1. SPECIAL NOTICE TO QUOTERS

The Government intends to evaluate quotations and award a contract without discussions.

Therefore, the Quoter’s initial quotation should contain the Quoter’s best terms from a technical and price standpoint. The Government reserves the right to conduct discussions if the Contracting Officer (CO) later determines them to be necessary. This action is to be executed in accordance with FAR Part 13.5, Simplified Procedures for Certain Commercial Items.

1.1 Each quotation shall clearly demonstrate that the Quoter understands both the general and specific technical requirements of the Performance Work Statement (PWS).

1.1.1 Failure to explain Quoter’s ability to meet all requirements may result in the Quoter's quotation not being considered. Clarity and completeness of quotations are of the utmost importance. Therefore, quotations must be written in a practical, clear, and concise manner.

1.1.2 Quotations that merely restate the requirement or state that the requirement will be met without providing supporting rationale are not sufficient.

1.2 This requirement is being awarded utilizing the procedures established in FAR Part 13.5.

FAR Part 15 procedures do not govern the evaluation of quotations under this solicitation. A Quoter may be eliminated from consideration without further exchanges if its quotation is not among those Quoters considered most advantageous to the Government based on the solicitation criteria.

1.3 Quoters may be asked to clarify certain aspects of their quotation to resolve minor or clerical errors and will not constitute discussions.

1.4 Failure to submit any of the information requested by this solicitation may result in an unfavorable quotation evaluation.

1.5 Upon receipt, all quotations become Government property. In accordance with FAR Subpart

4.8 (Government Contract Files), the Government will retain the original of all unsuccessful quotations.

1.6 Request for Quotation (RFQ) pricing for contract line items number (CLINs) 0001 – 4002.

Any quotation providing less than the specified acceptance period may not be considered acceptable and may not be considered for award.

1.7 The site visit date for this project is May 21, 2024, at 11:00 AM MST. Quoters are strongly encouraged to attend to fully inform themselves about the location and conditions under which the work is to be performed. 7. Factor D – Past Performance

7.1 The past performance evaluation will assess the relative risks associated with a quoter’s likelihood of success in fulfilling the solicitation’s requirements as indicated by the quoter’s record of past performance. In this context, “quoter” refers to the prime contractor. Present and past performance shall be evaluated as a measure of the Government’s confidence in the quoter’s ability to successfully perform based on previous and current contract efforts.

7.2 The quoter shall submit a completed Past Performance Questionnaire (PPQ) for three (3) references for past performance of recent work performed within the last five (5) years and shall be relevant to the complexity, size, and scope of this solicitation’s requirement.

ADDENEDUM TO 52.212-2 EVALUATION – COMMERCIAL ITEMS

I GENERAL

1. The Government anticipates awarding a firm-fixed-price task order to the quoter whose quotation is found to be the best value and most advantageous to the Government, price and other factors considered.

2. The Government intends to evaluate the quotations and issue a contract based on the initial quotations received. Therefore, the initial quotation should contain the best terms from a technical and price standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. This statement is not to be construed to mean that the Government is obligated to conduct discussions or exchanges.

3. Failure to provide a reasonable and complete quotation may reflect a lack of understanding of the requirements and may result in a determination that the quotation is unsatisfactory.

4. Quotations which merely restate the requirement or state that the requirement will be met, without providing supporting rationale, are not sufficient.

5. The Quoter shall submit a firm-fixed-price quotation according to the Addendum to 52.212-1 Instructions to Quoters. The factors identified below shall be used to evaluate the quotation.

6. This acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures.

Principles and procedures of FAR Part 15 do not apply. A quoter may be eliminated from consideration without further exchanges if its quotation is not among those considered most advantageous to the Government based the requirements of this solicitation.

7. The resulting contract from this solicitation will be awarded to the responsible Quoter whose quotation conforms to the solicitation and is determined to be the best value to the Government considering Price (Factor A, price), Technical Capability (Factor B, non-price), Technical Experience (Factor C, non-price) and Past Performance (Factor D, non-price). Non- Price evaluation factors Technical Capability(B), Technical Experience(C) and Past Performance

(D) are equal in importance. When combined, the non-price factors are greater in importance to price.

8. By submission of its quotation, the quoter is required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in a quotation being ineligible for award. Quoters must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

II FACTOR A – PRICE:

1. Price submittals will be subjectively evaluated to determine the reasonableness of the quotations for overall price and individual CLIN pricing. The Government will not conduct price realism analysis as part of its price evaluation. The Government will evaluate the quotation using price analysis techniques to determine fairness and reasonableness in relation to the PWS requirements. One or more of the following techniques will be used to ensure a fair and reasonable price:

1.1 Comparison of quoted competitive prices received in response to the Solicitation.

1.2 Comparison of quoted prices with the IGE.

1.3 Comparison of quoted prices with available historical information.

1.4 A total contract price or individual CLIN price that is found to be either unreasonably high or low in relation to the proposed work may be indicative of an inherent lack of understanding of the solicitation requirements and may result in the overall quotation being considered unsatisfactory.

2. Any inconsistency, whether real or apparent, between quoted performance and price/cost must be clearly explained in the price quotation. For example, if unique and innovative approaches

PAGE 15 OF 85 1333ND24QNB190236

are the basis for an apparently unbalanced/inconsistently priced quotation, the nature of these approaches and their impact on price must be completely documented.

3. The Government reserves the right to ask for any additional price related information to determine a price to be fair and reasonable.

III NON-PRICE / EVALUATION

1. The Government shall evaluate the non-price / technical portion of the quotation. Any aspect evaluated as “Unsatisfactory” may render the entire quotation unacceptable and unawardable.

Only those quotations determined, either initially or as a result of discussions, as satisfactory or better will be considered for award. However, quoters are reminded that the Government reserves the right to award this effort based on the initial quotation, as received, without discussions.

2. The quotations shall be evaluated against the following non-price factors:

2.1 FACTOR (B) – TECHNICAL CAPABILITY

2.1.1 Evaluation of this factor is a subjective evaluation of the Offeror’s understanding of the contract requirements (clauses, provisions, and the PWS) and demonstrated ability to meet contract requirements and Performance Work Statement (PWS) tasks based on its proposed technical details.

2.1.2 Technical details that do not adequately address how the Quoter proposes to meet the requirements may not be deemed as the best value to the Government. A technical approach, which is primarily a copy-and-paste version of the PWS requirements and performance standards, will not be considered for award.

2.1.3 Technical approach shall demonstrate experience with managing similar projects of similar complexity and magnitude or larger and shall include:

2.1.3.1 Use of proper equipment for the work, shall include methods for accessing elevated light heads.

2.1.3.2 Use of LED’s as part of the replacements when needed per the scope of work.

2.1.3.3 Subcontractor qualifications (if applicable)

2.1.3.4 Executable schedule designed to meet the performance period of the contract containing the following at a minimum:

2.1.3.4.1 Sequence of events pertinent to this site’s work with definable features of work.

2.1.3.4.2 Ability to accomplish all work scope by contract requirements.

2.1.3.4.3 Shall demonstrate that the contractor can perform monthly audits to meet the statement of requirements.

2.2 FACTOR (C) – TECHNICAL EXPERIENCE

2.2.1 The information submitted for this factor will be subjectively evaluated to determine technical acceptability. The standard for technical acceptability is met when the Contractor demonstrates the technical experience of the intended personnel to perform the work requirement.

2.2.1.1 Quote shall, at a minimum, demonstrate that the contractor has experience in electrical work and knowledge of lighting standards to be used on this contract. Quotes shall include example resume(s) for employee(s) who would perform on this contract and has performed electrical work of this scope in the past.

2.3 FACTOR (D) – PAST PERFORMANCE

2.2.1 Evaluation of this factor shall be accomplished by the Government, including but not limited to the resources identified in FAR Part 13. The past performance evaluation

PAGE 16 OF 85 1333ND24QNB190236

will assess the relative risks associated with an offeror's likelihood of success in fulfilling the solicitation's requirements as indicated by the offeror's record of past performance. In this context, "offeror" refers to the prime contractor. Present and past performance shall be evaluated as a measure of the Government's confidence in the offeror's ability to successfully perform based on previous and current contract efforts.

2.2.2 Past performance will be determined to be relevant if it demonstrates performance on a contract involving work that is similar in nature, size, and complexity to the requirements being procured under this solicitation. Past performance will be determined recent if the relevant work was performed within the past three years.

2.2.3 If an offeror has no record of recent or relevant past performance, the offeror will not be evaluated favorably or unfavorably. During comparative evaluation, offerors who can demonstrate recent and relevant past performance will be evaluated more favorably.

2.2.4 Offerors are reminded that the Government will review any or all of a combination of past performance information submitted by the offeror as required per the solicitation and past performance data available in the Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov/ and in the Federal Awardee Performance and Integrity Information System (FAPIIS) at https://www.fapiis.gov/. The Government reserves the right to obtain past performance information from any available source besides those specified and may contact customers other than those identified by the offeror when evaluating past performance. Offerors are reminded that the burden of proving low-performance risk rests upon the offeror.

2.2.5 The offeror shall provide three (3) references which shall be for recent work performed and shall be relevant to the complexity, size, and scope of this solicitation’s requirements (if previous work of this nature has been performed).

2.2.6 For references, offerors shall list:

i. Name/address of organization contract was with

ii. Contract or project number/title

iii. Period of performance of contract

iv. Brief description of contract/project scope and dollar value (total contract value inclusive of any options)

v. Point of contact information for reference (name/title/phone number/e-mail address)
