DESCRIPTION OF SERVICES
1. DESCRIPTION OF WORK
This project consists of the potable water collection sampling, testing, and results reporting of
Administrative and Recreation site potable water systems on the Fremont-Winema National Forest for calendar year 2021 plus four option years (subject to availability of funds). The work includes completing monthly drinking water sampling and testing of all listed water systems, reporting results to the Forest and to the Oregon State Department of Health Services – Drinking Water Program Database. All work shall be in accordance with the Oregon State Safe Drinking Water Standards and Requirements. Also included is the monitoring, sampling, and testing of all periodic water tests as required by the Oregon
Drinking Water Program (DWP). This includes, but is not limited to, potable standards, Nitrate, Lead and
Cooper, Synthetic Organic Compounds (SOC) Volatile Organic Compounds (VOC), Inorganic Compounds
(IOC), Alpha-Beta, etc., as required. This project will be awarded as a FIRMED FIXED PRICED CONTACT.
Collection, transporting, and analysis will be included in the quoted price per sample. See the Schedule of Items.
2. PROJECT LOCATION
The project sites are located across the landscape of the Fremont-Winema NF. All recreation sites and two administrative systems are open seasonally spring through fall. The remaining two administrative systems (Silver Lake Ranger District and Chemult Ranger District) are open year-round. The tables below identify all sites with approximate travel distances from Klamath Falls and Lakeview, which are the main population centers within the Fremont-Winema NF.

Additions and omissions of the systems listed above may be made by the Contracting Officer (CO) or
Contracting Officer’s Representative (COR) based on Forest program needs. Successful awardee will be notified by the U.S. Forest Service (USFS) when the sites will be opened and closed each season for required testing.
3. LANDSCAPE PRESERVATION AND DISPOSAL OF MATERIALS
Contractor shall take all necessary steps to protect structures, lawn, shrubs, pavements and all other improvements at testing sites.
Contractor shall remove all personal trash and refuse from the contract area. Material to be removed includes, but is not limited to: wood scraps, sawdust, plastic tarps, paper, garbage, etc. This material must be disposed of at a State, County, or Municipality designated solid waste disposal area.
Daily cleanup is mandatory.
4. COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52.211-10) (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 3 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete all work identified within the scope of this contract, including final cleanup of the premises.
Work is estimated to begin January 2021.
Contractor must take into consideration possible shutdowns for Industrial Fire Precaution Levels. Also, contractor agrees as a minimum to interrupt or delay operations under this contract in whole or part, upon written request of the CO for the following reasons:
a. To prevent serious environmental degradation or resource damage
b. Weather predictions or conditions indicate hazardous conditions warrant operation curtailment
c. Wildfire activity threatens contractor safety

6. CONTRACTING OFFICER’S GOVERNMENT TECHNICAL INSPECTOR REPRESENTATIVE
The CO designates their Representative. The CO Representative will be responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other mater deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the CO prior to completion of the contract.
The CO should be informed as soon as possible of any actions or inactions by the Contractor or the
Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the Representative provided they do not affect the delivery schedule or performance period stated in the contract.)
On all matters that pertain to the contract terms, the Contractor must communicate with the CO.
Whenever, in the opinion of the Contractor, the Representative requests effort outside the scope of the contract, the Contractor should so advise the Representative. If the Representative persists and there still exists a disagreement as to proper contractual coverage, the CO should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

7. PUBLIC OFFICIAL NOT PERSONALLY LIABLE
There shall be no personal liability upon the Government or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them by, or within the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government.
8. CERTIFICATION OF COMPLIANCE
Contractor shall certify compliance with specific fire precautionary measures included in the Contract.
The certification shall be made prior to commencement of work and shall be updated if at any time during performance the conditions change.
The Government may conduct verification inspections to ensure Contractor’s compliance.
9. FINAL CLEANUP
52.236-12 Cleaning Up (APR 1984)
The Contractor shall always keep the work area, including storage areas, free from accumulations of waste materials. Before completing the work, the Contractor shall remove from the work area and premises any rubbish, tools, scaffolding, equipment, and materials that are not the property of the
Government. Upon completing the work, the Contractor shall leave the work area in a clean, neat, and orderly condition satisfactory to the CO.
10. SAFETY PLAN
Prior to allowing any work to commence on the project, the Contractor shall submit a Safety Plan to the
CO that is in accordance with OSHA Regulations. Such safety plan shall include all tasks and related activities anticipated to be needed to successfully complete the work.
Contractor shall meet all Federal and State OSHA requirements during the execution of the project.
Contractor shall be aware of falling hazards, equipment operation hazards, and fatigue.

11. CONTRACTOR QUALITY CONTROL PLAN
Quality Control Plan. The Contractor shall provide a Quality Control Plan (QCP) as part of this Technical
Proposal. The Plan must demonstrate how the Contractor will assure the quality of performance meets the objectives and requirements of the contract. The QCP shall specify:
a. How quality will be monitored to assure performance standards are met
b. How the work will be supervised
c. How results of the monitoring will result in quality performance
d. Identify the personnel responsible for performing quality control
Contractor Quality Control Inspection. The Contractor shall assure themselves that performance meets contract specifications, in accordance with clause FAR 52.212-4., Contract Terms and Conditions –
Commercial Items, paragraph (a), Inspection/Acceptance prior to requesting the Government to inspect for payment or acceptance.
12. NOTIFICATION OF SUBCONTRACTING
The Contractor shall promptly notify the CO when submitting their quote; subcontractor shall not perform any work under the subsequent contract until such time as they are accepted by the CO. The subcontractor shall have the experience and be equipped for such work. The written notification shall include as a minimum:
a. The name, address, and telephone number of the subcontractor
b. The date upon which the subcontract was entered into and its duration
c. A detailed description of the work being subcontracted; including a listing of contract items, units, etc., as appropriate.
d. Documentation of the subcontractor’s representative authority. Subcontracting any portion of the contract shall not relieve the prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract.
13. AGAG 42.215-73 POST AWARD CONFERENCE (NOV 1996)
A post award conference with the successful quoter is required. It will be scheduled after contract award. The conference will be held at: Lakeview Interagency Office, Lakeview, Oregon, unless otherwise changed by mutual agreement.
14. AGAR 452.236-77 EMERGENCY RESPONSE (NOV 1996)
a. Contractor’s Responsibility for Fire Fighting
i. The Contractor, under the provisions of FAR clause 52.236-9, PROTECTION OF EXISTING
VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES AND IMPROVEMENTS, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work.
ii. The Contractor may be held liable for all damages and for all costs incurred by the
Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractors or the
Contractor’s agents or employees.
b. Contractor’s Responsibility for Notification in Case of Fire
The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.
15. KEY PERSONNEL (AGAR 452.237-74) (FEB 1988)
a. The Contractor shall assign to this contract those persons whose resumes, personnel data forms or personnel qualification statements were submitted as a requirement of the contract. No substitution or addition of personnel shall be made except in accordance with this clause.
b. During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the CO within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the CO at least 15 days prior to making any permanent substitutions.
c. The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutions, and any additional information requested by the CO. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The CO will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

NOTE: The paragraph below replaces the paper invoice copies requirement referenced on FAR
52.212-4 (g) invoices.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8G of the Inspector General Act of 1978 (5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and
(ii) Interview any officer or employee regarding such transactions.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), and (c), of this clause, the
Contractor is not required to flow down any FAR clause in a subcontract for commercial items, other than—
(i) Paragraph (d) of this clause. This paragraph flows down to all subcontracts, except the authority of the
Inspector General under paragraph (d)(1)(ii) does not flow down; and
(ii) Those clauses listed in this paragraph (e)(1). Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

18. FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Price is approximately equal in importance to other factors listed below, however cost may control award and past performance where rework was required or more than two notices of non-compliance were issued on past projects; may also control award. The contract may be awarded to other than the low quote in order to achieve the “Best Value” for the project. The following factors listed below shall be used to evaluate quotes and quoters must respond to each:
1) Past Performance.
Offerors shall provide past performance information. Including a list of clients, with contract information where similiar work was performed with in the past 3 years. Address items such as:
- Experience and Education
- Timeliness of performance
- Customer satisfaction
- Problems encountered
