SECTION G - CONTRACT ADMINISTRATION DATA

G.1 CONTRACT ADMINISTRATION OFFICE

G.2 CONTRACTING OFFICER'S AUTHORITY

The Contracting Officer is the only person authorized to approve changes in any of the requirements of this contract. In the event the Contractor affects any changes at the discretion of any person other than the Contracting Officer, the changes will be considered to have been made without authority and no adjustment will be made in the contract price or schedule to cover any increase in costs in-curred as a result thereof. The Contracting Officer shall be the only individual authorized to accept nonconforming work, waive any requirement of the contract, and/or modify any term or condition of the contract. The Contracting Officer is the only individual who can legally obligate Government funds. No costs chargeable to the proposed contract can be incurred before receipt of a fully executed contract or specific authorization from the Contracting Officer

G.3 SUBCONTRACTS / CONSULTANT ARRANGEMENTS

(a) When so required by FAR Part 44, the offeror's proposal shall identify all subcontracts / consultant arrangements proposed. Spe-cifically, the following information shall be provided to the Contracting Officer:

(1) Company name of each subcontractor, or the individual name in the case of independent consultants;

(2) Names of each subcontractor corporate officers:

(3) Name of each subcontractor's key personnel for this contract effort, including each individual's level of effort; and

(4) Scope of work to be performed by each subcontractor / consultant.

(b) Furthermore, throughout the term of this contract, the Contractor shall obtain prior written authorization from the Contracting Of-ficer for any additions, deletions or changes in subcontract / consultant arrangement entered into for the purpose of performing this contract effort. The Contractor shall furnish the Contracting Officer with the above-specified items of information for any subcontract / consultant arrangement that the Contractor proposed subsequent to contract award. The government may consider revision to this re-quirement if the contractor has a government approved purchasing system in accordance with FAR Part 44.

(c) ATF reserves the right to request the contractor to terminate any subcontractors, individual subcontractor employees, subcontractor principals, or consultants, for malfeasance or other appropriate cause (e.g., theft, criminal record(s), ties to organized crime, etc.)

(d) The provisions of this clause do not preclude any requirements regarding subcontracts that may be set forth elsewhere in this soli-citation / contract.

(e) Questions regarding this requirement shall be directed to the Contracting Officer.

ATF-14 ELECTRONIC INVOICING

ELECTRONIC INVOICING (Revised October 27,2008)

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) encourages contractors to invoice electronically. Invoicing electron-ically saves time, money, and physical storage space for both the Government and the contractor.

Each invoice must be a proper invoice in accordance with Federal Acquisition Regulations (FAR) 32.905(b). The contractor may sub-mit a combined invoice with each ATF contract/order number. The invoice must clearly identify the specific Contract Line Item (CLIN) or item number for which the contractor is seeking payment under the contract/order. If the invoice covers multiple CLINs or item numbers, the invoice must clearly identify specific amounts and activity applicable to each.

Electronic invoices must be submitted to the ATF Contracting Officer's Representative (COR)/POC named in Section G/Section

3.3 of this contract and Financial Management Division (FMD), Finance.Branch@ATF.gov. Electronic invoices will serve as the offi-cial original copy. The e-mail subject line must contain the name of the ATF COR/POC named in Section G/Section 3.3 of the oblig-ation document, the Order/Award number, the Invoice number and Vendor name (i.e.: John Doe_DJAxxxxxxxxx_Invoice #xxx_ABC, Inc.). ATF will return to the vendor any invoices that do not contain the correct subject line information.

Contractors who are unable to submit electronic invoices may mail their invoices to the COR/POC named in Section G/Section 3.3 of this contract and FMD address provided below:

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Con-tractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relat-ing to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to ap-peals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made avail-able until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. 3. CONTENT

3.1 Section I The Offeror is requested to provide the below information.

(1) General

(a) The Government is conducting this source selection in accordance with the competitive negotiation source selection pro-cedures contained in FAR Part 12 and 13.5.

(b) The Government intends to evaluate quotes and award a Purchase Order without discussions with the Offerors. Therefore, the initial quote should contain the Offerors' best terms from a technical and cost/price standpoint.

(c) When conducting the evaluation, the Government may use data included by Offerors in their quotes, as well as data ob-tained from other sources. Each Offeror is responsible for ensuring that the information provided is thorough, accurate, and complete.

(d) The Offeror must clearly demonstrate that all requirements of the SOLICITATION are met. The Offeror must also address all information requirements of the Solicitation.

(e) The quote price will be evaluated but no adjectival rating will be applied.

Basis for Award

This will be a Technically Acceptable Low Cost requirement. This is an EACT Match specification, no Substitution will be ac-cepted. To be considered technically acceptable, offerors must have exact match and have a past performance rating of Satis-factory Confidence or better, or be rated neutral.

(2) Price

The Offeror’s Price quote will not receive an adjectival rating. The price evaluation will assess the accuracy, completeness, and reas-onableness. This process involves verification that prices are included for all solicitation requirements, figures are correctly calcu-lated, and prices are reasonable and presented in an adequate format. A quote complying with solicitation requirements with the low-est price may not be selected for award if a higher-priced offer is determined to be the most advantageous to the Government.

(3) Past Performance

The quality of the contractor’s recent and relevant past performance will be evaluated to assess the offeror’s probability of meeting the solicitation requirements. The Government will first evaluate the submitted references to determine the relevancy and recentness of the past performance information. This evaluation will be based on the degree to which the contract descriptions and other past per-formance information demonstrates relevant/recent experience compared to the requirements of this solicitation in terms of similar size, scope, and complexity. Next the Government will evaluate the degree to which the performance of those efforts demonstrates an overall performance and quality record that supports an expectation of successful achievement of the solicitation requirements. Government may use information provided by the contractor in their proposal submission, information in both Government and com-mercial databases and other information available as ATF determines is reasonable.

If the contractor has no past performance, it will be evaluated as Neutral.
