THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A SEPARATE WRITTEN SOLICITATION DOCUMENT WILL NOT BE ISSUED. THE SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES FOR CERTAIN COMMERCIAL ITEMS UNDER THE AUTHORITY OF FAR 13
This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-07, dated July 2, 2020.
1352.215-72 INQUIRIES (APR 2010)
Offerors must submit all questions concerning this solicitation in writing to both the Contract Specialist (joni.laster@nist.gov) and the Contracting Officer (Donald.Collie@nist.gov). Questions should be received no later than five calendar days after the issuance date of this solicitation. All responses to the questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, on the question responses included in the amendment to the solicitation will govern performance of the contract. (end of provision)
The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 with a small business size standard of 1000 employees.
This acquisition is set aside 100% for small business only. Only quotations from small business concerns shall be considered.
The National Institute of Technology (NIST), Center for Neutron Research (NCNR), requires a 3D Laser Scanner to add to their suite of 3D metrology tools. This equipment shall allow for quick and accurate data acquisition of areas of the facility that are hard to get to and/or not often accessible.
This is a brand name or equal requirement. The part number identified in this request for quotation is for the brand name Surphaser. Quotations for other than the specified brand name must meet the salient characteristics of the brand name equipment.
All items must be new. Used or remanufactured equipment will not be considered for award. Experimental, prototype, or custom items will not be considered. The use of “gray market” components not authorized for sale in the U.S. by the Contractor is not acceptable. All line items shall be shipped in the original manufacturer’s packaging and include all original documentation and software, when applicable.

Equivalent equipment shall meet the salient characteristics of the Surphaser model number identified above and the salient characteristics listed below:
1. Shall have phase-shift distance measuring technology.
2. Shall have a continuous wave, class 1 laser, with a wavelength of 1550 nm
3. The beam width at the aperture shall be 3 mm or lower.
4. Shall have a capability of acquiring 75 or more points per degree in the horizontal plane.
5. Shall have a capability of acquiring 75 or more points per degree in the vertical plane.
6. Shall have 360 degrees field of view in the horizontal plane.
7. Shall have 270 degrees or more field of view in the vertical plane.
8. Shall have a minimum working range of 0.4 m or lower.
9. Shall have a maximum working range of 50 m or higher.
10. One standard deviation value of range error when measuring a planar target at 15 m from the laser scanner shall not exceed 0.7 mm.
11. Range noise when measuring a planar target that has a Lambertian surface shall be calculated from raw data of the target surface, without any additional filtering or smoothing. The following two specifications shall also be met:
a. One standard deviation value of range noise on a 90% reflective surface shall not exceed 0.06 mm when the target is between 0.4 m and 30 m from the laser scanner.
b. One standard deviation value of range noise on a 10% reflective surface shall not exceed 0.15 mm when the target is between 0.4 m and 30 m from the laser scanner.
12. One standard deviation value of angular error shall not exceed 25 arc seconds.
13. Two-face scanning capability shall meet both criteria a and b (below) for obtaining point cloud data:
a. Capture data in 360° in the horizontal place in one laser scanner; AND
b. Capture data in 180° in each face of the laser scanner simultaneously.
14. The laser scanner shall be capable of measuring up to 800,000 or more points per second. The scan rate of the laser scanner shall be user configurable up to this maximum rate.
15. The laser scanner shall have a tilt sensor.
16. The laser scanner shall have at least one internal camera capable of capturing color images of 5 mega pixels or higher and can output a picture of the scan region.
17. Weight of the laser scanner, including any batteries or accessories required, shall not exceed 10 kg.
18. The laser scanner shall be capable of operating via an AC power supply and an internal battery.
19. The laser scanner shall have the ability to communicate with a computer running Windows 10 x64 using a USB cable (version 2.0 or higher) and via a Wi-Fi connection.
Accessories:
1. Hard case for storage and shipping.
2. Ten (10) SMR-compatible targets with a carrying case.
3. Instrument tripod with rolling dolly and geared tilting head.
Software:
1. The contractor shall provide laser scanner software to control the laser scanner. The laser scanner control software should meet the criteria below. Multiple software programs to achieve the criteria will be acceptable.
a. The software shall provide control of the laser scanner as required for capturing scans and choosing scan settings.
b. The software shall be capable of exporting data to a non-propriety data file format.
c. The software shall be capable of automatically recognizing targets and reporting their centers.
2. Contractor shall provide one floating network license of 3D Systems Geomagic Design X with one year of software support and maintenance.
3. Contractor shall provide one floating network license of PolyWorks Inspector Standard and Modeler Standard by InnovMetric Software with one year of software support and maintenance.
Training
| 1. | Contractor shall provide onsite training on instrument setup, data acquisition, data processing and analysis, and | best practices for up to 6 trainees. |

Note: Training shall be completed not later than (NLT) 120 days from date of an award and shall be scheduled in advance with the designated Technical Point of Contact (TPOC).
Delivery Delivery shall be FOB Destination (or equivalent terms, such as INCOTERMS Delivered Duties Paid) are required and shall occur not later than (NLT) 60 days from date of an award. All shipping costs shall be included in the total firm-fixed price.
The Contractor shall notify the Technical Point of Contact (TPOC), Contract Specialist and the Contracting Officer, within five business days of shipping the equipment. The Contractor shall provide the tracking number of the shipment, method of shipping and estimated date for arrival. Due to the current Covid 19 pandemic, shipments must be scheduled and NIST’s availability to accept, must be confirmed in advance.
FOB Destination means: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery. The contractor shall deliver all Line Items to:
The National Institute of Standards and Technology 100 Bureau Drive, Building 301, Shipping and Receiving Gaithersburg, MD 20899-8441 Inspection and Acceptance In addition to the inspection and acceptance terms articulated in 52.212-4, the Government reserves the right to perform such performance tests and evaluations as defined below to verify specified system performance. Such tests and evaluations, if performed, shall be conducted within the environment that the system is to be operated. The Contractor has the right to be present during the tests and evaluations, if performed, at the Contractor’s expense.
A visual inspection of the equipment will be performed by the NIST TPOC to identify surface defects or any form of indication that the system was damaged during transport to NIST. The Government shall have sole discretion to require repair or replacement of damaged and/or nonconforming supplies at no cost to the Government. The Government at any time prior to acceptance shall reject the system due to defects and/or nonconformance. The vendor is responsible for latent defects discovered any time after final inspection.
The Government anticipates acceptance/rejection of the system within ten (10) working days from receipt of the equipment, by the NIST TPOC.
Warranty The contractor shall warrant the entire system for a period of a minimum of 2 years after receipt of the equipment and shall be in accordance with terms in FAR 52.212-4. Warranty shall commence upon final acceptance of the equipment by the Government.
Payment Schedule The Contractor shall be paid, in accordance with Net 30-day payment terms, upon receipt and acceptance of a proper invoice, in accordance with the following schedule:
100% after receipt and acceptance by the TPOC of full system which adheres to the minimum requirements as stated above and completion of acceptance testing as set forth by the Government. Acceptance shall take place upon completion of inspection.
NOTE: Partial shipments and partial invoices will not be accepted, unless otherwise requested and accepted by the Contracting Officer prior to award offer. Proposed payment schedules shall be submitted with vendor’s response to the RFQ for consideration.
FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS
INSTRUCTIONS:
System for Award Management (SAM) Registration
In accordance with FAR 52.204-7, An Offeror is required to be registered in SAM when submitting an offer or quotation and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
DUE DATE FOR QUOTATIONS
Offerors shall submit their electronic quotations, via email, so that NIST receives them not later than 12pm Eastern Time on July 31, 2020. E-mail quotations shall be submitted directly to the Contract Specialist at joni.laster@nist.gov and the Contracting Officer at donald.collie@nist.gov.
Please reference the RFQ number in the subject line of email communications. Offerors quotations shall not be deemed received by the Government until the quotation is entered in the e-mail inbox set forth above.
Addendum to FAR 52.212-1, Quotation Preparation Instructions:
Technical Quotation (Vol. I), Price Quotation (Vol. II), and (Vol. III) Terms and Terms and Conditions
Incomplete quotations may be considered non-responsive and removed from further consideration. Quotations shall be clearly and concisely written as well as being neat, indexed (cross-indexed as appropriate) and logically assembled. All pages of each part shall be appropriately numbered and identified with the name of the offeror, the date, and the solicitation number.
Volume I - Technical Quotation:
The technical quotation shall not include pricing and address the following:
Minimum Requirements:
The offeror must submit a technical description or product literature for the product it is proposing, which clearly identifies the manufacturer, and clearly demonstrates its proposed product meets or exceeds each of the salient characteristics, by providing a citation to the relevant section of its technical description or product literature and if applicable, evidence that the Offeror is authorized by the original product manufacturer to provide the item(s) in the quotation shall be included.
Volume II - Price Quotation:
The price quotation shall be separate from any other portion of the quotation.
The offerors firm fixed price must include FOB Destination shipping. *See delivery requirements above for definition of FOB Destination. Price quotations shall remain valid for a period of 90 days from the date quotations are due. Contractor shall state express warranty coverage (if applicable).
Volume III – Terms and Conditions
Provisions
Quoters shall provide a completed copy of all provisions listed below:
FAR 52.209-11 Representation By Corporations Regarding An Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Feb 2016) FAR 52.204-20 Predecessor Of Offeror (Jul 2016) FAR 52.225-6 – Trade Agreements Certificate (May 2014)
Acceptance of Terms and Conditions (Addendum to FAR 52.212-1(b) (11)):
If the contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:” [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor’s acceptance of the Government’s terms and conditions for inclusion into the resultant purchase order.
Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant purchase order, not the terms and conditions of the Offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation. CAR 1352.213-70, Evaluation Utilizing Simplified Acquisition Procedures (APR 2010)
Evaluation Factors:
The Government will issue an order resulting from this request for quotation to the lowest priced, technically acceptable offeror.
The Government will evaluate quotations based on the following evaluation criteria:
1) Technical Capability
2) Price
(1) Technical Capability:
No prototypes, demonstration models, used or refurbished instruments will be considered. Evaluation of technical capability shall be based on the information provided in the quotation. NIST will evaluate whether the offeror has demonstrated that its proposed equipment meets or exceeds all minimum requirements. Quotations that do not demonstrate the proposed equipment meets all minimum requirements will not be considered further for award. If an offeror does not indicate whether its proposed equipment meets a certain specification, NIST will determine that it does not.
All offerors must be able to meet the minimum technical requirements as posted to be considered for an award.
(2) Price: Price shall be evaluated for reasonableness

(a) Definitions. As used in this provision-- Commercial and Government Entity (CAGE) code means--
(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity; or (2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. FAR 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Dec 2019)
The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services-Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision—
“Covered telecommunications equipment or services”, “critical technology”, and “substantial or essential component” have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that it □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

FAR 52.209-11 Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (Feb 2016)
(1) In accordance with Sections 744 and 745 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), none of the funds made available by the Consolidated and Further Continuing Appropriations Act, 2015 funding may be used to enter into a contract with any corporation that-
(a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where an awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and has made a determination that this further action is not necessary to protect the interests of the Government, or
(b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government.
(2) The Offeror represents that, as of the date of this offer-

(a) If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.
(b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must-
(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2) Clearly identify the item by-
(i) Brand name, if any; and
(ii) Make or model number;
(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.
(c) The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.
(d) Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation.

(c) The Government will evaluate offers in accordance with the policies and procedures of Part 25 of the Federal Acquisition Regulation. For line items covered by the WTO GPA, the Government will evaluate offers of U.S.-made or designated country end products without regard to the restrictions of the Buy American statute. The Government will consider for award only offers of U.S.-made or designated country end products unless the Contracting Officer determines that there are no offers for such products or that the offers for those products are insufficient to fulfill the requirements of this solicitation.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Providing Accelerated Payments to Small Business Subcontractors (DEVIATION APR 2020)
(a) (1) In accordance with 30 U.S.C. 3903 and 10 U.S.C. 2037, upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, in accordance with the accelerated payment date established, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, with a goal of 15 days after receipt of a proper invoice and all other required documentation from the small business subcontractor if a specific payment date is not established by contract .
