THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A SEPARATE WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. THE SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES FOR CERTAIN COMMERCIAL ITEMS UNDER THE AUTHORITY OF FAR 13

This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-05, dated March 30, 2020.

1352.215-72 INQUIRIES (APR 2010)

Offerors must submit all questions concerning this solicitation in writing to both the Contract Specialist (joni.laster@nist.gov) and the Contracting Officer (Forest.Crumpler@nist.gov). Questions should be received no later than five calendar days after the issuance date of this solicitation. All responses to the questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, on the question responses included in the amendment to the solicitation will govern performance of the contract. (end of provision)

The associated North American Industrial Classification System (NAICS) code for this procurement is 333314 with a small business size standard of 500 employees.

This acquisition is being solicited for full and open competition. All interested parties shall be considered.

BACKGROUND:

The Microsystems and Nanotechnology Division (MND) within the National Institute of Standards and Technology’s (NIST) Physical Measurement Lab (PML) develops integrated microsystems by advancing the state of the art in nanofabrication, thereby enabling the transfer of NIST measurement technologies to the industrial, academic, and government communities. The Nanophotonics Lab in the Plasmonics and Photonics Group performs swept-wavelength linear and nonlinear optical spectroscopy measurements of chip-integrated photonic elements such as micro resonators and has new requirements for experiments in the visible and near-infrared wavelength bands. A continuous-wave Ti Sapphire laser with an output frequency mixing module/stage that provides automated swept-wavelength tunability over a wide spectral range is required to further advance projects vital to the research goals of the laboratory.

The MND requires a continuous-wave Ti:Sapphire laser with an output frequency mixing module/stage that provides automated wavelength tunability in the 700 nm to 1000 nm range and the 515 nm to 660 nm range. This overall tuning range of the laser system is needed to enable a wide range of experiments. The laser must have the ability to be reliably set to any specified wavelength within the overall tuning range of the system, with an accuracy and precision determine via feedback to an existing wavemeter system in our laboratory. The core optical measurement to be performed is swept-wavelength spectroscopy of high quality factor micro resonators in which the laser frequency must be tuned in a gap-free fashion across several tens of nanometers with adequate spectral resolution to resolve 10 MHz wide spectral features and within an appropriate amount of time for performing multiple iterative measurement cycles. Flexibility in the scanning parameters (scan range and step size) is critical to enable measurements of a variety of different devices. Because the laser will also be used in nonlinear optical measurements, its output power is also an important parameter. Outside of this core measurement, the laser will also be used for fluorescence excitation measurements on single quantum emitters and nonlinear frequency mixing experiments.

All items must be new. Prototypes, first articles, demonstration models, used, refurbished or otherwise developmental systems, will not be considered for award.

MINIMUM REQUIREMENTS:

1. General specification: system shall be a continuous wave Ti:sapphire laser whose optical output can either be directly accessed or sent into a frequency mixing module whose optical output can be accessed

2. Pump laser: system shall include a low-noise 532 nm, DPSS pump laser source providing 18 W or more of output power at a single frequency within a linewidth of less than 1 MHz over a 100 microsecond measurement time.

3. Wavelength coverage of the Ti:sapphire laser: The wavelength tuning range of the direct Ti:sapphire laser output must include the 700 nm to 1000 nm range without gaps and without changing the optics set.

4. Wavelength coverage of the frequency mixing module: The wavelength tuning range of the output of the frequency mixing module must include 515 nm to 660 nm (without gaps) and must be reached with at most two nonlinear crystals and without changing the crystal temperature. The frequency mixing module must also come with the external 1950 nm laser source needed to achieve this range of wavelengths.

5. Output power of the Ti:sapphire laser: A minimum output power of 1.4 W shall be achieved over the Ti:sapphire laser full wavelength tuning range specified in #3.

6. Output power of the frequency mixing module: A minimum output power of 150 mW must be achieved in the 515 nm to 600 nm range and 90 mW much be achieved in the 600 nm to 660 nm range.

7. Pump laser characteristics: The 532 nm pump laser must be a single frequency laser with a linewidth < 1 MHz and power stability of +/-0.5 % or better after the laser has been warmed up

8. Laser amplitude noise: The overall Ti:sapphire laser output and frequency mixing output must both have amplitude noise that is <0.1 % RMS above the pump laser noise

9. Laser linewidth: The absolute free-running Ti:sapphire laser linewidth must be <200 kHz over a 100 microsecond integration time. The linewidth of the frequency mixing module output must be <500 kHz over a 100 microsecond integration time.

10. Fully automated wavelength tuning: The system shall allow for wavelength tuning that is set up and monitored via a control computer.

11. Wavemeter interface: The system must be able to optically interface and electronically read out the measured wavelength from the end user’s existing wavemeter, a High Finesse WSU6-200 unit.

12. Fully automated wavelength scanning capability: The system shall allow automatic, continuous wavelength scans over different wavelength spans within the aforementioned wavelength operation range for both the Ti:sapphire laser output and frequency mixing module output. The laser scans must have the ability to be internally or externally triggered, and must be conditioned based on feedback from the user-supplied wavemeter to determine scan limits and stitching. The following scan options shall be provided to enable tuning over different wavelength spans, with stronger consideration given for: (1) faster sweep times for a scan range of 10 nm, and (2) an increased range of step sizes available for the scans.

a. Fine resolution standard scan: Mode-hop-free tuning over a 25 GHz or wider scan range with a scan speed as high as 20 GHz/s or higher and a step size within the range of 5 MHz to 10 MHz. Scanning at a slower speed of 200 MHz/s shall also be possible, with a step size in the range of 50 kHz to 100 kHz.

b. Fine resolution extended scan: Total scan range shall be 10 nm or greater with a step size resolution that is adjustable from 100 kHz (or smaller) to anywhere in the 5 MHz to 10 MHz range. Scanning shall be mode-hop-free, but can be broken up into sections of 20 GHz or wider. Periods of dead-time in between sections are acceptable, but the total scan time for a 10 nm range shall be less than 20 minutes (main Ti:sapphire range) and 60 minutes (frequency mixing module output) for an appropriately chosen step size that is no larger than 10 MHz. Scan status shall be indicated in software and hardware

c. Medium resolution extended scan: Total scan range from 1 nm to 100 nm or greater with a step size of up to 40 MHz. For a 10 nm scan range, in the main Ti:sapphire range the scan time must be less than 10 minutes at a step size no more than 40 MHz, while in the frequency mixing module output the scan time must be less than 30 minutes for a step size no more than 40 MHz. Scan status shall be indicated in software and hardware.

13. Laser construction: Laser head shall be hermetically sealed

14. Beam shape: Output beam shall be TEM00 with a M^2 value that is less than 1.2 (both for the Ti:sapphire output and the frequency mixing module output)

15. Computer control: The system shall allow for remote control from a computer through a USB or TCP/IP interface.

16. Footprint: Total footprint of the system on an optical table must be 70 cm x 140 cm or smaller. The laser will be used together with other optical setup and measurement systems on a single optical table, and therefore geometries that save space are preferable.

17. Cooling: Any chillers needed for water cooling the system shall be provided.

18. Software: All software for computer control, such as Labview, MATLAB, and Python drivers or standalone programs, shall be included.

WARRANTY:

Shall be warranted for a period of at least one year. Warranty shall commence upon final Government acceptance.

DELIVERY:

FOB Destination (or equivalent terms, such as INCOTERMS Delivered Duties Paid) are required. Delivery shall be completed within 24 WEEKS from receipt of an order. The Contractor shall deliver all equipment to NIST, Building 301, Shipping and Receiving, Gaithersburg, MD 20899.

FOB Destination means: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery. All shipping costs shall be included in the total firm-fixed price.

INSTALLATION:

Vendor shall assist with installation of the laser system (either in person or through detailed remote instructions)

INSPECTION AND ACCEPTANCE:

In addition to the inspection and acceptance terms articulated in 52.212-4, the Government reserves the right to perform performance tests and evaluations to verify specified system performance. Such tests and evaluations, if performed, shall be conducted within the environment that the system is to be operated. The Contractor has the right to be present during the tests and evaluations of the technical specifications, at the Contractor’s expense.

Inspection and acceptance shall occur within thirty (30) days after delivery and installation of the complete system at NIST.

Inspection will be performed on-site, by the Technical Point of Contact (TPOC) with measurements of microcavity resonators and comparison against existing data performed over targeted spectral bands using existing lasers.

FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

INSTRUCTIONS:

System for Award Management (SAM) Registration

In accordance with FAR 52.204-7, An Offeror is required to be registered in SAM when submitting an offer or quotation and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

DUE DATE FOR QUOTATIONS

Offerors shall submit their electronic quotations, via email, so that NIST receives them not later than 12pm Eastern Time on May 20, 2020. E-mail quotations shall be submitted directly to the Contract Specialist at joni.laster@nist.gov and the Contracting Officer at forest.crumpler@nist.gov.

Please reference the RFQ number in the subject line of email communications. Offerors quotations shall not be deemed received by the Government until the quotation is entered in the e-mail inbox set forth above.

Addendum to FAR 52.212-1, Quotation Preparation Instructions:

Technical Quotation (Vol. I), Price Quotation (Vol. II), Past Performance (Vol. III), and Terms and Conditions (Vol. IV)

Incomplete quotations may be considered non-responsive and removed from further consideration. Quotations shall be clearly and concisely written as well as being neat, indexed (cross-indexed as appropriate) and logically assembled. All pages of each part shall be appropriately numbered and identified with the name of the offeror, the date, and the solicitation number.

Volume I - Technical Quotation:

The offeror shall submit an electronic technical quotation, via email. The technical quotation shall address the following:

Minimum Requirements:

The offeror must submit a technical description or product literature for the product it is proposing, which clearly identifies the manufacturer, and clearly demonstrates its proposed product meets or exceeds each of the minimum requirements, by providing a citation to the relevant section of its technical description or product literature and if applicable, evidence that the Offeror is authorized by the original product manufacturer to provide the item(s) in the quotation shall be included.

Volume II - Price Quotation:

The offeror shall submit an electronic copy of the completed price quotation. The price quotation shall be separate from any other portion of the quotation. The offerors firm fixed price must include FOB Destination shipping. *See delivery requirements above for definition of FOB Destination. Price quotations shall remain valid for a period of 90 days from the date quotations are due. Contractor shall state express warranty coverage (if applicable).

Volume III – Past Performance:

The offeror shall provide past performance information regarding relevant contracts over the past three years with Federal, state, or local governments, or commercial customers.

A list of references, preferably at least 3, if available, to whom the same or similar equipment and or service has been provided. The list of references shall include, at a minimum:

1.The name of the reference contact person and the company or organization;
2.The telephone number and email address of the reference contact person;
3.The contract or grant number, the amount of the contract and the address and the telephone number of theContracting Officer if applicable; the date of delivery or the date services were completed, and a description ofthe equipment sold to each reference.

If the offeror has no relevant past performance, it may include a statement to that effect in its quotation. The government reserves the right to consider data obtained from sources other than those described by the offeror.

Volume IV – Terms and Conditions

Acceptance of Terms and Conditions (Addendum to FAR 52.212-1(b) (11)):

If the contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:” [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor’s acceptance of the Government’s terms and conditions for inclusion into the resultant purchase order.

Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant purchase order, not the terms and conditions of the Offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation. CAR 1352.213-70 , Evaluation Utilizing Simplified Acquisition Procedures (APR 2010)

Evaluation Factors:

The Government will issue an order resulting from this request for quotation to the responsible offeror whose quotation results in the best value to the Government, considering both price and non-price factors.

The Government will evaluate quotations based on the following evaluation criteria:

1) Technical Capability

2) Past Performance

3) Price

Technical capability and past performance, when combined, shall be more important than price. If Technical Capability and Past Performance are equivalent, price shall be the determining factor.

(1) Technical Capability:

No prototypes, demonstration models, used or refurbished instruments will be considered. Evaluation of technical capability shall be based on the information provided in the quotation. NIST will evaluate whether the offeror has demonstrated that its proposed equipment meets or exceeds all minimum requirements. Quotations that do not demonstrate the proposed equipment meets all minimum requirements will not be considered further for award. If an offeror does not indicate whether its proposed equipment meets a certain specification, NIST will determine that it does not.

All offerors must be able to meet the minimum technical requirements as posted to be considered for an award. Higher technical consideration shall be given to systems that are able to exceed the minimum requirements listed under specification 12.

Note: Past performance shall not be evaluated for offerors who are deemed technically unacceptable. Offerors that do not meet the minimum requirements, shall not be considered further for an award.

(2) Past Performance:

The Government will evaluate the Offerors past performance information and, if appropriate, its proposed subcontractors' past performance to determine its relevance to the current requirement and the extent to which it demonstrates that the offeror has successfully completed relevant contracts in the past five years. In assessing the offerors past performance information, NIST will evaluate, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, cost management, communications between contracting parties, proactive management and customer satisfaction. Evaluation of this factor will be based on information contained in the technical portion of the quotation and information provided by references. The Government will evaluate past performance information by contacting appropriate references, including NIST references, if applicable. The Government may also consider other available information in evaluating the offerors past performance. The Government will assign a neutral rating if the offeror has no relevant past performance information.

(3) Price: Price shall be evaluated for reasonableness

FAR 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Dec 2019)

The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services-Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision—

“Covered telecommunications equipment or services”, “critical technology”, and “substantial or essential component” have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that it □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

FAR 52.209-11 Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (Feb 2016)

(1) In accordance with Sections 744 and 745 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), none of the funds made available by the Consolidated and Further Continuing Appropriations Act, 2015 funding may be used to enter into a contract with any corporation that-

(a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where an awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and has made a determination that this further action is not necessary to protect the interests of the Government, or

(b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

1352.239-70 Software License Addendum (APR 2010)

(a) This Addendum incorporates certain terms and conditions relating to Federal procurement actions. The terms and conditions of this Addendum take precedence over the terms and conditions contained in any license agreement or other contract documents entered into between the parties.

(b) Governing Law: Federal procurement law and regulations, including the Contract Disputes Act, 41 U.S.C. Section 601 et. seq. , and the Federal Acquisition Regulation (FAR), govern the agreement between the parties. Litigation arising out of this contract may be filed only in those fora that have jurisdiction over Federal procurement matters.

(c) Attorney's Fees: Attorney's fees are payable by the Federal government in any action arising under this contract only pursuant to the Equal Access in Justice Act, 5 U.S.C. Section 504.

(d) No Indemnification: The Federal government will not be liable for any claim for indemnification; such payments may violate the Anti-Deficiency Act, 31 U.S.C. Section 1341(a).

(e) Assignment: Payments may only be assigned in accordance with the Assignment of Claims Act, 31 U.S.C. Section 3727, and FAR Subpart 32.8, “Assignment of Claims.”

(f) Invoices: Invoices will be handled in accordance with the Prompt Payment Act (31 U.S.C. Section 3903) and Office of Management and Budget (OMB) Circular A–125, Prompt Payment.

(g) Patent and Copyright Infringement: Patent or copyright infringement suits brought against the United States as a party may only be defended by the U.S.
