SON: PANOLIN Oil

1. Purpose and Scope

Restock the ship’s supply of PANOLIN lubricating oil for ships hydrographic winces.

Request delivery by April 29, 2021.

2. Requirements

Provide delivery of five (8) 55-gallon drums for a total of 440 gallons of:

- PANOLIN HLP Synth-46:

o Fully Synthetic Ester o Biodegradable o Non-Toxic o 100% Saturated ester oil complying with VDMA 24568 and ISO

15380 HEES

o Viscosity: ISO 46 o Refer to attached Executive Summary for performance characteristics

3. Minimum Standard

Products must meet above specifications.

4. Market Research

PANOLIN HLP Synth-46 is the only available product because existing supply is also PANOLIN HLP Synth-46. Oils of different characteristics and manufacturers are not compatible.

Panolin America, Inc. is the only provider for biodegradable Panolin oil for the US Government on the US East Coast. Ship currently has approximately $80,000 worth of Panolin hydraulic oil onboard throughout all hydraulic systems. Biodegradable hydraulic oil is the marine responsible oil required by OMAO Policy. When the policy requiring biodegradable hydraulic oil was first introduced, the ship purchased Panolin HLP Synth- 46 in bulk. All equipment on the ship is using Panolin HLP Synth-46. Oils of different brand types should not be mixed in order to avoid performance issues and chemical degradation between oil types. Mixing oil other than Panolin into the existing supply of Panolin could cause significant and irreparable damage to expensive and mission critical hydraulic systems used aboard ship, causing loss of project time and efficiency while replacement of damaged equipment occurred.

5. Delivery

Requested delivery by April 29, 2021. For delivery issues, contact vessel at XO.Henry.Bigelow@noaa.gov.

Henry B., Bigelow Lubrication Oil Procurement Request

1. Agency and contracting activity. Department of Commerce, NOAA Office of Marine and Aviation Operations, Acquisition, Analysis, and Accountability Branch.

2. Description of supplies or services required to meet agency needs (including the estimated value).

440 gallons of PANOLIN HLP Synth-46 in 55 gallon drums.

3. Identification of the single source or the brand name to be solicited.

PANOLIN HLP Synth-46 lubricating Oil.

Supporting rationale. Only one source or brand name is reasonably available as detailed below:

□ Brand Name – This particular brand name is essential to the requirement and market research indicates similar products do not meet or cannot be modified to meet agency needs.

Henry B. Bigelow currently has on board $80,000 of PANOLIN HLP Synth-46 lubricating oil for the ship’s main & mission hydraulic pumps. Lubricating oil from differing manufacturers have different operating properties and chemical additives that may not be compatible and should not be mixed according to manufacturer specifications.

Mixing oils of different brands could have catastrophic effects on sensitive parts which could result in hundreds of thousands of dollars in repair work.

4. Market Research.

(a) Definitions. As used in this clause-- "Internal confidentiality agreement or statement" means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.

"Subcontract" means any contract as defined in subpart 2.1 entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract. It includes but is not limited to purchase orders, and changes and modifications to purchase orders.

"Subcontractor" means any supplier, distributor, vendor, or firm (including a consultant) that furnishes supplies or services to or for a prime contractor or another subcontractor.

(b) The Contractor shall not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

(c) The Contractor shall notify current employees and subcontractors that prohibitions and restrictions of any preexisting internal confidentiality agreements or statements covered by this clause, to the extent that such prohibitions and restrictions are inconsistent with the prohibitions of this clause, are no longer in effect.

(e) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015, (Pub. L. 113-235), and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions) use of funds appropriated (or otherwise made available) is prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.

PAGE 9 OF 25 1333MK21QNMAN0018
