STATEMENT OF WORK
GENERAL
This is a “nonpersonal services contract” for an indefinite number (not to exceed 560 units) of Laboratory Services for the U.S.
Geological Survey (USGS) Pacific Coastal & Marine Science Center (PCMSC) in Santa Cruz, California. The USGS is a federal science agency in the U.S. Department of the Interior (DOI).
A “nonpersonal services contract” is defined in Federal Acquisition Regulation (FAR) 37.101. It is therefore understood and agreed that the contractor and/or the contractor’s employees: (1) shall perform the services specified herein as independent contractors, not as employees of the government; (2) shall be responsible for their own management and administration of the work required and bear sole responsibility for complying with any and all technical, schedule, or financial requirements or constraints attendant to the performance of this contract; (3) shall be free from supervision or control by any government employee with respect to the manner or method of performance of the services specified; but (4) shall, pursuant to the government’s right and obligation to inspect, accept or reject the work, comply with such general direction of the contracting officer, or the duly authorized representative of the contracting officer as is necessary to ensure accomplishment of the contract objectives.
BACKGROUND
The Pacific Coastal and Marine Science Center (PCMSC) of the U.S. Geological Survey (USGS) conducts field studies to characterize environmental samples that provide unbiased scientific information to the public about coastal, marine, and ecosystem processes primarily in the Pacific Region of U.S. states and territories. Lab Services are needed to prepare and/or characterize environmental samples.
PERIOD OF PERFORMANCE
Base period May 27, 2026–May 26, 2027 plus one Option Year.
TIMING
Field studies for sample collection occur intermittently. Thus, Lab Services will be requested on an as-needed basis. The technical liaison will provide at least 1-week advance notice when Lab Services will be needed. Products (see Deliverables) will be delivered within 4 weeks of notification.
NUMBERS OF SAMPLES (INDEFINITE QUANTITY)
Not to exceed 560 samples per year.
SCOPE OF WORK
This Scope of Work describes the Lab Services standard operating procedures (SOPs) required to prepare sediment and rock samples for various analyses or to perform routine lab analyses.
Sample prep of sediment samples for geochemical analysis:
• Freeze drying sediment and rock samples
• Sieving, griding, and splitting sediment samples
• Following clean lab procedures
• Preparation of samples for stable isotope analysis, including sediment weighing and acidification
• Sample archiving
• Data interpretation
• Potential ship-based field work
Sample prep of rock samples for geochemical and minerology analysis:
• Working directly with the technical liaison to describe rock and mineral samples and choose correct sampling plan
• Subsampling rock samples, which can include: crushing, dremeling, and cutting with rock saw.
• Preparing rock and sediment samples for X-ray diffraction in PCMSC, as well as preparing samples for geochemical analysis.
• Assisting in data organization and production where available (maintaining sample inventory organization, helping with data releases, and building out sample information sheets with notes from the technical liaison and taken from laboratory work)
• Running laboratory instrumentation when needed, including thermogravimetric analyzer and digital microscope.
REQUIRED SKILLS AND KNOWLEDGE
The contractor is required to have worked for six months full-time (or the part-time equivalent) in a physical or life science laboratory with Satisfactory or higher performance.
In addition, the Applicant must be proficient in:
• handling environmental samples without contamination
• use of a laboratory instrumentation (X-ray diffractor, thermogravimetric analyzer, analytical balance, freeze dryer)
• safe handling of hazardous materials (e.g., concentrated acids and bases)
• general lab safety protocols
• laboratory record-keeping
PERFORMANCE MEASURES
Lab services are deemed acceptable when they adhere to guidelines in the Scope of Work or another widely accepted Sediment Lab standard operating procedure, are performed accurately, and completed samples are delivered in accordance with the Timeliness criterion.
DELIVERABLES
• X-ray diffraction and geochemical data from prepared rock and sediment
• Remaining unsampled rock and sediment samples packaged and stored safely to minimize contamination, and organized subsamples; associated log sheets and notes completed and available for future subsampling analysis; samples sheets containing photos of samples before and during subsampling and laboratory notes.
• Sediment samples prepared for stable isotope analysis and associated laboratory notes.
• Notes and data produced during any other needed laboratory activities, including but not limited to thermogravimetric analysis and digital microscopy.
TIMELINESS
The technical liaison will provide at least 2 weeks advance notice when lab services will be needed. Products (see Deliverables) will be delivered within 4 weeks of notification.
SHIPPING COSTS
Shipping costs will be paid by the USGS.
LOCATION AND HOURS
Lab Services can be performed at an outside lab or at PCMSC. Work hours are fully flexible. If work occurs at PCMSC, Contractor access is limited to times when a federal employee is on site. Access to government facilities is contingent upon satisfactory Security Clearance and Training.
TRAVEL
Occasional travel may be required for field work.
GOVERNMENT EQUIPMENT
Contractors should provide their own equipment to perform services. After satisfying US Department of the Interior (DOI), USGS, and PCMSC security and training requirements (see below), the Contractor may use PCMSC labs, lab and office equipment, and a government laptop to carry out Lab Services if needed.
SECURITY CLEARANCE AND TRAINING
To conduct work at PCMSC, the Contractor must undergo Federal security clearance including a background check (low-risk National Agency Check and Inquiries (NACI) investigation) that may include fingerprinting; DOI Laboratory Safety training;
annual PCMSC Lab Safety overview training, training in PCMSC lab procedures and protocols; and any other applicable Federal security, data management, ethics, privacy, whistle-blowing, and scientific integrity training requirements. The Contractor must adhere to all security and training requirements.
SECURITY CLASSIFICATION
The services requested under this contract are low-risk, non-sensitive.
ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS - INTERNET PROCESSING PLATFORM (IPP)
(FEBRURARY 2021)
Payment requests must be submitted electronically through the U.S. Department of the Treasury's Internet Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973- 3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
GS0231 Technical Liaison - Technical Clarification (December 2024)
a) The performance required herein shall be subject to the technical clarification of the Technical Liaison (TL) as identified below. As used herein, "technical clarification" is defined as communication to help the contractor fully understand the requirements.
(b) The Technical Liaison is not delegated any Contracting Officer’s Representative responsibilities.
(c) The Technical Liaison may not modify the requirements in any way. All modifications must be authorized by the Contracting Officer.
(d) The contractor shall immediately notify the Contracting Officer, in writing, if they believe the Technical Liaison is directing work outside the requirements of this contract. The contractor may not be reimbursed for any work outside the requirements of this contract.

GS0199 PREVENTION OF MALICIOUS CODE (JUN 2018)
(a) Definitions Malicious code is a computer code developed for the purpose of causing some form of intentional damage to computer systems or networks. Malicious code may be a complete program or code imbedded in software programs that appear to provide useful functions. The term includes computer viruses and other destructive programs, such as "Trojan Horses" and network "worms."
(b) The contractor must have in place an anti-virus procedure to ensure that media supplied is uncontaminated by malicious code.
(c) The contractor is required to scan all delivered software to insure it is free of malicious code prior to its installation or operation on USGS-owned computers or contractor-owned computers connected to USGS computer systems or networks.
Contractors using diagnostics software disks or connecting to a non-USGS computer while performing repairs or upgrades to a USGS computer will scan the serviced computer's drive(s) to insure they are free of malicious code upon completion of the service call, or prior to return of serviced equipment, if servicing is performed off-site.
GS1131 Unilateral Deobligation of Unexpended Funds (May 2013) The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.
GS1338 Notice to the Government of Delays (July 2001) In the event the contractor encounters difficulty in meeting performance requirements, or when it anticipates difficulty in complying with the contract delivery schedule or date, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely performance of this contract, the contractor shall immediately notify the contracting officer and the COR (if one has been designated), in writing, giving pertinent details. This data shall be informational only in character. Notice under this provision shall not be construed as a waiver by the Government of any delivery schedule or date or of any rights or remedies provided by law or under this contract.
GS1364 Nonpersonal Services and Supervision of Contractor’s Employees (September 2017) This contract is a “nonpersonal services contract” as defined in FAR 37.101. It is therefore, understood and agreed that the contractor and/or the contractor’s employees:
Shall perform the services specified herein as independent contractors, not as employees of the government;
Shall request clarification in writing from the Contracting Officer if the Contractor finds it necessary with respect to the scope of services to be performed or the manner in which the services are to be performed hereunder.
Shall be responsible for their own management and administration of the work required and bear sole responsibility for complying with any and all technical, schedule, or financial requirements or constraints attendant to the performance of this contract;
Shall be free from supervision, direction or control by any government employee with respect to the manner or method of performance of the services specified; but shall comply with such general direction of the Contracting Officer (or the duly authorized representative) pursuant to the government’s right and obligation to inspect, accept or reject the work as is necessary to ensure accomplishment of the contract objectives.
Shall not be at any time during the contract period employees of the U.S. Government.
The contractor's employees and subcontractors must make clear, in dealings with the public, federal employees, or other contractors that they are not federal employees. To minimize possible confusion, contractors and subcontractors are not permitted to wear clothing or other items (apart from official identity credential) bearing the name, logo, or seal of the U.S.
Geological Survey while performing work under this contract.

(a) The Government may extend the term of this contract by written notice to the Contractor within 10 days provided that the
Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires.
The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 2 years.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision—
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub.
L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.
52.204-26 Covered Telecommunications Equipment or Services-Representation (October 2020)
