UNIT: KAIBAB NATIONAL FOREST

PROJECT: FOREST ROADS MAINTENANCE

1. Introduction. USDA Forest Service, Kaibab National Forest, has a requirement for Road Maintenance performance-based services requested herein.

2. Type of Award. As a result of this solicitation, Government anticipates awarding a Firm Fixed-Price contract for the services.

3. Submission of Offers. Contractors are encouraged to thoroughly review the Request For Quotes (RFQ) and submit any interested offers (completed Schedule of Items, Vendor Information Page, and Reps & Certs) on or before August 19, 2021, 1600 Pacific Daylight Time, via email to: warren.abbott@usda.gov .

Offerors shall submit (completed) as part of their offer, before the deadline:

• Solicitation pages 1-2, SF18 and Schedule of Items;

• Section K – Representations and Certifications;

• Section M documentation as required;

The remainder of the solicitation document is informational for the Offeror.

4. Basis for award. Section M. Evaluation will be based on best-value principles. Submit with your offer your firm’s technical capability statement along with past performance.

SECTION C—PERFORMANCE WORK STATEMENT

C.1 SCOPE OF WORK

The contractor shall provide all materials, labor, equipment, tools, transportation, supervision, expertise, and other incidentals necessary, except as otherwise provided, to successfully perform road maintenance services on Kaibab National Forest. Work consists of grading aggregate surfaced roads, clean and reshape roadside ditches, clean and reshape wing and leadoff ditches.

The government intends to award Firm Fixed-Price contract for services from this solicitation. Award will be made based on Best Value—Tradeoffs in FAR Part 15.

SECTION D--PACKAGING AND MARKING

D-1 PACKING AND MARKING

All shipments of materials, equipment and/or supplies shall be addressed to the Contractor and not to the Government.

D-2 PROJECT LABELING FOR OFFICIAL COORESPONDENCE

The Government singularly identifies each project with a contract number at time of award. The contract number is a unique identifier to purposely and permanently represent an awarded project. The Government issued contract number is to be referenced on all official communication starting upon notice of award.

SECTION E--INSPECTION AND ACCEPTANCE

E.1 CLAUSES

52.246-4 INSPECTION OF SERVICES-FIXED-PRICE (AUG 1996)

(a) Definition. “Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may-

(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and

(2) Reduce the contract price to reflect the reduced value of the services performed.

(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may-

(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the

Government that is directly related to the performance of such service; or

(2) Terminate the contract for default.

SECTION G--CONTRACT ADMINISTRATION DATA

G.1 CLAUSES

452.215-73 POST AWARD CONFERENCE (NOV 1996)

A post award conference with the successful offeror is required. It will be scheduled and held within 30 calendar days after the date of contract award. The conference will be held at to be determined.

GOVERNMENT FURNISHED ITEMS/SERVICES

Access to National Forest Road System (NFSR) to perform maintenance services as described herein.

CONTRACTOR FURNISHED ITEMS/SERVICES

Contractor’s equipment provided for the performance of the work shall be of the appropriate size, type, and number, and in good working condition, suitable for the work required. Operators shall be competent and experienced in the operation of the equipment. Equipment shall have safety signing and appurtenances required by OSHA, such as rollover protection (ROPS), fire suppression devices, lights and slow-moving vehicle signs. The equipment used for blading shall be a diesel, tandem drive motor patrol of at least 150 horsepower. Grading equipment must be capable of cutting, crowning, and shaping operations necessary to successfully perform the tasks of this contract. The contractor’s equipment shall be made available for inspection, prior to notice to proceed. If at any time during the course of this contract, the equipment is deemed unsatisfactory or unsafe, the Contracting Officer may require removal and a satisfactory replacement at no expense to the Government. Any movement or transportation of equipment to or from work areas, to repair or replace equipment, or for the contractor’s convenience shall be at the contractor’s expense.

The contractor shall furnish all equipment/personnel as required by the Fire Plan(s) (See Section J – List of Attachments).

PAYMENTS WILL BE PROCESSED IN THE INVOICE PROCESSING PLATFORM – REFERRED TO AS IPP.

OUTSIDE OF IPP, THE ITEMIZED INVOICE SUBMITTED TO THE COR, SHALL MIRROR THE SCHEDULE OF ITEMS AND SHALL

INCLUDE AT A MINIMUM:

Contractor Name, Address, Phone Number and e-mail address Contract and Task Order Numbers Invoice Number Description and date of services or work completed.

Final Payment - Following completion and acceptance of the work (including return of Government-furnished property and site cleanup), Final payment will made within 30 calendar days after presentation of a properly executed invoice.

CONTRACTOR NOTIFICATION & RELEASE OF CLAIMS FOR FINAL PAYMENT

Upon completion and acceptance of all work, a notification and release of all claims form shall be completed by the contractor and submitted to the CO for the contract file.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H.1 CLAUSES

452.237-74 KEY PERSONNEL (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: __________________

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer.

Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions.

The contract will be modified to reflect any approved changes of key personnel.

FIRE PREVENTION AND CONTROL.

The contractor shall, both independently and in cooperation with the Forest Service, take all reasonable and practicable action to prevent and suppress fires in the project area using all necessary personnel and equipment at Contractor’s disposal on the site.

The Fire Plan outlines the Contractor’s responsibilities for fire prevention and suppression activities within the Contractor’s project area. For the purposes of this provision, the project area is defined as the area within one half mile (0.5 miles) of the project boundary. See Section J Emergency Control - Fire Plan Attachment.

SAFETY PLAN

When required the Contractor shall prepare a Safety Plan which addresses the specific hazards of the work site, and shall include working in areas of dead trees and falling debris. The Contractor shall identify the specific conditions that s/he considers is a hazard.

The Safety Plan shall also address the personal protective equipment and mitigating measures the Contractor will do to increase safety on the worksite. The Safety Plan should also include safety hazards and mitigation while working in areas of bear habitats.

The Safety Plan should be updated with pertinent information when a task order is issued. Pertinent information may include location of local emergency care facilities, contact information for employees should an accident occur at the worksite, etc.

A copy of the Safety Plan shall be submitted to the Contracting Officer for the contract file. The Contractor’s Safety Plan is neither approved nor disapproved by the government but will be provided to OSHA when requested.

CAMPING PERMITS.

The Contractor does/does not intend to camp on National Forest lands. Forest Service permits, issued by the District Ranger, will specify restrictions regarding campsite and sanitary provisions. Combustible refuse, resulting from lunches, etc., may be burned if authorized. All noncombustible materials, cans, bottles, etc., shall be removed from Forest land.

NOXIOUS WEEDS.

The contractor shall ensure that prior to moving on to the National Forest all equipment is free of soil, seeds, vegetative matter, or other debris that could contain or hold seeds. The contractor shall employ whatever cleaning methods are necessary to ensure that equipment is free of noxious weeds. The contractor shall provide the Contacting Officer with certification, in writing, that all equipment is free of noxious weeds prior to start-up of operations. Equipment shall be considered free of soil, seeds, and other such debris when a visual inspection by the Government does not disclose such material.

Disassembly of equipment components or specialized inspection tools is not required. Unless otherwise directed by the CO, the Government will not require the contractor’s equipment to be cleaned before moving to another treatment unit if the contractor is moving directly from one contract unit to another.

PUBLIC SAFETY

a. Contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient warning lights, danger signals, and warning signs and furnish all necessary traffic control flagging. All necessary precautions shall be taken for the protection of the work and safety of the public. All signs and devices remain the property and responsibility of the Contractor. All signing shall conform to current MUTCD standards.

b. Warning signs shall be positioned in such locations as to be readily visible and the work area defined to the traveling public.

Signs shall be located no more than one mile in advance of any activity. Signs shall be posted only when the machinery is working.

c. Berms of materials or other obstructions caused by maintenance operations shall be removed prior to the end of each day’s operations and are not to remain overnight, weekends, and holidays. If, due to weather conditions or equipment breakdowns, berms or obstructions cannot be removed, they shall be signed as a hazard and visibly illuminated at night.

d. Vehicular traffic shall not be obstructed for periods in excess of twenty (20) minutes.

e. Work of an extraordinary nature, which will interfere with the safe use of the roadway, shall not begin until an acceptable traffic control plan has been approved by the Forest Service.

PROTECTION OF PROPERTY AND UTILITIES.

Public and private property along and adjacent to the project shall not be damaged. Any damaged or destroyed property shall be promptly repaired or replaced at the contractor’s expense. When operating adjacent to railways, telegraph, telephone, or power lines, the contractor shall make all necessary arrangements to prevent damage and shall assume all responsibilities should any damage occur.

CONTROL OF SEDIMENTATION AND POLLUTION

Contractor’s operation shall be conducted so as to prevent siltation of streambeds, lakes, stock tanks, or reservoirs.

Pollutants such as fuels, lubricants, bitumen, and any other harmful material shall Not be discharged on Forest Service lands.

Mechanized equipment shall not be operated outside of the existing roadway prism without prior archaeological survey and clearance.

Water supply may be very limited in remote stretches of the service area. Other private sources may be available in the area, but not guaranteed. The Forest Service areas, under this RFP, shall be considered not having a viable water source.

(a) Definitions. As used in this provision— “Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. Registered in the System for Award Management (SAM) means that–

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record “Active”.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor.

As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
