52.215-1 INSTRUCTIONS TO OFFERORS -- COMPETITIVE ACQUISITION (JAN 2004)
(a) Definitions. As used in this provision --
“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer’s discretion, result in the offeror being allowed to revise its proposal.”
“In writing,” “writing,” or “written” means any worded or numbered expression which can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.
“Proposal modification” is a change made to a proposal before the solicitation’s closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.
“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.
“Time,” if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.
(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).
(c) Submission, modification, revision, and withdrawal of proposals.
(1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages
(i) addressed to the office specified in the solicitation, and
(ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror. Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.
(2) The first page of the proposal must show --
(i) The solicitation number;
(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);
(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;
(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this solicitation;
and
(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority, unless that evidence has been previously furnished to the issuing office.
(3) Submission, modification, revision, and withdrawal of proposals.
(i) Offerors are responsible for submitting proposals, and any modification, or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.
(ii)
(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and --
(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or
(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or
(3) It is the only proposal received.
(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.
(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.
(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.
(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.
(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.
(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.
(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).
(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall --
(1) Mark the title page with the following legend:
This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed -- in whole or in part -- for any purpose other than to evaluate this proposal.
If, however, a contract is awarded to this offeror as a result of -- or in connection with -- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government’s right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and
(2) Mark each sheet of data it wishes to restrict with the following legend:
Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.
(f) Contract award.
(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation. (Using Best Value – Tradeoffs)
(2) The Government may reject any or all proposals if such action is in the Government’s interest.
(3) The Government may waive informalities and minor irregularities in proposals received.
(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.
(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government’s best interest to do so.
(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.
(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.
(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.
(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(i) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.
(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(iv) A summary of the rationale for award.
(v) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

12817318B0003 – This solicitation is a 100 percent Total Small Business Set-Aside. NAICS 238990 $15.0 Million is size standard for small business.
The USDA Forest Service, Apache—Sitgreaves National Forests, Springerville, Arizona, has a requirement for Range Fence Maintenance and Construction on an Indefinite Delivery / Indefinite Quantity (IDIQ) for the Counties of Apache, Coconino/Navajo, and Greenlee in Arizona. The Contracting Officer intends to make multiple awards from this solicitation for a minimum of two (2) IDIQ contracts using Best Value – Tradeoffs evaluation factors.
The minimum guarantee per awarded contract will be $2,000 to satisfy the minimum requirement for life of the awarded contract (3-years). The maximum order limit for all combined awarded contracts awarded under this is $1,000,000. There is no guarantee that task orders will reach the maximum order limit. The Period of Performance for each awarded contract is from March 1, 2018 through September 30, 2021 (subject to appropriated funding approved by Congress). The period of performance for awarded task orders is from contract award date through completion or December 31, 2021.
All of this work is covered under the Davis-Bacon Act, for which the appropriate wage determinations have been incorporated into the solicitation package. This work may require specialized equipment, transports, safety, and tools.
Payment and Performance bonds will be required upon award of task orders $30,000 and over.

Pricing is for life cycle of the contract. Included in the price per mile, for each line item, is Mobilization (sometimes to remote areas).
For Hazard Tree felling: The Government estimates that on average a contractor shall cut dead trees that could fall on the fence, 75 feet out on each side of the fence line. Considering 75 feet on each side of the fence line over 5,280 feet/mile, we estimate approximately 18 acres of hazard tree felling per mile of fence line. ((150 feet x 5,280 feet)/43,560 sq. feet. per acre = 18 acres).
Mile is defined as 5,280 feet in length. All Fence Materials required to be made in USA.

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C1 SCOPE OF WORK:
The USDA Forest Service, Apache—Sitgreaves National Forests, Springerville, Arizona, has a requirement for Range Fence Maintenance and Construction on an Indefinite Delivery / Indefinite Quantity (IDIQ). Awarded Contractor(s) shall provide all supervision, expertise, labor, transportation, equipment, supplies, tools, pack animals, motorized equipment, contractor supplied materials, lodging, and miscellaneous items in accordance with the statement of work for Range Fence Construction.
The minimum guarantee per awarded contract will be $2,000 to satisfy the minimum requirement for life of the awarded contract (3-years). The maximum order limit for all combined awarded contracts awarded under this is $1,000,000. There is no guarantee that task orders will reach the maximum order limit. The Period of Performance for each awarded contract is from March 1, 2018 through September 30, 2021 (subject to appropriated funding approved by Congress). The period of performance for awarded task orders is from contract award date through completion or December 31, 2021.
Mobilization to work sites (sometimes in remote areas) shall be included in the contractors costs based on the price for 1 mile for each line item. Mobilization shall be considered to be within a 150 mile radius west or south of Springerville, AZ.
Contractors are not required to propose an offer for every line time in the Schedule.
C2 BASIS FOR AWARDS
The Government anticipates making a minimum of two (2) awards under IDIQ Multiple Award Schedule (MAS) format. The Government guarantees a minimum of at least one task order of $2,000 for the life cycle of this contract. The Contracting Officer (CO) will make the determination of the competitive range of proposals. Awards will be determined using Best Value
– Tradeoffs evaluation factors (See Section M).
All awarded contractors will be expected to begin performance of the work of task orders within the ten day (10) calendar day window from issuance of Notice-To-Proceed (NTP). Contractors will be required to make Government work the highest priority over other commercial business activities. The contractor shall also furnish all tools, equipment, supervision, transportation, and safety equipment necessary to complete the projects
C3 LOCATION OF PROJECTS
The following zones are established by County for all price and cost related factors, mobilization, and Davis-Bacon Wage Determinations:
Apache County – Alpine Ranger and Springerville Ranger Districts
Navajo/Coconino Counties – Black Mesa and Lakeside Ranger Districts
Greenlee County – Clifton Ranger District and some southern portions of Alpine Ranger District
Task orders (projects) will located within a 150 mile radius west or south of Springerville, AZ, on the Apache-Sitgreaves National Forests. Locations may occur in wilderness areas for which walk-in is required and that require materials to be brought in pack animals.
The elevation could range from approximately 3,500 to 11,000 feet. Terrain can vary from relatively flat to steep and rocky (both loose and solid above and below ground with some areas of bedrock).
Weather conditions can change quickly, particularly during the summer rain period of July, August and September when strong thunder and lightning storms occur. Heavy snowfall is common in the late fall throughout the winter into spring.

Additionally there is the potential for contractors to have to work around timing restrictions for Fire season, Threatened, Endangered, & Sensitive species, sensitive or wet soils.
C4 TECHNICAL SPECIFICATIONS
AGAR 452.211-72 Statement Of Work/Specifications (FEB 1988)
C4.1 [B1.0] FENCE RIGHT-OF-WAY CLEARING AND HAZARD TREE FELLING
The right of way will be 8 feet, with 4 feet on each side of the fence. The right of way shall be: cleared of all dead trees, cleared of all live trees less than 5 inches DBH, brushed out with slash and logs removed from 4 feet on either side of the fence line.
• Fence Right of Way Clearing in Primitive areas o The area to be cleared will total 12 feet, measuring 4 feet on one side and 8 on the other. Based on terrain and management objectives, FS personnel will determine which side of the fence receives the larger clearing on a fence by fence basis.
o Only primitive tools may be used.
o Pines and mixed-conifers in all vegetation types will be removed according to the following criteria:
Live trees less than 5 inches DBH (Diameter Breast Height) will be removed.
Any dead trees within the right-of-way will be removed (A tree is considered dead if less than 10 percent of the canopy foliage is green).
o No stump shall be taller than 6 inches, and hazardous stumps shall be flush cut (parallel to the ground). All stumps shall be flush cut where the right-of-way comes against NF System Trails.
o All low branches within the 12 feet right-of-way will be removed. Ground vegetation will be left intact.
o A finished right-of-way shall be free of brush and all cut trees, and all cut materials shall be scattered
15 to 20 feet outside the right-of-way and away from established trails and drainages.
• Hazard Tree Felling (High density)(B1.3) Outside of the 8 feet right of way, all dead trees that could fall on the fence* shall be cut. A tree will be considered dead if: see attachment A. High density areas could have anywhere from 75-100 percent tree mortality and 250 or more dead trees per acre**.
• Hazard Tree Felling (Moderate density)(B1.4) Outside of the 8 feet right of way, all dead trees that could fall on the fence* shall be cut. A tree will be considered dead if moderate density could have anywhere from 25-75 percent tree mortality and approximately 100-250 dead trees per acre**.
• Hazard Tree Felling (Low density)(B1.5) Outside of the 8 feet right of way, all dead trees that could fall on the fence* shall be cut. A tree will be considered dead if low density could have anywhere from 0-25 percent tree mortality and approximately 0-100 dead trees per acre**.
*The Government estimates that on average a contractor shall cut dead trees that could fall on the fence, 75 feet out on each side of the fence line. Considering 75 feet on each side of the fence line over 5,280 feet/mile, we estimate approximately 18 acres of hazard tree felling per mile of fence line. ((150 feet x 5,280 feet)/43,560 sq. feet. per acre=18 acres)
**The density of trees per acre is just an estimate and could vary from project to project, within each individual project, and by tree species.

C4.2 [B2.0] EXISTING FENCE—MAINTENANCE ROUTINE
This could be considered annual maintenance needed to maintain the functionality of a fence such as cutting trees of the fence that have fallen over the winter, fixing the broken wires, replacing broken or missing stays and posts, and tightening sagging wires from snowload and wildlife crossing.
• 3 & 4 Strand Fence specifications (two separate line items) o Government supplied & contractor supplied materials (two separate line items)
C4.3 [B3.0] HEAVY FENCE MAINTENANCE
This would be a fence that is not old enough or in disrepair enough to replace but that has not been maintained for some time and will require cutting several trees off the fence, splicing several broken wires, replacing several stays and posts and possibly some braces, and tightening the fence up.
C4.4 [B4.0] FENCE ROLL UP AND REMOVAL
• Fence Removal Roll up and removal of old fence materials. Wooden portions of the fence such as wood stays may be scattered away from the fence line. Wire, metal stays, and bent or broken t-post will be removed and disposed of as dictated by the Forest Service. Re-use of removed materials is prohibited to prevent to prevent soil contamination from one type of area to another.
• Fence Removal from Remote or Primitive areas Roll up and removal of old fence materials using primitive tools and pack animals. Wooden portions of the fence such as wood stays may be scattered away from the fence line. All wire, metal stays, and bent or broken t-post will be removed and properly disposed as dictated by the Contracting Officer. Re-use of removed materials is prohibited to prevent to prevent soil contamination from one area to another.
C4.5 [B5.0] NEW FENCE CONSTRUCTION
The Forest Service will provide the following fence materials: barbed wire, smooth wire, steel brace posts and down braces plus hardware, wood or metal stays, stay wire, and fence clips. Contractor will provide concrete for the steel brace post holes and down brace holes. The contractor will also provide any other miscellaneous materials needed. All Forest Service provided fence materials will be issued to the contractor by Forest Service personnel. Materials become the responsibility of the contractor after issue and will need to be replaced by the contractor if they are lost or stolen. Any material left over after completion of the project will be returned to the Forest Service personnel that issued the material.
• Government supplied & contractor supplied materials (two separate line items)
• Metal line T-posts will have 48 inches remaining above ground. Straddle jack braces and/or rock crib/wire crib/ or rock drill may be used, where it is not possible to dig or drive posts. Contractor will provide rock drill, straddle jacks and rock/ wire/wood cribs if needed.
• Wire spacing will be determined on a project by project basis. In some areas more wires may need to be added to achieve the desired bottom or top wire height. Weights will be attached to fence in low spots to prevent lift up of t-posts. All wires shall be tight.
• Line post spacing will typically be 20 feet (but could vary some dependent upon terrain, etc.) with three stays (stay material determined on a project by project basis) evenly spaced between and secured to each barbed wire strand. The stays must be perpendicular to barbed wire. The spacing of T-posts shall not be greater than specified in each task order but may be closer to maintain the specified bottom wire distance to the ground or the specified top wire height.

• Stretch braces will be installed at the end of each quarter mile as a minimum. Additional braces will be needed as dictated by terrain or fence direction changes. All stretch, angle and corner center brace posts shall be in the ground a minimum of 36 inches in depth and shall be solidly placed (i.e. no movement) with a 12 inch diameter concrete footing and will consist of a center 7 foot post and( 2) 7 foot downbraces. All downbrace ends will be in the ground with a 1 feet x 1 feet x 1 feet 6 inch concrete footing. All braces not 180 degrees (straight in line) with the fence, shall either have a counter weight or a third downbrace installed to prevent the brace posts from being pulled out of the ground. (Number of braces needed and brace material (wood or metal) will vary by project)
• Watergaps will be needed in areas where water gaps currently exist in old fence or in areas that have high flows. The watergap will consist of a break – away fence from the steel braces (braces shall be installed on both sides of the wash). (Number of watergaps needed will vary for each project).
• No trees (live or dead) will be substituted for posts in the construction of the fence. No wire shall be attached directly to a tree.
• Gates will be installed at each road crossing and on one side of cattleguards. Gates shall be 16 feet wide at roads. Additional gates for livestock/ATV movement will be 12 feet wide. All gates will be built as 4 strand wire gates with stays. (Number of gates will vary for each project but typically average 2 gates per mile).
C4.6 [B6.0] NEW FENCE CONSTRUCTION IN REMOTE AREAS
Specifications will remain the same as listed above for New Fence Construction, however fence construction in these areas may require a contractor to pack equipment and materials to the fence site by pack animals.
C4.7 [B7.0] NEW FENCE CONSTRUCTION IN PRIMITIVE/WILDERNESS AREAS WITH PRIMITIVE TOOLS
Specifications will remain the same as listed above for New Fence Construction, however fence construction in these areas will require the contractor to utilize pack animals and primitive tools (non-motorized).
C4.8 [B8.0] ELK EXCLOSURE FENCING WITH CARBON STEEL PIPE BRACE POSTS
• Carbon Steel Pipe and Treated Wood Post fence specifications (two separate line items) o Government supplied & contractor supplied materials (two separate line items) (B8.1, B8.2, B8.3, B8.4)
Construction Sequence and Procedures -Perform Right-of-Way Clearing and Hazard Tree Felling as specified previously, if required in the task order.
- Braces shall be located at all corners and gates.
-An access gate will be installed at each exclosure location, located where specified in the task order. This will include both a walk thru and a swinging vehicle access gate (swinging vehicle access gate will be 10 feet wide and can be made out of smaller diameter 1½ inch pipe). Walk thru gate will allow an average person to pass through (3 feet opening) but prevent ungulate animals from passing)
- Assuming the fence material is 330 feet long, stretch braces should be installed a minimum of 165 feet apart (half way) to maintain structural integrity throughout the length of the fence.
-Concrete set brace posts: Drill holes in firm, undisturbed or compacted soil. Set posts 48inch below surface, deeper if necessary in soft or loose soil. Pour concrete around posts. All stretch and corner brace posts shall have a minimum of a 12 inch diameter concrete footing.

-Weld horizontal braces between uprights with a bead around entire end of pipe where it attaches to upright.
-T-post shall be 10 feet long and spaced 10 feet apart. The T-post should be driven into the ground ensuring that the spade is at least 6inch below the ground level and the post should be perpendicular to level ground. All posts shall be vertically aligned on sloped ground.
-Install 8 feet field fence.
• Two panels of fencing, shorter than 8feet, may be used for ease of handling as long as the fence is 8feet tall and the two panels of fencing overlap each other by at least 4 inch. Bottom panel should touch the ground.
Bottom panel will be placed so that the smaller mesh is closest to the ground. The field fence will be securely attached to all steel and wooden post using appropriate fastening materials (such as 14 gauge galvanized tie wire or metal post clips. Attach the top and bottom panels of the field fence to each other and to posts (hog rings or wire tie).
- T-post clips will be used to attach the field fence to the T-post.
- 8-foot long re-bar should be installed between the T-posts. The re-bar shall be weaved through the field fence and secured (tie wire).
- No trees (live or dead) will be substituted for posts in fence construction or reconstruction/repair. No wire shall be attached directly or indirectly to any tree.
-Water gaps will be needed in areas of high flow, to allow water flow, and prevent ungulates from entering.
-When working in a wet meadow environment use management practices that will protect sensitive soils and water (see Section H).
-Clean up debris and unused materials, and remove from site.

Hazard Tree Abatement Specifications for Fence Construction.
A. The following criteria will be used first for determining to cut a hazard tree for all species.
1. All standing or leaning dead trees, with no green needles or leaves present, which have the potential to fall on the new fence shall be felled prior to construction of the new fence. Broadleaf trees (aspen, oak, willow, etc.) which have shed their leaves for winter but are still alive will have fresh buds set on the branch tips.
2. If less than 15 percent of live crown remains.
B. The following specific criteria will be used second for determining to cut a hazard tree of particular species.

1. Ponderosa Pine & Douglas Fir:
o If severe fire damage to bark is visible on 3 or more faces, and any of the remaining crown is now fading in color from green to tan red, or brown on the entire branch (not just on a portion of each branch which is normal fall needle-cast).
2. Aspen, Corkbark Fir, White Fir, White Pine, & all Spruces:
o If the tree has fire blackened bark around the entire circumference, boles so scorched that sapwood is exposed, loose bark is sloughing off.
SECTION D - PACKAGING AND MARKING
For purposes of this solicitation and any subsequent awards:

Stays
• Wood Stays o Width & thickness shall be at a minimum 1.75 inches x 1.75 inches up to a maximum 2 inches x 2 inches, with flat edges/sides. The length shall be 48 inches exact.
o Species for wood stays shall be Ponderosa pine, Fir, Juniper or Spruce.
• Metal Stays o OK Brand equivalent specifications for metal fence stays. 9.5 gauge, Class I galvanized coated wire. Length will generally be 36inch but could vary slightly by project.
Barbed Wire
• OK Brand equivalent specifications for Barbed Wire. 2 point Select, Class I, 5inch barb spacing, 12.5 gauge, 1320 feet rolls, approximately 78 lbs. Made in the USA.
Barbless Wire
• OK Brand equivalent specifications for Barbless Wire. Barbless Premium, Class I, 12.5 gauge, 1320 feet rolls, approximately 70 lbs. Made in the USA.
Tie Wire
• 14 gauge galvanized
T-post
• ATSM spec. 1.33 heavy with green paint. Length will generally be 6 feet but could vary slightly by project. Length will be 10 feet for elk exclosure fence.

SECTION E - INSPECTION AND ACCEPTANCE
52.246-12 INSPECTION OF CONSTRUCTION (AUG 1996)
(a) Definition. Work includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.
(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.
(c) Government inspections and tests are for the sole benefit of the Government and do not—
(1) Relieve the Contractor of responsibility for providing adequate quality control measures;
(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;
(3) Constitute or imply acceptance; or
(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.
(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officerfeets written authorization.
(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes re-inspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.
(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.
(g) If the Contractor does not promptly replace or correct rejected work, the Government may—
(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or
(2) Terminate for default the Contractor’s right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.
(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Governmentfeets rights under any warranty or guarantee.

52.246-13 INSPECTION—DISMANTLING, DEMOLITION, OR REMOVAL OF IMPROVEMENTS (AUG 1996)
(a) Unless otherwise designated by the specifications, all workmanship performed under the contract is subject to
Government inspection at all times and places where dismantling or demolition work is being performed. The Contractor shall furnish promptly, and at no increase in contract price, all reasonable facilities, labor, and materials necessary for safe and convenient inspection by the Government. The Government shall perform inspections in a manner that will not unduly delay the work.
(b) The Contractor is responsible for damage to property caused by defective workmanship. The Contractor shall promptly segregate and remove from the premises any unsatisfactory facilities, materials, and equipment used in contract performance, and promptly replaces them with satisfactory items. If the Contractor fails to proceed at once in a workmanlike manner with performance of the work or with the correction of defective workmanship, the Government may—
(1) By contract or otherwise, replace the facilities, materials, and equipment or correct the workmanship and charge the cost to the Contractor; and
(2) Terminate for default the Contractor’s right to proceed. The Contractor and any surety shall be liable, to the extent specified in the contract for any damage or cost of repair or replacement.

52.246-21 WARRANTY OF CONSTRUCTION (MAR 1994)
(a) In addition to any other warranties in this contract, the Contractor warrants, except as provided in paragraph (i) of this clause, that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier.
(b) This warranty shall continue for a period of 1 year from the date of final acceptance of the work. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of 1 year from the date the Government takes possession.
(c) The Contractor shall remedy at the Contractor’s expense any failure to conform, or any defect. In addition, the Contractor shall remedy at the Contractor’s expense any damage to Government-owned or controlled real or personal property, when that damage is the result of—
(1) The Contractor’s failure to conform to contract requirements; or
(2) Any defect of equipment, material, workmanship, or design furnished.

(d) The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause. The Contractor’s warranty with respect to work repaired or replaced will run for 1 year from the date of repair or replacement.
(e) The Contracting Officer shall notify the Contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage.
(f) If the Contractor fails to remedy any failure, defect, or damage within a reasonable time after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the Contractor’s expense.
(g) With respect to all warranties, express or implied, from subcontractors, manufacturers, or suppliers for work performed and materials furnished under this contract, the Contractor shall—
(1) Obtain all warranties that would be given in normal commercial practice;
(2) Require all warranties to be executed, in writing, for the benefit of the Government, if directed by the Contracting
Officer; and
(3) Enforce all warranties for the benefit of the Government, if directed by the Contracting Officer.
(h) In the event the Contractor’s warranty under paragraph (b) of this clause has expired, the Government may bring suit at its expense to enforce a subcontractor’s, manufacturers, or supplier’s warranty.
