All services shall be performed onsite at Aneth Community School, East Hwy 162, San Juan County Rd. 466 Montezuma Creek, UT 84534.

SECTION C – DESCRIPTIONS AND SPECIFICATIONS
STATEMENT OF WORK
Project Title: Counseling Services Location: Aneth Community School, Montezuma Creek, UT
Background:
The Bureau of Indian Education, Aneth Community School (ASC) is mandated by the Individual with Disabilities Act (IDEA) to provide a free and appropriate education to all disabled Indian children within its jurisdiction. ACS is located in Aneth, Utah on the Navajo Indian Reservation.
The school has approximately 130 students enrolled and is a Bureau of Indian Education (BIE) funded and operated school. ACS is seeking psychological evaluation service for the school Special Education Program.
Objective:
The objective is to provide all necessary and/or professionally qualified psychological evaluation services, necessary supplies, materials, and equipment and testing materials to perform the work as described in this Statement of Work.
Required Qualification and Experience:
The scope of work shall be provided by a Certified Psychologist who must be licensed in the State of Utah.
The contractor must have security clearance from the Bureau of Indian Affairs.
Scope of Work:
The contractor will be required to perform psycho-educational evaluations and classroom observations for all referrals during the course of the contract period and evaluations will occur at ACS.
The contractor will be expected to be present during initial, tri-annual, and review of existing data IEP team meetings for evaluation results on students evaluated by the contractor to be held within the time frame mandated by law.

In addition to the all required evaluation results IEP team meetings referred to in section b; the contractor will meet with, advise and make recommendations to parents and teachers in matters regarding the assessment, evaluation, and creation of programs resulting in an increase of learning outcomes for individual students referred.
The contractor will be expected to provide training and support to teachers on various diagnostic areas such as interpretation of test results and meanings of scores (standard scores, grade-equivalent scores, means, and standard deviations), implementing recommendations, and proper placement to best fit student needs in the least restrictive environment, and following all other matters in regards to the IDEA LAW.
After being provided a complete referral packet indicating the RTI process has been implemented followed by recommendation for assessment made by the Child Study Team and informed consent has been signed, or parental request (another method of informed consent) for evaluation has been made in writing the contractor shall:
A. Complete a comprehensive review and summarize the following records provided by the local education agency for each child referred for assessment.
1. All data (contained with the students confidential file) collected for the contractor will include:
A. Referral form B. Vision and hearing screening C. Review of past educational history D. Teacher narratives/progress reports E. Medical case history F. Letter of notification G. Language proficiency measured H. Documentation of interpretations and parent contracts I. 2 Myklebust observations J. Learning characteristic observations
B. Complete evaluation and assessment according to laws regarding minority, non-discriminatory practices.
1. IDEA requires that procedures developed for the purpose of evaluation and placement of disabled children will not be racially or culturally discriminatory. Such materials or procedures shall be provided and administered in the child’s language or mode of communication unless it is not clearly feasible to do so and no single instrument or test shall be the sole criterion for determining the appropriate education program for a child.
2. The examiner under contract shall consider the following adaptations:
a. Local Community norms, if available, shall be considered when not referenced tests are used.
b. Criterion-referenced instruments can be used to determine levels of academic achievement.

c. The examiner should inquire about the local cultural practices, language variables and distinctive social patterns.
d. Interpretation in the native language should be available when necessary.
C. The contractor will complete student evaluations based on guidelines, standards and criteria identified by the State of Utah.
D. The contractor (certified psychologist) must be available to perform the services specified herein during Monday through Friday within the hours of 8:00am-3:00 p.m. (7 hours) on-site; no travel time will be included in 7 hours. Evaluations may not be done on weekends (Saturday/Sundays), federal holidays, or tribal cultural days. These considerations are to be applied to the completion of all referrals.
E. The contractor (certified psychologist) will provide reports within two weeks of the examination date. The reports (findings) are to be hand-delivered or mailed with original protocols to ACS. All reports should be clearly labeled and marked “Confidential”. A written summary of the findings and tentative recommendations on paper will be left with the school special education coordinator or designee, for filing into the student’s confidential folder. In addition, the contractor will enter into the NASIS system the evaluation summary for discussion during the evaluation results meeting to determine eligibility status.
F. Said staff members will be expected to comply with requests for the completion of the necessary referral data or whatever other scale or devices are requested by the contractor in the interest of providing that information necessary for the completion of the most appropriate evaluation in terms of the laws regarding minority non-discriminatory practices as outlined in this contract proposal. The contractor will be paid for psycho-educational report – not on the basis of services leading to their completion or upon receipt of completed evaluation reports – but within guidelines contained in this proposal.
G. The contractor is required to log in and log out of ACS main office and to schedule herself/himself for student IEP team committee meeting at the school’s request.
H. The contractor will be expected to provide own supply and material needed to perform requested service.
I. The contractor will be expected to meet with parents and teachers of the students evaluated (as noted in section I part c) and review any questions regarding parental rights, test results, and support the recommendations made during the evaluation results IEP team meeting. In addition, the contractor will meet with the team of evaluators on a mutually agreed upon date as needed, to plan schedules, keep current on school events, and discuss issues involving evaluations to support general communication needs within the school environment.
J. At least one training for staff members will be provided by the contractor on the referral process, explanation of the importance of a complete interpretation of test scores, implementation of recommendations in the classrooms and proper placement of students for services.
K. The contractor should have experience of at least one year in psycho-educational diagnosis, one year of actual classroom teaching in a special education setting, credit hours in individual intellectual assessment for those children referred for special education and/or gifted/talented. Documentation of experience should be provided.

L. The contractor will be able to adapt to the demands of a computer “NASIS” system to fulfill required documents for referred students file. It is the sole responsibility of the contractor to keep current on all required trainings to secure the usage of the NASIS system in a timely manner.
EVALUATION REPORT OF PROGRAM EVALUATION
All reports should contain all necessary information required to remain in compliance with any and all pertinent regulations mandated by Federal or State Laws including .L., 105-17 (IDEA) and as amend by Education Standards for the State of Utah regarding special education program standards.
CONFIDENTIALITY
All materials furnished or produced by the contractor under this agreement, including, but not limited, to documents, reports, and correspondence will remain CONFIDENTIAL. The contractor shall not release information to any persons, group of persons, firm or organization other than the Bureau of Indian Education, Aneth Community School with information related to work performed, and research or information derived from work performed under this agreement. Breach of confidentiality shall be denied substantial breach of this agreement and may be grounds for rescission.
CONTRACT PERFORMANCE
The contractor shall submit copies of resumes and state license/certifications to the BIE/Aneth Community School and to the BIA Procurement/Contracting Officer.
Delivery:
The work will be performed Monday through Friday during hours within the school business hours: Monday thru Friday from 8:00 am to 3:00 pm.
Period of Performance:
The base year period of performance will be from September 3, 2019 to July 31, 2020 with four option years that may be exercised by the Government subject to successful past performance, ongoing need and availability of funding.
Government Furnished Equipment:
The contractor will be expected to provide own supplies and materials needed to perform the requested service.
Security Requirements:
Contractor will report to the office and sign in on days schedule and sign-out when exiting the building.
C.1 TYPE OF CONTRACT
This is a firm-fixed price, single award contract, with the option years. Services shall be in accordance with the Statement of Work. The North American Classification Industry System

(NAICS) for this requirement is 611710, Education Support Services, and the small business size standard is $15M. No additional sums will be payable on account of any escalation in the cost of materials, equipment or labor, or because of the Contractor’s failure to properly estimate or accurately predict these prices or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted on account of fluctuations in the currency exchange rates.
C.2 BACKGROUND INVESTIGATION
In accordance with 25 U.S.C. 3201 (P.L. 101-630), Indian Child Protection and Family Violence Prevention Act; 42 U.S.C. 13041, Crime Control Act of 1990; 441 Departmental Manual, Personnel Security and Suitability Requirements all positions with duties and responsibilities involving regular contact with or control over Indian children are subject to a background investigation and determination of suitability for employment. Accordingly, all such positions require a favorable screening (applicant and suitability) determination made by the Bureau of Indian Affairs (BIA) Office of Indian Education Programs (OIEP), Personnel Security and Suitability Program; and a favorable background investigation determination conducted by the Office of Personnel Management (OPM).
A favorable screening (applicant and suitability) determination must be made by the Bureau of Indian Affairs (BIA) Office of the Indian Education Programs (OIEP), Personnel Security and Suitability Program prior to contract award or made within 60 days of incorporation of this clause into a current/existing contract. Pending completion of a background investigation by OPM, the Contractor who has been granted a favorable screening (applicant and suitability) determination must be within the sight and under the supervision ofa Government employee who has had a completed background investigation (42 U.S.C 13041 (3)) during contract performance until a final background investigation determination has been made.
Prior employment with the Federal Government, including BIA, OIEP or the Bureau of Indian Affairs, does not assure that the appropriate screening or investigation was conducted nor does it alleviate or guarantee a favorable screening (applicant and suitability) determination or background investigation. Prior to an award or during the 60 day period discussed in paragraph two, it is solely the company, individual or contractor's responsibility to contact the BIA, OIEP Personnel Security and Suitability Program at 505-563-5287/5288/5289/5294 in order to obtain a complete security package, which includes but is not limited to appropriate investigative forms and/or inquire about their previous investigation; and, obtain a screening (applicant and suitability) determination, and subsequent final background investigation.
If an unfavorable screening (applicant and suitability) determination is made, a purchase order shall not be awarded to the individual who received an unfavorable screening or to the company who has proposed to employ the individual to perform the work. The individual and or the company who proposed to employ this individual may be determined to be non-responsible if an unfavorable screening (applicant and suitability) determinations is made, which will make them ineligible for purchase order award.
If an unfavorable final background investigation determination is made, the purchase order may be terminated and the employee in question shall not be authorized to provide service to the BIA, OIEP, if the services involve contact with or regular control over Indian children.
C.3 FEDERAL TRAVEL REGULATIONS
*NOTE: This clause is applicable to pre-approved travel outside the scope of services in the SOW. Travel costs to/from the school for services as stated in the SOW are included in the

Firm Fixed Price as stated in Section B.3.
Travel cost incurred for transportation, lodging, meals, and incidental expenses (as defined in the regulation cited in FAR 31.205-46) shall be considered to be reasonable and allowable only to the extent that they do not exceed on a daily basis the maximum per diem rates in effect at the time of travel as set forth in the Federal Travel Regulation.
The consultant will be reimbursed for travel to provide support at a Government site or other site as may be specified and approved bythe COTR under this effort. All travel shall be approved, by the COTR, prior to commencement of travel. Consultant shall provide supporting documentation and a detailed breakdown of incurred travel costs with each invoice.
C.4 NON-PERSONAL SERVICES
This contract is a non-personal services contract, under which the contractor is an independent contractor. The Government may evaluate the quality of professional services provided. The Contractor is required to indemnify the Government for any liability producing act or omission by the Contractor, its employees and agents occurring during contract performance. The Contractor shall maintain medical liability insurance, which is not less than the amount normally prevailing within the local community for the specialty concerned.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice
- A copy of the contractor’s invoice shall be included with the IPP invoice. If no invoice is attached, the Invoice will be rejected.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
