DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. Bureau of Reclamation, Acquisition Operations Branch

(AOB), Denver Colorado.

2. Name and Address of Single Source. Cision U.S. Inc. subscriptions, this contract is a Firm

Fixed Price, using FY19 funds on PR i. the amount of$ . This justification is only for brand name.

3. Description of Supplies/Services and Estimated Cost. Cision U.S. Inc. subscriptions is a low cost, highly informative web based public relations tool designed to manage contact lists with media, customer, stakeholder and elected officials and the public. II distributes new releases by email and through a news distribution service. Tracks press inquiries and automatically captures and stores news clips with the ability to distribute these to the selected contacts. This procurement will cover a period of performance ending 12/31/2019, and the estimated cost is $ The Contractor will utilize a web-based system that is compatible with the existing avenue to utilize the subscription.

4. Description of Circumstances, including why only one source is reasonably available.

The manufacturer Cision has combined multiple programs and resources that are required and currently being utilized by Reclamation. This subscription allows the Bureau of Reclamation to utilize the existing web base subscription. The Cision brand has been used for the past four years throughout the Bureau and continues to meet or exceed the mission of the Bureau of

Reclamation. Lastly, all end users have received formal training on the current web-based system, which allows flexibility to best support the mission. A new system would require

Cision provides the product in one subscription that includes everything that is required by the Specifications in one package. Other vendors offer portions of the requirement but lack the ability to offer all in one package. Cision program is compatible with the operating systems currently being utilized. Utilizing this brand name/manufacturer will avoid interruption of service, continuity of services utilized by employees and will eliminate the need to have multiple contracts and log in requirements for other products. Cision web-based program is the only program that will fulfill Reclamations requirements.

5. Determination of Fair and Reasonable Price. lAW FAR 13.106-3(2)(i)(ii) The same requirement was awarded on R , dated 12/20/2012 in the amount of $.‘

It was competed on a GSA schedule, but the contents of the subscription are no longer on a

GSA Schedule. Current contract ) was awarded to a small business that is not able to sell on their GSA schedule. Current contract was competed under small business set aside and LPTA was used. Pricing will be compared to previously awarded contract pricing.

6. Description of Market Research. Market research was conducted through SBA, GSA, Google, FPDS, and previous purchases. Recent history shows that the Bureau of

Reclamation used Cision U.S. Inc., which is a large business manufacturer, most recent contract was awarded to The Millennial Group a small business. Per email from Millennium

Group, they are the oniy small business vendor authorized reseller of this product. Cision US

Inc. and the Millennial Group are the only sellers of this product.

It would not be cost effective for Reclamation to use another brand at this time, and it would cause an administrative burden with additional time and resources to train staff members.
