(d) Comptroller General Examination of Record. The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within14 calendar days of contract expiration.

Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to

FAR 13:

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

452.237-74 Key Personnel (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: Contract Manager.

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

C. Scope of Work:

The Contractor shall provide all necessary management, supervision, labor, materials, supplies and equipment to mow the lawn, sweep parking lots and walkways, remove litter, and complete other tasks identified in this statement of work.

Vendors are advised to inspect the site prior to submitting their offers. Arrangements to see the site can be made by contacting the above listed COR and local contact. Bidders must be registered in the System for Award Management (https://www.SAM.gov) prior to award of contract.

D. Performance Requirements:

Contractor will work only during normal business hours, which are Monday through Friday 0800

– 1600, unless arranged in advance with COR.

DESCRIPTION OF SITE

The grounds at the U.S. Forest Service building consists of trees, shrubbery, bushes, flower beds, sidewalks, staircases, and driveways and parking areas. Vendors are advised to attend a site visit with COR prior to bidding. An aerial view of the site is at the bottom of this document.

TASKS AND EXPECTATIONS:

1 April – 31 October:

Lawn Mowing will be performed when the grass exceeds 2 ½” in height. The following method will be used:

1. Police the lawn area before cutting. Pick up and dispose of any litter on the site and remove any fallen tree branches. Tree branches can be put on the brush pile behind the garage.

2. Cut grass to 1 ½” in height. Mulching blades will be used.

3. Pickup clippings after cutting, if excessive.

4. Clippings shall not be blown onto parking lots, sidewalks, or other paved areas surrounding these facilities.

5. Remove cut grass from paved areas and sidewalks.

6. Excess clippings may be composted at area on site designated by COR.

7. South side: there are two picnic tables that must be moved in order to mow under them.

These are metal and easy to drag. They will be left on the grass, not on pavement.

8. Grass and vegetation around STOP signs for entering roadways (2) shall be kept short, and all weeds removed to ensure that drivers can see the roadway.

Spring Clean Up:

9. The date will be determined by the COR and will be during the first two weeks of May, on a weekday during normal business hours.

10. Remove any dead branches from the yard areas and place them on the brush pile in the back of the lab (behind the garage) or in another area determined by the COR.

11. Pick up litter found on site and dispose of in dumpster.

12. Weed mulched beds in front of building at entryway, and on south side of building by south entry door.

Fall Clean Up:

13. The date will be determined by COR and will be in the last two weeks of October, on a weekday, during normal business hours.

14. Rake up leaves on all grass areas and under shrubs at the front, back, and sides of the building and dispose of in dumpster.

15. Pick up litter found on site and dispose of in dumpster.

16. Remove any dead branches from the yard areas and place them on the brush pile in the back of the lab (behind the garage) or in another area determined by the COR.

17. Weed mulched beds in front of building at entryway, and on south side of building by south entry door.

18. Cut back ivy and other vegetation on north and south stairs so it doesn’t grow over the concrete or railings and into the steps.

Bidders MUST be registered in the System for Award Management prior to award of contract.

Remove all debris from site after each day of work. Clean up site.

Minimize use of any gas-powered equipment in the immediate vicinity of air intakes (located at sides of lab building). No idling motors at sides of building. There is no Smoking anywhere on Forest Service Property.

EQUIPMENT AND MATERIALS

Equipment, materials, and personnel will be the responsibility of the contractor and shall be dependent on the amount of work and type of treatment ordered. All materials, methods of application, and rates of application required to perform services requested shall be provided to the COR prior to beginning the work. The Contractor will keep necessary equipment and manpower at the site during the workday and continue with performance of work until it is completed to the satisfaction of the COR. CONTRACTOR’S EQUIPMENT OR MATERIALS.

SUPERVISION

The Contractor shall designate one supervisor for satisfactory supervision of the contract work.

The Contractor or his/her on-site representative shall be available at all times when the contract work is in progress to receive notices, reports, or requests from the COR or his/her representative. It is the policy of the U.S. Forest Service that Government direction or supervision of Contractor’s employees directly or indirectly, shall not be exercised.

The Contractor shall provide in writing, to the COR, at least five workdays prior to contract starting date, and each time there is a change, the names and telephone numbers of the on-site supervisor. The term on-site supervisor means a person designated in writing by the Contractor who has authority to act for the Contractor on a day-to-day basis at this work site and to accept and sign inspection reports and any other correspondence on behalf of the Contractor.

REMOVAL OF DEBRIS

The Contractor will dispose of all litter and debris found on site. The dumpster on site may be used. If any hazardous materials are found, they must be brought to the attention of the COR immediately.

SUPPLEMENTAL INSTRUCTIONS

1. Although the performance of all work requirements is under the responsibility and management of the Contractor, the Government reserves the right to review and approve all work items before their accomplishment.

2. The Contractor is required to discuss with the COR the scheduling of daily work requirements.

3. Work shall not be considered completed until the Contractor has removed from the premises all trash, debris, litter, excessive grass cuttings, etc. which accumulated in the performance of the work.

4. The Contractor shall restore any damage caused by his operations, including the replacement of plant material damaged as a result of negligence, at no cost to the Government.

The Contractor shall provide adequate number of appropriately trained personnel to properly and satisfactorily work during the scheduled times indicated.

The Contractor shall check with the COR daily for instructions, requests, or special problem situations. The Contractor or his/her designated management representative will confer with the COR to discuss contract administration.

GOVERNMENT-FURNISHED PROPERTY

The Government shall deliver to the Contractor the following listed materials, supplies, property, or services (hereinafter referred to as “Government-furnished property”) at the places and times specified below. The Contractor shall be liable for all loss or damage of such delivered Government-furnished property until completion and final acceptance of work required under this contract and shall replace all components in equal.

Government-furnished property shall consist of:

A. Trash dumpster may be used for disposal of litter found on the site.

B. Facilities/Utilities: Contractor may use facility water at the first floor break room, for employees to fill up water bottles, if they coordinate this with the COR. The Durham lab is a locked facility and employees will not be permitted to enter without the COR.

CONTRACTOR’S RESPONSIBILITIES

The Contractor shall meet the following obligations:

A. Ensure that adequate numbers of trained personnel are available to perform the tasks as specified.

B. Refer to the COR, any problem that may arise beyond the scope of this contract.

C. Use all tools, equipment, and cleaning products appropriately according to manufacturer’s instructions.

D. Provide to employees all personal protective equipment (PPE) necessary for tasks related to this contract and train personnel in proper use of PPE. Ensure that PPE is worn when required and maintained as needed.

E. At all times, maintain building security by relocking doors that were locked, prohibiting unauthorized entrance to building, and reporting any suspicious persons or items.

Contractor Invoices

• Must be submitted in a timely fashion.

• Must list tax ID number, contact information, contract number, and dates work was performed.

Equipment and Materials Equipment, materials, and personnel will be the responsibility of the contractor and shall be dependent on the amount of work required.

Damage to Government Property In the event that the contractor damages personal property (automobiles) or government property (including facilities), the contractor will immediately inform COR. Office phone number and email address for COR are listed above and cell phone will be provided to contractor upon award of contract. Any damage to Government Property incurred during the implementation of this contract must be repaired or replaced by the contractor to the satisfaction of the Government representatives.

Safety:

Contractor shall adhere to all applicable safety standards and should exercise caution in the performance of their duties. Contractor will ensure that personnel working on Government property are aware of job hazards and take measures to mitigate them. The Forest Service takes safety very seriously. No work will be performed in an unsafe manner.

The contractor shall comply with all OSHA standards for employee safety. It is the contractor’s responsibility to ensure employees are properly trained and equipped for potential hazards.

1. Report to the COR, or his designated representative, any safety problem that may arise beyond the scope of this contract.

2. Contractor will inform COR prior to any work being done that will produce loud noise, dust, fumes, vapors, vibrations, or otherwise disrupt building occupants.

Contractor must provide Safety Data Sheets (SDSs) for any chemicals used on the premises.

OTHER INSTRUCTIONS:

1. Although the performance of all work requirements is under the responsibility and management of the Contractor, the Government reserves the right to review and approve all work.

2. The Contractor will provide COR advance notice for work that will disturb occupants (noise, dust, fumes, vibration, etc.) so that they can notify occupants. This can be done immediately prior to starting a job if it is an emergency but should be done in advance to the maximum extent possible for other work.

3. The Contractor should ask for COR assistance with any issues related to moving vehicles in the parking lot.

4. Security: A Forest Service representative will be on premises at all times during work performance and may check work quality and contractor safety procedures.

5. The use of Government telephones, copier machines, fax machines, and computers is not authorized for any purpose.

6. Damage to Contractor’s Property: The Government will not be responsible in any way for damage to the Contractor’s equipment or the Contractor’s employees’ personal belongings brought onto the Government premises.

7. Contact COR on days of severe weather to verify facility operation.
