Inquiries

Any prospective quoter desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing, not later than 5 calendar before the closing date, to allow a reply to reach all prospective quoters before submission of their quotes. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Submission of Quotes

(a) Electronic Submissions (Email submissions are preferred if possible)

(1) Quoters may submit electronic responses to this solicitation. Email quotes to tracy.marino@usda.gov. Please limit the size of your file to 5 MB or less; more is not always better, so please be concise. Include the solicitation number in the subject line of the email. Files in Adobe Acrobat are the preferred file type; other types may be accepted but the quoter may be required to change type if the Government cannot open the attachment.

(2) If any portion of a quote received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document--

(i) The Contracting Officer immediately shall notify the quoter and permit the quoter to resubmit the quote.

(ii) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the quoter; and

(iii) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timelines, provided the quoter complies with the time and format requirements for resubmission prescribed by the Contracting Officer.

To be considered for award all bidders must be successfully registered in the SAM database (www.sam.gov) AT THE TIME A BID IS SUBMITTED. See FAR Clause 52.204-7, System for Award Management, as applicable for requirement information.

Effective June 29, 2018, all non-Federal entities who create or update their registration in SAM.gov will no longer need to have an approved Entity Administrator notarized letter on file before their registration is activated. All non- Federal entities still must mail the original, signed copy of the notarized letter to the Federal Service Desk. Failure to do so within 30 days of activation may result in the registration no longer being active. 1. DESCRIPTION OF WORK:

This contract is for the supply and delivery of 7,200 tons of crushed aggregate for the use by the government in road maintenance. The contractor shall furnish all labor, supervision, transportation, operating supplies, and incidentals necessary to perform this project. Contractor furnished aggregate shall comply with Section 703.05(b) of the attached Forest Service Specifications, Grading Designation G.

The contractor shall provide a water truck and operator for dust abatement of the haul route. Aggregate shall be delivered to the project in bottom dump trucks only. Contractor shall provide a minimum of 8 trucks for delivery and hauling of material. Aggregate shall be placed in windrows for the full length of the project as directed by the Contracting Officer. Government operated equipment will mix, spread, compact and grade the windrowed aggregate.

Contractor shall be responsible for providing a quality control plan to assure that the materials meet specifications.

Material sampling and testing is required as specified in Table 1 of the attached specifications.

Placement of aggregate materials shall be in support of Force account work and is to be coordinated with the Roads Maintenance Crew Supervisor, Daren Mueller, at 530.310.3550, to ensure the deliveries and windrowing of the aggregate material is at the right time and at the right location.

2. PROJECT LOCATIONS:

The Project is located approximately 9 miles southwest of Old Station, CA. From Old Station travel 9 miles west on State Highway 44 to NFS road 33N16. 32N25 is a 2.5 mile segment located approximately 1.5 miles from State Highway 44 on the west side of 33N16 (Forest route 16). See the project drawings for more information.

3. SPECIFIC WORK REQUIREMENT:

Dust Abatement - The Contractor shall be responsible for dust abatement (watering) along the haul route during operations. Water sources can be found at North Battle Creek Reservoir; T32N, R3E, Section 29 and Lost Creek at T31N, R4E, Section 3.

Traffic Safety - The Contractor shall be responsible for traffic control, signs, flagmen and other traffic control devices to ensure public safety. All such signs or warning devices shall conform to Part VI of the Manual on Uniform Traffic Control Devices for Streets and Highways. The Contractor shall not obstruct public traffic for a period over 10 minutes.

Pollution and Erosion Control - During all operations under this contract, the Contractor shall prevent or minimize soil erosion and pollution of water and other resources. Damage to any improvements or natural resource by the Contractor, including damage to roads that is not caused by normal operations, shall be promptly repaired to the satisfaction of the Contracting Officer.

Acceptable Quality Levels (AQLs) - Weight tickets shall be required prior to acceptance and payment for contractor furnished aggregate. Aggregate sampling and testing results (for contractor furnished aggregate) shall be submitted to the Contracting Officer as specified in Table 1 of the attached specifications.

4. COMMENCEMENT PROSECUTION, AND COMPLETION OF WORK

Once the Government is ready to begin work on the roads the Contractor shall be given the notice to proceed, once started it is estimated to take approximately 20 days to complete . Work is estimated to begin approximately August 5st, 2019.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

452.228-71 Insurance Coverage. (NOV 1996)

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

(a) Definitions. As used in this provision-

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate-

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern-

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
