STATEMENT OF WORK

JANITORIAL SERVICES FOR THE OFFICE OF LAW ENFORCEMENT

GENERAL INSTRUCTIONS

The Contractor shall furnish all labor, tools, equipment, and supervision necessary to perform janitorial services detailed in this Statement of Work for the Office of Law Enforcement, 1412 Airport Way, Fairbanks, Alaska.

The following specifications apply to the building:

Approximately 1700 square foot single story facility with full basement (total warm square footage approximately 2800 square feet), of which 2100 feet is carpet and 700 sure feet is tile.

This includes four (4) hallways, one (1) staircase, seven (7) offices, one (1) reception area, two

(2) restrooms, one (1) supply/computer/storage room, one (1) copy/break room, and one (1) conference room.

HOURS OF OPERATIONS

Services shall be conducted every Friday between 9:00 am and 4:00 pm.

Annual services will be discussed with and agreed upon by the Contracting Officer’s Representative (COR) and the Contractor during the pre-performance meeting.

CONTRACTOR PERSONNEL

The Contractor shall provide a list of employee names, addresses, and Social Security Numbers of all personnel that will be assigned to work on this contract. For any proposed new personnel, the same information must be provided. No persons other than those designated in writing and with an approved background check shall be permitted in this facility. The Contractor is responsible for all costs associated with obtaining background investigations for their employees.

The contractor shall furnish adequate supervision on the premises to ensure that work is performed in a satisfactory manner. It is the responsibility of the Contractor to maintain close surveillance over personnel employed to perform work on this contract.

The Contractor shall have a designated on-site representative authorized to make decisions and act on behalf of the contractor, available to the COR and/or CO to, at all times. The on-site representative must be fluent in English. The on-site representative shall provide a phone number where he/she can be contacted for any issue regarding performance.

CONDUCT OF CONTRACTOR EMPLOYEES

The Contractor shall provide a qualified work force meeting the contract requirements. The contract manager or alternate shall be available on cleaning days before 4:30p.m to discuss problem areas with the COR.

The following conduct is expected of the Contractor and his/her employees:

(a) Employees shall perform their duties in such a way that there will be no interruption to, or interference with, the normal operation of Government business on the premises.

(b) No children shall accompany Contractor employees while performing work.

(c) None of the office equipment is available for cleaning personnel use. This includes telephones, photocopier, fax machine, computers, and other office equipment.

(d) Janitor closet is to be kept clean, neat, organized, and free from any odor (i.e. stale wet mops, un-emptied trash cans). All cleaning compounds shall be environmentally sound.

(e) The Material Safety Data Sheets (MSDS) for all cleaning compounds and products must be kept in the janitor closet and easy to locate. All cleaning material containers must be clearly labeled with their contents. All cleaning products shall be environmentally friendly and safe.

(f) Janitor personnel vehicles are to be parked in the parking lot, away from the front door of the buildings except when loading and unloading equipment and supplies.

(g) All janitorial personnel shall keep a checklist of completed tasks posted for review by the COR. Each checklist should indicate that the task was completed and the date of completion. All tasks shall be completed in compliance with the frequency/cleaning schedule for the area listed.

(h) Two weeks prior to starting work, complete and submit clearance request forms as provided by the COR.

CONTRACTOR FURNISHED EQUIPMENT AND PROPERTY

The Contractor shall determine and furnish all equipment required for the performance of work under this contract. All equipment will comply with applicable OSHA guidelines, and shall be in good operating condition. The Contractor shall operate the equipment in accordance with the original manufacturer's recommendations. Equipment shall include but is not limited to, buffing, polishing, and scrubbing machines for use on floors, vacuum cleaners, ladders, buckets, mops, cloths, brushes, squeegees, brooms, bulk waste receptacles, rolling trash bins, etc. Equipment used shall be in good operating condition. Electrical appliances shall be equipped with grounded type male plugs of the most suitable grade for the purpose intended.

CONTRACTOR FURNISHED SUPPLIES

The Contractor shall furnish all cleaning supplies and materials necessary for the performance of work under this contract. Materials include but are not limited to cleaners, dust rags, tile cleaner, polishes, trash can lines (for offices and bathrooms), bathroom toilet tissue, liquid soap, paper (hand) towels for all bathroom dispensers, and wax. Material shall be priced into the cost of the weekly and semi-annuals services, as applicable.

All materials left on site shall have:

(a) Legible markings on containers that designate what the product is

(b) Legible Material Safety Data Sheet (MSDS) in a folder, in the storage closet(s) where the product is stored.

Executive Order 13101, Greening the Government through Waste Prevention, Recycling and Federal Acquisition requires items designated by the Environmental Protection Agency (EPA) be purchased with the maximum recycled content possible. The Contractor is required to use products with the highest recovered material content whenever they are commercially available at a reasonable price. Items to be furnished under this contract that are on EPA's designated list include, but are not limited to: trashcan liners, paper towels and bathroom toilet tissue. The Contractor shall purchase these products containing the highest content of recovered material possible unless products are not:

(1) Available competitively within a reasonable timeframe, or

(2) Available at a reasonable price.

If one of the two exceptions above applies, the contractor shall furnish the COR with a written justification prior to purchase of the listed items without the minimum recommended recovered material content.

GOVERNMENT FURNISHED MATERIAL AND PROPERTY

The Government will furnish the use of janitor closet for storage, and utilities as needed to perform the work described herein, including electricity and hot/cold water. In addition, space will be assigned to the Contractor by the COR for storage of bulk supplies and the equipment which will be used in the performance of the work. MSDS will be maintained in a folder by contractor as described in section “CONTRACTOR FURNISHED SUPPLIES”. All cleaning supplies that are flammable will be stored in flammable material storage facilities which will be furnished by the Government. The Government will not be responsible for damage and/or loss to the Contractor's stored supplies, materials, equipment, or the personal belongings of the Contractor's employees occasioned by fire, theft, accident, or otherwise. Failure to keep any of the storage facilities described above in a clean and orderly condition, satisfactory to the COR, may result in the withdrawal of the privilege of using them.

DAMAGE TO PROPERTY

The Contractor is liable for damage to both Government and private property in performance of this contract where the damage is the fault of the Contractor or caused by operations, as determined by COR.

INTERFERENCE WITH BUSINESS

The Contractor shall not commit or permit any act that will interfere with the performance of work by any other contractor or by Government employees. The services under this contract shall be performed in such a way that there will be no interruption to or interference with the normal operation of Government business on the premises. Persons employed by the contractor shall, while on the premises, comply with all applicable regulations.

The Contractor shall comply with all laws, ordinances, and regulations and shall obtain and pay for all necessary permits and licenses.

ATTIRE

The Contractor shall provide protective equipment or clothing such as appropriate protective gloves and eyewear as necessary for employees performing tasks under this contract. All janitorial employees will, at all times, be properly and professionally attired.

The proper attire shall be left up to the Contractor, but the COR may request uniform changes if they deem the attire inappropriate.

PRE-PERFORMANCEMEETING

The Contractor shall contact the COR to schedule a meeting upon notification of award of this contract. The purpose of this meeting is to review the duties, provide communication and understanding between both parties, and to issue key(s) to the Contractor.

GENERAL DESCRIPTION OF WORK TO BE PERFORMED

Janitorial services as described below are required for the Office of Law Enforcement, 1412 Airport Way, Fairbanks, Alaska. Areas and surfaces shall receive the cleaning, care, and treatment specified at the frequency designated below. The Contractor shall perform janitorial services in all designated spaces including, but not limited to, offices, bathrooms, work areas, entrance ways, lobbies, storage areas, and stairways. The Contractor shall furnish all managerial, administrative, and direct labor personnel necessary to accomplish the work in this contract. The Contractor is required to complete all duties listed in the “Janitorial Duties” sheet inside the cleaning locker which is located in the ladies room. The Contractor's employees performing the work shall sign and date the form prior to leaving the building.

WEEKLY SERVICES

1. Empty all wastebaskets and replace trash bags or liners that are supplied by the janitorial company & take all trash out to a borough transfer station as USFWS OLE does not have a dumpster at the building.

2. Dust all furniture, desk tops, tables, bookcases, blinds, window sills, heater vents, air conditioners, picture frames, fronts and tops of file cabinets, in other words, all surfaces.

Remove dust or cobwebs from walls and corners, etc.

3. Vacuum all carpeted floor surfaces and linoleum surfaces including stairs. Spot clean any stains that occur.

4. Remove fingerprints, streaks and marks from light switches, doors, handles and other surfaces in the building.

5. Thoroughly clean and sanitize both bathrooms including sinks, toilets, mirrors, the men’s bathroom shower stall, all fixtures and countertops. All surfaces shall be free of grime, soap scum, mold, and smudges.

6. Mop all linoleum floors.

7. Check bathrooms for supplies including paper towels, toilet paper and hand soap that are supplied by the janitorial company and when needed, replenish and store in both bathrooms under the cabinets.

8. Store all cleaning supplies that are provided by the janitorial company in the tall cabinet in the ladies bathroom and replenish as needed. Vacuum cleaner and mops and buckets, etc. are also to be stored in the ladies bathroom.

ANNUAL SERVICES

1. Wash windows on the inside and outside including both glass surfaces in doors. When complete, the inside window surfaces shall be free of smudges, lint, streaks, film, dirt, and water.

2. Machine shampoo all carpeting. Move chairs, boxes, wastebaskets, coat racks, etc., but heavy furniture is not required to be moved and shampooing can be done around them.

QUALITY ASSURANCE STANDARDS

The Contractor shall perform all services in compliance with accepted industry standards (i.e.

Building Owners and Management association (BOMA) and National Association of Professional Cleaners (NAPC)), guidelines, and practices and in accordance with any quality assurance program normally used by the Contractor.

PERFORMANCE STANDARDS

The objective of this contract is to provide clean facilities and a healthy environment for employees. Specifically, the Contractor shall ensure that the building presents an overall appearance of cleanliness. The definition of clean is to remove dirt, water streaks, gum, grease, tar or any other extraneous matter from all surfaces or objects in order to present an overall appearance of cleanliness. The Contractor shall ensure that the facilities are sanitized and kept free from accumulations of dust. Finally, the Contractor shall furnish all necessary labor, supervision, equipment, and supplies to adequately maintain the facilities at an acceptable level of cleanliness that is consistent with comparable industry standards (i.e. BOMA and NAPC).

USFWS R7 Environmentally Preferable and Energy-Efficient Products and Services Policy

Whenever cost effective, the contractor should provide products and/or services that are energy efficient, promote water conservation and are bio-based. The use of nonhazardous and recovered materials is encouraged.

DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP) (APR 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date.

52.204-26 Covered Telecommunications Equipment or Services-Representation. (Oct 2020)

(a) Definitions. As used in this provision, "covered telecommunications equipment or services " and "reasonable inquiry " have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment .

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) ( https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services ".

52.212-3 Offeror Representations and Certifications-Commercial Items. (Nov 2021)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions. As used in this provision—

"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3)of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veteransor, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service connected, as defined in 38 U.S.C. 101(16).

Small business concern—

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

(2) Through another subsidiary of a parent corporation

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
