Statement of Work Pharmaceutical Prescription Data

3-1 Introduction

The mission of the Drug Enforcement Administration (DEA) is to enforce the controlled substances laws and regulations of the United States and bring to the criminal and civil justice system of the United States, or any other competent jurisdiction, those organizations and principal members of organizations, involved in the growing, manufacture, or distribution of controlled substances appearing in or destined for illicit traffic in the United States; and to recommend and support non-enforcement programs aimed at reducing the availability of illicit controlled substances on the domestic and international markets.

Of all the major drugs of abuse, only marijuana is available as a natural, harvested product. The others, whether they are illicit drugs such as cocaine, heroin, methamphetamine, or legitimately produced pharmaceuticals, must be manufactured. Many problems associated with drug abuse are the result of legitimately made controlled substances being diverted from their lawful purpose into illicit drug traffic.

The mission of DEA's Diversion Control Division is to prevent, detect, and investigate the diversion of controlled pharmaceuticals and listed chemicals from legitimate sources while ensuring an adequate and uninterrupted supply for legitimate medical, commercial, and scientific needs.

DEA’s Diversion Control Division oversees the Diversion Control Program, and carries out the mandates of the Controlled Substances Act by preventing the diversion of controlled substances and listed chemicals into the illicit market while ensuring a sufficient supply of the substances and chemicals for legitimate medical, scientific, research, and industrial purposes. Major components of the Diversion Control Program include:

• Scheduling controlled substances,

• Setting production quotas for certain controlled substances and regulated chemicals,

• Establishing import and export controls,

• Investigating DEA registrants to detect diversion and, where diversion occurs, prosecuting violators,

• Conducting liaison with industries and associations representing registrants,

• Assisting state and local authorities, and

• Maintaining international liaison and representing the United States on matters related to controlled substances and regulated chemicals at the United Nations.

The Diversion Control Division directs the worldwide DEA Diversion Control Program to include domestic and international diversion control, registration, voluntary compliance, state and local assistance, industry liaison, and associated support programs. The Diversion Control Division maintains an overall geographic picture of drug and chemical diversion and abuse problems to identify new trends or patterns in diversion and abuse. This enables the Diversion

Control Division to appropriately direct resources. The Diversion Control Program is executed by maintaining the closed system of distribution, regulating and controlling over 1.5 million DEA registrants, and investigating activity related to the diversion of controlled substances and listed chemicals.

3-2 Background/Objective

The Drug Enforcement Administration (DEA) is required by 21 U.S.C. 826 to establish the amounts of certain drugs that are to be produced in the U.S. each year and to equitably apportion those amounts among the producers. The objective of this contract is to obtain the following data in order to determine the amounts of certain drugs that should be allowed for production in a given year:

Many of the narcotics, depressants, and stimulants manufactured for legitimate medical use are subject to abuse and have, therefore, been brought under legal control. Under federal law, all businesses that import, export, manufacture, or distribute controlled substances; all health professionals licensed to dispense, administer, or prescribe them; and all pharmacies authorized to fill prescriptions must register with the DEA. DEA registrants must comply with regulatory requirements relating to drug security and recordkeeping. The DEA is also obligated under international treaties to monitor the movement of licit controlled substances across U.S. borders and to issue import and export permits for that movement.

Fees paid by DEA registrants, such as manufacturers, distributors, dispensers (including physicians), importers, and exporters of controlled substances (such as narcotics and stimulants) and certain listed chemicals (such as ephedrine) are deposited in the Diversion Control Fee Account. Fees collected are used to recover the full costs of the program, including personnel costs and operation costs such as investigative costs, travel, and the purchase of goods and services.

Task 1: The Contractor shall provide the data described below in accordance with the details herein:

• Purchases by drug store retailers (i.e. independent pharmacies, chain pharmacies/mass merchandisers, food stores with pharmacies, and mail order pharmacies) of specific prescription and over-the-counter (OTC) drugs and drug products projected to national U.S. levels.

• Purchases by non-retail settings (including U.S. Non-Federal hospitals, HMO’s, Clinics, Universities, Long term care facilities, Home Health Care, Federal Facilities and Prisons) of prescription and OTC drugs and drug products projected to national U.S. levels.

• A measure of the retail outflow of prescriptions from independent and chain retail pharmacies via formal prescriptions projected to national U.S. levels.

• A measure of the outflow of prescriptions via formal prescriptions from mail order pharmacies and long term care facilities projected to national U.S. levels.

• All data shall be accessible via a PC-based software or online application that enables the automated retrieval and manipulation of data.

This information shall be provided on a monthly basis for 130 drugs. DEA has the option of re-designating which 130 drugs are included on a monthly basis. See List attached.

Task 2:

• The Contractor shall also provide prescription audit regional data by State and MSA for the retail, long term care and mail order channels, on a quarterly basis. All data shall be accessible via a PC-based software or online application that enables the automated retrieval and manipulation of data.

Task 3:

The Contractor shall provide Ad Hoc reports pursuant to Contractor estimate and Contracting approval (See description below in Ad Hoc Report Section (C-7))

3-3 Description of Required Data and Reports

(1) Long Term Care Data: measures the dispensing of non-retail prescriptions by nursing homes with in-house pharmacies and by nursing home provider contract pharmacies within the United States projected to National levels.

(2) Mail Order Prescription Data - Measures the outflow of prescriptions via formal prescriptions from mail order pharmacies in the United States projected to national levels.

(3) National Prescription Data - Measure of the retail outflow of prescriptions, or the rate at which drugs move out of independent and chain retail pharmacies into the hands of the consumers via formal prescriptions in the United States projected to national levels.

(4) Consolidated Prescription Data Report- Report to include a total of (1) Long Term Care Data; (2) Mail Order Prescription Data; and (3) National Prescription Data into a Total U.S.

Prescription Projection.

(5) Drugstores/Pharmacy Purchase Data - Data on the purchases made by retailers of prescription and OTC drugs and drug products projected to national levels.

(6) Non-Retail Purchase Data - Data on the purchases made by hospitals and other non-retail setting (specified above) of prescription and OTC drugs and drug products projected to national levels.

(7) Consolidated Purchase Data Report- Report to include a total of Drugstores/Pharmacy Purchase Data and Non-Retail Purchase Data into a Total U.S. Drug Purchase Projection.

8) State and MSA Report- Report to include prescription audit regional data by State and MSA for the retail, long term care and mail order channels, on a quarterly basis.

3-4 Requirements

The Contractor shall:

• Furnish the necessary personnel, materials, services, facilities, and other items necessary for or incidental to the provision of the work described in this document. The Contractor must be the entity that collects data and establishes databases.

• Provide subscriptions to the following pharmaceutical data covering the period January 1, 2020 through December 31, 2020. DEA also would like the option of extending the data each calendar year. Therefore, the Government will have the option of acquiring the same type data updated for calendar year 2021, 2022, 2023, and 2024.

• Provide data access to DEA in a database format which allows DEA to search and query the database and produce output reports (and have the capability of exporting data to a spreadsheet application software such as MS-Excel for data manipulation and production of charts/graphs).

• Provide timely updates (including national projections) each calendar month within eight weeks of the end of the calendar month. For example, the contractor shall provide January data no later than eight weeks after January 31, 2020. (E.g. Received by DEA prior to April 2020). The contractor shall provide DEA with State data for 2 (two) years of running data trending purposes. The contractor shall provide DEA with National level data dating back to 1992 for all 130 drugs, for trending purposes.

• Provide data which is collated on a monthly, quarterly, annual and year-to-date basis.

• Provide purchase information which is retrievable as kilograms purchased and as extended number of dosage units purchased. All data shall differentiate between manufacturers and dosage strengths and include data elements outlined below.

• Provide prescription dispensing data which includes total prescriptions dispensed, the number of new prescriptions dispensed, the number of refills dispensed, the average number of days of therapy per prescription, the average daily consumption, and the number of extended units dispensed for all prescriptions.

• Contractor will make data available via online access with query capabilities. Data shall be available to DEA 24 hours a day 7 days a week.

• Provide data for up to 130 drugs, initially including the following drug/drugs:

III. Data shall include the following data elements for each drug/drug product. Data can be sorted and queried for each of these data elements:

a. Channel/source of drug (differentiation between type of distribution channel e.g.

pharmacy vs. grocery store vs. convenience store, etc.)

b. Branded product vs. generic product

c. Single entity drug product vs. multi-active ingredient product

d. By Manufacturer

e. Sustained release vs. immediate release formulations

f. By Product form (e.g. solids, liquids)

g. By Route of administration and product form: (e.g. systemic vs. topical product, I injectable vs. oral vs. sublingual vs. implant)

h. By Strength (e.g. mg of active ingredient)

3-5 Use of Data

The Contractor shall grant DEA the authorization to share reports containing trend information or aggregate data with outside agencies and/or organizations without prior review by the Contractor. Such information will primarily be shared with the U.S. Department of Health and Human Services (HHS), the U.S. Department of Justice, the Office of Management and Budget, and some State and Local Regulatory Agencies such as State Boards of Pharmacy. These data and trends may have been developed through an analysis of the Contractor's pharmaceutical data provided under this contract.

The Contractor shall also allow DEA to provide a third party DEA contractor with any data received. DEA will stipulate that the information will be used only by the third party contractor in the performance of its duties and will not be given to outside sources (those without a contractual agreement with DEA).

3-6 Installation And Training

If data is made available via online Internet access, the contractor will provide training to DEA on query capabilities and use of the online system. Access shall be provided for up to 50 DEA employees to have capability of accessing the online system simultaneously.

3-7 Technical Assistance and Support

The Contractor shall provide technical assistance and support to DEA, as needed, on the installation and operation of quarterly updates to the subscription service. This assistance and support shall include telephone inquiries and on-site visits to resolve problems with the Contractor provided applications. The Contractor shall provide the technical assistance and support at no additional cost to the Government.

The Contracting Officer’s Representative (COR) will initiate a request for technical assistance and support by contacting the Contractor by telephone and providing a description of the problem. The contractor shall respond to the problem over the telephone or coordinate a date and time with the COR for an on-site visit to resolve the issue. The Contractor shall schedule all required on-site visits within 72 hours of the initial telephone call placed by the COR.

3-8 Ad Hoc Reports

The Contractor shall, as required, provide special ad hoc reports for various types of audit data contained in its database. The ad hoc reports will be coordinated between the COR and Contractor prior to a request being issued from the Contracting Officer in order to insure that the data is available and can be presented to the Government in a concise, useable format. Upon receipt of the request form, the contractor shall promptly provide DEA with a price quotation for providing the requested ad-hoc report(s). Following agreement by the parties on all aspects of the request, DEA will issue an appropriate Delivery/Task Order.

3-9 Period of Performance

The period of performance for furnishing supplies or services is from February 1, 2020 through January 31, 2025, with four twelve-month option periods, subject to need and availability of funds. In the event the options are exercised, the period of performance shall be:

Option I: February 1, 2021 - January 31, 2022 Option II: February 1, 2022 - January 31, 2023 Option III: February 1, 2023 - January 31, 2024 Option IV: February 1, 2024 - January 31, 2025

3-10 Contract Administration

The Diversion Control Division requests that Mr. Douglas Snyder be designated the Contracting Officer’s Representative (COR) for this task order. Mr. Snyder received his DOJ COR certification on April 28, 1995.

3-11 Security Requirements

All contractor personnel supporting this procurement are entrusted with a certain level of trust due to the nature ofDEA's mission. The Government expects the vendor will employ persons of integrity and trustworthiness. To ensure this, DEA reserves the right to conduct background screening or a full background investigation on all employees if a need arises. While all services provided on this contract will be performed outside of DEA, all contractors must be escorted if entering a DEA facility. DEA reserves the right to modify the security requirements found in this contract at anytime. In addition, all contract personnel supporting this project shall complete and submit a security Standard Form 85 before entering the compound to start work.

(b) The date of record for invoice receipt is established on the day of receipt of the e-mail if it arrives before the end of standard business hours (5 p.m. local), or the next business day if the invoice arrives outside of normal business hours. Scanned documents with original signatures in .pdf or other graphic formats attached to the e-mail are acceptable. Digital/electronic signatures and certificates cannot be processed by DEA and will be returned.

(c) In addition to the items specified in FAR 32.905(b), a proper invoice shall also include the following minimum additional information and/or attached documentation:

(1) Total/cumulative charges for the billing period for each Contract Line Item Number

(CLIN);

(2) Dates upon which items/services were delivered; and

(3) The Contractor’s Taxpayer Identification Number (TIN).

(d) Invoices will be rejected if they are illegible or otherwise unreadable, or if they do not contain the required information or signatures.

(a) The Contractor shall submit a copy of the final invoice to the Contracting Officer at the address listed in clause DEA-2852.242-71, Invoice Requirements. The final invoice must be marked “Informational Copy – Final Invoice.”

(b) By submission of the final invoice and upon receipt of final payment, the Contractor releases the Government from any and all claims arising under, or by virtue of, this contract. Accordingly, the Government shall not be liable for the payment of any future invoices that may be submitted under the above referenced order.

(c) If residual funds on the contract total $100 or less after payment of the final invoice, the Government will automatically deobligate the residual funds without further communication with the vendor.

(d) If funds greater than $100 remain on this order after payment of the final invoice, the Government will issue a bilateral modification to deobligate the residual funds. The contractor will

The contractor’s signature on the modification shall constitute a release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically exempted from the operation of the release. If the contractor fails to sign the modification or assert a claim within the stated period, the Government will deobligate the residual balance and proceed with close-out of the contract.

DEA-2852.242-70 CONTRACTOR PERFORMANCE ASSESSMENT (JUL 2014)

(a) Pursuant to FAR subpart 42.15, the Government will assess the Contractor’s performance under this contract. Performance assessment information may be used by the Government for decision-making on exercise of options, source selection, and other purposes, and will be made available to other federal agencies for similar purposes.

(b) Performance will be assessed in the following areas:

(1) Quality of product or service;

(2) Schedule;

(3) Cost control;

(4) Business relations;

(5) Management of key personnel; and

(6) Other appropriate areas.

(c) For contracts that include the clause at 52.219-9, Small Business Subcontracting Plan, performance assessments will consider performance against, and efforts to achieve, small business subcontracting goals set forth in the small business subcontracting plan.

(d) For any contract with a performance period exceeding 18 months, inclusive of all options, the Government will perform interim performance assessments annually and a final performance assessment upon completion of the contract.

(e) The Government will prepare contractor performance assessment reports electronically using the Contractor Performance Assessment Reporting System (CPARS), which is the approved feeder system for the Past Performance Information Retrieval System (PPIRS). Additional information on CPARS may be found at www.cpars.gov and on PPIRS at www.ppirs.gov.

(f) The Contractor will be provided access to CPARS to review performance assessments. The Contractor shall designate a CPARS point-of-contact for each contract subject to performance assessment reporting. Upon setup of a contract in CPARS, the Contractor’s CPARS point-of-contact will receive a system-generated e-mail with information and instructions for using CPARS. Prior to finalizing any contractor performance assessment, the Contractor shall be given 14 calendar days to review the report and submit comments, rebutting statements, or additional information.

Disagreements between the Contractor and the Government performance assessment official will be resolved by a Government Reviewing Official, whose decision on the matter will be final. Upon finalization of each performance assessment, CPARS will upload the performance assessment data to PPIRS.

(g) The Government will also report in the Federal Awardee Performance and Integrity Information System (FAPIIS) module of PPIRS information related to:

(1) A Contracting Officer’s final determination that a contractor has submitted defective cost or pricing data;

(3) Any issuance of a final termination for default or cause notice; or

(4) Any subsequent withdrawal or a conversion of a termination for default to a termination for convenience.

Subcontracting Compliance

The contractor shall complete the subcontracting certification form located in Section 5. Submission shall be made to the Contracting Officer and the Contracting Officer’s Representative (COR) annually, upon completion of each contract period of performance (i.e. base year plus any option period). The certificate shall be completed by a designated company official authorized to act on behalf of the company.
