This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This requirement is for the Department of Interior (DOI), Bureau of Indian Affairs (BIA) to acquire software.

RFQ Number: The RFQ number is 140A1620Q0054. This solicitation document incorporates provisions and clauses associated with commercial item procurement.

SET-ASIDE: The procurement will be made in accordance with the Buy Indian Act, 25.u.s.c 47 and therefore, 100% set-side for Indian Small Business Economic Enterprise (ISBEE). Only quotes received from ISBEEs will be considered for award. Vendors who do not qualify under the ISBEE set-aside will be immediately removed from the competitive range.

DELIVERY: Delivery shall be FOB destination. The period of performance shall begin on the date the government accepts the equipment. The equipment shall be delivered and inspected prior to acceptance.

PURCHASE ORDER TYPE: firm-fixed-price (FFP) purchase order.

QUESTIONS: If you have questions regarding this requirement, please submit your inquiries immediately via email to Colette.Lagrave@bia.gov no later than 5:00 PM Eastern Time, 15 July 2020.

All communications regarding this requirement shall be between the Offeror and BIA only. Please be advised that the Government reserves the right to transmit those questions and answers of a common interest to all prospective vendors through email.

QUOTE DUE DATE: The due date for responses to this RFQ shall be sent via email to Colette.lagrave@bia.gov, no later than 4:00 PM Eastern Time, 16 July 2020. Quotes must be submitted through email. Any other method of submission will NOT be considered. Please allow time for any delays that may impact submitting your quote. Any submissions received after the date and time specified herein will NOT be considered for award.

INSTRUCTIONS FOR QUOTE PREPARATION AND EVALUATION: BIA is issuing this Request for Quote (RFQ) to solicit ISBEE vendors for the purpose of entering into a Purchase Order. The quote http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/12.htm#P311_50761

Document Title Proofpoint Software & Support Page 5 of 26 submitted shall be in accordance with the terms and conditions of the RFQ. The quote shall be broken down as described below and the Offeror shall submit the price quote separately from the technical quote.

The following information must be submitted in order to be considered for award:

Volume I Technical Quote

1. Detailed description of brand name and specifications

2. The quote shall also contain the following:

a. Tax identification number (TIN)

b. Dun & Bradstreet Number (DUNS)

c. Complete business mailing address

d. Contact name, phone number, email address, and fax number

e. This RFQ number

f. Offeror’s Quote number

g. Expiration date of the Quote

h. Proposed delivery date

Volume II Price

1. Price: Provide a Firm-Fixed-Price quote

2. Provide pricing information for each line item listed on pages one (1) through four (4) of this

RFQ with any and all discounts taken into consideration

Price quotes shall be all inclusive. The failure to submit any of the information requested in this RFQ may lead to the rejection of your quote without further consideration.

This is a RFQ only and in no way obligates the Government to award a Delivery Order or to reimburse Offeror(s) for any costs incurred in preparing their quote.

AWARD: The Government anticipates awarding one Firm-Fixed Price single award Purchase Order for all items. Partial awards will not be made.

Vendors shall address all requirements in this RFQ and shall provide clear evidence of understanding and the ability and willingness to comply with the Government’s specifications. Failure to address a specification/requirement will be construed by the Government as inability to meet the need, or the Vendor’s taking exception to it. Any assumptions not meeting the Government’s requirement will be considered as taking exception to the Government’s requirement and will be evaluated accordingly.

The Government intends award a Purchase Order without discussion with Offerors. Therefore, the Offeror’s initial quote should contain the best terms from a price and technical standpoint.

The Government reserves the right to contact Offeror(s) regarding their quote including price discounts or the Government may make award without contacting the Offeror.

The Government reserves the right to not make an award, if necessary.

PURCHASE ORDER ADMINISTRATION: The following sections will become a part of the resulting Purchase Order:

a) Deliverables: All equipment shall be delivered by the vendors on or before the due date and shall be delivered to the Contracting Officer’s Representative (COR) mentioned in the award. When questions

Document Title Proofpoint Software & Support Page 6 of 26 concerning the requirement arise, the Offeror shall follow the direction of the COR who will coordinate with the Government Contracting Officer (CO).

b) Section 508: All Software shall be compliant with the requirements referenced in these documents including Section 508 of the Rehabilitation Act of 1973 and 29 USC 794d, sub-part B, Technical Standards, 1194.21.

(a) If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. (b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must—

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
