FOREWORD

Work to be performed under this solicitation is to be performed at the Bureau of Reclamation’s Nebraska-Kansas Area Office located at 1706 West 3rd Avenue, McCook, NE 69001. The project is located in Red Willow County and will include construction in the public right-of-way.

Work under these specifications includes:

A. Remove and dispose of existing crushed rock, soil, concrete, asphalt and gravel at the north (rear) driveway entrance including:

1. Existing concrete curb and gutter;

2. Existing sidewalk.

B. Install new concrete driveway including:

1. Concrete curb and gutter;

2. Concrete sidewalk.

C. Repair adjacent landscaping, fencing and other improvements disturbed by construction.

POINT OF CONTACT:

The point of contract is the Contract Officer, Mr. Paris Everson. All questions and correspondence concerning this solicitation will be directed to him via email at peverson@usbr.gov. Phone calls will not be accepted to ensure all communication will be properly documented for record purposes.

TYPE OF CONTRACT:

This requirement is solicited as a “Request For Quote" (RFQ) using the Federal Acquisition Regulation Sub Part 13, Simplified Acquisition Procedures. Results from this solicitation will be an anticipated award of a Firm Fixed Price contract.

MAGNITUDE OF PROJECT:

$25,000 - $150,000.

NORTH AMERICAN INDUSTRIAL CLASSIFICATION SYSTEM:

238990 – Construction of Highways, Roads, Streets & Bridges.

A PRE-QUOTE SITE VISIT: will be held on July 12, 2018, at the Bureau of Reclamation’s Nebraska-Kansas Area Office located at 1706 West 3rd Avenue, McCook, NE 69001, beginning at 1:00 pm CT. Prospective bidders should make arrangements by contacting Carl Koenig at ckoenig@usbr.gov or (308) 345-1023. Attendees are to provide and wear safety boots, hard hats, safety vests.

RECLAMATION SAFETY AND HEALTH STANDARDS (2014 EDITION):

For information regarding Bureau of Reclamation's publication "RECLAMATION SAFETY AND HEALTH STANDARDS" (2014 Edition at http://www.usbr.gov/ssle/safety/RSHS/rshs.html) which is applicable to work under this contract, see clause at "WBR 1452.223-81 SAFETY AND HEALTH."

SYSTEM FOR AWARD MANAGEMENT (SAM):

Effective July 29, 2012 all contractors interested in doing business with the Federal Government must be registered in the System for Award Management (SAM) database prior to an award or agreement. Note: Registering in “SAM” does not constitute an automatic award of any contract or agreement to the registering contractor. SAM is centralized database for consolidating the Central Contractor Registration (CCR), the online Representation and Certifications Application (ORCA), and the Excluded Parties List System (EPLS). Additionally, the contractors “DUNS and BRADSTREET” and banking information are required for the SAM registration and annual confirmation requirements must be accomplished through the SAM website at https://www.sam.gov. INVOICE PROCESSING PLATFORM (IPP):

Payment requests for the anticipated contract or agreement must be submitted electronically through the U.S. Department of Treasury’s “Invoice Processing Platform” (IPP) System via the IPP website at https://www.ipp.gov. Contractors are required to use the IPP website to access and use IPP for submitting request for payment. Registration assistance can be obtained by contacting the “IPP Production Helpdesk” via email ippgroup@bos.fbr.org or phone 1-866-973-3131. If the contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the contractor can submit a waiver request in writing to the Contractor Officer with its proposal. Note: Waivers will be on a case by case basis and not automatically granted as determined by the Contract Officer.

PART 1 GENERAL

1.01 MEASUREMENT AND PAYMENT

A. Cost:

1.03 SUBMITTALS

A. Submit the following in accordance with Section 01 33 00 - Submittals.

B. RSN 01 14 10-1, Land Use and Landscape Rehabilitation Plan:

1. For each Contractor use site on Government land:

a. Show use location and extent of impact. Uses include but are not limited to the following:

1) Buildings and service areas including offices, shops, warehouses, storage areas, fuel and oil storage areas, and fabrication yards.

2) Parking areas, temporary roads, and haul routes.

3) Utilities including air, power, and water lines; fire hydrants; and compressor station.

4) Areas for processing, storing, and disposing of waste materials from construction operations.

5) Temporary fences.

b. Describe methods to preserve, protect, and repair, vegetation (such as trees, shrubs, and grass) and other landscape features on or adjacent to jobsite, which are not to be removed and which do not interfere with work required under this contract. Include methods to mark work area limits, protect disturbed areas, and prevent erosion.

c. Describe methods to protect, and repair if damaged, existing improvements and utilities at or near jobsite.

d. Describe methods for removing temporary structures and facilities, cleanup, and rehabilitating site after completion of construction activities.

2. Submit revised drawings of changes in use of Government land made during design and erection stages or after use of Government land is in operation.

1.04 PROJECT CONDITIONS

A. Government land (as shown in Section 52 00 00 – Drawings) may be used for required construction facilities.

B. Portions of construction will be located in the public right-of-way. The Government shall secure construction permits through the City of McCook Public Works Department for driveway and sidewalk improvements.

C. Work is located within a restricted, Government access area. Temporary removal of a portion of the perimeter security fencing will be necessary to complete the work.

Temporary orange fencing will be installed by the Contractor as shown on the drawings in Section 52 00 00 – Drawings. The Contractor will not perform work beyond the orange fencing, within the perimeter security fencing area of site, without a Government representative present. Refer to Section 01 56 20 – Temporary Safety and Existing Fences.

D. Buried electric, water and sanitary sewer lines are located beneath the project area. Care should be taken to protect these lines from damage. Refer to Section 01 56 15 – Protection of Existing Utilities.

E. Location, construction, operation, maintenance, and removal of construction facilities on Government land will be subject to approval of COR.

F. Do not interfere with work of other contractors or the Government in vicinity, or with reservations made by the Government for use of such land.

G. Housing for construction personnel will not be permitted on Government land, except housing for guards or watchmen as may be approved by COR.

3.01 CLEANING

A. Construction equipment:

3.02 RESTORATION

C. Submit sets specified in “Sets to be sent:” columns in Table 01 33 00A - List of Submittals.

1. Electronic submittals:

a. In Portable Document Format (PDF).

b. Include RSN transmittal letter.

c. Do not include Personally Identifiable Information (PII) in electronic submittals.

2. Submit electronic submittals via email or CD/DVD based on size:

a. The Government can receive e-mails up to 25 MB. However, e-mails over 10 MB should be considered extra large. E-mailing of electronic submittals exceeding 10 MB should only occur after transmittal of larger size e-mail has been verified.

1.06 REVIEW OF SUBMITTALS

A. Time Required:

1. Submittal review will require 21 days for review of each submittal or resubmittal, unless otherwise specified.

2. Time required for review of each submittal or resubmittal begins when complete sets of materials required for a particular RSN are received and extends through return mailing postmark date.

B. Time in Excess of Specified:

1. The CO may extend the contract completion date to allow additional time for completing work affected by excess review time.

a. The time extension will be to the extent that excess review time caused delay to the contract completion date.

b. The time extension will not exceed the time used in excess of the specified number of days for review of submittals or resubmittals.

c. Concurrent days of excess review time resulting from review of two or more separate submittals or resubmittals will be counted only once in extending the contract completion date.

2. No time extension will be allowed if the Contractor fails to make complete action submittals in sequence and within time periods specified.

3. Adjustment for delay will be made only to the extent that:

a. Approval was required under the contract, and

b. Requests for approval were properly and timely submitted and were approved.

4. Adjustment will be subject to terms of paragraphs (b) and (c) of the clause at FAR 52.242-14, Suspension of Work, however, no such delay shall be deemed to be a “suspension order” as the term is used in that clause.

C. Submittal Response:

1. A response letter from the COR for each submittal will be sent to the Contractor indicating if the submittal is either approved, approved subject to identified changes, or not approved.

1.03 SUBMITTALS

A. Submit the following in accordance with Section 01 33 00 - Submittals.

B. RSN 01 35 20-1, Safety Program:

1. Submit a comprehensive, job-specific safety and health program in accordance with Section 01 33 00 – Submittals and in accordance with the requirements of Section 3.3 of the Reclamation Safety and Health Standards (RSHS) and these specifications.

2. The Safety Program will not be accepted for review by the COR unless it addresses, in order, lettered and numbered per Appendix B of the RSHS, a http://www.osha.gov/ http://www.acgih.org/

01 35 20 - 2 comprehensive narrative for each applicable item in the outline and program elements contained in these specifications.

3. Generic company safety programs are not acceptable. The Safety Program must be site specific for this contract.

4. The Contractor’s Safety Program must be submitted and accepted by Reclamation prior to commencing onsite work, including mobilization.

5. The Safety Program Statement of Responsibility must state that “the contractor is responsible for ensuring that all work will be in compliance with Reclamation Safety and Health Standards and these specifications.”

6. The Safety and Health Program shall include but not be limited to the following program elements:

a. Emergency Action Plan:

1) Detail coordination plan for outside emergency services including response time and a site visit where a rescue requires special capabilities or equipment.

2) This plan shall address detailed emergency contacts and procedures to be used during an onsite emergency.

b. Electrical Safety:

1) Include safe work procedures at the site, electrically qualified persons, grounding techniques, use of mobile generators, construction lighting, power tool safety, and use of personal protective equipment.

c. Job Hazard Analysis:

1) Provide a list of proposed JHA’s in the Safety Program for each anticipated work task.

2) A detailed JHA shall be completed onsite prior to starting each work task. Work will not begin on the phase of the work until a JHA is acceptable to the Onsite Government Representative.

3) Activities involving hazardous materials shall have the appropriate Material Safety Data Sheet(s) attached to the JHA.

d. Respiratory Protection:

1) Identify respirator users, tasks and operations with recognized respiratory hazards.

2) The plan shall address exposure to respirable silica associated with concrete work as follows.

a) Use of tight fitting half face air purifying respirators with P100 cartridges in the absence of an on-site exposure assessment.

b) The level of respiratory protection may only be diminished on the basis of an exposure assessment conducted by a certified industrial hygienist (CIH) specific to each dust-generating operation that is acceptable to Reclamation.

e. Hearing Conservation:

1) Include a task- and site-specific hearing conservation plan.

2) Identify the type of hearing protection and verify that workers are in a Hearing Conservation Program.

f. Personal Protective Equipment (PPE):

1) Include a detailed plan for each task that specifies which personal protective equipment shall be used for all construction activities.

2) The employer must ensure that the PPE is verified by the manufacturer for the intended use and protection.

3) Provide appropriate PPE at no cost to the employees.

4) Standard designs are used.

7. The Contractor shall be responsible for insuring that Subcontractors comply with the requirements set forth in these specifications, the regulatory standards and the industry standards incorporated by reference in the RSHS and OSHA standards.

C. RSN 01 35 20-2, Monthly Accident Summary Report:

1. Form 7-2218 or other acceptable form in accordance with paragraph 3.8 of RSHS.

2. Submit on the first day of every month.

D. RSN 01 35 20-3 Respirator User Documentation:

1. Submit documentation of medical qualifications less than 12 months old for all respirator users at the site.

2. Submit results of fit tests less than 12 months old for all users of tight fitting negative pressure respirators at the site.

E. RSN 01 35 20-4, Other Training Certificates:

1. First Aid/CPR certifications for onsite foremen and/or safety personnel.

1.04 SAFETY AND HEALTH

A. Comply with RSHS, local safety programs, and any other referenced safety and health standards. Perform work in accordance with the specific safety program elements and referenced standards.

B. Provide and maintain a work environment and procedures that will:

1. Safeguard the public, Government personnel, and Contractor employees from Contractor operations and activities that are unsanitary, hazardous, or dangerous to health and safety.

2. Avoid interruptions of site operations and delays in project completion dates.

3. Control costs in contract performance.

C. For each operation requiring the use of heavy equipment, in addition to the use of backup alarms and high visibility vests, include in the JHA specific steps to ensure the protection of onsite personnel (internal traffic control) from the hazards of being struck by or caught between moving equipment while working around such equipment. Possible methods of controlling said hazards may include radio communications, backup cameras and/or proximity devices, designated observers, etc. Provide all appropriate safety barricades, signs, and warnings. Erect or label all limited approach and arc flash hazard boundaries for exposed energized equipment. Coordinate these activities with Reclamation electricians.

D. Comply specifically with all requirements contained in RSHS Section 3 - Contractor Requirements.

E. Investigate and report all accidents, incidents and near misses in accordance with RSHS Section 3.7.

F. When the Contractor fails or refuses to promptly correct a compliance directive, the Contracting Officer may issue an order to stop all or any part of the work:

1. When satisfactory corrective action is taken, an order to resume work will be issued.

2. The Contractor shall not be entitled to extension of time or to claim for damage or to additional compensation by reason of ether the directive or the stop order.

3. Failure of the Contracting Officer to order discontinuance of any or all of the Contractor’s operations shall not relieve the Contractor of the responsibility for the safety of personnel and property.

G. Disputes regarding safety and health issues will be settled in accordance with RSHS Section 3.

H. The Contractor shall be responsible for providing medical and emergency assistance in a timely manner that is consistent with recognized emergency protocols.

1. In instances where local emergency responders are not readily available, the responsibility to provide emergency services shall default back to the Contractor.

I. The Contractor shall be responsible for insuring that Subcontractors comply with the requirements set forth in this specification, written programs, the regulatory standards and the industry standards incorporated by reference in the RSHS and OSHA standards.

J. Where there is conflict between the standards, the more stringent or restrictive shall be utilized.

K. The Contractor shall fully participate in the Contractor Safety Program Review meeting, according to RSHS Section 3.4.1. The Contractor Safety Program Review meeting will take place before the start of construction:

1. Include subcontractor management representatives.

2. The Safety Personnel shall be present, in order to discuss in detail the Safety Program and Plans.

3. The COR, the Contractor's principal onsite representative, and designated members of respective staffs must participate in the scheduled monthly safety meeting (JPSM) according to RSHS Section 3.4.2.

L. The minimum work crew at any time on the construction site shall consist of no less than two (2) people.
