Submission of Quotes

(a) Electronic Submissions

(1) Quoters may submit electronic responses to this solicitation. Email quotes to tmarino@fs.fed.us. Please limit the size of your file to 5 MB or less; more is not always better, so please be concise. Include the solicitation number in the subject line of the email. Files in Adobe Acrobat are the preferred file type; other types may be accepted but the quoter may be required to change type if the Government cannot open the attachment.

(2) If any portion of a quote received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document--

(i) The Contracting Officer immediately shall notify the quoter and permit the quoter to resubmit the quote.

(ii) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the quoter; and

(iii) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timelines, provided the quoter complies with the time and format requirements for resubmission prescribed by the Contracting Officer.

CONTRACT DOCUMENTS, EXHIBITS AND ATTACHMENTS

Susan River Aggregate Supply and Hall 2018

Description of Work:

This contract is for the supply and delivery of 15,000 tons of crushed aggregate for use by the government in road maintenance. The contractor shall furnish all labor, supervision, transportation, operating supplies, and incidentals necessary to perform this project. Work is scheduled to begin in early August 2018 and be completed within three

(3) weeks. Work schedule shall be Monday - Friday 0700 - 1700

Contractor furnished aggregate shall comply with Section 703.01(b) of the attached project specifications, Grading Designation G.

The Contractor shall provide an adequate water supply and apply water by means of water trucks as necessary for aggregate compaction and dust abatement. Aggregate shall be delivered to the project in bottom dump trucks only.

Contractor shall provide a minimum of 12 trucks for delivery and hauling of the material.

Aggregates shall be placed in windrows at locations as follows, reference attached Susan River Stormproofing aggregate haul map:

1) Goumaz Road, 30N03. At the beginning of the project, which is intersection with Lassen County Road 230.

-Place aggregates from milepost 0.00 to milepost 0.80.

-Place aggregates from milepost 4.40 to milepost 8.40.

-Place aggregates from milepost 9.20 to milepost 10.20.

2) Willard Creek Road, 29N03.

-Place aggregates at milepost 0.25 to milepost 1.50.

3) East Willard Creek Road, 29N02, -Place material 115 tons each side of the Low water crossing at the water source.

4) National Forest System Road 29N03, Milepost 0.00, begins at the intersection with Willard Cr. Road at Roxie Peconom Campground.

-Place 600 tons of aggregate across wet area rolling dip to be constructed, milepost 1.50.

5) Hamilton Mountain Road, 29N85.

-Place aggregates from milepost 2.00 to milepost 4.60.

Contactor shall provide a commercial certification that the material complies with all contract requirements in conformance with Section 106.03 of the attached project specifications.

Specific Work Requirements:

Dust Abatement: The contractor shall be responsible for dust abatement (watering) along the haul routes during operations. The water sources are shown on the attached Susan River Stormproofing aggregate haul map. The water sources for this project are located at: T29N, R10E, Sec. 13; T29N, R10E, Sec. 25; T29N, R10E, Sec. 27; T30N, R10E, Sec. 33.

Traffic Safety: The Contractor shall responsible for traffic control, signs, flagmen, and other traffic control devices to ensure public safety. All such signs and warning devices shall conform to Part VI of the Manual on Uniform Traffic Control Devices for Streets and Highways. The aggregate placement operations shall be performed in a manner such that the public traffic will not be delayed by a period of more than 10 minutes as a result of the aggregate placing activities.

Pollution and Erosion Control: During all operations under this contract, the Contractor shall prevent or minimize soil erosion and pollution of water and other resources. Damage to any improvements or natural resource by the Contractor, including damage to roads that is not caused by normal operations, shall be promptly repaired to the satisfaction of the Contracting Officer.

Acceptable Quality Levels (AQLs): Weight tickets shall be provided to the Contracting Officer prior to acceptance and payment for Contractor furnished aggregate. Commercial certification for Contractor furnished aggregates shall be submitted to the Contracting Officer as stipulated in Section 106.03 of the attached project specifications.

Project Location: The Project is located approximately 9 miles west/southwest of Susanville, California. From Susanville travel 9 miles west on State Highway 36 to National Forest System Road, 29N03. Project begins at intersection of State Highway 36 and National Forest System Road 29N03.

The legal description for the project beginning is Section 13 Township 29 North, Range 10 East, Mount Diablo Meridian. The water sources for this project are located at: T29N, R10E, Sec. 13; T29N, R10E, Sec. 25; T29N, R10E, Sec. 27; T30N, R10E, Sec. 33.

106 - Acceptance of Work

106.01 Conformity with Contract Requirements.

Perform work according to the contract requirements. Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the Susan River Stormproofing Aggregate Haul Route Map and as specified in the contract.

Placement of aggregate materials in support of Force account work and is to be coordinated with the Roads Maintenance Crew Supervisor, Daren Mueller, at 530.310.3550, to ensure the deliveries and windrowing of the aggregate material is at the right time and at the right location to support the Road Crew Force Account work to be accomplished with the material provided by this contract.

Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of the tolerance range is to accommodate occasional minor variations form the median zone that are unavoidable for practical reasons.

The Government may inspect, sample, or test all aggregate materials furnished at any time before final acceptance of the project. When the Government tests aggregate materials furnished, copies of test reports are furnished to the Contractor upon request. Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor-s results may be used by the Government to evaluate the aggregate materials furnished for acceptance. Do not rely on the availability of Government test results for process control.

Acceptable work conforming to the contract will be paid for at the contract unit bid price.

Remove and replace work that does not conform to the contract, or to prevailing industry standard where not specific contract requirements are noted, at no cost to the Government.

As an alternative to removal and replacement, the Contractor may submit a written request to:

(a) Have the work accepted at a reduced price; or

(b) Be given permission to perform corrective measures to bring the work into conformity.

The request must contain supportive rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.

106.02 Visual Inspection.

Acceptance is based on visual inspection of the work for compliance with the contract and prevailing industry standards.

106.03 Certification.

Provide a commercial certification, one for all similar materials from the same manufacturer, that the material complies with all contract requirements.

109 - Measurement and Payment

109.01 Measurement of Work

Measurement shall be by the ton delivered and placed at the specified location in conformance with the contract and these special project specifications. Ton is defined as 2,000 pounds avoirdupois measured by a commercial weighing system. Weigh slips shall be provided to the on-site government representative who will provide them to the CO for verification of delivery of materials. The supplier-s weigh slips shall include net mass or volume converted to mass.

Periodic check weighing may be required.

Payment for all contract work provided, either directly or indirectly, shall be by the unit price bid for the contract quantity of materials supplied by the ton.

151 - Mobilization

151.01 Payment

Mobilization is considered an indirect cost of this contract and will not be compensated as a separate work item.

170 - Develop Water Supply and Watering

170.01 Description.

This work consists of developing an acceptable water supply, furnishing, hauling, and applying water to provide for compaction and control dust.

170.02 Development of Supply and Access.

Develop water supplies and access to the water supplies as required. Use designated water sources or other approved water sources. Before using non-designated water sources, obtain all necessary permissions, water rights, and permits.

170.03 Equipment.

Provide mobile watering equipment with watertight tanks of known capacity. Provide for positive control of water application for the driver's position. Provide an adequate water supply and apply water as needed.

107.04 Application.

Apply water uniformly without ponding or washing.

170.05 Measurement.

Not used.

170.06 Payment.

Develop water supply and watering is considered and indirect cost of this contract and will not be compensated as a separated work item.

171 - Weed and Disease Prevention

171.01 Description.

This work consists of washing and treating construction equipment to remove seeds, plants, and plant fragments for the equipment before the equipment is used on National Forest System Lands.

171.02 General.

Notify the CO in writing at least 15 days before moving any construction equipment onto National Forest System Lands. Construction equipment does not include cars, pick-up trucks, and other vehicles that regularly travel between the construction site and areas outside of National Forest System Lands.

Perform all work at locations approved in writing. Provide the CO with an opportunity to monitor the washing and make inspections.

171.03 Equipment.

Use a high pressure washing system.

If washing occurs on National Forest System Lands, use a washing system that traps all wash water and either stores it for removal from National Forest System Lands or recycles the water for continued use. If the equipment recycles water, provide adequate filters for seed removal. Dispose of the filter material and removed seeds in an approved manner. Do not mix soaps, detergents, or other chemicals with the wash water.

If washing is at a commercial washing facility, use an approved facility.

171.04 Washing.

Wash the sides, tops, and undercarriages of all construction equipment. Remove all seeds, plants, plant fragments, dirt, and debris from the construction equipment.

171.05 Not used

171.06 Inspection.

Inspect the washed construction equipment, including the undercarriage, to ensure that the washing removed the dirt, debris, and seeds from the construction equipment. Rewash the construction equipment as necessary or as described.

171.07 Acceptance.

Acceptance is based on visual inspection of the work for compliance with the contract and prevailing industry standards.

171.08 Measurement.

Not used.

171.09 Payment.

Not used.

703 - Aggregate

52.219-28 Post-Award Small Business Program Rerepresentation. (JUL 2013)

(a) Definitions. As used in this clause-

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. Insurance

Pursuant to the requirements of the contract clause 52.228-5 titled "Insurance-Work on a Government Installation", in accordance with FAR 28.307-2, the contractor shall obtain and maintain at least the following kinds of insurance and minimum liability coverage during any period of contract performance:

(a) Workmen's Compensation and occupational disease coverage as required by law except that, if this contract is to be performed in a state which does not require or permit private insurance, then compliance with the statutory or administrative requirements in any such state will be satisfactory. The required Workmen's Compensation Insurance shall extend to cover employers' liability for accidental bodily injury or death and for occupational disease with a minimum liability limit of $100,000.

(b) Comprehensive General Liability Insurance in the minimum limit of $500,000 per occurrence for bodily injury liability.

(c) Comprehensive Automotive Liability Insurance with minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury, and a minimum limit of $20,000 per occurrence for property damage.

Invoice Submission Procedures

(a) The "SUBMIT INVOICES TO ADDRESS" for invoices on USDA orders is the Department of Treasury's Invoice Processing Platform (IPP). All invoices for work performed under this contract or materials delivered shall be submitted via the electronic Invoice Processing Platform. The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision-

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except-

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
