – DESCRIPTION/SPECIFICATIONS
PERFORMANCE WORK STATEMENT (PWS)
PART 1 GENERAL INFORMATION
1.1. Description of Services/Introduction:
The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to perform the requirements of the contract as defined in this Performance Work Statement, except as specified in Part 3 as government furnished property and services. The contractor shall perform to the standards in this contract.
1.2. Background:
OSHA has a broad mandate to reduce injuries and illnesses in America’s workplaces.
OSHA has responded to this mandate by targeting enforcement to active construction projects. OSHA has relied on project-level data for over 20 years to identify employers within the scope of its construction inspection targeting programs. OSHA uses these data to develop inspection-targeting lists for both National Emphasis and Local Emphasis programs. As a result, project-level data enables efficient use of government resources.
1.3. Objectives:
OSHA will use the Construction Project Data to identify projects based on project value, projected start date, end-use type, and other variables. The required project data is inclusive of all construction types in all areas of the Nation.
1.4. Scope:
The Contractor shall furnish the U.S. Department of Labor, Occupational Safety and Health Administration (OSHA), hereafter referred to as the Government, with data on construction projects located in the United States which would satisfy the Government's demand for information to conduct the Agency’s core inspection program for the construction industry. Due to the mobility of the construction industry, the transitory nature of construction worksites and the fact that construction worksites frequently involve more than one construction employer, inspections are scheduled from a list of construction worksites rather than construction employers.
OSHA inspection targeting programs are based on neutral and fair criteria. To be neutral and fair, fundamentally all active construction projects under OSHA’s jurisdiction should have an equal chance of selection for inspection. To achieve this goal, the data supplied by the Contractor must be inclusive of all construction types in all areas of the Nation.
The construction inspection system relies upon a statistical abstract of information available on construction project starts and on estimated construction project durations derived from econometric modeling. The Contractor will supply these required statistical abstracts as described below.
a. The Contractor shall furnish the Government and (Government’s agent) with a monthly file of construction data.
(1) The Contractor shall compile the data and furnish it to the Government electronically every month through an FTP online deliverable site provided and maintained by Contractor. The data will be delivered in an agreed upon format (e.g. Microsoft Access; text, csv).
(2) The file will identify construction contract awards in the entire United States and Washington, D.C., with the ability to identify the projects by state and county FIPS codes.
(3) The file will include construction starts on RESIDENTIAL, NON- RESIDENTIAL AND NON-BUILDING PROJECT TYPES categorized by structure code.
(4) The following data for each project shall be included:

b. The Contractor shall furnish project details for reports selected by the Government from the file furnished under section a. above. The Contractor shall provide monthly outputs, and as-needed supplemental reports.
(1) The Contractor shall furnish the data to the Government and/or (the Government’s agent) electronically in an agreed upon format.
(2) The Contractor data shall include details on the project location, project type, project timing, project value, project owner, project general contractor, and project architect. The following fields are illustrative of desired details.

c. The Contractor shall furnish the Government with a subscription to an online service that allows the Government to search the Contractor’s construction project data by at least geography, project type, and company. The Government will be provided a minimum of four (4) seats to the system.
d. The Contractor shall furnish the Government with an annual summary to include the number of projects started in each building category at the U.S. level. This will include the number of projects and dollar value of starts. The Government can request and receive up to 6 additional ad-hoc summary reports as needed.
1.5. General Information
1.5.1 Quality Control:
The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. As a minimum, the contractor shall develop quality control procedures that address the areas identified in Technical Exhibit 1, “Performance Requirements Summary”. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.
1.5.2 Quality Assurance:
The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.5.3 Government Remedies:
The contracting officer shall follow FAR 52.212-4, “Contract Terms and Conditions- Commercial Items” or 52.246-4, “Inspection of Services-Fixed Price” for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.
1.5.4 Recognized Holidays:
The contractor is not required to perform services on these days Holidays.

1.5.5 Hours of Operation/Place of Performance:
The contractor is responsible for conducting services Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this statement of work when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the work force are essential.

1.7 Post Award Conference/Periodic Progress Meetings:
The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.8 Contracting Officer Representative (COR):
A COR will be delegated under separate cover.
1.9 Contract Manager:
The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.
1.10 Identification of Contractor Employees:
All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.
PART 2 DEFINITIONS & ACRONYMS
PWS. Performance Work Statement
Contracting Officer’s Representative (COR). A representative from the requiring activity assigned by the Contracting Officer to perform surveillance and to act as liaison to the contractor
Defective Service. A service output that does not meet the standard of performance associated with it in the Performance Work Statement.
DOL. Department of Labor
Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
Quality Control. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the PWS.
Quality Assurance. Those actions taken by the government to assure services meet the requirements of the Performance Work Statement.
PART 3 GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND
SERVICES
3.1 General:
The government shall provide, the facilities, equipment, materials, and/or services listed below.

5.1 Basic Services:

The contractor will use the parameters listed in section 1.4.a and b. to create a monthly targeting list.
The contractor will deliver the file(s) in an agreed upon format and delivery method (e.g. a comma delimited txt file or Oracle database through a secure ftp website).
Task 2 – Statistical Reports
The contractor will provide the government with annual and ad statistical reports described in section 1.4.c.
Task 3 – Database access.
The Contractor shall furnish the Government with a subscription to an online service that allows the Government to search the Contractor’s construction project data by at least geography, project type, and company. The Government will be provided a minimum of four (4) seats to the system.

The Government reserves the right to extend the term of this contract at the prices set forth in Section B in accordance with the terms and conditions contained in clause 52.217-9 entitled, “Option to Extend the Term of the Contract”.

CONTRACTING OFFICER REPRESENTATIVE (COR)

inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual scope of work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.
(c) The COR does not have the authority to alter the contractor’s obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If, as a result of technical discussions, it is desirable to alter/change contractual obligations or the scope of work, the contracting officer must issue such changes.
A COR is not authorized to direct any action that results in a change in the scope, price, terms or conditions of this contract.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
