PART I – Continued

SCHEDULE NOTES

• The contractor shall provide a firm fixed price per gallon for the delivered product of DowDuPont nematicide Telone II (1, 3-dichloropropene 97.5 %, inert ingredients 2.5 %) for the USDA, APHIS.

• Shipping and delivery is FOB destination; therefore, delivery of the item must be included in the price for the line item as well as all overheard and material costs to deliver the items to the various fields in Bingham and Bonneville Counties in Idaho where the fumigation services will be performed. All the fields to be treated are within an 8 ½ mile radius.

• The selected contractor must be able to provide the entire quantity of Telone. According to the DOWDuPont Representative Andrew Kaler, he stated the Telone II DowDuPoint provides the vendor for this award would be separate from their current or regular allocation.

• Because the vendors selling this product are distributors, in accordance with FAR 19.102 and

13 CFR 121.406, this solicitation is being issued as a full and open competition. There is not a nonmanufacturer class waiver for this type of product. The NAICS Code is 325320 with a size standard of 1,000 employees.

• This is a brand name request. See Attachment One entitled "Attachment One – Brand Name

Justification and Approval" for this brand name request.

This Request for Quote for commercial items is being conducted in accordance with FAR Subpart 13.5 test program procedures for commercial items. Simplified acquisition procedures will be followed.

This solicitation will result in a firm fixed price commercial supply contract.

In order to be considered for this contract the Contractor must submit the following:

• A firm fixed price quote showing the price for line item 001.

• The required documentation requested below on page 2 in the section entitled EVALUATION OF QUOTES, which includes information that addresses the technical evaluation factors to verify your company’s ability to provide the product described in the Specifications.

• Paragraph (b) of the provision 52.212-3, Offeror Representations and Certifications- Commercial Items if you have completed the annual representations and certification electronically via the System for Award Management (SAM) Website located at

• PLEASE DO NOT INCLUDE A COPY OF THE SOLICTIATION WITH YOUR QUOTE

PACKAGE. You need only reference the solicitation number in your submission.

If the Contractor’s quote does not contain all of the items listed above, the quote may be considered incomplete for evaluation purposes and no further consideration will be given to the Contractor’s quote, thereby making the quote ineligible for award.

EVALUATION OF QUOTES

The Government will award a contract in accordance with FAR part 13.106-1 and 13.106-2 resulting from this solicitation to the responsible contractor whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

Award will be made to the lowest priced technically acceptable quote meeting or exceeding the technical evaluation factors listed in this Request for Quote/solicitation which are as follows:

1. Contractor has an Idaho pesticide dealer’s license, with certification for selling and distributing the restricted use pesticide (Telone II), or the proven ability to obtain one before contract award. (The estimated award date of the contract is June 8, 2018.)

2. Contractor demonstrates the ability, has the product, labor services and ability to provide the chemical to the applicator as needed to ensure fumigation can be completed within 15 operational days from the start of fumigation services.

3. Ability to store the pesticide appropriately in a secured storage area.

4. Contractor is a DowDuPont Certified Telone Dealer. THE CONTRACTOR MUST PROVIDE

A COPY OF THE DOWDUPONT DEALER CERTIFICATION AND THEIR IDAHO

PESTICIDE DEALERS LICENSE WITH THEIR QUOTE.

PART II - SPECIFICATIONS

1.0 BACKGROUND

This requirement is for the United States Department of Agriculture (USDA), Animal Plant Health and Inspection Service (APHIS), Plant Protection and Quarantine Services (PPQ) Pale Cyst Nematod (PCN) program.

The USDA Animal and Plant Health Inspection Service (APHIS) Plant Protection and Quarantine Services (PPQ) in Idaho intends to secure services including all labor, equipment, supervision, transportation, operating supplies, and incidentals necessary for applying Telone II (1,3-dichloropropene 97.5 %, inert ingredients 2.5 %) over a specific area in Bingham and Bonneville Counties, Idaho, United States. The type and amount of equipment and personnel needed to accomplish the contract work is the responsibility of the Contractor.

1.1 CONTRACT TYPE AND TERM

This solicitation will result in the issuance of a firm fixed price commercial supply contract. The period of performance is from date of award through completion or through October 15, 2018.

1.2 SCOPE OF WORK

The type and amount of equipment and personnel needed to accomplish the contract work is the responsibility of the Contractor. The work shall be done in strict compliance with the specifications provided by the Contracting Officer Representative and the terms, specifications, conditions, and provisions of this solicitation and Statement of work. USDA APHIS will solicit for an application contractor separately. This solicitation is for the transport, storage, and delivery of the chemical Telone II (1, 3-dichloropropene 97.5 %, inert ingredients 2.5 %).

The Contractor will be required to deliver the product to the applicators equipment for each application. It is the Contractor’s responsibility to work with the applicator to coordinate delivery of the product in accordance with the contractors schedule for application. The USDA will provide the name of the applicator for the contractor to coordinate deliveries.

The Contractor shall be required to commence work under this contract as early as August 15, 2018, or upon official notification by the Contracting Officer. No application will be performed on Sundays.

The deliveries of the product to the applicator shall be completed within 15 operational days from the start of applicator services unless there are excusable delays.

Excusable delays will be handled in accordance with FAR 52.212-4 (f). The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the U.S. Federal Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such

Contractors are reminded that there are numerous biological and entomological factors that determine the time and sequence of treatments. The importance of starting and completing a program within specified limits is critical. The objective of this program is to achieve the desired coverage of the designated geographic areas within specified time frames.

1.3 CONTRACTOR RESPONSIBILITY

• Supplies, materials, equipment. The Contractor shall furnish all supplies, materials, equipment, transportation and personnel to provide products and services in accordance with this solicitation, except as shown under Government obligations.

• Personnel. The Contractor shall furnish qualified personnel to carry out all phases of the work to insure that the chemical is safely and properly stored, transported, and delivered to the treatment areas in accordance with all local, state, and federal regulations.

• Personal Protective Equipment (PPE). The Contractor shall follow all directions regarding PPE as specified on the pesticide label.

• Fumigant. EPA Reg. No 62719-32 which is 1,3-dichloropropene = 97.5 by weight and inert ingredient 2.5 % by weight - liquid.

• Sanitation. Vehicles, equipment, personnel and conveyances which have entered PCN-infested fields will be required to be cleaned and/or steam treated in accordance with state and federal regulations before departure from each field. Government inspectors will perform the required sanitation, inspection, permitting, and certification for equipment leaving PCN-infested fields.

• Consultation. The Contractor will provide consultation to USDA, APHIS and field operators to ensure field conditions are within standards for an effective fumigation treatment. Crop residues, soil temperature, soil tilth, and soil moisture should be considered.

1.4 SAFETY REQUIREMENTS

The following safety precautions and procedures will be adhered to:

1. In the event of contamination of personnel, water for washing and a change of clothes will be readily available.

2. When not in use, the pesticide will be stored in tightly-closed original container, in a specially secured and labeled storage location away from dwellings (i.e.

truck).

1.5 GOVERNMENT RESPONSIBILITY

The Government will provide the following:

• Maps, Information, and Briefing for fields to be treated.

• Record Keeping Requirements: Provide Federal Register, 7 CFR part 110 (Record keeping Requirements for Certified Applicators of Federally Restricted Use Pesticides), to the Contractor for their review and information. Additional information can be found at:

• Payment for Acres of Fumigant Applied: Contractor will be paid for each gallon of pesticide acceptably furnished based on the application records and partial delivery receipts prepared by the Government providing the following conditions are met:

1. Invoices shall show the total number of gallons acceptably delivered with inclusive date of delivery for the period covered.

2. Invoices shall not be submitted for less than a one-week period, except upon completion of the contract. Invoices shall be submitted electronically to the IPP invoicing system.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
