LIMITED SOURCES JUSTIFICATION
Sole Source
1. CONTRACTING ACTIVITY: Procurement & Contracting
U.S. Department of Justice (USDOJ)
Executive Office for Immigration Review
5107 Leesburg Pike
Falls Church, VA 22041
2. DESCRIPTION OF ACTION: This justification for other than full and open competition will result in award of a firm fixed price delivery order for sole source GoTo
Webinar and Open Voice Audio software, and components in support of the EOIR Public
Affairs. EOIR Public Affairs must utilize GoToWebinar and Open Voice Audio to support on line web meetings with audio recording collaboration within EOIR components as well as external agencies to include the White House.
3. DESCRIPTION OF SUPPLIES: This sole source requirement is for the GoTo Webinar and Open Voice Audio service with additional add in software. This procurement will be used to sustain the ability to provide on line web meetings with audio recording collaboration for EOIR Public Affairs internally and with its affiliates.
4. AUTHORITY CITED: 10 U.S.C. 2304(c)(1), as implemented by FAR6.302-1, “Only one responsible source and no other supplies or services will satisfy this requirement.”
5. REASONS FOR AUTHORITY CITED: For this action, The Office of Information
Technology, USDOJ Headquarters request a sole justification for LogMein who is the only provider for GoToWebinar and Open Voice Audio. LogMein is the Original
Equipment Manufacturer (OEM) for GoToWebinar and GoToMeeting and that the Sr.
Account Executive, in a letter dated August 5, has told us that no reseller is allowed to sell open audio portion of our requirement. Not only is GoToWebinar and Open Voice
Audio integrated into our infrastructure, but without the renewal of the specified software the mission critical offices mentioned in paragraph 2 would not be able to continue to attend online meetings or connect to audio conferences related to mission objectives or the organization. As a result of not renewing this service, EOIR’s mission of fairly, accurately and expeditiously adjudication immigration cases would not be upheld.
6. EFFORTS TO OBTAIN COMPETITION: Market research was conducted on GSA, NASA SEWP, and the open market. Similar products are available; however, none researched have Open Voice audio integration which is a critical feature EOIR currently makes use of to meet its mission needs. The procurement of the renewal licenses will continue to support EOIR as well as provide a venue to provide an enterprise solution for all of EOIR. Procuring software support from another manufactured would not provide the full capabilities of this product or the needs of the agency.
7. ACTIONS TO INCREASE COMPETITION: USDOJ OIT continually works to seek compatible equipment beyond the accepted standard. However, at this time, the stated product listed in Paragraph 3 is currently the brand name that meets the Government requirements and is critical to the current user base at EOIR.
8. MARKET RESEARCH: Market research was conducted and this product meets the current Public Affairs needs.
The following market research was found to support this product:
1. Ease of use (per results/feedback from Pilot Group)
2. Cost Effective
3. Section 508 Compliant
4. AD Connector Compatibility
a. Automated Provisioning for license management and assignment
b. Integrates with open voice audio Conference
5. Compatibility with Applications already approved for Mobile Devices
6. Technology Features:
a. Integration of phone line for audio conference with computer
b. Recording capability with video playback for all participants
7. Resources:
a. Removes SD personnel from first contact support
8. Customer Support Full availability and excellent service
Because of the User support requirements at the offices mentioned above, it is critical to have the right equipment. Any procurement of incompatible software poses a risk to the existing infrastructure.
