JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

UNDER FEDERAL ACQUISITION REGULATION SUBPART 6.3

1. AGENCY AND CONTRACTING ACTIVITY: The Department of Defense, Washington Headquarters Services, Acquisition Directorate, Enterprise Acquisition and Sustainment Division.

2. DESCRIPTION OF ACTION: This action is for a short term, four (4) month bridge contract to allow adequate time to re-procure a contract to replace the instant contract (HQ003415C0010) without a break in service to the Government.

3. DESCRIPTION OF SUPPLIES/SERVICES: The contractor will continue to provide Treaty Compliance analytical and technical support for the Office of Strategic Deterrence and Capabilities (SDC) in the Office of the Under Secretary of Defense for Acquisition and Sustainment (OUSD(A&S)) from 29AUG2020 through 31JAN20201 for the amount of $349,313.92

The approval of this requirement will avoid disruptions to mission critical programs and activities currently underway at the Office of Strategic Deterrence and Capabilities while this requirement is being re-procured, as described in further detail below.

The Government has the following critical requirements that must be met by various ad-hoc deadlines, as described below:

Monitoring DoD programs and activity compliance with relevant treaty obligations, new and existing;

Advising and assistance to DoD elements/agencies regarding impact of treaty obligations on RDT&E and acquisition programs; and

Database Maintenance regarding DoD treaty implementation and compliance.

4. AUTHORITY CITED: This action is authorized under provisions of 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.

5. REASON FOR AUTHORITY CITED: Due to the short duration of the contract no other vendor would be capable of providing the required services without a transition period. This turnover period would exceed the duration of the contract and as such would expose the Government to risk of unsuccessful contract performance.

SAIC has the unique knowledge and background working with the Office of Strategic Deterrence and Capabilities (SDC), has the required staff, the specific technical expertise, and the required TS/SCI or Secret clearances. Continuity during this period is essential. Failure to bridge this contract will result in a significant reduction in the available resource (workforce) that risks DOD’s ability to monitor and advise compliance against new and existing treaties, potentially jeopardizing DOD’s arms control responsibilities.

Further, SAIC has been supporting this contract for over five years. If any other firm is brought in to support this work, the deadlines described above would be compromised. A recompete and award to another firm, on such short notice, would set the office back months while the vendor was brought up to speed. The depth of knowledge possessed by SAIC in the associated subject matter and relationships with key stakeholders cannot be replaced by another company and still allow SDC to meet deadlines on short notice.

The technical knowledge required to support the government is not readily available, nor are the required security clearances and access to programs and data. There are no firms aside from SAIC that could adequately staff the requirement prior to contract expiration leaving the government at significant risk of mission failure. This bridge contract will continue work on an already existing contract.

6. EFFORTS TO OBTAIN COMPETITION: The Government will post the solicitation as soon as practicable. This action represents the best value to the Government in that the incumbent has exhibited outstanding performance in the execution of the current contract. Because of the short duration of the bridge contract no other contractor could perform the tasks required by the Government without adequate turnover which would exceed the length of the bridge contract. Executing a short term bridge contract with the incumbent represents the best value to the Government while providing the least risk to successful contract performance.

7. FAIR & REASONABLE COST DETERMINATION: The Contracting Officer will ensure that the anticipated price for this contract action will be fair and reasonable, based upon techniques identified at FAR 15.404-1(b)(2)).

8. MARKET RESEARCH: The Government conducted market research for the re-procurement requirement and determined at least two (2) firms could meet the requirement in the performance work statement;

however, the short duration of this contract would allow no vendor other than the incumbent to adequately and successfully perform the work required by the Government.

9. OTHER SUPPORTING FACTS: None

10. INTERESTED SOURCES: A solicitation will be published as soon as practicable for the re-procurement.

11. ACTIONS TO INCREASE COMPETITION: The short nature of this contract precludes a reasonable method to increase competition while providing adequate service to the Government. This action will be re-procured through an appropriate solicitation.

12. Is this acquisition for a non-competitive follow-on acquisition previously awarded on a non-competitive basis? No, the original acquisition was issued on a competitive basis.
