SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
Scope of Contract To crush 2,500 cubic yards of ¾” Aggregate Base at Paul Cole’s Pit and crush 5,000 cubic yards of ¾” Aggregate Base at Walker Plains Government Pit.
Contractor Responsibility: The Contractor shall provide everything--including, but not limited to, all equipment, supplies, transportation, labor, and supervision--necessary to complete the project, except for that which the contract clearly states is to be furnished by the Government.
Project Location
The Plumas National Forest. Feather River Ranger District is in Oroville, CA.
Paul Cole’s Pit can be located by traveling Oro-Quincy Highway 162 approximately 14 miles to intersection of Foberstown Road (Butte County Road 275811) following BC 275811 for approximately 8 miles to intersection of Feather Falls (Butte County Road 27672) turn left, travel approximately 15 miles to town of Feather Falls, turn right on Forest Service Road 22N27, travel 7 miles to intersection of Forest Service Road 22N94, turn right and travel 2 miles to intersection of Forest Service Road 20N15, turn right travel ¼ mile turn left into Paul Cole’s Pit. T20N, R7E, Sec. 2
Walker Plains pit can be located by traveling on Oro-Quincy Highway 162 from Oroville approximately 25 miles to intersection of Butte County Road 49665A, turn left follow detour signs for 3 miles to intersection of Forest Service Road 22N49, turn right travel 3.5 miles to intersection of Oro-Quincy Highway (Butte County Road 27562), turn left and travel 12 miles to Walker Plains Pit. T22N, R6E, Sec. 4 NOTE: Any prospective bidder desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing soon enough to allow a reply to reach all prospective bidders before submission of their bids. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

Work may be performed at any time during the period of the contract, except as outlined here. Nothing in this part shall be construed to take away any of the Government's rights under the Suspension of Work Clause (52.242-14). Restrictions are as follows: None

2. When the Contracting Officer (or designated representative) determines that adverse weather has made access too dangerous or that continued vehicular travel would cause unacceptable road damage.
Licenses and Insurance
The contractor shall obtain the insurance and licenses listed here; (see also Section L, Notices to Offerors and Respondents).
Worker's Compensation Insurance
The Contractor shall provide evidence of Worker's Compensation Insurance or a written explanation as to why the Contractor is exempt from the requirement. NOTE: The Contractor working alone is not required to carry the insurance.
Camping and Housing
Camping is not permitted in US Forest Service campgrounds. Contractor [X] will [ ] will not be permitted to camp elsewhere on US Forest Service land. Camping on Forest Service land is not a right; permission may be revoked for failure to comply with the terms of the permit. (See also Section H, Camping Permit Compliance)
Physical Data Data and information furnished or referred to in this contract is for the Contractor’s information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the contractor. Rock material is available immediately at the quarry site within the boundaries indicated on the project quality and quantity of material in the source, other than some possible processing requirements to deal with pockets or layers of unsuitable material. On past crushing projects minimal unsuitable material has been encountered.

Aggregate shall be within the grading requirements listed below, as determined by AASHTO – T-11 and T-27 test methods.

(b) STOCKPILE CONSTRUCTION
(1) The stockpile sites shall be prepared by clearing and disposing of all woody debris to include any trees, stumps, and brush, the floor shall be reasonably uniform in cross-section. The stockpile sites for each quarry are shown on drawings.
(2) Stockpiles. The stockpile shall be constructed at the area shown on the drawings. The stockpile shall not be less than 20 feet in height and shall be neat and regular in form.
(c) WASTE MATERIAL
Waste material or oversize material that cannot be incorporated into the specified product shall remain on the property of the Government, and shall be disposed of by piling it on the site at a convenient location agreed to by the Contractor and Contracting Officer. See Pit Development (Site Plan Map) for specific requirements.
SECTION E--INSPECTION AND ACCEPTANCE

FEDERAL ACQUISITION REGULATION (48 CFR CHAPTER 1) CLAUSES
52.246-12 Inspection of Construction (AUG 1996) QUALITY CONTROL PLAN – The Contractor shall conduct inspections on all units in accordance with his/her Quality Control Plan (QCP). The Contractor’s Quality Control Plan shall be submitted and accepted by the Government prior to any work starting.
GOVERNMENT INSPECTIONS
Government inspections are for the purpose of satisfying the Government that the services are acceptable and do not relieve the Contractor of the responsibility for maintaining quality control.
The Contracting Officer's Representative or designated inspector will conduct all inspections. The Contractor (or designated representative) is encouraged to be present to observe inspections. Summary results will be made available on request.
Compliance Inspections. Visual compliance inspections will be made on a periodic basis. Such inspections are not final and do not constitute acceptance by the Government.
Final Inspections. Final (formal) inspections for payment will be made on completed sub-items only. Contractor shall request final inspections in writing and give the Forest Service at least two working days advanced notice. Inspections will be completed within four working days after the notice is received If the work is not ready for inspection at the time specified by the Contractor, the cost associated with the inspection attempt may be charged to the Contractor.
Disputed Inspection.
The Contractor may request reinspection without rework if the results are unacceptable. Reinspection must be requested in writing within 48 hours after receiving written notice of the inspection results. Reinspection will be accomplished within five working days after receipt of the contractor's written request.
The same sampling and inspection procedures will be used, but new samples will be taken. The inspection pattern will be shifted so that new samples will not overlap previously inspected samples. Results will be rounded to the nearest whole percent.

Work on this contract will be deemed acceptable when total cubic yards of crushed aggregate has been met.
Quality Assurance Plan (General Instructions) (Narrative) (Table) Quality Assurance Plan - General Instructions This plan is designed to help you answer these two questions and convey the answers clearly to the contractor:
· When or how will I know that the outcome has been satisfactorily achieved?
· How much deviation from the performance standard will I allow the contractor, if any?
The QAP must include the following information:
· Tasks/Subtasks – should be the same as C.3.
· Quality Standard – use end result specifications in the quality standard
· Acceptable Quality Level – use only when modifying the quality standard
· Minimum Acceptable Level – a level below which no payment will be made.
· Means of Measurement – For most projects, use the inspection procedures outlined in Section E. All projects over $100,000 will rely on government inspections. COs have determined that resource projects less than $100,000 will also require reliance on government inspections. Non-resource projects less than $100,000 should rely on contactor data records and reports, with random verification by the government.
The QAP should include both a narrative and a table, unless complete clarity can be achieved using only one of the methods.

AGAR 452.211-74 Period of Performance (FEB 1988) The period of performance of this contract is from August 12, 2019 through October 12, 2019.
SECTION G--CONTRACT ADMINISTRATION DATA
GOVERNMENT-FURNISHED PROPERTY
The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.
NONE
Pre-work Pre-work conference. Before work begins on service contracts, a pre-work conference is normally held to discuss the contract--especially the specifications, labor provisions, plan of work, and selected standard clauses. The pre-work meeting should be attended by an officer of the firm or someone designated in writing to act on behalf of the firm. The pre-work meeting may be waived at the discretion of the Contracting Officer.
No work may begin on this contract until the Contracting Officer has issued a Notice to Proceed.
Payment
Payments and Deductions. Payment will be made for fully acceptable work at the prices bid in the schedule of items. In the event of extended non-work periods because of adverse weather, the Contracting Officer may authorize progress payments for partially completed sub-items on a case-by- case basis. In accordance with the inspection clause, payment may be made for less than fully acceptable work at a reduced price.
Contract Release. The following supplements the Payments clause in Section I:
Before final payment will be made the Contractor shall sign a release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically excepted from the operation of the release. A release may also be required of the assignee if the Contractor's claim to amounts payable under this contract has been assigned under the Assignment of Claims Act of 1940 (31 U.S.C. 3727 and 41 U.S.C. 15).
RETAINAGE (applicable to service contracts where work accomplishments are measured in units other than time) The following supplements Clause 52.232-1, Payments:
The Contracting Officer may retain up to 10 percent of the invoiced amount if the contractor is behind schedule at the time the invoice is presented. “Behind schedule” means that the percentage of work completed is less than the percentage of time used.
Invoices
Payment will be made from the contractor’s invoice. All invoices are to be submitted via the electronic Invoice Processing Platform (IPP). This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm. There is no pre-award registration.
After award of a contract, please make sure that your company registers promptly at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish your account. PRIOR to starting the IPP enrollment process, please verify that the point of contact’s (POC’s) email address is up to date in your company’s System for Award Management (SAM) account at www.sam.gov and that any recent update(s) have been allowed time to process resulting in an “Active” status on the SAM account. The one-time enrollment in IPP means a series of emails will be sent to the SAM POC. If you have questions on the IPP enrollment process, the help desk phone number is 1-866-973-3131.
Invoices shall be accompanied by the signed contractor certification, using the exact wording in the clauses, FAR 52.232-5, and be up-to-date on certified payrolls for the invoiced timeframe, FAR 52.222-8. (See next page for invoice certification language.) Invoices that do not meet these requirements will be rejected.
The Contractor shall submit payrolls weekly for each week in which any contract work is performed. The copies shall be sent to the COR. Payrolls submitted shall set out accurately and completely all of the information listed on the form WH-347 (available for download at www.dol.gov), including the certification verbatim from the WH-347. Forms from other State or County governments are not compliant.
SECTION H--SPECIAL CONTRACT REQUIREMENTS
Emergencies

Area of Responsibility for Fire. Unless otherwise noted elsewhere in the contract, the following define the limits of a contractor's area of responsibility for fire under the terms of the Fire Plan (Section J):

Superintendence by Contractor
In addition to Clause 52.236-6, the following applies: The name and the specific authorities of the foreman or superintendent must be designated in writing to the Contracting Officer. The Contractor may use his/her own prepared letterhead stationery or a "Designation of Contractor's Representative" form available from the Contracting Officer. If the Contractor or the designee is not present when work is being performed on the contract, a Suspend Work Order may be issued with contract time continuing to run. The Contractor shall have a person on-site that is fully conversant in the English language.
Camping Permit Compliance
Contractor shall comply with all terms and conditions of any camping permit issued to allow use of premises. Any non-compliance will result in suspension of work until compliance is achieved.
Archaeological and Historic Sites
Location of known archaeological, historic, or pre-historic materials--such as Amerind artifacts and/or historic mining, logging, or fur trapping remains protected by the American Antiquities Act (l6 USC 433)--will be identified for the contractor before work commences.
Spill Plan
If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare and implement a Spill Prevention and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112), including certification by a registered professional engineer. The Contractor under the direction of the Contracting Officer, or in the absence of said officer, acting independently, shall immediately take action to contain and clean up, without expense to the Government, all petroleum products spills on or in the vicinity of the project which are caused by the Contractor's employees directly or indirectly as a result of contract operations. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government for the containment and clean up of petroleum products spills caused by Contractor's employees or resulting from contract operations. The Contractor shall immediately report all petroleum products spills to the Contracting Officer.
Equipment Cleaning
All off-road equipment used on this project shall be washed before moving into the project area so that the equipment is free of soil, seeds, vegetative material, or other debris that could contain or hold seeds of noxious weeds. “Off-road equipment” includes all logging and construction equipment and such brushing equipment as brush hogs, masticators, and chippers; it does not include log trucks, chip vans, service vehicles, water trucks, pickup trucks, and similar vehicles not intended for off-road use.
Equipment will be considered clean when visual inspection does not reveal soil, seeds, plant material, or other such debris. Disassembly of equipment components or specialized inspection equipment is not required. Contractor shall notify the Contracting Officer at least five days in advance of moving equipment in so that arrangements can be made for inspection.
If the project area is known to contain noxious weeds, the equipment shall be cleaned before moving to other Forest Service system lands which do not contain noxious weeds.

(a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –
(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and
(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.
(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.

SECTION M--EVALUATION FACTORS FOR AWARD
AWARD DETERMINATION
Award will be made to the offeror whose acceptable offer provides the best value to the government, considering price and the non-price factors listed below. Non-price evaluation factors, when combined, are approximately equal to cost or price.
The selection official will base the award decision on a tradeoff between price and non-price factors, comparing the relative risk to the government of poor or non-performance posed by each of the offerors, and making a judgment as to whether or not reduced risk of performance is worth the additional cost. In some cases this will result in award to a lower-ranked but lower-priced offer; in other cases the result will be award to a higher-ranked but higher-priced offer.
ACCEPTABILITY OF THE OFFER
The Government will determine the acceptability of each offer on a pass or fail basis. An offer is acceptable when it manifests the offeror's assent, without exception, to the terms and conditions of the RFQ, including attachments. If an offeror takes an exception to any of the terms and conditions of the RFQ, then the Government will consider its offer to be unacceptable.
CAPABILITY OF THE OFFEROR
The Government will assess the capability of each offeror on the basis of the following criteria:
(1) Technical Approach, (2) Key Personnel, (3) Relative Past Performance. The Government will not assess capability on a pass/fail basis, but will use its assessments of capability as a basis for comparing offerors to determine best value.
1. Technical Approach. The evaluators will conduct an appraisal of the offeror’s technical approach to determine the feasibility of the operations plan and associated special requirements in addition to whether the contractor understands the Performance Work Statement.
Provide an Operations Plan with a general project information narrative that specifically includes the following information. The technical approach should be in as much detail as the offeror considers necessary to fully explain the proposed technical approach or method. The technical proposal should reflect a clear understanding of the nature of the work being undertaken and should, at a minimum, include:

Project Schedule b.
Proposed Contractor Safety Plan and Quality Control Plan.

List of subcontractors expected to perform more than 20% of the work.
d.
Blasting Plan should be submitted for review by Regional Basting Coordinator and Plumas County Sheriff Department in Quincy, Calif.
2. Key Personnel. The Government will assess the quality and extent of the qualifications of the offeror’s proposed personnel based on a detailed review of the content of the information and resumes submitted as part of the offer (proposal).
