The Department of the Interior (DOI)/Interior Business Center (IBC), Acquisition Services Directorate (AQD) on behalf of the Appraisal & Valuation Services Office (AVSO) is issuing a request for quotation for appraisal report on:

DELIVERY/PERIOD OF PERFORMANCE

The target period of performance 80 calendar days from the date of the Purchase Order (PO) award. If the target delivery date is not achievable, then the contractor may provide justification (workload, vacation, etc.) and propose an alternative delivery date. TECHNICAL QUALIFICATION FOR REQUIREMENT

Factor 1 - State Certification

The applicant must hold a current appraiser license from the State of California as demonstrated by attaching a copy of their State Licensing Certificate to their proposal, or have the ability to obtain a temporary practice permit for California. If the appraiser is licensed in another state and applying for a license in the subject jurisdiction, he/she must provide a copy of his/her current state license.

Factor 2 - Technical Acceptability

a. Experience for Assignment: The applicant must possess the ability to estimate the fair market rent for vacant desert property. Both geographical competency and technical competency will be considered. The contractor shall provide a standard Appraiser's Statement of Qualifications and a signed proposal letter that describes and attests to the following:

i. A brief statement about the experience your firm has in appraising vacant property in Southern California desert locations. The statement should be accompanied by a brief list of those appraisals done for Federal agencies (see Factor 3 below).

ii. The Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA, a.k.a. the “Yellow Book”) was revised in 2016. All bidders should have taken a Yellow Book Update course since then. Please include the date you last took a UASFLA class.

iii. A designation from a recognized professional appraisal organization will be considered but is not required.

b. Qualifications of Associate Appraisers: Any associates expected to contribute to the appraisal must be identified in the proposal and a statement of qualifications and copy of license or permit must be provided for each individual. Those qualifications will be considered in the evaluation of proposals, with emphasis on professional designations and license, years of appraisal experience, and extent of education applicable to the appraisal of residential real estate. Sub-contracting of this assignment is not permissible.

Factor 3 - Past Performance

Include in your cover letter a brief list of vacant desert land appraisals performed under UASFLA for Federal agencies in the last 10 years, including the agency and name of the reviewer.

Factor 4 - Delivery/Inspection Date

The target date for the initial appraisal report is 60 days from the award of the contract. If the target date is not achievable, then the contractor may provide alternative delivery dates up to 120 days and the reason for the later delivery. Early delivery is preferable.

Factor 5 - Price

The bidder must submit an all-inclusive price quote for the appraisal including the post submittal review process.

All of these criteria will be considered and evaluated for selection of the real estate appraiser to be awarded the contract for this assignment.

EVALUATION OF QUOTATIONS

FAR 52.212-2 Evaluation-Commercial Products and Commercial Services (Nov 2021)

a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award of this Purchase Order will be made on a Best Value/Trade Off basis.

• The following factors shall be used to evaluate offers:

A. Technical, B. Past Performance - Delivery/Inspection Date and C. Price.

Technical, and Past Performance - Delivery/Inspection Date when combined, are more important than cost or price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

SECTION 1 - SUBJECT IDENTIFICATION & GENERAL INFORMATION

Project Summary: The National Park Service (NPS) is requesting a multi-parcel appraisal report of 8 vacant desert land parcels owned by the Mojave Desert Land Trust (MDLT). The appraisal will be used to evaluate potential acquisitions by NPS and must conform to the Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA).

Client: U.S. DOI - Appraisal and Valuation Services Office (AVSO).

Intended Users: AVSO and NPS

Intended Use: To assist NPS in its determination of the amount to be paid as just compensation for the property rights to be acquired.

Controversies / Issues: Access over NPS controlled roads may limit development potential. Tract

107-42 was four separate APNs when MDLT acquired it in one transaction from one seller and is now assessed as a single parcel. Whether this tract is one or more larger parcels is to be determined by the appraiser. Should any other controversies or issues be identified by the Appraiser during the course of the assignment, the AVSO Review Appraiser identified in this document must be immediately notified.

Outstanding Rights: None known. If any unrecorded documents, agreements, easements and/or encumbrances are discovered during the appraisal process, verification with the property owner is advised and notification of the AVSO Review Appraiser is required.

SECTION 2 - APPRAISAL REQUIREMENTS & INSTRUCTIONS

Appraisal Standards: The appraisal report must conform to the Uniform Standards of

Professional Appraisal Standards (USPAP); the Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA. - Yellow Book); and the requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (49 CFR 24 as amended). No other supplemental standards are applicable.

Market Value: “The amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of the appraisal, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.” [Interagency Land Acquisition Conference, Uniform Appraisal Standards for Federal Land Acquisitions, 6th ed. (Appraisal Institute, 2016), 10.]

Property Interest: Fee simple subject to encumbrances of record. Tract 102-42 has an appurtenant easement over Quail Springs Spur. There are no proposed reservations.

Date of Value: Synonymous with the date of last property inspection; which must be no later than 30 calendar days prior to the submission of the completed appraisal report, unless the appraiser receives written approval from the AVSO Review Appraiser prior to preparation of the appraisal report.

Extraordinary Assumption(s): The Appraiser may not assume or invoke any Extraordinary Assumptions without documented written approval from the AVSO Review Appraiser

Hypothetical None allowed without documented written approval from the Condition(s): AVSO Review Appraiser.

Jurisdictional Exception: The definition of market value includes a reference to reasonable exposure time. However, UASFLA requires that an opinion of value not be linked to a specific exposure time. As such, this assignment will involve a Jurisdictional Exception to USPAP for the lack of developing and stating an opinion of reasonable exposure time linked to that value opinion as required by USPAP Standards Rule 1-2(c) and Standards Rule 2-2(a)(v).

General Appraisal Requirements & Instructions:

• The contracted Appraiser must hold a valid State Certificate as a Certified General Appraiser for the jurisdiction in which the subject property is located. (Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.)

• The AVSO Statement-of-Work and employment contract must be included within the Addenda to the appraisal report.

• The appraiser is required to offer the property owner and/or the owner’s representative an opportunity to accompany the Appraiser during the property inspection. The appraiser must certify in the report that such an offer was extended.

• The Appraiser must make a personal inspection of the subject property and photograph all of the comparable market properties used in the analysis. It is recognized that many of the properties are remote and not easily accessible. Therefore, it is permitted to inspect and photograph properties from the nearest possible vantage point.

• The appraisal is to be prepared in conformity with UASFLA. Findings of inadequacy, if any, will require clarification and/or correction to the report.

• The appraiser’s conclusion of highest and best use must be an economic use. A non-economic highest and best use, such as conservation, natural lands, preservation or any use that requires the property to be withheld from economic production in perpetuity, is not a valid use upon which to estimate market value.

• Essential in the appraiser’s conclusion of highest and best use is the determination of “Larger Parcel”.

The appraiser must make a larger parcel determination in every appraisal (see Special Appraisal Instructions above).

• The preferred method of adjusting comparable sales is through supported quantitative adjustments (percentage, $/acre, etc.); qualitative adjustments (similar, inferior, or superior) are to be used only when the market variables cannot be quantified. Quantitative adjustments without support are unacceptable.

When the Appraiser must resort to qualitative analyses, support that is more extensive and discussion of the Appraiser’s reasoning why a comparable sale is similar, inferior, or superior to the subject property is required.

• Documentation of the comparable sales and other market data utilized in the appraisal must comply with reporting requirements of UASFLA and the Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970. For instance, the latter requires “A description of the comparable sales, including a description of all relevant physical, legal and economic factors such as parties to the transaction, source and method of financing, and verification by a party involved in the transaction.”

• If sales to governmental entities, including sales to non-profit entities with the intention of transferring the sale property to a governmental entity, are included in the appraisal report, they are subject to

• Photographs and maps of comparable properties shall be included in the appraisal report. Aerial photographs for the comparable properties will be accepted unless the aerial photographs are so dated that they do not accurately represent the property as it physically existed on the date of inspection. Any unusual property features must be photographed from ground level.

• The appraisal report and all information and comments furnished to the Appraiser are DOI internal documents and are to be considered confidential by the Appraiser. All requests for information concerning the appraisal must be referred to the AVSO Review appraiser. The general public is not an intended user of the appraisal report; however the Appraiser must also be aware that the Freedom of Information Act and Agency policy may result in the release of all or part of the appraisal report to others.

• The Appraisal and Valuation Services Office (AVSO) will not normally accept custody of confidential information. Should the Appraiser find it necessary to rely on confidential information, he or she will contact the AVSO Review Appraiser for instructions. The AVSO Review Appraiser will provide further instruction to the Appraiser regarding handling and storage of the confidential information.

SECTION 3 – PERFORMANCE & SUBMISSION REQUIREMENTS

After contract award, the Appraiser must address any questions regarding appraisal instructions and/or technical requirements for the appraisal to the AVSO Review Appraiser. The contract award package will identify the AVSO Review Appraiser and his/her contact information in the Project Contact Information document.

The contractor shall have 60 calendar days from the date of award to deliver the initial appraisal report to the AVSO Review Appraiser. If the contractor determines that a performance period of 60 days is not realistically feasible, it is the contractor’s responsibility to provide an alternative delivery date, with justification for the change, in the bid proposal. NOTE: Preference may be given to the quotes which best meets the stated delivery date.

(a) Definitions. As used in this clause— Covered article, as defined in 41 U.S.C. 4713(k), means—

(1) Information technology, as defined in 40 U.S.C. 11101, including cloud computing services of all types;

(2) Telecommunications equipment or telecommunications service, as those terms are defined in section 3 of the Communications Act of 1934 (47 U.S.C. 153);

(3) The processing of information on a Federal or non-Federal information system, subject to the requirements of the Controlled Unclassified Information program (see 32 CFR part 2002); or

(4) Hardware, systems, devices, software, or services that include embedded or incidental information technology.

FASCSA order means any of the following orders issued under the Federal Acquisition Supply Chain Security Act (FASCSA) requiring the removal of covered articles from executive agency information systems or the exclusion of one or more named sources or named covered articles from executive agency procurement actions, as described in 41 CFR 201–1.303(d) and (e):

(1) The Secretary of Homeland Security may issue FASCSA orders applicable to civilian agencies, to the extent not covered by paragraph (2) or (3) of this definition. This type of FASCSA order may be referred to as a Department of Homeland Security (DHS) FASCSA order.

(8) The intelligence elements of the Army, the Navy, the Air Force, the Marine Corps, the Coast Guard, the Federal Bureau of Investigation, the Drug Enforcement Administration, and the Department of Energy;

(9) The Bureau of Intelligence and Research of the Department of State;

(10) The Office of Intelligence and Analysis of the Department of the Treasury;

(11) The Office of Intelligence and Analysis of the Department of Homeland Security; or

(12) Such other elements of any department or agency as may be designated by the President, or designated jointly by the Director of National Intelligence and the head of the department or agency concerned, as an element of the intelligence community.

National security system, as defined in 44 U.S.C. 3552, means any information system (including any telecommunications system) used or operated by an agency or by a contractor of an agency, or other organization on behalf of an agency—

(1) The function, operation, or use of which involves intelligence activities; involves cryptologic activities related to national security; involves command and control of military forces; involves equipment that is an integral part of a weapon or weapons system; or is critical to the direct fulfillment of military or intelligence missions, but does not include a system that is to be used for routine administrative and business applications (including payroll, finance, logistics, and personnel management applications); or

(2) Is protected at all times by procedures established for information that have been specifically authorized under criteria established by an Executive order or an Act of Congress to be kept classified in the interest of national defense or foreign policy.

Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of any covered articles, or any products or services produced or provided by a source. This applies when the covered article or the source is subject to an applicable FASCSA order. A reasonable inquiry excludes the need to include an internal or third-party audit.

Sensitive compartmented information means classified information concerning or derived from intelligence sources, methods, or analytical processes, which is required to be handled within formal access control systems established by the Director of National Intelligence.

Sensitive compartmented information system means a national security system authorized to process or store sensitive compartmented information.

Source means a non-Federal supplier, or potential supplier, of products or services, at any tier.

(b) Prohibition. (1) Unless an applicable waiver has been issued by the issuing official, Contractors shall not provide or use as part of the performance of the contract any covered article, or any products or services produced or provided by a source, if the covered article or the source is prohibited by an applicable FASCSA orders as follows:

(i) For solicitations and contracts awarded by a Department of Defense contracting office, DoD FASCSA orders apply.

(ii) For all other solicitations and contracts DHS FASCSA orders apply.

(2) The Contractor shall search for the phrase “FASCSA order” in the System for Award Management (SAM) at https://www.sam.gov to locate applicable FASCSA orders identified in paragraph (b)(1).

(3) The Government may identify in the solicitation additional FASCSA orders that are not in SAM, which are effective and apply to the solicitation and resultant contract.

(4) A FASCSA order issued after the date of solicitation applies to this contract only if added by an amendment to the solicitation or modification to the contract (see FAR 4.2304(c)). However, see paragraph (c) of this clause.

(5)(i) If the contractor wishes to ask for a waiver of the requirements of a new FASCSA order being applied through modification, then the Contractor shall disclose the following:

(A) Name of the product or service provided to the Government;

(B) Name of the covered article or source subject to a FASCSA order;

(G) Reason why the applicable covered article or the product or service is being provided or used;

(ii) Executive agency review of disclosures. The contracting officer will review disclosures provided in paragraph (b)(5)(i) to determine if any waiver is warranted. A contracting officer may choose not to pursue a waiver for covered articles or sources otherwise covered by a FASCSA order and to instead pursue other appropriate action.

(c) Notice and reporting requirement. (1) During contract performance, the Contractor shall review SAM.gov at least once every three months, or as advised by the Contracting Officer, to check for covered articles subject to FASCSA order(s), or for products or services produced by a source subject to FASCSA order(s) not currently identified under paragraph (b) of this clause.

(2) If the Contractor identifies a new FASCSA order(s) that could impact their supply chain, then the Contractor shall conduct a reasonable inquiry to identify whether a covered article or product or service produced or provided by a source subject to the FASCSA order(s) was provided to the Government or used during contract performance.

(3)(i) The Contractor shall submit a report to the contracting office as identified in paragraph (c)(3)(ii) of this clause, if the Contractor identifies, including through any notification by a subcontractor at any tier, that a covered article or product or service produced or provided by a source was provided to the Government or used during contract performance and is subject to a FASCSA order(s) identified in paragraph (b) of this clause, or a new FASCSA order identified in paragraph (c)(2) of this clause. For indefinite delivery contracts, the Contractor shall report to both the contracting office for the indefinite delivery contract and the contracting office for any affected order.

(ii) If a report is required to be submitted to a contracting office under (c)(3)(i) of this clause, the Contractor shall submit the report as follows:

(A) If a Department of Defense contracting office, the Contractor shall report to the website at https://dibnet.dod.mil.

(B) For all other contracting offices, the Contractor shall report to the Contracting Officer.

(4) The Contractor shall report the following information for each covered article or each product or service produced or provided by a source, where the covered article or source is subject to a FASCSA order, pursuant to paragraph (c)(3)(i) of this clause:

(i) Within 3 business days from the date of such identification or notification:

(A) Contract number;
