Solicitation No. 140D8021R0005 Questions & Answers (Q&A)
Section Page Paragraph Question
A1 B10.5
The solicitation requirement states that the … “Primary Pilot for each aircraft will need to be either a Level 1 or Level 2 SEAT Pilot as specified in Section B”. The previous BIA Bemidji Fire Boss, current BIA Deer Park Fire Boss, and current BLM Alaska Fire Boss contracts all require the Primary Pilot to be Level 1 and relief pilots to be Level 1 or Level 2.
Why has the Primary Pilot qualification standard for the new BIA Bemidji Fire Boss Exclusive Use contract been reduced from Level 1 to either Level 1 or Level 2?
Answer: Sections A1 and B10.5 has been corrected to read as follows:
A1: “Primary Pilot for each aircraft will need to be a Level 1 SEAT Pilot as specified in Section B.”
B10.5: “The approved primary pilot must be designated "Level I" (journeyman level). Relief pilot may be either "Level I or II". However, a Level II relief pilot is not allowed for more than four (4) days in a 14-day period. Pilot levels are described below and are based on the criteria shown:”
A2
D4 D12
Bottom of Price Table
D4.2 D12
D4.2 requires that offerors … “enter an extended amount for each year as well as an amount for the total for all years”. D12 indicates that … “The totals for daily availability, flight time, extended daily availability, extended flight time, additional pay items, and the possible six (6)-month extension under FAR 52.217-8 will be added together to arrive at the TEP for each offeror”. The price table on Page 8 does not incorporate rows to show pricing for the possible six-month extension or the Total Estimated Price.
Should offerors enter values below the table on Page 8 showing a total price for the possible extension and the TEP?
Answer: No. Offerors should not offer pricing for the possible 6-month extension. FAR clause 52.217-8 states that the Government may require continued performance of any services within the limits and at the rates specified in the contract. While this optional extension could be issued at any time during performance of the contract, it would most likely be issued after the final year of performance. Therefore, the rates and pricing from the final year of performance (Exclusive Use Period 2025), will be added to the offeror’s proposed pricing for the basic five (5)-year ordering period to arrive at the Total
Evaluated Price (TEP), which will be used for evaluation purposes. Neither the solicitation, nor the resultant contract award, will include a pricing table for the six(6)-month optional extension under 52.217-8.
The following verbiage has been added to Section D12 to provide clarification:
“The solicitation notified offerors that the award will include the Government’s unilateral option to extend performance for an additional period of up to six (6) months under FAR 52.217-8, during which time, the pricing and terms of the period in which the option was exercised shall apply. The Government cannot predict if or when the option may be exercised. Because any exercise of the Government’s option extends the pricing and terms of the period in which the option was exercised, the Government expressly and affirmatively evaluates pricing for the option to extend under FAR 52.217-8 co-extensive with the Government’s price evaluation for each exclusive use period of this award.
Because pricing for each period subject to possible extension under FAR 52.217-8 has been evaluated, pricing for any possible future use of that option to extend has, likewise, been evaluated and would apply in strict accordance with this evaluation in the event of the Government’s exercise of the option to extend services.”

Offer Contents
Exhibit E-5 Offer
Contents
D4 indicates that … “The contents [of our proposal] must be tabbed and organized in the order described below:”. This order is different than the one listed in Exhibit E-5 Offer Contents.
Given that this will be an electronic submission, will a file naming convention listing the offer contents in the proper order meet the tabbing requirement?
Which content order is acceptable (D4 or Exhibit E-5)?
Answer: The order outlined in D4 should be followed. A file naming convention listing the offer contents in the order identified within D4 will meet the tabbing requirements. Exhibit E-5 is meant as more of a checklist to help offerors ensure that they submitted all of the required documentation and is not meant to dictate the order in which documents are organized.

E A
D4.6.3 B32.1 and B32.1.1
Exhibit 15 A1
This section requires offerors to provide a current aircraft weight and balance record, an equipment list certified accurate at the time of weighing, and weight and balance revision records indicating any changes to the aircraft and equipment that may have occurred after the time of weighing. It also states that section B32 of this solicitation be referenced. B32.1 states that … “The aircraft’s required weight and balance record must be determined by actual weighing of the aircraft, in contract configuration”. B32.1.1 further states that … “The aircraft must be weighed following any major repair, major alternation or change to the equipment list that significantly affects the center of gravity of the aircraft”. Exhibit 15, Aircraft Questionnaire requires offerors to enter the Aircraft Equipped Weight. Note 1 on Exhibit 15 requires the offeror to acknowledge that the documentation provided supports the minimum aircraft requirements in Sections A and B of the solicitation. Section A specifies that the required aircraft be a single engine amphibious water scooping aircraft equipped as specified in Section B. Section B lists the equipment and avionics that must be installed on the aircraft but does not specify water scooping floats or associated modifications.
Given that the aircraft modifications required for the Fire Boss STC are extensive, increase the aircraft empty weight by more than 1,800 pounds, and significantly change the aircraft’s center of gravity, what aircraft configuration must the aircraft weighing, and certified Equipment List be based on?
1. An AT-802F or AT-802AF with the complete Fire
Boss/Wipaire 10,000 series float STC modification installed (e.g. floats, additional hydraulic pump, larger hopper vents, water scoop control computer, water overflow system, water rudder control system, larger finlets, finlets bracing) or
2. An AT-802F or AT-802AF on wheels with the Fire Boss modifications calculated as “Equipment to be Added to Meet the Aircraft Specifications Requirements” as shown on the Exhibit 15 Aircraft Questionnaire form?
Answer: Each proposed aircraft must have a current weight and balance and certified equipment list showing the aircraft was weighed in amphibious water scooping configuration.
Section A Minimum Aircraft Requirements has been amended to include the following verbiage:
“Must be an amphibious water scooping aircraft”
D4 76 D4.10 This section requires a copy of the offeror’s applicable FAA Operations Specifications showing that the offeror is certificated to operate in Alaska. Our Company’s Operations Specifications are not geographically specific, and our FAA Principal Inspector has advised that specific approval for Alaskan operations is not a requirement for Part 137 Operators.
Could you please explain this requirement in more detail?
Answer: Section D4.10 has been deleted as it only applies to 135 certificate holders. 137 operators can operate in any geographic area.

Additionally, provide copies of records as the evidence of results achieved or activities performed.
D4.11 Flight Hours and Accidents
D4.11.1 The Offeror is required to submit the total number of manned and unmanned flight hours (separately) separating fixed-wing and rotary-wing aircraft regardless of make and model flown by the organization up to/during the past five calendar years (commencing from the solicitation date).
Include any accidents or incidents as determined by the NTSB that met the “substantial damage” criteria as defined within 49 CFR 830.2. If the accident was reported to the NTSB and it was downgraded to an incident, you must provide evidence from the NTSB. Additionally, please include all FAA violations incurred during the same period.
D4.11.2 If the Offeror has had an accident in the last five calendar years, provide an accident prevention action plan or evidence of actions taken to prevent future accidents.
Volume IV, Past Performance
D4.12. Offeror must include a completed copy of the Past Performance Information Sheet (PPIS), Exhibit E-4, to include all requested information. The PPIS shall be used to include information on no more than three (3) of the most relevant contracts performed by the prime offeror for any local, state, and Federal agencies, and commercial customers during the three (3) years prior to the date of issuance of this solicitation. Relevant contracts include performance of efforts that are similar in scope, magnitude, and complexity than the effort described in this solicitation. The offeror has discretion in determining the most beneficial mix and quantity of contracts by prime offeror covering as many of these elements as is practical.
D5 Period for Acceptance of Offers
The offeror agrees to hold the prices in its offer firm for 180 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
D6 Late Submissions, Modifications, Revisions, and Withdrawals of Offers
Late Submissions, Modifications, Revisions and Withdrawals of Offers are subject to the terms of Federal Acquisition Regulation (FAR) clause 52.212-1(f), which is incorporated
SECTION D – INSTRUCTIONS TO OFFERORS
SOLICITATION NO. 140D8021R0005 79
D11.4 The Government will give greater weight to its own experiences with the offeror (specifically DOI), if any, than it will give to reports obtained from others. Offerors with no relevant past or present performance history shall receive a Neutral rating.
D12 Total Evaluated Price (TEP)
D12.1. The Government will apply the rates/unit prices in acceptable offers, including out year unit prices, to the daily availability quantities identified in Section A. For the purpose of evaluating flight time, the estimates in Section A will be applied to the flight rates offered for each year. The totals for daily availability, flight time, extended daily availability, extended flight time, additional pay items, and the possible six (6)-month extension under FAR 52.217-8 will be added together to arrive at the TEP for each offeror. Once the total evaluated prices of all offers have been determined, the Government will then perform a tradeoff analysis, as described below in D13. The total evaluated price is for evaluation purposes only and does not become a contractually binding amount after contract award.
D12.2 The solicitation notified offerors that the award will include the Government’s unilateral option to extend performance for an additional period of up to six (6) months under FAR 52.217-8, during which time, the pricing and terms of the period in which the option was exercised shall apply.
Because pricing for each period subject to possible extension under FAR 52.217-8 has been evaluated, pricing for any possible future use of that option to extend has, likewise, been evaluated and would apply in strict accordance with this evaluation in the event of the Government’s exercise of the option to extend services.
D12.3 The Government reserves the right to reject offers that have materially unbalanced availability and flight rates. An offer is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and there is a reasonable doubt that the offer will result in the lowest overall cost to the Government even though it may be the low evaluated offer, or if it is so unbalanced as to be tantamount to allowing an advance payment.
D13 Tradeoff Analysis and Contractor Selection
D13.1 The Contractor will be selected on the basis of the Government’s evaluation of the proposal against the evaluation factors set forth in the solicitation: Technical
Capability, Organizational Safety, Past Performance, and Total Evaluated Price.
D13.2 If one offer is best on all the factors, then that offer will be selected as being the best value to the Government. If no offer is best on all the factors, then the Government will consider the differences among offers and make tradeoffs in order to determine which offer is the best value. The Government will award the contract to the offer that has the best combination of Technical Capability, Organizational Safety, Past Performance, and Total Evaluated Price.
D14 Inquiries Regarding the Solicitation
