SYNOPSIS:

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a separate written solicitation will not be issued.

The solicitation is being issued as a Request for Quotation (RFQ). Quotes are requested as described in the attached instructions and a hard-copy written solicitation will not be issued. The solicitation document and incorporated clauses and provisions are those in effect through Federal

Acquisition Circular 2005-100.

In accordance with the Federal Acquisition Regulation (FAR) Subpart 12.6, and in conjunction with FAR Part 13, this combined synopsis/solicitation is posted for the United States Department of the Interior (DOI) Bureau of Safety and Environmental Enforcement (BSEE) Acquisition

Management Division, Acquisition Operations Branch which is the contracting activity for this acquisition, submitted on behalf of the Bureau of Ocean Energy Management (BOEM) in

Sterling, VA. The purpose of this solicitation is to solicit quotes for items in support of an

MulitRAE Benzene Gas detector. The objective of this requirement to purchase a gas detector with benzene specific detection capability for each district to properly equip BSEE Inspectors.

The required delivery date for this requirement is 30 days from date of award.

Offers are due must be received by the Point of Contract (POC) below at the time and place identified in Section 4 of the RFQ. This acquisition is NOT being competed as a small business set-aside. It is available for full and open competition. The applicable NAICS code for this acquisition is “334511 Search Detection, Navigation Guidance Aeronautical and Nautical

System and Instrument Manufacturing” which has a size standard of $32.5 million.

SECTION 1

PRICING

1.1 GENERAL INFORMATION

This acquisition is being conducted in accordance with FAR Subpart 13 – Simplified Acquisition

Procedures. Under this Request for Quote (RFQ), the United States Department of the Interior (DOI), Bureau of Safety and Environmental Enforcement (BSEE), anticipates awarding a Firm Fixed Price

Purchase Order for MultiRAE Benzene Gas Detector as required in Section 1.2 of this RFQ. The North

American Industry Classification System (NAICS) code for this acquisition is 334511 Search Detection, Navigation Guidance Aeronautical and Nautical System and Instrument Manufacturing” which has a size standard of $32.5 million.

SECTION 2

STATEMENT OF WORK/SPECIFICATIONS

2.1 BACKGROUND

The Bureau of Safety Environmental Enforcement (BSEE) District Operations Support GOMR has a requirement to purchase (8) MultiRAE PID Benzene Gas Detector model 6228. Inspectors have also faced other gas detection issues when conduction inspections. A functioning calibrated gas detector is essential to being able to complete investigations that require hot work permits for taking pictures. Gas monitoring is also essential for any confined or partially confined space entry or possibility of H2S.

Currently a gas detector is not part of the basic kit that BSEE inspectors offshore equipment. BSEE want to have at least one of these gas detectors in each inspection district.

2.2 SCOPE

BSEE requires the purchasing of a gas detector with benzene specific detection capability for each district to properly equip BSEE Inspectors, as described in Section 2.3.

2.3 SPECIFICATIONS FOR REQUIRED ITEMS

The MultiRAE Benzene monitor combines the ability to make quick benzene-specific assessment (“snapshot”) measurements with the advantages of a versatile multi-gas monitor that can support up to 20 intelligent interchangeable sensor options. Its optional wireless capability improves safety and productivity by providing real-time access to instrument readings and alarm status from any location, which delivers better situational awareness and faster incident response.

SECTION 3

GENERAL PURCHASE ORDER TERMS AND CONDITIONS

3.1 SCOPE

A Firm Fixed Price (FFP) Purchase Order shall be issued by the Bureau of Safety and Environmental

Enforcement (BSEE), for the required items as stated in Section 1.2 and Section 2 of this RFQ.

3.2 DELIVERY DATE

The delivery date is 30 days from date of award.

3.5 INVOICING REQUIREMENT

An Invoice shall be submitted in accordance with Section 3.6.1 below, one time after Government’s acceptance of all deliverables.

3.5.1 DIAPR 2011-4 ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS –

INVOICE PROCESSING PLATFORM (IPP) (APR 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's

Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the

Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 - 5 business days of the contract award date.

If the Contractor is unable to comply with the requirement to use IPP tor submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

3.6 CONTRACTOR’S QUOTE

The Contractor’s quote may be incorporated by reference into the purchase order. Any inconsistencies or in event of a conflict between terms and conditions of the purchase order and the contractor’s quote shall be resolved by giving precedence to the terms and conditions of the purchase order.

3.7 AVAILABILITY OF CLAUSES:

3.7.1 In accordance with FAR 52.252-2, this solicitation incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. The Contractor shall comply with these clauses unless the circumstances do not apply. Upon request, the Contracting Officer will make their full text available. (d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller

General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

SECTION 4

QUOTATION PREPARATION INSTRUCTIONS

4.1 QUOTATION PREPARATION

Your quote in response to this RFQ shall be submitted to the Contracting Officer, Gerald Garnett, at gerald.garnett@bsee.gov. Please be advised that it is the Offeror’s responsibility to ensure that the

Government receives your submission on or before the specified due date.

4.2 QUOTATION SUBMISSION

The Offeror shall quote a pricing structure in accordance with Section 1.2 of this RFQ. The price quote shall be based on open market pricing, utilizing any and all available discounts. The quote shall provide the pricing necessary to meet the requirements of this RFQ. The quote shall be received by the due date and time established in Section 4.4.

4.3 ASSUMPTIONS, CONDITIONS, OR EXCEPTIONS

The Offeror must submit all (if any) assumptions, conditions, or exceptions with any of the terms and conditions, and/or price/cost of this RFQ. If not noted in your quote, it will be assumed that the Offeror proposes no assumptions for award, and agrees to comply with all of the terms and conditions as set forth herein in this RFQ. It is not the responsibility of the Government to seek out and identify assumptions, conditions, or exceptions buried within the offeror’s quote.

4.4 QUOTE DUE DATE/ METHOD OF DELIVERY

The quote submitted in response to this RFQ shall be electronically submitted to the Contracting

SECTION 5

EVALUATION OF QUOTATIONS

5.1 GENERAL INSTRUCTIONS

A quote shall be prepared and submitted in accordance with the instructions contained in Section 4 of this

RFQ.

5.2 BASIS FOR AWARD/ EVALUATION CRITERIA

The Government will evaluate the quote on the basis of information furnished by the Offeror in accordance with Sections 1 and 2 of this RFQ. The Government is not responsible for locating or obtaining any information that is not identified in the offer.

Award shall be made to the Contractor that provides an acceptable technical solution at the lowest price.

The quote must conform to the requirements of this RFQ. The technical evaluation shall be performed based on the quote meeting or exceeding the requirements set forth.

5.3 PRICE EVALUATION

Offerors are expected to propose a reasonable price in accordance with information provided in Sections

1 and 2 of this RFQ. The Contracting Officer may evaluate the quoted price for fairness and reasonableness by comparison to the other quotes received as well as other price analysis techniques. The

Government reserves the right not to make an award if, in the opinion of the Government, the quote would not provide satisfactory performance at the a price that is considered fair and reasonable and/or economically feasible, or if agreement between the Government and Contractor on the terms and conditions cannot be reached within the timeframe established by the Contracting Officer.

(a) Definitions. As used in this provision--

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).

Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern

Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the

Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor”
