RE: 15B41421Q00000002 – Provide Air Handler Units with Factory Startup at USMCFP Springfield
Dear Offeror:
Enclosed is a Request for Quote package for project 4D2U to provide two (2) air handler units with factory startup that meets the minimum specifications as listed in attached statement of work (SOW). This is a supply with startup only, installation will be conducted by Government, with startup work monitored at all times by a Government assigned Contract Officer Representative (COR).
This package contains all the necessary information for submitting a request for quote for evaluation. Offerors should consider all information provided herein and follow all instructions located in the quotation package. Furthermore, ensure your company is registered in SAM www.sam.gov with the NAICS code of 238220.
A site visit will be held on Monday, November 23, 2020, at 8 a.m. This site visit is not mandatory. The site visit will be inside the perimeter fence and all individuals who plan on attending must complete and sign the attached NCIC check form. Ensure that completed NCIC’s are sent with company letter head stating number of individuals expected to attend along with contact information in case of denial. This must be emailed to T1Bradshaw@bop.gov, no later than noon on November 19, 2020. If you do not complete this requirement by this date and time, you will not be allowed to enter the institution. If an NCIC check is submitted timely but clearance is not obtained based on the results of the background check, you will not be allowed to attend the site visit.
All contractors approved to enter the institution for the site visit must: 1) Utilize the Kansas Expressway entrance, 2) Stop at the speaker box located on the left side of the road from the guard tower, 3) Inform the guard you are attending the pre-bid site visit, 4) Bring a photo ID and your license plate number, 5) The following are not allowed: Weapons (including pocket knives), cell phones, blackberries, pagers, radios, cameras, drugs, and alcohol. Please arrive at least 15 minutes early to allow time for security and pre-screening procedures for COVID-19.
Masks are mandatory and we ask that you ensure you are practicing CDC best practices to prevent transmission of COVID-19: hand washing, coughing/sneezing in your elbow, social distancing when possible, wearing a mask when inside the institution, and following all other advertised precautions to assist in reducing the spread of the illness.
Following the site visit all questions must be submitted to the government for clarification no later than Friday, November 27, 2020.
Offers shall be received on or before Tuesday, December 8, 2020 at 10:00 a.m. central standard time.

Section 3 - Contract Clauses

CONTRACT REQUIREMENTS :
Contract Requirements:
The Government is looking at awarding a firm-fixed price supply with factory startup contract to the vendor whom can provide two
(2) Air Handler Units with factory startup that meets the minimum specifications as list in attached statement of work (SOW). The Supply portion of this contract has a delivery time frame of ninety (90) calendar days from ARO with factory startup to be completed upon government install but no later than thirty (30) calendar days from date of install. Factory startup to be mutually coordinated upon award.
This is a contractual agreement and not a government appointment. All duties outlined in this Statement of Work shall be performed in accordance with standards and methods generally accepted within the contractor’s own field of expertise. Payment is based on an end product or the accomplishment of a specific result. The service does not constitute an employer/employee relationship. The contractor will not be subject to Government supervision, except for security related matters. However, the contractor performance shall be monitored.
Contractual language per BPAP 37.103-73(c)
(1) Department Policy on Domestic Violence, Sexual Assault, and Stalking.
It is the Department’s policy to enhance workplace awareness of and safety for victims of domestic violence, sexual assault, and stalking. This policy is summarized in DOJ Policy Statement 1200.02 (Federal Workplace Responses to Domestic Violence, Sexual Assault, and Stalking), available in full for public viewing at http://www.justice.gov/sites/default/files/ovw/legacy/2013/12/19/federal-workplacee-responses-to-domesticviolence-sexualassault-stalking.pdf. Vendor agrees, upon contract award, to provide notice of this Policy Statement, including at a minimum the above-listed URL, to all of Vendor’s employees and employees of subcontractors who will be assigned to work on Department premises.
(2) Point of Contact for Victims of Domestic Violence, Sexual Assault, and Stalking.
Upon contract award, the Department will notify contractor of the name and contact information for the Point of Contact for Victims of domestic violence, sexual assault, and stalking for the component or components where Contractor will be performing. Contractor agrees to inform its employees and employees of subcontractors who will be assigned to work on Department premises of the name and contact information for the Victim Point of Contact.
Security:
The U.S. Medical Center for Federal Prisoners is a federal prison. The contractor agrees to adhere to all regulations prescribed by the institution for safety, custody and conduct of inmates. All appropriate security clearances shall be obtained prior to contract personnel entering the institution. The Program Manager will determine what security requirements are required in accordance with policy. Such requirements may include the following:
The purpose is to establish security and supervision requirements for contract and consultant personnel involved in the delivery of services to Bureau of Prison facilities. The following investigative procedures shall be applied and appropriate forms completed before an individual is permitted inside an institution. The Supply portion of this contract has a delivery time frame of ninety (90) calendar days from ARO with factory startup to be completed upon government install but no later than thirty (30) calendar days from date of install. Factory startup to be mutually coordinated upon award. Therefore, infrequent memos will be completed as needed.
Vendors employees will be required to complete an NCIC release form to receive security clearances prior to entering the institution.
Inmate Management:
Provisions of services under this contract may require contact with inmates. The contractor will be accompanied by and in the presence of staff. The contractor will not be responsible for the management of inmates for this contract. The contractor shall report to the Correctional Supervisor in charge, any infractions of institutional rules and regulations on the part of the inmate.
Faith-based and Community Based Organizations have the right to submit offers/bid equally with other organizations for contracts which they are eligible.

All contractors doing business with the federal government must obtain a valid Duns and Bradstreet number (DUNS) and be registered and maintain registration in the System for Award (SAM) system prior to award. This shall include registration of Offeror Representations and Certifications. Information may be obtained at www.sam.gov.
Evaluation Factors:
The Government will evaluate all responses that meet specifications and evaluate based on the following factors: price and favorable past work history.
The Government will award to the offeror who can meet these requirements and who provides the best price.
52.21-603-70 Contracting Officer's Representative (COR) (June 2012)
(a)Tim Bradshaw , General Foreman , USMCFP, 417-862-7041 x 1143, is hereby designated as the Contracting Officer's Representative (COR) under this contract.
(b) The COR is responsible, as applicable, for: receiving all deliverables, inspecting and accepting the supplies or services provide hereunder in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contractor effort, fills in details or otherwise serves to accomplish the contractual Scope of Work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.
(c) The COR does not have the authority to alter the contractor's obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If as a result of technical discussions it is desirable to alter/change contractual obligations or the Scope of Work, the Contracting Officer shall issue such changes.
BOP 2852.237-76 Notice of Contractor Personnel Security Requirements (OCT 2005)
Compliance with Homeland Security Presidential Directive-12 (HSPD-12) and Federal Information Processing Standard Publication
201 (FIPS 201) 1 entitled "Personal Identification Verification (PIV) for Federal Employees and Contractors," Phase I.
1. Long-Term Contractor Personnel:
In order to be compliant with HSPD-12/PIV I, the following investigative requirements must be met for each new long-term 2 contractor employee whose background investigation (BI) process begins on or after October 27, 2005:
a. Contractor Personnel must present two forms of identification in original form prior to badge issuance (acceptable documents are listed in Form I-9, OMB No. 1615-0047, "Employment Eligibility Verification," and at least one document must be a valid State or Federal government-issued picture ID);
b. Contractor Personnel must appear in person at least once before a DOJ official who is responsible for checking the identification documents. This identity proofing must be completed sometime during the clearance process but prior to badge issuance and must be documented by the DOJ official;
c. Contractor Personnel must undergo a BI commensurate with the designated risk level associated with the duties of each position.
Outlined below are the minimum BI requirements for each risk level:
* High Risk - Background Investigation (5 year scope)
* Moderate Risk - Limited Background Investigation (LBI) or Minimum Background Investigation (MBI)
* Low Risk - National Agency Check with Inquiries (NACI) investigation
d. The pre-appointment BI waiver requirements for all position sensitivity levels are a:
1) Favorable review of the security questionnaire form;
2) Favorable fingerprint results;
3) Favorable credit report, if required;3
4) Waiver request memorandum, including both the Office of Personnel Management schedule date and position sensitivity/risk level;
and
5) Favorable review of the National Agency Check (NAC) 4 portion of the applicable BI that is determined by position sensitivity/risk level.
A badge may be issued following approval of the above waiver requirements.
If the NAC is not received within five days of OPM's scheduling date, the badge can be issued based on a favorable review of the Security Questionnaire and the Federal Bureau of Investigation Criminal History Check (i.e., fingerprint check results).

e. Badge re-validation will occur once the investigation is completed and favorably adjudicated. If the BI results so justify, badges issued under these procedures will be suspended or revoked.
2. Short-Term Contractor Personnel:
It is the policy of the DOJ that short-term contractors having access to DOJ information systems and/or DOJ facilities or space for six months or fewer are subject to the identity proofing requirements listed in items 1a. and 1b. above. The pre-appointment waiver requirements for short-term contractors are:
a. Favorable review of the security questionnaire form;
b. Favorable fingerprint results;
c. Favorable credit report, if required;5 and
d. Waiver request memorandum indicating both the position sensitivity/risk level and the duration of the appointment. The commensurate BI does not need to be initiated.
A badge may be issued following approval of the above waiver requirements and the badge will expire six months from the date of issuance. This process can only be used once for a short-term contractor in a twelve month period. This will ensure that any consecutive short-term appointments are subject to the full PIV-I identity proofing process.
For example, if a contractor employee requires daily access for a three or four-week period, this contractor would be cleared according to the above short-term requirements. However, if a second request is submitted for the same contractor employee within a twelve-month period for the purpose of extending the initial contract or for employment under a totally different contract for another three or four-week period, this contractor would now be considered "long-term" and must be cleared according to the long-term requirements as stated in this interim policy.
3. Intermittent Contractors:
An exception to the above-mentioned short-term requirements would be intermittent contractors.
a. For purposes of this policy, "intermittent" is defined as those contractor employees needing access to DOJ information systems and/or DOJ facilities or space for a maximum of one day per week, regardless of the duration of the required intermittent access. For example, the water delivery contractor that delivers water one time each week and is working on a one-year contract.
b. Contractors requiring intermittent access should follow the Department's escort policy. Please reference the August 11, 2004, and January 29, 2001, Department Security Officer policy memoranda that conveys the requirements for contractor facility escorted access.
c. Due to extenuating circumstances, if a component requests unescorted access or DOJ IT system access for an intermittent contractor, the same pre-employment background investigation waiver requirements that apply to short-term contractors are required.
d. If an intermittent contractor is approved for unescorted access, the contractor will only be issued a daily badge. The daily badge will be issued upon entrance into a DOJ facility or space and must be returned upon exiting the same facility or space.
e. If an intermittent contractor is approved for unescorted access, the approval will not exceed one year. If the intermittent contractor requires unescorted access beyond one year, the contractor will need to be re-approved each year.
4. An individual transferring from another department or agency shall not be re-adjudicated provided the individual has a current (within the last five years), favorably adjudicated BI meeting HSPD-12 and DOJ's BI requirements.
5. The DOJ's current escorted contractor policy remains unchanged by this acquisition notice.

52.204-13 System for Award Management Maintenance (Oct 2018)
(a) Definitions. As used in this clause--
"Electronic Funds Transfer (EFT) indicator" means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management (SAM) records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.
"Registered in the System for Award Management (SAM)" means that--
(1) The Contractor has entered all mandatory information, including the unique entity identifier and the EFT indicator (if applicable), the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the SAM;
(2) The Contractor has completed the Core, Assertions, Representations and Certifications, and Points of Contact sections of the registration in SAM;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Contractor will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record "Active".
"System for Award Management (SAM)" means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes--
(1) Data collected from prospective Federal awardees required for the conduct of business with the Government;
(2) Prospective contractor-submitted annual representations and certifications in accordance with FAR subpart 4.12; and
(3) Identification of those parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits.
"Unique entity identifier" means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity.

(b) If the solicitation for this contract contained the provision 52.204-7 with its Alternate I, and the Contractor was unable to register prior to award, the Contractor shall be registered in SAM within 30 days after award or before three days prior to submission of the first invoice, whichever occurs first.
(c) The Contractor shall maintain registration in SAM during contract performance and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement. The Contractor is responsible for the currency, accuracy and completeness of the data within SAM, and for any liability resulting from the Government's reliance on inaccurate or incomplete data.
To remain registered in SAM after the initial registration, the Contractor is required to review and update on an annual basis, from the date of initial registration or subsequent updates, its information in SAM to ensure it is current, accurate and complete. Updating information in SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.
(d) (1) (i) If a Contractor has legally changed its business name or "doing business as" name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to--

(A) Change the name in SAM;
(B) Comply with the requirements of subpart 42.12 of the FAR; and
(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor shall provide with the notification sufficient documentation to support the legally changed name.
(ii) If the Contractor fails to comply with the requirements of paragraph (d)(1)(i) of this clause, or fails to perform the agreement at paragraph (d)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the "Suspension of Payment" paragraph of the electronic funds transfer (EFT) clause of this contract.
(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in SAM record to reflect an assignee for the purpose of assignment of claims (see FAR subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the SAM. Information provided to the Contractor's SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the "Suspension of Payment" paragraph of the EFT clause of this contract.
(3) The Contractor shall ensure that the unique entity identifier is maintained with the entity designated at www.sam.gov for establishment of the unique entity identifier throughout the life of the contract. The Contractor shall communicate any change to the unique entity identifier to the Contracting Officer within 30 days after the change, so an appropriate modification can be issued to update the data on the contract. A change in the unique entity identifier does not necessarily require a novation be accomplished.

(d) Comptroller General Examination of Record.
