PERFORMANCE WORK STATEMENT (PWS)

FOR

MANNED SECURITY GUARD SERVICE

AMERICAN MEMORIAL PARK

SAIPAN, NORTHERN MARIANA ISLANDS

July 2024

1.0 DESCRIPTION OF SERVICES

The Contractor shall provide all personnel, tools, equipment, transportation, and labor necessary to ensure nightly private security services at American Memorial Park (“AMME”) are accomplished. Pre-coordination activities following contract award but in advance of the performance start date may be required. A 30 day start-up period is allowed, upon contract award to the initial start of performance. The Contractor shall comply with pre-coordination directions issued by the Contracting Officer that serve to initiate contract performance.

1.1 BACKGROUND

American Memorial Park located within the West Pacific on the island of Saipan, Northern Mariana Islands, honors the American and Marianas people who gave their lives during the Marianas Campaign of World War II. At the park, memorials stand in tribute to the courage and the sacrifice of the US Servicemen and Chamorro and Carolinian civilians who were killed in the battles between the United States and Japan that took place on Saipan, Tinian, and the Philippine Sea in 1944.The Park’s facilities, inclusive of a Visitors Center, Amphitheater, indoor theater, tennis courts, a softball field, beach front spaces and paved walkways are highly utilized by residents and tourists on a daily and nightly basis. American Memorial Park currently does not have a stationed Law Enforcement Ranger.

1.2 SCOPE

The safety and security of American Memorial Park’s assets, visitors and employees are of priority. Although administration, visitor’s service and other divisions operate on a 7-day work week, American Memorial Park’s normal operations cease at about 5:00pm. After operational hours, American Memorial Park’s outdoor areas are accessible to the public. The contractor shall provide services from 8pm-6am on a Monday to Sunday schedule, inclusive of Holidays at American Memorial Park.

1.2.1 Task 1 Building security checks

The Contractor shall provide a stationary guard conducting physical security checks every hour of American Memorial Park’s facilities, grounds, and other assets. Amphitheatre: Visually inspect, checking for unlocked doors and vandalism. Visitor Center: Patrol exterior to include the parking lot. Shall manually check all doors to ensure that they are all locked. Administrative Office: located below the amphitheater seating. Ensure that all doors and windows are secured and locked. Maintenance Building: Facilities and grounds- Physically check to ensure the building’s doors and chlorinator/water are locked and secured.

1.2.1.1 Task 1 Grounds and Asset security check

The Contractor shall provide physical security checks every hour on American Memorial Park’s grounds and assets. Court of Honor- Visual inspection of surrounding area including the parking lot. Visible inspection of the Carolinian Bell Tower, Micro Beach Pavilion, the Marianas Memorial, the tennis courts and adjoining building, Micro beach restrooms and the old maintenance yard.

1.2.2 Task 2 Additional Duties

The Contractor shall ensure a daily/nightly log is established and maintained. All suspicious/criminal activity and other emergencies must be immediately reported to the National Park Service, the Department of Public Safety, and local Emergency Medical Services. The Contactor and/or designee shall not physically detain a person(s) of interest, but rather call the aforementioned authorities. In the event of a maintenance need or safety hazard, such as a water line break, toilet overflow or exposed wirings, the Contractor shall immediately contact the COR or the National Park Service representative. All immediate emergencies inclusive of medical needs and “in progress” crimes shall be reported in the following order:

1. DPS and/or DFEMS – 911 (immediate response)

· Contact made if not successful with Chief Ranger

· Contact made if not successful with any of the park staff Except for 911, all non-emergencies shall be reported in the same order of park staff.

1.3 PERMITS, LICENSE & INSURANCE

The Contractor shall be responsible for obtaining and holding all necessary permits, licenses and insurance required to accomplish these services, including final disposition. The contractor shall comply with all Federal, State and Local requirements for waste disposal and any other service activities made under this effort. The same standards apply to subcontractors for any sub-contracted service activities.

1.4 CONTRACTOR PROVIDED EQUIPMENT AND SUPPLIES

The Contractor shall be responsible for providing equipment, personnel, transportation, and material to fulfill the scope of work. Any means of transportation within American Memorial Park shall be provided by the Contractor. Golf carts, bicycles and other immediate means of transportation shall be operated on paved roads and paths in a safe manner and in accordance with applicable statutes, laws, and regulations. Operation of motorized vehicles on grass shall only be permitted during an emergency. The Contractor is responsible for the repair or replacement of their equipment and material.

2.0 CONTRACT PERFORMANCE

2.1 SERVICE SUMMARY (SS)

The contract service requirements are summarized in the performance objectives below. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The SS provides information on contract requirements, the expected level of Contractor performance and the expected method of government validation and confirmation of services provided. These thresholds are critical to mission success. Procedures as set forth in the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies.

2.2 CONTRACTOR WORK SCHEDULE

The contractor shall provide services from 8pm through 6am, from Monday through Sunday, seven days a week, inclusive of Holidays at American Memorial Park.

2.3 PROGRESS MEETINGS

The CO, COR, and other NPS personnel, as appropriate, and the Contractor shall periodically meet to discuss the Contractor’s performance. The following issues shall be discussed: opportunities to improve the contract, required contract modification(s), unsatisfactory inspections and trends against each performance objective observed, positive performance and steps taken by the contractor to prevent unsatisfactory occurrences in the future. The contractor shall address and respond to customer complaints, and shall provide root cause analysis, performance improvement plan and insight into any identified trends.

2.3.1 Progress Meeting Minutes

The CO will develop meeting minutes and distribute those minutes to the Government team and the Contractor. Should the Contractor not concur with the minutes, the Contractor shall provide a written notification to the CO identifying areas of non-concurrence for resolution.

2.4 CONTRACTOR’S QUALITY CONTROL

The Contractor shall develop and maintain a quality program to ensure the services described by this PWS are performed in accordance with commonly accepted commercial practices. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. At a minimum the contractor shall develop quality control procedures addressing the areas identified in paragraph 2.0, Service Summary.

2.4.1 Contractor’s Quality Control Plan (QCP)

The Contractor shall develop and maintain a Quality Control Plan that, at a minimum, communicates: (1) What will be monitored; (2) How monitoring will take place; (3) When monitoring will take place; (4) Who will conduct monitoring; and, (5) How monitoring efforts and results will be documented.

2.4.2 Contractor’s Quality Control Checklist(s)

The Contractor shall develop and maintain one or more Quality Control Checklists that align with the Contractor’s QCP and capture, at a minimum, the following: (1) Tasks; (2) Validation of acceptability of tasks; (3) Inspector name; (4) Inspection method; (5) Inspection date; and, (6) Inspection time.

2.5 QUALITY ASSURANCE

The Government shall inspect and evaluate the Contractor’s performance to ensure services are received in accordance with requirements set forth in this PWS. The CO will appoint a primary and alternate representative for management of the day-to-day activities of the contract. The identity, title, and authority of this representative will be provided in writing to the Contractor after contact award. The contractor shall provide work schedules to the Contracting Officer’s Representative (COR) in accordance with paragraph 2.2 of this PWS. The COR may inspect by validating actual work performance, physically checking an attribute of the completed task, checking a management information report, investigating customer complaints, conferring with facility managers or otherwise inspecting the task or its results to determine whether or not performance meets the standards contained in this PWS.

2.6 GOVERNMENT REMEDIES

The Contracting Officer (CO) will follow FAR 52.212-4 Contract Terms and Conditions-Commercial Items, for the contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

3.0CONTRACTOR PERSONNEL
3.1CONTRACT MANAGER

The contractor shall establish a contract manager or alternate(s) that can be contacted during work hours. The contract manager or alternate shall be available during normal duty hours to discuss contract related matters. The contractor shall provide the CO the telephone number(s) where performance validation results and complaints can be reported. This information will be kept updated by the contractor whenever personnel changes occur. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to the daily operation of this contract.

3.2CONTRACTOR EMPLOYEE
3.2.1APPEARANCE

Contractor personnel shall present a neat appearance. contractor personnel shall be easily recognizable while on the installation in conjunction with this contract. This shall be accomplished through the wear of distinctive clothing, overcoats, or hats, bearing the company name or logo. The coloring or design of the items selected should be such that identifies personnel easily and quickly for reasons of safety and personal protection. All contractor personnel shall always be fully clothed while performing the services of this contract. "Fully Clothed" is deemed to mean that a shirt (or T-shirt), trousers, closed-toe shoes, and personal protective equipment, if required, shall always be worn. Tact, diplomacy, and courtesy shall always be used during contact with the community. Uniform and attire provided by the Contractor shall be representable with no obscene photos or letterings.

3.2.2 QUALFICATIONS OF PERSONEL-General Requirements

To be eligible to perform under this contract, each contract employee must meet the following citizenship, age, education, experience, health, and security requirements.

· Citizenship Subject to existing law, regulations and other provisions of this contract, illegal or undocumented aliens shall not be employed by the Contractor, or with this contract. To be eligible to perform under this Contract, all Contractor employees must meet, to the satisfaction of the CO and COR, the following requirements: be a citizen of the United States of America or lawfully admitted aliens qualified to work under current Immigration and Naturalization Service Regulations and have a Social Security Card issued and approved by the Social Security Administration.

· Age and Fitness All contractor employees must be a minimum of eighteen (18) years of age. While there is no limit as to the maximum age of security guards, all security guards must be able to withstand the physical demands of the job. In addition to general good health, the prospective contractor employees must have no condition which might preclude performance of any task assigned under this task order. All contractor employees must have full binocular vision corrected to at least 20/30 and no significant hearing impairment being able to hear normal conversation at approximately twenty (20) feet. It will be the Contractor’s responsibility to ensure that medically acceptable documentation regarding the guards hearing and eyesight is on file and available to the CO and COR upon request.

· Education/Experience The waiver of any education requirement shall be requested in writing from the CO via the COR. If the waiver is allowed, the reply shall be in writing and must be placed in the employee's On-Site Personnel folder.

The contractor's employees must:

A. Possess a high school education or equivalency, and have two (2) years of experience demonstrating:

1. The ability to meet and deal with the general public.

2. The ability to clearly speak and write in English and be able to read and understand directions in English.

3. The ability to read, understand and apply printed rules, detailed orders, instructions, and training materials.

4. The ability to maintain poise and self-control under stress.

B. Possess a current Security Guard License certification.

C. Possess a current State/Local Driver’s License.

Possess a current certification to operate other forms of transportation (i.e., golf cart, ATV, etc.).

3.3 EMPLOYEE RESTRICTIONS

The Contracting Officer is authorized to restrict employment under the contract of any contractor employee or prospective contractor employee who is identified as a potential threat to the health, safety, security, general well-being, or operational mission of the installation and its population.

4.0GENERAL INFORMATION
4.1DAYS AND HOURS OF OPERATION: American Memorial Park, Saipan

The contractor shall be responsible to provide services at American Memorial as outlined in the scope of work. The Contractor shall perform the required services during the following hours:

Sunday to Monday: 8:00pm to 6:00am CHST Monday to Tuesday: 8:00pm to 6:00am CHST Tuesday to Wednesday: 8:00pm to 6:00am CHST Wednesday to Thursday: 8:00pm to 6:00am CHST Thursday to Friday: 8:00pm to 6:00am CHST Friday to Saturday: 8:00pm to 6:00am CHST Saturday to Sunday: 8:00pm to 6:00am CHST

4.2 HOLIDAYS & CLOSURES

In line with the scope of work schedule, the contractor shall be providing services on all Federal Government Holidays.

4.3 GOVERNMENT FURNISHED PROPERTY AND SERVICES

The Contactor will not be utilizing Government Furnished Property or Government Furnished Services.

5.0INSTALLATION ACCESS
5.1WORK RESTRICTIONS & RESOURCE PROTECTION

The NPS is the steward of unique resources found within the national parks. The NPS is committed to protecting natural, cultural, historical, archaeological, and other resources found within the parks and the adjacent lands. The Contractor’s scope of work will have no direct impact to American Memorial’s natural, cultural, historical, archaeological and other resources.

5.2 INSTALLATION SECURITY AND ACCESS REQUIREMENTS

The contractor shall have no access to any sensitive or secured equipment or assets. The contractor shall be responsible to ensure their assigned guard has met their company’s security pre-employment requirements.

5.3 SAFETY REQUIREMENTS AND REPORTS

The Contractor shall perform work in a safe manner as required by the Occupational Safety and Health Administration’s (OSHA) requirements. The Contractor shall immediately provide a verbal report to the CO and COR for each occurrence of damage to Government property or an accident resulting in death, injury, occupational disease, or adverse environmental impact.

5.4 DAMAGES TO GOVERNMENT BUILDINGS, EQUIPMENT OR VEGETATION

Damages to government buildings, equipment, or vegetation are addressed in FAR 52.237-2, Protection of Government Buildings, Equipment and Vegetation. The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor’s failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.
