SECTION 1 – GENERAL

STATEMENT OF WORK

Coconino National Forest – Mogollon Rim Ranger District Road Maintenance

GENERAL INFORMATION

The contractor shall provide all materials, labor, equipment, tools, transportation, supervision, expertise, and other incidentals necessary, except as otherwise provided, to successfully perform road maintenance services on National Forest roads. This work includes, but is not limited to, grading aggregate and native material roads, cleaning and reshaping ditches, cleaning and reshaping wing and leadoff ditches, and equipment rental.

PERFORMANCE STATEMENT OF WORK (PWS)

SECTION I – GENERAL

SCOPE OF WORK.

The contractor shall provide any and all labor, equipment, supervision, transportation, services, permits, and licenses necessary to provide road maintenance services on an as-needed basis, within the Mogollon Rim Ranger District of the Coconino National Forest.

LOCATION DESCRIPTION

Roads scheduled for maintenance are located within the Mogollon Rim Ranger District of the Coconino National Forest, in the southeast section of the Forest.

See attached drawings for general locations.

These roads are located on flat to steep, mountainous terrain varying from low-speed, narrow, winding single lane roads to double lane traffic facilities. Road conditions vary from native materials to aggregate surfacing, and hard/solid rock.

1.1 CONTRACTOR REPRESENTATIVE.

The contractor shall provide a contract representative throughout the performance of the contract. The name of this person and any alternate(s) who shall act for the contractor when the contractor is absent shall be designated in writing to the Contracting Officer.

The contractor representative or alternate shall have full authority to act for the contractor on all contract matters relating to the daily operation of this contract. The contractor representative and alternate(s) must be able to read, write, speak, and understand English.

1.2 ORDERING SERVICES.

The contractor shall begin work within 10 calendar days after issuance of a task order or as specified on the task order, whichever is later. Contract times will be 180 days and will be strictly enforced to ensure road maintenance is not repeated unnecessarily and be completed within seasonal and federal restrictions. Contract time will only be extended as authorized by the Contracting Officer.

1.3 TASK ORDER PROGRESS SCHEDULES.

Contractor shall provide a time chart or schedule of proposed progress prior to commencement of work on each task order. This will ensure that work is planned to be completed within the contract time allowed. If the contractor’s progress falls behind schedule, the contractor shall take such action as necessary to improve progress. The contracting officer may require the contractor to submit a revised schedule and proposed plan of work.

1.4 PUBLIC SAFETY

a. Contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient warning lights, danger signals, and warning signs and furnish all necessary traffic control flagging. All necessary precautions shall be taken for the protection of the work and safety of the public. All signs and devices remain the property and responsibility of the Contractor. All signing shall conform to current MUTCD standards.

b. Warning signs shall be positioned in such locations as to be readily visible, and the work area defined to the traveling public. Signs shall be located no more than one mile in advance of any activity. Signs shall be posted only when the machinery is working.

c. Berms of materials or other obstructions caused by maintenance operations shall be removed prior to the end of each day’s operations and are not to remain overnight, weekends, and holidays. If, due to weather conditions or equipment breakdowns, berms or obstructions cannot be removed, they shall be signed as a hazard and visibly illuminated at night.

d. Vehicular traffic shall not be obstructed for periods in excess of twenty (30) minutes.

e. Work of an extraordinary nature, which will interfere with the safe use of the roadway, shall not begin until an acceptable traffic control plan has been approved by the Forest Service.

1.5 PROTECTION OF PROPERTY AND UTILITIES.

Public and private property along and adjacent to the project shall not be damaged. Any damaged or destroyed property shall be promptly repaired or replaced at the contractor’s expense. When operating adjacent to railways, telegraph, telephone, or power lines, the contractor shall make all necessary arrangements to prevent damage and shall assume all responsibilities should any damage occur. It is the contractor’s responsibility to contact the relevant property owner and have the work area marked or staked by Arizona 811.

1.6 CONTROL OF SEDIMENTATION AND POLLUTION.

Contractor’s operation shall be conducted so as to prevent siltation of streambeds, lakes, stock tanks, or reservoirs. Pollutants such as fuels, lubricants, bitumen, and any other harmful material shall Not be discharged on Forest Service lands. Mechanized equipment shall not be operated outside of the existing roadway prism without prior archaeological survey and clearance. Any spills will be reported the Contracting Officer’s Representative, or Contracting Officer, as well any required emergency services immediately upon discovery. The contractor shall take immediate steps upon discovery to contain, control, and clean the spill as required or allowed by Local, State, and Federal guidelines.

SECTION II – DEFINITIONS

2.1 STANDARD DEFINITIONS.

2.1.1 ACCEPTABLE QUALITY LEVEL (AQL). The maximum allowable deviation from perfect performance that may occur before the Government will invoke payment deduction. An AQL does not allow a contractor knowingly to offer defective service, but limits reduced payment to circumstances in which defective performance results in a measurable reduction in the value of services rendered.

2.1.2 DEFECTIVE SERVICE. A unit of service which contains one or more defects, or nonconformance with specified requirements.

2.1.3 PERFORMANCE REQUIREMENTS SUMMARY (PRS). Identifies the key service outputs of the contract that will be evaluated by the Government to assure contract performance standards are met by the contractor.

2.1.4 QUALITY ASSURANCE. Those actions taken by the Government to assure services meet the requirements of the Performance Work Statement (PWS).

2.1.5 CONTRACTING OFFICER’S REPRESENTATIVE (COR). A Government person appointed by the contracting officer to help the contracting officer with contract administration and surveillance.

2.1.6 GOVERNMENT INSPECTOR. A Government person responsible for surveillance of contractor performance.

2.1.7 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document used for quality assurance surveillance. The document contains specific methods the Government will use to perform surveillance of the contractor.

2.1.8 QUALITY CONTROL. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the PWS.

2.2 TECHNICAL DEFINITIONS.

2.2.1 MAINTENANCE LEVEL DEFINITIONS.

a. Maintenance Level 3: Roads open and maintained for travel by a prudent driver in a standard passenger car. User comfort and convenience are not considered priorities.

Typically these roads are low-speed, single-lane with turnouts and native or aggregate surfacing. The road surface is maintained to provide the passage of low-clearance vehicles (i.e., passenger cars). MUTCD is applicable.

b. Maintenance Level 2: Roads open for use by high-clearance vehicles. Passenger car traffic is discouraged, and the surface is not maintained for this use. Traffic is minor administrative, permitted, or dispersed recreation. Surface maintenance is performed only for purposes of drainage control. Maintenance is normally performed by a dozer rather than a motor grader, although either may be used.

SECTION 3 – PROJECT ADMINISTRATION

3.01 ADMINISTRATION

A. Pre-Bid meeting shall be by request. No formal meeting is scheduled.

B. Kick-off Meeting. Upon receipt of a written Notice to Proceed from the contracting officer, contractor shall conduct a kick-off meeting with the Forest Service to review the scope of the project, develop a project schedule, and confirm deliverables.

The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work/Specifications referenced in Section J.

52.246-1 Contractor Inspection Requirements. (APR 1984)

52.246-4 INSPECTION OF SERVICES-FIXED-PRICE (AUG 1996)

(a) Definition."Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract.

The Government shall perform inspections and tests in a manner that will not unduly delay the work.

(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may-

(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and

(2) Reduce the contract price to reflect the reduced value of the services performed.

(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may-

(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or

(2) Terminate the contract for default.

52.252-2 Clauses Incorporated by Reference. (FEB 1998)

52.211-10 Commencement, Prosecution, and Completion of Work. (APR 1984)

The Contractor shall be required to (a) commence work under this contract within ten

(10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than two hundred and ten (180) calendar days after the date the contractor receives the notice to proceed. The time stated for completion shall include final cleanup of the premises.

52.204-7 System for Award Management. (OCT 2018)

(a) Definitions. As used in this provision-

Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that-

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in

SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record “Active”.

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b)(1) An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the Offeror’s name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in SAM.

© If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:

52.204-9 Personal Identity Verification of Contractor Personnel. (JAN 2011)

(a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24, and Federal Information Processing Standards Publication (FIPS PUB) Number 201.

(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:

(1) When no longer needed for contract performance.

(2) Upon completion of the Contractor employee’s employment.

(3) Upon contract completion or termination.

© The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.

(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor’s employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.

(a) Definition. Small business concern, as used in this clause-

(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless-

(1) The product cannot be acquired-

(i) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3©). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(i) Spacecraft system and launch support equipment.

(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(a) The Government shall make all reasonably required amounts of utilities available to the Contractor from existing outlets and supplies, as specified in the contract. Unless otherwise provided in the contract, the amount of each utility

(b) The Contractor, at its expense and in a workmanlike manner satisfactory to the Contracting Officer, shall install and maintain all necessary temporary connections and distribution lines, and all meters required to measure the amount of each utility used for the purpose of determining charges. Before final acceptance of the work by the Government, the Contractor shall remove all the temporary connections, distribution lines, meters, and associated paraphernalia.

Commercial item and commercially available off-the-shelf item have the meanings contained in Federal Acquisition Regulation (FAR)2.101.

(a) Contractor’s Responsibility for Fire Fighting. (1) The Contractor, under the provisions of FAR clause 52.236-9, PROTECTION OF EXISTING

VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND

IMPROVEMENTS, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work.
