Section B - CONTINUATION OF SOLICITATION/CONTRACT FORM B-1 Salient Characteristics

Background:

The USGS Caribbean-Florida Water Science Center (CFWSC), Davie office, requires the purchase of an automated chloride analyzer. The analyzer must be able to accurately determine chloride concentration for water samples collected by the office. The Davie laboratory has used a Seal AQ1 Discrete Analyzer for over 10 years. During that time, it has been used to provide accurate and timely results to researchers and cooperators and has proven itself reliable and robust. The replacement should allow us to continue providing the same level of analytical data with little to no interruption. The current automated methods and used in the Davie laboratory were created using the Seal AQ1 instrument and the replacement instrument should use the same methods without requiring significant time spent on new method development to produce comparable results. The replacement instrument should easily meet laboratory quality control requirements.

Specifications:

Operational Specifications:

1. All chemistries on the automated multi-chemistry system must operate on the principle of discrete batch robotics analysis.

2. The robotics system must provide immediate, on-demand start-up, automated method changeover, and automated shutdown under computer control with no operator intervention.

3. The analyzer must be method-based, capable of replicating the sample and reagent ratios specified in prescribed manual or continuous flow methodologies.

4. The system shall be capable of analyzing tests from a combined volume of sample and reagents of 500 µL per test. If required, the combined volume of sample and reagents per test may go up to 1000µl.

5. The system must allow for at least 7 chemistries to be run sequentially with no operator intervention.

6. The system shall be able to apply only the required tests on each sample.

7. The system shall not require reagent baseline stabilization.

8. The software must run under Windows 7 or higher and must perform simultaneous instrument control, data acquisition and report generation.

9. The system must not require any post-run carryover correction. As soon as the sample is through the detector, the final concentration value must be available.

10. Automatic dilution with a high resolution 1000 µL syringe dilutor must be available to enable automated preparation of working standards from a stock standard and automated dilution of off-scale samples to bring their concentrations within the working range of the chemistry.

11. Diluted samples must be re-run automatically and results integrated into a final report.

12. System must have the option of a sample tray for more than 95 samples on board.

13. The system must have the option to place up to 18 reagent containers. Containers must be capable to be filled up to at least 40 mL.

14. The system must be able to perform a minimum of 180 tests without operator´s manual intervention and must have the capability to add samples during the run.

15. The system must have the capability to pause a run, measure emergency samples and continue with the paused run.

16. The system must allow at least 180 tests without the need for manual interaction. This requirement is for larger number of samples; including pre- and post-dilution, calibrations for multiple tests and CCV, CCB as required.

Instrument Specifications:

1. All operating parameters must be computer-programmable with no manual switching of manifolds, pump tubes, sample loops or interference filters.

2. The system must allow true walk-away operation with no operator monitoring or intervention.

3. The system must be capable of performing analyses on-demand. Specifically, if the appropriate reagents are loaded, the system will allow the user to schedule up to at least 7 individual tests to be run on specified samples without additional instrument setup.

4. The instrument must be capable of automated method changeover to specifically include computer-controlled sample volume, reagent volumes, reaction times and detection wavelengths.

5. The pipette system must be able to dispense at least 2 -500 µL sample and 10 - 500 µL reagent. The minimum dosing volume must be at least 2 µL.

6. Sample trays must be keyed so that they only go on one way to avoid any wrong positioning.

7. The instrument must accommodate up to 18 reagent/bulk container reservoirs incorporating a Peltier-cooled system for the containers to bring reagents to 10 degrees C below ambient and perforated reagent vessel caps to reduce reagent volatilization, eliminate cross-contamination among reagents and samples, extend reagent lifetime and prevent odorous chemicals from entering the laboratory's atmosphere. These reagents must be in addition to 95 sample cup positions in the same run.

8. Only the exact amount of reagent required for the test shall be consumed.

9. The reaction system must provide an electrical heating system to bring the reaction product to a steady state of 39 degrees C.

10. The detection system must be decoupled from the sample/reagent mixing system to maximize throughput and analytical precision.

11. The system shall employ stopped-fill reaction product reading in a temperature- stabilized optical glass flow through cuvette to eliminate flow noise and maximize the signal-to-noise ratio.

12. The system must be equipped with a 10 mm path length, temperature-stabilized, optical quality glass, flow through cuvette to ensure a highly reproducible optical path. Complete flushing between samples prevents carryover and cross-contamination. The system must not require a wiping system to either the flow through cuvette or reaction wells.

13. The high quality photometer must have a measuring and a reference detector and have a resolution of at least 0.0001 AU and a dynamic range up to 2.500 AU. The wavelength range must be at least from 350 - 880 nm.

14. The system shall have the option to perform automatic reagent level sensing prior to analysis based on the number of samples to be analyzed. In the event of insufficient reagent volume being available, the system shall alert the operator to top off the reagent reservoirs as required.

17. The system is able to perform automatic dilution of the over-range samples by a user-selectable dilution factor and re-measure these samples. If the sample is still over-range the dilution is rerun with a squared dilution factor.

18. In case of opening the front cover the system must have a warning system to prevent any harm of the users.

19. The system must be capable to request a pre-dilution in the range of 1:1 to 1:100 per sample. The instrument must be capable, in addition, to automatically dilute any off- scale samples that were pre-diluted by the system. No space on sample carousel should be required for automatic dilutions.

20. The instrument must have the ability to prepare working standards from a stock solution using the automatic dilutor with the user only needing to enter the value of the high standard, number of calibration points and % required for each point into the software one time.

21. The instrument must communicate ONLY via USB connection and require no external serial to USB converter.

22. The instrument must employ a static wash well equipped with constant clean water recirculation to ensure efficient cleaning of probe and dispense system.

23. The system must employ an additional moving probe wash assembly which constantly cleans the probe before each travel action.

24. The system must employ segregated waste lines for separate disposal of hazardous reagent waste and rinse water to further reduce disposal volume and costs.

Chemistry Specifications:

1. The system shall not require individual manifolds to accommodate each chemistry.

2. All chemistries shall be performed using a common pipettor, reaction wells and detection systems.

3. All method operating parameters shall be computer-programmable and not require any manual changeover by the operator.

4. All methods must include manufacturer lab tested data collected using that method and specified instrumentation in use including linearity, accuracy, precision, method detection and reporting limit data across multiple days.

5. All appropriate environmental chemistries must employ USEPA, ISO or other accepted methodologies.

6. Approval documentation from USEPA must be included for each test specified.

Instrument Software Specifications:

1. The software must allow the operator to view and print the calibration curve following the calibration run.

2. The software must allow for one or more calibration standards to be eliminated from the curve and the least squares fit and correlation coefficient automatically recalculated in % error determined for each calibration point.

3. The software must communicate from the computer to the chemistry unit solely through a USB port and shall not require a plug-in card to perform communication, analog-to-digital conversion or digital input-output control.

4. The software must automatically detect off-scale samples and schedule these samples for dilution to bring their concentration within the range of the calibration.

5. The calibration report must include percent residual data and the date and time of analysis for each and all calibration standards.

6. The software must run under WindowsTM 7 or higher.

7. The software must allow the user to specify a minimum correlation coefficient value for the calibration curve which, if not met, will notify the operator.

8. The software must perform closed-loop data quality monitoring and control wherein QC samples and standards (spikes, duplicates, check standards, proficiency standards, etc.) can be specified together with their QC limits. If any QC limit is exceeded, the operator can also specify a corrective action. For example, if a check standard fails, the operator can direct the analyzer to automatically recalibrate and re-run all samples from the last check standard that passed then continue on with the remaining samples with no operator intervention.

9. The software must allow for both short and long-term QC charting to track system performance with respect to accuracy and precision by continually tracking check standard mean and standard deviation. For convenience, the user can then plot QC charts showing limits of 1, 2, and 3 times the defined acceptable standard deviation of that standard.

10. The software must allow for post-run rescheduling and re-run of samples or controls, with or without a user-specified dilution.

11. The software must allow for seamless reporting across batches and templates.

12. The software must have bulk standard and control capabilities.

13. The software must have automatic Spike preparation and calculation.

14. The software must be capable to allow alternative diluents - waters, acids, digests, etc.

15. The software must provide an automatic data output for CSV format.

Service/Support Specifications:

1. The system must have at least a one-year warranty on parts and labor.

2. Vendor must provide installation and commissioning and, at least, three-day training courses either on-site or at the vendor's customer training facility by vendor's own qualified chemist staff.

3. Vendor must supply technical support from own employees and not contracted out labor to ensure minimum downtime.

4. To provide on-going support for method development and validation, vendor must employ a minimum of five qualified chemists in the US for Technical Support. Contractors are not acceptable.

5. Vendor must maintain a dedicated Technical Support email address, which is monitored at least once per hour during normal operating hours, for online help.

6. Vendor must maintain a dedicated Technical Support telephone line, answered by a qualified Technical Support specialist and permanently manned during normal operating hours. Answering machines are not acceptable.

7. Vendor must demonstrate that they maintain a database containing all sales, warranty, parts and technical support calls and emails to ensure prompt and accurate Technical Support.

8. Vendor must have own in house method development laboratory, operated by own chemists, to provide local application training, support for future methodology changes.

(a) The performance required herein shall be subject to the technical direction of the Technical Liaison (TL) as identified below. As used herein, "technical direction" is defined as direction to the contractor that fills in details, suggests possible lines of approach, or otherwise supplements the scope of the work set forth herein and shall not constitute a new assignment, and does not supersede or modify any article or clause of this contract.

(b) The Technical Liaison is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the

Disputes Clause;

(4) Terminate, for any reason, the contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government. Only a warranted Contracting Officer is authorized to obligate funds on this or any other contract action.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

C-5 52.232-40 Providing Accelerated Payments to Small Business Subcontractors. (MAR 2023)

C-6 52.247-34 F.o.b. Destination. (JAN 1991)

(a) The term f.o.b. destination, as used in this clause, means -

(1) Free of expense to the Government, on board the carrier's conveyance, at a specified delivery point where the consignee's facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and

(2) Supplies shall be delivered to the destination consignee's wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or "constructive placement" as defined in carrier tariffs) or the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including "piggyback") is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for "heavy or bulky freight." When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarder for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.

(b) The Contractor shall -

(1)(i) Pack and mark the shipment to comply with contract specifications; or

(ii) In the absence of specifications, prepare the shipment in conformance with carrier requirements;

(2) Prepare and distribute commercial bills of lading;

(3) Deliver the shipment in good order and condition to the point of delivery specified in the contract;

(4) Be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract;

(5) Furnish a delivery schedule and designate the mode of delivering carrier; and

(6) Pay and bear all charges to the specified point of delivery.

C-8 GS1131 Unilateral Deobligation of Unexpended Funds (MAY 2013)

The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.

C-9 DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (February 2021)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice [Contracting Officer to edit and include the documentation required under this contract]:

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. Section E - SOLICITATION PROVISIONS E-1 52.204-7 System for Award Management. (OCT 2018)

(a) Definitions. As used in this provision-

Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that-

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record "Active".

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b)(1) An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in SAM.

(c) If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:

E-3 52.204-26 Covered Telecommunications Equipment or Services-Representation. (OCT 2020)

(c) Representations. (1) The Offeror represents that it [ ] does, [ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

(2) After conducting a reasonable inquiry for purposes of this representation, the offeror represents that it [ ] does, [ ] does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services.

E-4 52.211-6 Brand name or equal. (AUG 1999)

(a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation.

(b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must -

(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;

(2) Clearly identify the item by -

(i) Brand name, if any; and

(ii) Make or model number;

(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and

(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.

(c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.

(d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation.
