STATEMENT OF WORK

Residue Analytical Method Development, Residue Storage Stability Testing, and Residues in Meat Testing of Sodium Nitrite.

INTRODUCTION

Within the next few years, USDA APHIS will be submitting a pesticide registration application to the US EPA under Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA; 7 USC 136) Section 3 for a product containing the unregistered active ingredient, sodium nitrite, for controlling feral swine. EPA has classified this pesticide product for feral swine as having a terrestrial food use pattern (40 CFR 158). All of the applicable data requirements listed in 40 CFR 158 for a terrestrial food use product application must be met and included in USDA APHIS’ application before EPA will initiate a review.

These data requirements provide the residue data for the unregistered active ingredient, sodium nitrite upon which judgments are made by EPA as to the identity and magnitude of residues resulting from the proposed use, and they must provide a means for enforcement of the tolerance if granted. The meat residue study will be conducted in pigs. The analytical method development, and storage stability studies will all be conducted using pig tissues. All testing and submissions will follow the requirements of OPPTS guidelines 860.1340 (1), 860.1380 (2) and 860.1480 (3) (40 CFR 158, Subpart F). The independent laboratory validation (ILV) of the developed method as described in OPPTS 860.1340 (1) is not a requirement of this statement of work (SOW). These studies must also be conducted following EPA FIFRA regulatory requirements for Good Laboratory Practice Standards (GLPs; 40 CFR 160) (4).

DEFINITIONS

a. Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA): The federal pesticide regulation legislation (7 USC 136).

b. U.S. Environmental Protection Agency (EPA): The federal regulatory agency responsible for the regulation of pesticides including pesticide product registration under FIFRA.

c. Unregistered active ingredient: An active ingredient is “…an ingredient which will prevent, destroy, repel, or mitigate any pest” (7 USC 136(a) (1)). An active ingredient is unregistered when it is not already an active ingredient within currently-registered pesticide products.

d. Good Laboratory Practices (GLP): The set of organizational processes and the conditions under which non-clinical health and environmental safety studies are planned, performed, monitored, recorded, archived and reported intended to assure the quality and integrity of non-clinical laboratory studies intended to support research or marketing permits for products regulated by government agencies including the EPA (40 CFR 160) (4).

PURPOSE

The purpose of this requisition is to fulfill three of the data requirements for a future USDA APHIS pesticide registration application to EPA for a toxicant for feral swine containing sodium nitrite. These studies will 1) develop an analytical method to measure nitrite residues in pig tissues, 2) evaluate the storage stability of residues in pig tissues, 3) conduct a dosing study of sodium nitrite in pigs to determine nitrite residues in meat when administered sodium nitrite orally. These studies will be conducted in accordance with EPA OPPTS guidelines 860.1340, 860.1380 and 860.1480, and EPA FIFRA GLP requirements.

SCOPE OF WORK

The scope of this contract will include drafting a study protocol, laboratory testing, data analysis, final report writing, and quality assurance reviews for each study in accordance with EPA OPPTS guidelines 860.1340, 860.1380 and 860.1480, and EPA FIFRA GLP requirements.

(h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals--

(1) [_] Are, [_] are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) [_] Have, [_] have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; and

(3) [_] Are, [_] are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) [_] Have, [_] have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
