Submission of Quotes There is no need to return any portion of the solicitation that is not part of a quote.

Submission of quotes by email is preferred, to svincent02@fs.fed.us Submission of quotes by fax of up to 20 pages is acceptable to 530-226-2474.

SAM Entity Required to Receive Award The System for Award Management (SAM) is an online database for Contractor registration, representations and certifications. Quoters must have a DUNS Number and an Active SAM Entity to receive award.

1. Quoters with an Active SAM Entity shall provide their DUNS Number.

2. Quoters without an Active SAM Entity shall fill out FAR Provision 52.212-3, Offeror Representations and Certifications - Commercial Items, and return it completed as part of the quote. The Provision has been provided in full-text in the Solicitation Provisions section. Quoters may submit quotes before SAM Entity Registration/ Activation is complete, but are advised that Activation takes 7-10 to process after registering and that the Government is not obligated to delay award while an Entity becomes Active. Response to Evaluation Factors (Technical and Price Criteria) All Quoters must respond to all Evaluation Factors as described in the Evaluation Factors section.

Site Visit (Pre-Quote) A pre-quote site visit is planned for April 18, 2018, at 8:00 AM at the Forest Service Mt. Shasta McCloud Management Unit, 2019 Forest Road, McCloud, CA 96057. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, SMMU Water Drafting Site Improvements Page 8 of 38

Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.246-4 Inspection of Services - Fixed-Price. (AUG 1996)

(a) Definitions. Services, as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may (1) require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and (2) reduce the contract price to reflect the reduced value of the services performed.

(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may (1) by contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or (2) terminate the contract for default.

C - Contract Documents

SCOPE OF CONTRACT

The purpose of this contract is to bring six current water drafting sites up to Best Management Practices (BMP) standards. All six sites are routinely used by the U.S. Forest Service (USFS) for vegetation management projects. Each site is approximately half an acre or less (including access spurs). The Shasta- McCloud Management Unit (SMMU) is proposing to repair and improve each site with site specific measures to meet BMP standards. The range of activities proposed includes but is not limited to: rocking access spurs to drafting sites, native boulder bank reinforcement, placing native boulders (as wheel stops) to prevent trucks from entering the water source, infiltration improvement, and adding Geotextile. There are four sites where trees may need to be cut to facilitate improvements. A borate compound shall be applied to any cut stumps 14-inches or greater, following manufacturer's directions and state law, to help prevent the infection of Annosus (Heterobasidion root disease).

The Contractor shall utilize site-specific information provided in this solicitation to implement improvements within the bounds of the provided preliminary drawings. The Contractor shall furnish all technical expertise, labor, equipment, supervision, transportation, operation supplies (including but not limited to gravel, geotextile, and large boulders from local aggregate sources that match the materials found on-site) and incidentals necessary to complete the project, except for that which the contract clearly states is to be furnished by the Government. All equipment within the Contract area shall be in such mechanical condition and of an appropriate type to meet the requirements of the work.

DESCRIPTION

Location Project sites are located on the McCloud Ranger District of the Shasta Trinity National Forest. Detailed maps of the Shasta Trinity National Forest are available from the Headquarters office or the McCloud/Mt.

Shasta Ranger Station offices. Access to certain sites may be limited; the Government is not obligated to do any unscheduled road maintenance. It is the responsibility of the Contractor to determine the most suitable route to the project areas. All sites are normally accessible by standard pickup on forest roads.

Project Area Maps Maps provided in the contract are intended to show the general location and shape of the project areas.

UNIQUE FACTORS

Endangered Species The Government may direct the Contractor to discontinue operations in the event that listed or proposed threatened or endangered plants or animals protected under the Endangered Species Act of 1973, are discovered to be present in or adjacent to the project area. Actions taken under this paragraph shall be subject to the Stop-Work Order clause FAR 52.242-15.

Preservation of Historical and Archeological Resources If, in connection with operations under this contract, the Contractor, subcontractors, or the employees of any of them, discovers, encounters or becomes aware of any objects or sites of cultural value on the project area, such as historical or prehistorical ruins, graves or grave markers, fossils, or artifacts, the Contractor shall immediately suspend all operations in the vicinity of the cultural value and shall notify the COR in writing of the findings. No objects of cultural resource value may be removed. Operations may resume at the discovery site upon receipt of written instructions. Actions taken under this paragraph shall be subject to the Stop-Work Order clause FAR 52.242-15.

Environmental Interruption of Work Environmental - The Contracting Officer, by issuance of a suspend work order, may direct the Contractor to shut down any work that may be subject to damage due to weather conditions or fire danger. The

Contractor will be given a resume work order that will document the date the work suspension ends. The count of contract time will stop during work interruptions in excess of one day at a time. All periods of interruptions directed by the Government will be documented. The Contractor will not be entitled to additional monetary compensation for such suspensions regardless of duration.

Camping Camping is not permitted in US Forest Service campgrounds; however, it may be allowed elsewhere on US Forest Service land with the approval of the District Ranger and subsequent issuance of a camping permit, and a fire permit, along with following any fire restrictions that may be in place.

PERIOD OF PERFORMANCE

Estimated Start Date: May 29, 2018 Total Contract Time: 14 calendar days Completion By: July 27, 2018

Contract time shall begin within three calendar days of the date given on the Notice to Proceed. Work shall progress at a rate which will insure job completion within the calendar time specified above.

Note: Estimated starting date is not compulsory. Weather and appropriate ground conditions along with the Contractor's work schedule may dictate starting time as long as the whole project is complete by July 27, 2018.

Notice to Proceed The Government will issue a Notice to Proceed as soon as weather and ground conditions are favorable for the work, Contractor's work plan is accepted, and proof of worker's compensation insurance has been received.

Post-Award / Pre-Work Meeting A post award conference with the awarded Contractor may be required, and if so, will be held at a location and time mutually agreeable to the Government and the Contractor.

Work Restrictions Work may be performed at any time during the period of the contract except as determined by the COR or as stated below:

(1) In accordance with the Fire Plan.

(2) When the Contracting Officer (or designated representative) determines that adverse weather had made access too dangerous or the continued vehicular travel or use of equipment would cause unacceptable road or resource damage.

(3) Work is suspended by notice of a Work Order for non-compliance with the requirements of this contract.

Should additional resource protection measures become apparent, regardless of when such facts become known, the contract may be modified (bilaterally if measures would affect a contract scope change).

Discovery of such areas (include wildlife areas, heritage resource areas, and noxious weeds) by either party shall be promptly reported to the other party. Access may be delayed due to heavy logging activity and/or weather.

Rate of Progress Contract work shall be performed in accordance with the order of preference approved by the Contracting Officer Representative in the Contractor's work plan. The Contractor shall maintain progress at a rate which will assure quality and completion within the period of performance specified above. The Contractor shall inform the Contracting Officer as soon as possible of any actions or inactions by the Contractor or the Government which may affect the required delivery or completion times stated in the contract.

DEFINITIONS

For all intents and purposes of this contract the following definitions apply:

Site: Water drafting site which needs improvement.

Cultural Resources: Tangible and intangible aspects of cultural systems, living and dead, that are valued by a given culture or contain information about the culture. Cultural resources include, but are not limited to sites, structures, buildings, districts, and objects associated with or representative of people, cultures, and human activities and events. Cultural resources include the entire spectrum of resources for which the Heritage Program is responsible, from artifacts to cultural landscapes, without regard to eligibility for listing on the National Register of Historic Places.

Dispersed Recreation: is activities that take place outside of developed camping or concessionaire-operated facilities, excluding motorized recreation.

Erosion: The process in which a material is worn away by precipitation, a stream of water, glaciers, winds and waves.

French drain: A French drain is a trench filled with gravel or rock or containing a perforated pipe that redirects surface water and groundwater away from an area. A French drain has perforated hollow pipes along the bottom to quickly vent water that seeps down through the upper gravel or rock.

Natural Disturbance Event: Events that alter the structure, composition, or function of terrestrial or aquatic habitats. Natural disturbances include, among others, drought, floods, wind, fires, wildlife grazing, and insects and diseases.

Resource Protection Measures (RPM): Resource Protection Measures are site specific protections or actions intended to minimize or eliminate potential environmental effects while achieving the desired condition. Development was guided by Forest Plan direction as well as other applicable law, regulation and policy; project-specific objectives; and resource concerns identified by the resource specialists.

Riparian Reserve (RR): Forest Plan management prescription for riparian areas (area consisting of riparian ecosystems, aquatic ecosystems, or wetlands referring to the land bordering a stream, lake, marsh, or wet meadow) where the conservation of aquatic and riparian dependent terrestrial resources received primary emphasis.

Rolling Dips: Rolling dips are depressions in a road or trail that force water to drain at the low spot.

GOVERNMENT PERSONNEL

Contracting Officer (CO) The Contracting Officer has full authority for the administration of the contract and will personally handle all matters beyond the authority of the COR. No other person is authorized to make changes to clauses, provisions, terms or requirements of the contract. Mutual agreement between the CO and Contractor is required for changes of time or cost to commercial services contracts.

Contracting Officer's Representative (COR) The COR is the on-site contract administrator for the Contracting Officer, whose duties and responsibilities include full authority for the day-to-day administration of the contract, except for matters pertaining to changes in contract price and time. Duties which are reserved for the CO are listed on the COR Designation Form.

Inspector(s) Inspectors may be designated by the COR who are responsible for checking the Contractor's compliance with the contract requirements.

The Government is not responsible for costs incurred during the performance of work not covered under this contract or resulting from direction by non-authorized persons. If the Contractor is given direction that is considered to be outside of the scope of the contract, the Contractor should advise the Contracting Officer.

GOVERNMENT-FURNISHED COMPONENTS

The Government will perform removal of houndstongue at the Tate Creek Site.

CONTRACTOR PERSONNEL

Qualified contractors shall possess all of the skills, abilities and qualifications required to perform contract requirements.

Contractor On-Site Representative The Contractor shall designate in writing, a representative to act for the Contractor (signatory authority) during his or her absence. The Contractor's representative shall read and speak fluent English. The Contractor shall list the extent of authority the designated representative will have on the job. The Contractor or acting authorized Representative shall receive in-field communications or documentation from the COR/Inspector as required to keep the job in progress and adherence to technical specifications, as needed, to finish the job.

Subcontractors The Contractor shall promptly notify the Contracting Officer about any proposed subcontract arrangement related to this contract, in advance of entering into a subcontract. Any subcontractor must have the relevant experience and appropriate equipment for such work. The written notification shall include as a minimum:

(1) The name, address and telephone number of the subcontractor.

(2) The date upon which the subcontract would be initiated, and its duration.

(3) A detailed description of the work to be subcontracted, including a listing of contract items, units, etc., as appropriate.

(4) Documentation of the subcontractor's representative authority.

CONTRACTOR-FURNISHED COMPONENTS

The Contractor shall furnish all technical expertise, labor, equipment, supervision, transportation, operation supplies, materials not available naturally and appropriately at work sites, and incidentals necessary to complete the project.

EQUIPMENT CLEANING

Contractor shall clean all off road equipment prior to arrival on the District, and again before leaving the Tate Creek site, making sure equipment is free of soil, seeds, vegetative matter, or other debris that could contain or hold seeds. Areas identified by the Forest Service as being infested with invasive species of concern must not move equipment off-site without first taking reasonable measures to make each such piece of equipment is free of soil, seeds, vegetative matter, or other debris that could contain or hold seeds.

Contractor must advise Forest Service of measures taken to clean equipment prior to moving equipment off-site. Reasonable measures (such as the use of air pressure) shall not require the disassembly of equipment components or use of any specialized inspection tools.

SITE DESCRIPTIONS AND SPECIFICATIONS

Resource Protection Measures (RPMs) for all sites:

(1) Apply a registered borate compound to all stumps 14 inches and larger to prevent the spread of Heterobasidion root disease according to label directions.

(1) Add native boulder bank reinforcement to armor the edges of the site.

(2) Place boulders as a block to stop trucks at the edge of the parking area: boulders to be 3-foot minimum diameter with flat face down and/or partially embedded as appropriate to inhibit displacement.

(3) Add appropriate geotextile and 3-inch aggregate subgrade for soil stabilization and better infiltration for pad where water trucks will be staging.

(4) Add a 1-inch plus surface rocking on the vehicle parking site.

(5) Shift parking area one vehicle width away from FA13 roadway.

(6) Perform slope improvement to drain away from creek. Allow water from parking area to drain away from creek, in case of overflow from trucks, to reduce erosion and risk of contamination into creek.

(7) Approximately 10 trees under 3 to 10-inch DBH to be cut; all trees are Ponderosa Pines. Trees shall be left on the ground for fire wood. Lop tops and limbs. Lop slash created (trees and limbs smaller than 4-inches in diameter) to 1-foot or less, or chip.

Ash Creek @ Sugar Pine Butte Road (FA19) E1/2E1/2 Sec. 30, T41N, R1W, MDBM Existing Condition: Several unauthorized routes provide access to the creek and none are currently managed. Drafting is done from the road as well.

Specifications (Contractor determines sequence):

(1) Improve road gradient by reducing the pitch slope down to creek and add surface rocking (1-inch plus) to this section of road spur, and the existing turn around area. Include drainage and/or rolling dip on road where appropriate for trucks to still use.

(2) Add native boulder bank reinforcement to armor the creek bank.

(3) Place large boulders to prevent vehicles from entering the Creek: boulders to be 3-foot minimum diameter with flat face down and/or partially embedded as appropriate to inhibit displacement.

(4) Add appropriate geotextile and 3-inch aggregate subgrade.

(5) Add a 1-inch plus surface rocking.

(6) Perform slope improvement to drain away from creek.

(7) Block unauthorized routes, and stabilize other creek access using native rocks; allowing sites to revegetate naturally.

(8) Approximately 4 trees 12 to 15-inch DBH to be cut: 3 trees are cedars and 1 is a Doug fir. Trees shall be left on the ground for fire wood. Lop tops and limbs. Lop slash created (trees and limbs smaller than 4-inches in diameter) to 1-foot or less, or chip.

Bear Springs @ McKenzie Butte Road (FA31) SW1/4 Sec. 18, T40N, R3W, MDBM Existing Condition: The pond received maintenance in 2014 but the approach and drainage was recently inspected and noted to be deficient. Overflow drains directly back into the pond; there is no defined parking area or structures to prevent vehicles from backing into the pond.

(1) Improve back in/ turn around location as needed to accommodate vehicles. Existing access is possible but requires improvement to allow safe use of the site.

(2) Add a 1-inch plus surface rocking on the vehicle parking site/ turn around area.

(3) Place boulders to prevent vehicles from entering the pond: boulders to be 3-foot minimum diameter with flat face down and/or partially embedded as appropriate to inhibit displacement.

(4) Modify slope around area to prevent any sediment coming off the road into pond and such that excess inflow into the pond flows away and is dispersed back into the woods and eventually the creek channel below the pond.

(5) Armor the area with 6-inch plus rock or permeable pavers that would allow vegetation to grow where drafting hose from trucks will enter the pond. Could be similar design as the outflow structures.

(6) Increase the capacity of the pond. Current capacity is approximately 7,500 gallons; target capacity is 10,000 to 12,500 gallons. Pond may be expanded up to 20-feet to the west to increase the holding capacity.

(7) Place boulders along side of FA31 road to block vehicles from driving into the pond: boulders to be 3-foot minimum diameter with flat face down and/or partially embedded as appropriate to inhibit displacement.

(8) Create drainage along FA31 road to drain away from pond where possible.

(9) Trees to be cut: One 49-inch DBH Douglas Fir shall be cut; seven to ten Port Orford cedar saplings under 4-inch DBH shall be hand cut to prevent the spread of Port Orford cedar root disease; and up to three other hazard trees may be cut if needed for Contractor safety. Trees shall be left on the ground for fire wood. Lop tops and limbs. Lop slash created (trees and limbs smaller than 4-inches in diameter) to 1-foot or less, or chip.

RPMs Be aware of Bear Springs water diversion site off of 41N31 near the bear springs drafting location. There is an intake box on the North side of the road along the spring source. Be sure to protect this feature if while making improvements to the site any actions impact the water diversion.

Tate Creek @ 39N51 SW1/4 Sec. 2, T39N, R1W, MDBM Existing Condition: The access road was recently added to the Forest Transportation system but no improvements have been made for drafting. Overflow from the site drains directly back into the creek.

Reducing the slope down to the existing site may improve pump operation.

Specifications (Contractor determines sequence):

(1) Add rock (1-inch plus) to the road surface approximately 150-feet leading to the designated drafting site.

(2) Block access from road to the creek with large boulders: boulders to be 3-foot minimum diameter with flat face down and/or partially embedded as appropriate to inhibit displacement.

(3) Add native boulder bank reinforcement to armor the creek bank.

(4) Place large boulders as wheel stops to prevent vehicles from entering the Creek: boulders to be 3-foot minimum diameter with flat face down and/or partially embedded as appropriate to inhibit displacement.

(5) Add appropriate geotextile and 3-inch aggregate subgrade.

(6) Perform slope improvement to drain away from creek.

(7) Block unauthorized routes, and stabilize other creek access using native rocks; allow sites to revegetate naturally.

RPMs This site has Burgundy houndstongue (Cynoglossum officinale) and will need to be treated to remove houndstongue prior to work occurring. Forest Service will treat, but shall be given 1-2 days' notice before work is initiated by Contractor at this site.

McCloud River @ Algoma and 39N06 Existing Condition: The existing site pulls up directly adjacent to the McCloud River. Some rock is in place but there is no grading for managing drainage or streamside protections.

Specifications (Contractor determines sequence):

(1) Add rock (1-inch plus) to the road surface leading to the designated drafting site.
