QUESTIONS AND ANSWERS
The Government strongly urges offerors to inspect the site to gain a better understanding of the work requirements and to satisfy themselves regarding all general and local conditions that may affect the cost of performance. In no event shall failure to inspect the site constitute grounds for a claim after award.
Solicitation Number: 140L3621R0004 Project Title: Great American Outdoors Act - Moose Creek Road Surfacing Date and Time: 08/24/2021 at 9:00 am Meeting Place: Moose Creek Road, Exit 99 of I-15, Montana.
Conducted by: Zach Morgan
Q1: Can we get water out of the Creek?
A1: Contractor shall be responsible for obtaining the water source. The project site is adjacent to Moose Creek.
The Contractor shall obtain and bear all costs for any permits required to draw water from Moose Creek or any other water source as required by state law.
Q2: What permits do we need? Who do we contact for a permit?
A2: Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work. Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor’s fault or negligence. Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.
Q3: For reconditioning the road, is it really the whole road (the whole 3.5 miles)?
A3: Road conditioning shall be paid out by the mile, with an estimated quantity of 3.5 miles per the contract documents.
Q4: Where is the 3.5-mile marker stop point at with a government vehicle?
A4: The 3.5-mile marker is shown on the contract documents and as measured from the beginning of work.
Government reserves the right to require additional maintenance past mile marker 3.5 at the bid price in accordance with the contract documents and Federal Acquisition Regulations.
Q5: Who’s in charge of compaction testing? Will it be checked by Government or Contractor?
A5: Government will be responsible for performing all compaction testing requirements. Contractor shall supply certified proctor for surfacing material as part of required submittals.
Q6: How is the aggregate going to be measured? Weight tickets? What will be the conversion factor be?
A6: Aggregate base material shall be paid by the loose cubic yard. Volume of material shall be determined by the unit weight of the material as supplied by the Contractor in the form of a material submittal received from a certified geotechnical laboratory.
Q7: Does the 3.5 miles of road end at the gate just past the Trailhead?
A7: This is the anticipated end of the surfacing area. Exact distances will be measured by the Government to include all linear miles of road that is prepared and maintained as per the contract documents. All turnouts, approach road connections, and parking areas are incidental to road preparation and surfacing and shall be considered under the unit price of each schedule line item.
Q8: Where is the 1.5 miles of truck maintenance section of road? Or is it a typo or is it the full 3.5 miles of road?
A8: Per the specifications. Contractor will not be compensated for additional grading work on the upper 1.5 mile of road due to truck traffic and turning trucks around at the upper parking area during aggregate base course work.
Q9: On rough, rocky areas for the reconditioning, there are places that won’t scarify with the surface, and it will be tearing up the road. Would it require the wetting and add additional rock like a binder course of 4” to 6” on the road below the 4” of rock?
A9: Preparation of the subbase prior to the placement of the 4” aggregate shall be required by the Contractor.
Additional aggregate, or leveling coarse, will not be allowed as part of work. Shaping tolerances and prescribed preparation methods outlined in the contract documents shall strictly be met by Contractor, regardless of native material type.
Q10: Will the road require roadside brushing or tree removal?
A10: Roadside brushing and tree removal shall be at the discretion and expense of the Contractor.
Q11: Is weekend work allowed because 18 days is a short time frame?
A11: The performance period established for this contract is based upon all work being conducted during regular working hours between 7:30 a.m. and 5:30 p.m., Monday through Friday, excluding government holidays. If the Contractor desires to carry on work outside regular hours, including Saturdays, Sundays, and government holidays, a request must be submitted to the Contracting Officer in sufficient time to allow satisfactory arrangements to be made by the Government for access to the work site and inspection.
Q12: What are the consequences of going over the 18 days?
A12: In the event that the Contractor is unable to complete the project in the allotted time, actual damages will be paid to the Government to cover all financial damages incurred by the delay. This will be reviewed in detail during the pre-construction meeting.
Q13: Will work be able to start sooner than the date in the contract?
A13: All contract responses shall be placed with the assumption that the work will begin on the scheduled contract dates.
Q14: Quotations are due on September 7th and awarded how soon after?
A14: Award for the project is expected by 09/20/2021. Contractor shall begin performance within 10 calendar days from the date of Notice to Proceed.
Q15: What are going to be defined as turnouts? Can private property be labeled on map?
A15: Turnouts are considered part of the existing road and will be identified by the Government in the field.
Private property will not be labeled on the existing map. The entire length of the existing road is owned and maintained by the BLM.
Q16: Are the culverts getting replaced or brush cleared out or away from them?
A16: All culverts shall be identified by the Contractor. All culverts shall remain clear and free for unobstructive flow.
Q17: Are the contractors cleaning out the cattle guards?
A17: No; It is the responsibility of the Contractor to not fill the cattle guards and maintain the positive drainage away from each structure. In the event that excess material is cast into a cattle guard, Contractor shall be required to clear the structure of any objectionable material at no cost to the Government.
ADDITIONAL QUESTIONS RECEIVED
Offerors shall submit questions by August 27, 2021, at 5:00 pm, Mountain Time. Questions submitted after this date and time will not be accepted.
Q18: In the plans I can’t find anything on the bonding for the retainage time frames.
A17: Federal Acquisition Regulation Clauses 52.228-2 and 52.228-15 outline the requirements for performance and payment bonds associated with construction projects. Additionally, per the Warranty of Construction clause found in Section E of the solicitation, warranty shall continue for a period of 1 year from the date of final acceptance of the work.
Q19: As well as days for liquidated damages/penalties A19: This project does not contain liquidated damages/calculations. Should the required completion date not be met, the Contracting Officer could assess actual damages.
Q20: Wide spot locations are to be included in the quantities. An interested contractor, on the way back out from the upper end, counted the wide spots and estimated the size of each. There is no description in the specification or plans for minimum size or length of these locations. So, what is intended as a minimum for "wide Locations" or Pullouts for vehicle by passing?
A20: All turnouts, approach road connections, and parking areas shall be included as part of the work and included in the cost of road maintenance and surfacing work at no additional price.
Q21: At near the bottom end of the road is a big turnout. A RV Trailer and Truck are parked there. It’s been there for some time, and I’ve never seen anyone there. I live very near this area; I drive by here often. I checked with a local Rancher and its apparently a Gold Mine claim "camp." But it’s parked in the middle of the Turn Out. Coordination may be required to be able to get that moved for the resurfacing of that area.
Time will be of the essence. Please Advise.
A21: BLM will communicate the road closure to the public through public relations and social media prior to the contract and will make reasonable attempts to communicate to all stakeholders along the road.
Contractor shall be responsible for communicating the road closure to the public in accordance with MUTCD standards, following award through project completion. Road closure shall be communicated to the public through the use of construction signage.
