JUSTIFICATION FOR SOLE SOURCE or BRAND NAME SPECIFIED (Simplified Acquisitions <$150K)

In accordance with FAR 13.106-1(b), the Contracting Officer determines if the circumstances of the contract action deem only one source reasonably available or a portion of the purchase specifies a particular brand-name item. This determination must be supported with full justification for Sole Source or Brand Name from the Technical/Requirements personnel. When the Technical/Requirements personnel describe an item with a purchase description which limits the competition, the justification must explain why the item is the only one that will meet the Government’s requirement. The Technical/Requirements personnel shall provide the following information:

1. Organization/Line Office:

National Ocean Service (NOS), Engineering Division

2. Procurement Request Number:

NCNT1000-15-01644

3. Description of Action being Approved:

Firm-Fixed-Price Purchase Order

4. Description of item or services required to meet the Agency’s needs (including estimated value):

Acoustic Doppler Current Profilers and associated equipment that will be utilized in conducting current surveys for the National Current Observation Program.

Base Period: 6/24/2015 thru 9/18/2015:

5. List the proposed contractor (name and address) or brand name and describe the unique characteristics that limit availability to only one source (explain why the suggested source is the only source which can provide the supplies or services):

The NOAA National Current Observation Program (NCOP) employs standardized sensors and equipment in order to help maintain a robust, reliable, and cost efficient system of deployable bottom mounted current sensors. Sensor and instrumentation compatibility and interchangeability are critical to the operations and maintenance of the systems. System and sensor standardization also helps to ensure that the data gathered while systems are deployed is suitable for post analysis, assessment, and use in updating tidal datum, currents tables, and navigational charts. Furthermore, system and sensor interoperability helps to reduce the cost of maintenance through ease of replacement and component upgrade. The Nortek Aquadopp sensors were originally selected for use by CO-OPS in 2001. Extensive market research conducted in 2011 and again in 2014 led to the selection of the Aquadopp 600kHz 2D and 1MHz Acoustic Doppler Current Profilers as the best value current profilers for meeting the NOAA NCOP requirements in shallow-water areas. The sensors are extremely compact and light weight, facilitating their use in various mounting configurations on buoys, bottom mounts, and pile / seawalls. The profiler bodies employ non-corrosive Delrin and polyurethane plastics with titanium screws. The Nortek sensors have performed consistently under the demanding requirements of the NOAA National Current Observation Program operational surveys, proving extremely reliable under the most grueling test and operational conditions.

NOAA has invested significant time and resources in developing mounting systems, brackets, survey procedures, and sensor partnering to help maximize data returns during current surveys. Procurement of a different type of acoustic profiler would require system integration research, extensive testing, engineering mounting hardware development, spares inventory build-up, and would delay operational current surveys supporting maritime navigational safety. Utilizing a different acoustic profiler could also delay chart updates, reducing chart accuracy and NOAA support to maritime navigation and commerce.

6. Describe how the Government will determine the cost to be fair and reasonable:

The suggested vendor’s equipment is widely used within this niche market and the prices quoted are in-line with industry-wide pricing, and the vendor offers the US Government a modest price reduction from commercial rates. The Government will also use prior and recent price quotes from the vendor to help determine that the cost is fair and reasonable.

7. Description of market research conducted:

In-depth research and testing, both laboratory and field, of multiple comparable acoustic profilers which resulted in selecting the Nortek ADCPs as the best value acoustic profilers meeting the NOAA NCOP requirements for shallow-water environments. This market research was conducted in 2001, 2011, and again in 2014. In addition, an exhaustive internet search produced no other sources beyond Nortek, the original equipment manufacturer for the required instrumentation. Searches were performed on Google and GSAAdvantage. All links found to reference the Nortek Aquadopp series of sensors were either only for instrument leasing, informational, or directed potential purchasers to contact Nortek directly for sales information. Nortek is the sole manufacturer and only authorized supplier of this instrumentation.

8. Statement of actions, if any, to remove barriers to competition in the future:

NOAA CO-OPS undertakes a system analysis and evaluation of standardized equipment and sensors every 3-5 years and re-evaluates requirements and other manufacturer’s systems. If equipment or a sensor representing a better value to the government that meets CO-OPS’ requirements is identified, CO-OPS will take action to begin procuring the newly identified equipment or sensor for integration into the NCOP surveys.

9. Any other facts supporting justification:

This item is a standardized piece of equipment used to measure currents within NOAA’s current observation mission and is available only from the suggested source. These ADCPs are mission critical items.

10. Certification:

Technical/Requirements Personnel:

I certify the requirement meets the Government’s minimum need and that the facts, representations, and data included in this justification are complete and accurate.
