Pursuant to FAR subpart 13.106-1(b)(1)(i) and (ii), for purchases not exceeding the Simplified Acquisition Threshold (SAT), Contracting Officers may solicit from only one source if the circumstances deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Text5: The contractor's qualifications derive from being the only entity that can provide water to flood wetlands on this portion of Sutter NWR. SEWD owns the only water rights and canal infrastructure that can deliver water to this portion of Sutter NWR. The multi-million dollar canal system was designed specifically to deliver water to the Refuge and surrounding agricultural lands. Sutter NWR lacks alternative water rights and infrsatructure that would allow it to receive water from another source.
