JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD

2. Description of the Action Being Approved.

This Justification and Approval (J&A) is for the sole source procurement of four (4) MTS Flex Test 40 Controller Assemblies with associated components and accessories to include onsite installation, calibration and commissioning. MTS Systems Corporation is the sole vendor capable of providing these products to NAWCAD, Pax River and will be procured through a Non-Government Services Administration (Non GSA) Commercial Firm Fixed Price Contract with MTS Systems Corporation. MTS Systems Corporation is located at 235 Route 73 North, Suite G, West Berlin, NJ 08091.

The contract supports the Naval Air Systems Command (NAVAIR) Air 5.2 Air Vehicle Modification and Instrumentation (AVMI) department 5.2.9.2 AVMI Structures Laboratory, which provides aircraft instrumentation data acquisition system design, development, installation and flight test support for various aircraft and aircraft component assets under the Naval Air Systems Command.

3. Description of Supplies/Services.

The MTS Flex Test 40 Controller Assemblies will be used to replace out of date and obsolete MTS Test Star IIs controllers. The Flex Test 40 Controllers will be used to operate existing individual MTS static and fatigue load frames located in the 5.2.9.2 AVMI Structures Laboratory. These frames are used for the calibration and testing of various aircraft load bearing and fatigue susceptible aircraft components and structures, therefore the controllers must be identical in form/fit/function to the existing units being replaced and meet new IA network requirements that have been mandated by Department of the Navy. MTS will be tasked to deliver, calibrate, install and commission the Flex Test 40 Controllers with the existing MTS static and fatigue load frames equipment in the 5.2.9.2 AVMI Structures Laboratory located at the Naval Air Warfare Center, Patuxent River, MD. The actual part numbers, descriptions, and quantities of the procured items are identified in Table 1 below.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

The four (4) Flex Test 40 Controllers and associated hardware and components will be used to replace four (4) out of date and obsolete MTS Test Star IIs controllers and associated components that do not meet new IA network requirements that have been mandated by Department of the Navy. The controllers will be used to operate the four (4) individual MTS static and fatigue load frames currently located in the 5.2.9.2 AVMI Structures Laboratory. These frames are used for load and fatigue calibrations utilized in Test and Evaluation (T&E) of aircraft components, therefore the controllers must be identical in form/fit/function to the existing units being replaced and meet new IA network requirements that have been mandated by Department of the Navy. No other controllers researched meet the interface and IA requirements for the current static and fatigue load frames being utilized. Replacement of current static and fatigue load frames would result in additional cost and program delays for procurement and renovation of the 5.2.9.2 AVMI Structures Laboratory to accommodate new load frames. These controllers are only available from MTS Systems Corporation. The controllers being purchased will be a one for one direct swap with the controllers being used at the present time.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

NAVAIR’s AVMI Division maintains in-depth knowledge of Structural Load and Calibration technology developments and static and fatigue load testing mechanisms. This includes insight into technologies that individual companies are focused on and their technical and production capabilities. AVMI representatives maintain this knowledge through routine review of industry journals, attendance at industry symposiums and conferences. They also periodically visit industry facilities for briefings on companies’ Internal Research and Development (IRD) efforts. Market research by AVMI has disclosed no alternate available sources that can meet the requirements and resulted in a determination that procurement of these Flex Test 40 Controller Assemblies from any other source is not feasible.

In accordance with NAVAIR Communique 15-38, a requirement exists for the Government to issue a Sources Sought for requirements in an effort to promote competition.

A Sources Sought for this requirement was posted in FEDBIZOPPS on 24 January 2017. Responses were due on 8 February 2017. No responses were received.

7. Determination of Fair and Reasonable Cost.

As this is a commercial product based on the definition in FAR 2.101 and the estimated value of the procurement falls under the applicable threshold in FAR 13.5 (Test Programs for Certain Commercial Items), the Government will proceed with the procurement using FAR 13.5 procedures. This will include the use of price analysis as the basis for ensuring the negotiated price for the products is fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

Through the review of industry journals, attendance at industry symposiums and conferences, and visits to industry facilities, NAVAIR's AVMI Department maintains an in-depth knowledge of Structural Load and Calibration technology developments as well as static and fatigue load testing mechanisms. The market will be surveyed continually for future Controller Assemblies options and alternative sources.
