NOTICE OF INTENT TO AWARD WOSB SOLE SOURCE

TITLE: REMOVE CARPET AND INSTALL RESINOUS FLOORING

SOLICITATION NO. 140P5219Q0004

Pursuant to FAR 5.207 (c) (15), In the case of noncompetitive contract actions (including those that do not exceed the simplified acquisition threshold), identify the intended source and insert a statement of the reason justifying the lack of competition.

The National Park Service intends to award WOSB sole source to RAS Epoxy Coatings LLC in Baton Rouge, LA. This concern specialize in residential and commercial applications of epoxy resinous flooring systems in the local trade area, and is eligible under the WOSB Program.

Authority to sole source is derived from FAR 6.302-5 Authorized or required by statute.

(a) Authority.

(1) Citations: 41 U.S.C. 3304(a)(5).

(2) Full and open competition need not be provided for when—

(i) A statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source

(b) Application. This authority may be used when statutes expressly authorize or require that acquisition be made from a specified source

(7) Sole source awards under the WOSB Program–15 U.S.C. 637(m) (see 19.1506).

Furthermore, pursuant to FAR 19.1506 (b) A contracting officer shall consider a contract award to a WOSB concern eligible under the WOSB Program on a sole source basis, before considering small business set-asides provided none of the exclusions at 19.1504 apply and—

(1) The acquisition is assigned a NAICS code in which SBA has determined that WOSB concerns are substantially underrepresented in Federal procurement;

(2) The contracting officer does not have a reasonable expectation that offers would be received from two or more WOSB concerns (including EDWOSB concerns); and

(3) The conditions in paragraph (c) of this section exist.

(c)(1) The anticipated award price of the contract, including options, will not exceed—

(i) $6.5 million for a requirement within the NAICS codes for manufacturing; or

(ii) $4 million for a requirement within any other NAICS codes.

(2) The WOSB concern has been determined to be a responsible contractor with respect to performance.

(3) The award can be made at a fair and reasonable price.

(d) The SBA has the right to appeal the contracting officer’s decision not to make a sole source award to either an EDWOSB concern or WOSB concern eligible under the WOSB program.

Market research conducted by the Agency to locate capable vendors in the local trade area by searching SAM database, SBA Dynamic Business Search tool, as well as other Internet sources, did in fact fail to identify other WOSB sources that are capable of satisfying this requirement.

Thus, the Contracting Officer has no reasonable expectation of obtaining offers from two or more responsible small business concerns that are competitive in terms of market prices, quality, and delivery.

Notwithstanding, all responsible WOSB sources with the capability to satisfy this requirement may submit a quotation or offer which shall be considered by the agency. Any prospective contractors that respond timely, must satisfy FAR 9.104-1 General standards in order to be determined responsible by the Contracting Officer and receive further consideration for award based upon price alone.

DESCRIPTION: This acquisition anticipates the award of a single, firm fixed price construction purchase order/contract resulting from this notice. The priced contract line item number include:

00010: Base Bid: Remove old carpeting (approx. 2400 SF) and install a seamless epoxy resinous flooring with 4” integrated wall base within the Barataria Education Center in accordance with the statement of work

00020 Bid Additive: Remove old carpeting (approx. 3300 SF) and install a seamless epoxy resinous flooring with 4” integrated wall base within the Barataria Visitor Center in accordance with the statement of work.
