Question 2

C13 Extension of Exclusive Use Period

The Government reserves the right to unilaterally exercise the optional line item to extend the exclusive use period and obligate additional funding via modification of the contract or task order. The revised end date for performance will be established in the modification; however, extensions are subject to the day-to-day decision making of the Government, and the Government may release the Contractor at any time during an extension. Release of the Contractor under an extension period is solely at the discretion of the Government, not the Contractor. The contract terms, conditions, specifications, and prices will apply to such extension.

In the past this was a bilaterally agreed to decision by the government and the vendor.¿ Can we have the word bilateral returned to the solicitation and contract?

Answer: C13 Extension of Exclusive use period has been changed to:

Upon mutual agreement of both parties, the

Contracting officer shall issue a bilateral modification(s) to a task order to extend the exclusive use period and obligate additional funding, if needed. The revised end date for performance will be established in the modification; however, extensions are subject to the day-to-day decision making of the Government, and the Government may release the Contractor at any time during an extension. Release of the

Contractor under an extension period is solely at the discretion of the Government, not the

Contractor. The contract terms, conditions, specifications, and prices will apply to such extension. In accordance with the Federal Travel

Regulations {FTRs), the Government will pay subsistence daily for each authorized crew member while operating at the Designated Base, or an alternate base.
