1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Product”
Contracting Activity: This document is a justification for other than full and open competition for the Department of the Interior (DOI), Bureau of Indian Affairs (BIA), Office of the Chief Financial Officer, Central Acquisition Office. The product is Bender King (“BK”) Radio equipment

3. A description of the supplies or services required to meet the agency’s needs.
BIA needs Bender King (“BK”) Radio equipment to bolster its operations. BK is utilized by all BIA Forestry and 638 Tribal Fire Departments to provide public safety communications interoperability with other BIA Forestry Departments, Tribal Fire Departments. The following are the components and specifications of the BK radio equipment needed:

4. An Identification of the statutory authority permitting other than full and open competition.
This is an acquisition conducted under the authority of the Simplified Acquisition Procedures, FAR13. The statutory authority permitting the purchase of an item peculiar to one manufacturer is FAR 11.105.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
Bender King (“BK”) Radio equipment is utilized by all BIA Forestry and 638 Tribal Fire Departments to provide public safety communications interoperability with other BIA Forestry Departments, Tribal Fire Departments. BK Radio equipment also allows for Forestry Fire Fighters to gain interoperability communications when they are detailed to other locations, providing fire support to other Government Fire Agency’s outside of BIA.
This equipment is compatible with existing training procedures and equipment that is in service in all BIA Forestry Fire equipment and requires specific wires and cables. Utilizing this equipment greatly enhances fire fighter and public safety and preservation of life and limb. Issuance of a different brand would require retraining fire fighters to use new equipment creating an fire fighter/community safety risk Current parts and accessories are brand specific for mobile radios no other parts could be used and another procurement would need to be done with a JOFOC to justify the accessories.
Technicians would need to be retrained and new software and programming equipment would need to be procured.
Fire Fighter/public safety cannot be calculated as a dollar figure, a fire fighter during a wildland fire or life safety stressful encounter will be forced to forget the use of the portable previously issued and rely upon memory of training for new equipment.
In addition, the NIFC Codan repeaters are the only equipment capable of providing the models required at the level of quality required because of the radios ordered are unique or highly specialized. There are no other known radios that will meet these critical needs. The radios will be part of a system containing solar repeater sites. As such, this requires the procurement of radio equipment that has low-current power demands during standby, startup, and active modes.
Low current requirements reduce the scale and size of power systems, minimizing the overall carbon footprint while maximizing backup power

Codan/Daniels products are the only known products that meet the low current requirements, not only with extremely low standby current, but also for the lowest current draw in an active state (transmitting) relative to other manufacturers’ direct current (DC) powered offerings. These systems are used for law enforcement, fire suppression, and safety of life and property. Thus, maximum power efficiency and the
4 | P a g e corresponding availability of these systems is critical to employee and public safety. All of the radio system components will be compliant with the APCO Project 25 (P25) TIA-102 standard and are technical categories with Codan/Daniels.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The requirement will be posted for solicitation as a set aside to Indian Small Business Economic Enterprises (ISBEE)
7. A determination by the contracting officer that the anticipated cost to the
Government will be fair and reasonable.
I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The contracting officer determines that the anticipated price(s) will be fair and reasonable based on adequate price competition expected to result from the solicitation.
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
Based upon market research conducted, there are adequate sources capable of meeting the requirement needs.
9. Any other facts supporting the use of justification of other than full and open competition, such as:

The LMR Division does not have any plans to change the current infrastructure;
although, market research is a continual process where new technologies, products, and manufacturers are sought to satisfy future LMR infrastructure needs.
