SECTION C - Description/Specifications/Statement of Work

DESCRIPTION/STATEMENT OF WORK

The contractor shall furnish all labor, supervision, transportation, equipment, supplies and incidentals necessary to complete the required janitorial services, in accordance with the attached specifications.

Estimated first floor usable space is approximately 14,453 square feet. Estimated Mezzanine usable space is approximately 3,440 square feet. The estimates include space that will not require janitorial services such as Secure Rooms for Law Enforcement, IT and other storage. Total square footage requiring janitorial services is 12,258 sq ft.

All janitorial services shall be performed three times a week between the hours of 5:00 p.m. and 6:30 a.m. Monday, Wednesday and Friday, except legal holidays and days when the office is closed due to weather or other unforeseen circumstances, such that daily cleaning is accomplished by 6:30 am Monday , Tuesday, and Thursday. The Contractor has the option to perform Friday's janitorial work on Saturday or Sunday, or on Monday holidays, as applicable. Work may be performed anytime on weekends and federal holidays. The contractor will be responsible for maintaining building security during the hours the building is occupied due to the Contractor’s operations. An option item is included in the schedule of items for two additional days per week on

Tuesdays and Thursdays between 5:00 p.m. and 6:30 a.m.

The hours shall not be changed unless authorized by the Contracting Officer.

The work shall not interfere with Government business, employees, or work being done by other contractors. The Contractor shall not disturb papers on desks, open drawers, cabinets, use telephones or other office machines; including reading or inspecting items found on desks or in work areas and repeating any information to others outside the government facilities. No wastebaskets, cleaning supplies, or other items are to be placed on office equipment, desks or tables. The Contractor shall not confront employees about cleanliness of workspaces. The Contractor shall not bring pets or any unauthorized persons into the government facilities, or allow access to anyone other than those authorized under the contract.

Cleaning tasks such as exterior window washing may be performed during normal business hours with written approval from the

Contracting Officer.

Annual and semi-annual cleaning activities shall be scheduled and performed only with prior written approval from Contracting

Officer.

Contractor shall be held responsible for the security of the building and all fixtures and appliances attached when performing on the premises and shall ensure building is securely locked before leaving.

PROJECT LOCATION

Umatilla National Forest Supervisor’s Office, Pendleton, Oregon

From Pendleton, travel east on I-84 for approximately 6 miles to Exit # 216. Take off ramp and turn left onto OR 331 N. Market Rd.

Cross the I-84 overpass and continue ahead towards Arrowhead Truck Stop. Just past the truck stop, turn left onto Coyote Road into

Coyote Industrial Park. Take the first road on the left and travel ahead approximately 0.1 mile to new building at end of the road.

BIOBASED PRODUCTS

The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order

(EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition

Regulation to provide biobased products.

The Contractor shall utilize products and material made from biobased materials (e.g., biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conforms to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the

Contracting Officer (CO).

The following is an example list of products that may be used in this contract for services for which biobased products are available.

The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

Paper Products

Biobased products that are designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov . The Contractor shall provide data for their biobased products such as biobased content. In addition to the biobased products designated by the U.S. Department of

Agriculture in the BioPreferred Program, the Contractor is encouraged to use other biobased and recycled products.

The Contractor shall submit with the initial proposal a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the contract.

The Contractor shall comply with the provision at FAR 52.223-1, Biobased Product Certification.

The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products Under Service and

Construction Contracts.

Expectation is that each room, each work cubicle and office will have one or more waste baskets to be emptied.

III. Outside Policing: Government does not expect Contractor to police public or fleet parking areas except to retrieve trash/litter scattered by Contractor operation.

TECHNICAL SPECIFICATIONS

Interior Standards

Bare Floors

Floors: Floors, base moldings, and grout shall be clean and free of debris including but not limited to dirt, water streaks, mop marks, string, gum, tar, and other foreign matter. The floors shall maintain their natural luster and not have a dull appearance.

Wet mopped floors are to be cleaned using disinfectant cleaner(s) with additional scrubbing, if necessary. These floors shall be slip resistant. Surfaces, baseboards, and corners shall be clean and dry. Walls, baseboards, and other surfaces shall be free of splashing and markings from the equipment. There shall be no visible buildup of finish in corners or crevices.

Asphalt Floors: Damp mopping shall be the only method of wet cleaning for floors containing asphalt material.

Stripping and Finishing: The old finish or wax shall be removed and new sealant applied in accordance with standard commercial practices. Spots shall be eliminated. There shall be no evidence of gum, burns, scuffmarks, or wax build-up in corners or crevices.

Burnishing, High speed buffing, or Dry stripping methods shall not be used. Walls, baseboards, and other surfaces shall be free of finish residue and marks from equipment. Floors shall be free of streaks, mop strand marks, and skipped areas. The finished area shall have a uniform luster.

Sealing: Sealant must adhere to the floor. Floor areas must be evenly coated with a slip resistant seal.

Carpet and Rugs

Vacuuming: Carpet surfaces are to be free of dirt, dust, and other debris. Vacuuming shall be done at a frequency that will protect the integrity of the carpet and prevent wear. For example, high use areas may need to be vacuumed daily while low use areas may need to be vacuumed only 2-3 times per week.

Cubicle/work station carpeted floor space shall be vacuumed to extent possible without moving or picking up items left on floor.

Spot Cleaning: Carpet surfaces shall be free of removable spots, soiled traffic patterns, dirt, dust, debris, gum, and crusted material.

Heavy Cleaning (Public Areas and Work Areas): Whole office carpet cleaning shall be twice annually during each contract period.

Prior written approval from the Contracting Office of schedule is required.

Built-up, spills, or crusted material shall be removed along with spots and smears. There shall be no areas of deterioration or fuzzing to the carpets and rugs as a result of harsh brushing or scrubbing. Cleaned areas of carpets and rugs shall be reasonably blended with surrounding carpets. The carpet shall be dry before customers occupy the building on the next business day. The Contractor shall take measures to prevent the growth of mold. The Contractor shall coordinate with the CO about the date and time for carpet cleaning. Moving of duplicating equipment, computer equipment, and similar type electric and electronic equipment is to be coordinated with the CO prior to cleaning of the carpet. In no event shall the contractor move equipment without government consent.

Break Rooms, Kitchens, or Food Preparation Areas

Floors: The quality standard for providing standard service is the same as that described for Floor Care in the Standard Service

Section in Bare Floor Standards.

Dispensers: Contractor shall replenish paper towel & soap dispenser. The supplies for provided dispensers shall be compatible with the dispenser manufacturer’s requirements.

Trash Cans: Empty and replenish bags.

Rest rooms, Toilet Rooms

Clean and Sanitize: Areas shall be cleaned with a disinfectant cleaner. Partitions, doors, vents, sills, and walls shall be free of dust, dirt, body fluids or waste, and graffiti. Rooms shall be free of discarded materials.

Fixtures: Fixtures and surfaces (sinks, washbasins, urinals, modesty or stall panels, toilets, shower stalls, etc.) shall be cleaned with disinfectant cleaner. Fixtures shall maintain a high level of luster and be free of dust, mold, mildew, streaks, stains, and encrustation or mineral deposits.

Floors: The quality standard for providing standard service is the same as that described for Floor Care in the Standard Service

Section.

Waste or trash containers: Containers shall be emptied and bags replenished. Containers shall be cleaned with disinfectant as needed.

Dispensers: Contractor shall replenish all dispensers as a standard service. The supplies for provided dispensers shall be compatible with the dispenser manufacturer’s requirements.

Sanitary Receptacles (disposal containers): The Contractor shall empty, clean, and sanitize sanitary napkin disposal containers after any use. Sanitary napkin disposal containers shall be lined with new receptacle bags. Disposal of waste shall be treated the same as

Blood Borne Pathogens as specified in 29 CFR 1910.1030. Http://www.access.gpo.gov/nara/cfr/waisidx_06/29cfr1910a_06.html .

The Contractor shall supply Sanitary Product(s) for Dispensers. Monies collected from tampon and sanitary napkin dispensers shall be retained by the Contractor.

Drinking Fountains

Clean and Sanitize: Drinking fountains shall be sanitized and present a lustrous appearance. All fountains shall be shall be free of dirt, watermarks, encrustation or mineral deposits, and all other debris.

Surfaces (for example, walls, desk tops, dividers)

Horizontal surfaces: All surfaces shall be free of dust, dirt, oil spots, or smudges. Cabinets and desks with papers, computers, and keyboards shall not be disturbed.

Metal, Brass and Woodwork: Surfaces (including corners, crevices, moldings, ledges, hand rails, grills, doors, door knobs, door frames, kick plates, etc.) shall be free of dust, streaks, spots, hand marks, oil, smudges, dirt, soil substances, encrustation, and streaks.

Glass Cleaning: All glass, clear partitions, and mirror surfaces (within approximately 70 inches off the floor) shall be clean and free of dirt, dust, streaks, smudges, watermarks, spots and grime, and shall not be cloudy. There shall be no water spots on the glass or adjacent fixtures and furniture.

Vertical surfaces: All surfaces shall be free of dust, dirt, oil spots, or smudges. Posted items shall not be disturbed.

Clean Spots and Marks: Wall surfaces (within approximately 70 inches off the floor) shall be free of smudges, marks, dirt, and spots.

Cleaning should not cause discoloration.

Heavy Cleaning (Public Areas and Work Areas): Fabric Cleaning: Cleaning of fabric cubicle panels shall be scheduled with the CO and completed annually. Prior written approval by the Contracting Officer of schedule is required.

High Cleaning

High Surfaces: Surfaces between 70 inches and ceiling level shall be cleaned, free of dirt, dust, and cobwebs. Where glass is present, both sides shall be clean and free of streaks. This does not include removal of vents, tiles, or fixtures.

Trash Containers or Wastebaskets

Trash: All trash (including restroom and break rooms) shall be collected and removed to the dumpster in a location designated by the

CO. Trash containers shall be emptied and kept clean, odor-free, and free of dirt, dust, debris, residue, and spilled material. Plastic liners for all trash, debris containers shall not be torn, worn, or contain residue.

The Contractor shall notify the CO of any item or material identified by the Environmental Protection Agency (EPA), and State and local regulatory agencies as hazardous waste, hazardous materials, or Universal Waste, observed in the trash receptacles. Typical prohibited wastes include but are not limited to fluorescent light bulbs, thermostats, thermometers, most chemicals, and batteries (40

CFR Parts 260-273).

Elevator and Stairways

Door Tracks: Tracks shall be clean and free of dirt, debris, built up grime, dust, smudges, and other extraneous matter.

Exterior and Interior Elevator Car Surfaces: Surfaces shall be clean and free of finger marks, smudges, and spills. Carpets and floors shall be free of removable spots, dirt, and debris. Floors requiring a finish shall be maintained at a high luster.

Exposed Surfaces, Treads, Risers and Landings: Stairways, escalators, entrances, landings, railings, risers, ledges, grills, doors, radiators, and surrounding areas shall be free of dirt, dust, litter, and debris.

Interior Plate Glass

Cleaning: All glass (to include glass over and in exterior and vestibule doors, all plate glass around entrances, lobbies, and vestibules) shall be clean and free of dirt, grime, streaks, and moisture and shall not be cloudy.

Window Washing

Windows shall be cleaned annually during this contract period as the standard service. Cleaning of both sides of the windows shall be approved by the CO. See also Exterior Performance Standards.

Cleaning: Both sides of the glass shall be clean and free of dirt, grime, streaks and moisture, and shall not be cloudy. Window sashes, sills, woodwork, and other surroundings of glass shall be wiped free of drippings and other watermarks.

Blinds and Coverings (Not including Drapes, Curtains, and Unique Coverings)

Dusting of Blinds and Coverings: All blinds and coverings, cord tapes, and valances shall be clean and free of dust and spots. Blinds and coverings that are not operating properly shall be reported to the COR for repair.

Washing of Blinds and Coverings: Both sides of blinds and coverings shall be washed annually per manufacturers specifications.

Heavy Cleaning (Windows, Blinds & Coverings):

The annual and semi-annual cleaning frequencies established in this contract shall be performed only with CO’s prior written approval of proposed cleaning schedule. Proposed cleaning schedule shall be established, at a minimum, two weeks prior to proposed activity.

Exterior Standards

The Contractor shall provide all resources, labor, tools, equipment, transportation, hauling away and disposal, training, supplies, materials, and oversight to ensure that quality and performance standards are successfully achieved.

Plate Glass

Cleaning: All glass (to include spandrel glass, glass over and in exterior and vestibule doors, all plate glass around entrances, lobbies, and vestibules) shall be clean and free of dirt, grime, streaks and moisture, and shall not be cloudy.

Exterior Window Washing

Windows shall be cleaned annually during this contract period. Cleaning of both sides of the windows shall be coordinated with the

CO. Proposed cleaning schedule shall be established at a minimum of two weeks prior to proposed activity.

Cleaning: Both sides of the glass shall be clean and free of dirt, grime, streaks and moisture, and shall not be cloudy. Window sashes, sills, woodwork, and other surroundings of glass shall be wiped free of drippings and other watermarks.

The Contractor is required to accomplish window washing work consistent with safety requirements promulgated by the Occupational

Safety and Health Administration (OSHA).

Trash and Solid Waste Containers

Holding areas for solid waste accumulation will be identified by the CO. All solid waste, trash, and debris shall be emptied into the appropriate containers with no overflow of these materials in the area around the container. Any overflow of materials from containers and dumpsters to ground shall be picked up by the Contractor.

The Contractor shall notify the CO of any prohibited or unauthorized items observed in the trash receptacles, including the utility-provided dumpster(s) on site. Typical prohibited wastes include but are not limited to fluorescent light bulbs, thermostats, thermometers, most chemicals, batteries (nickel-cadmium and small, sealed lead acid batteries in electronic equipment, mobile phones, portable computers, and emergency lighting). In addition, electronic equipment such as computers and printers shall not be discarded in the trash containers. Unauthorized items include the use of the utility-provided dumpster for garbage or trash generated at other work sites or personal residences.

Recycling

It is the intent of the Government that recycling programs shall be used to keep the maximum amount of material from the landfill through aggressive recycling. The Government participates in office paper and cardboard recycling.

The Contractor is encouraged to recycle materials generated by custodial work to the maximum extent possible.

Pest Management

Contractor shall perform minor pest control such as not leaving exterior doors propped open and employ practices and techniques in cleaning and trash or materials handling that reduce the sources of food, harborage, and access routes used by pests in and around buildings and dumpsters.

Contractor shall notify CO of observed pests such as small ant infestations or signs of rodents in the building.

INSPECTION

The Government will inspect the building to determine the acceptability of workmanship. Any deficiencies encountered will be called to the attention of the Contractor for immediate corrective action, and shall be completed and corrected at no charge to the

Government.

Any Government personnel or visiting public may observe unacceptable services, incomplete work or required services not performed and may contact the CO or the COR to communicate a complaint. Customer complaints will be substantiated by the CO for validity.

Failure to correct rejected workmanship may cause the Government to take necessary action under the “Termination for Default” clause.

The Government Inspection form is located in Section J of this solicitation and any resultant contract.

The period of performance of this contract is from June 1, 2021 through May 31, 2022 for the base year.

Option 1 is for the period June 1, 2022 through May 31, 2023.

Option 2 is for the period June 1, 2023 through May 31, 2024.

CONTRACTOR QUALITY CONTROL PLAN (QCP)

The Contractor shall establish and implement a complete Quality Control Plan (QCP) to assure the requirements of the Contract are met. The QCP shall be prepared by the Contractor and provided to the CO for review and acceptance as part of post award meeting.

The contractor shall not rely upon Government inspections to provide notification of unsatisfactory performance, but shall perform inspections and keep QCP inspection records on site at an agreed upon location.

The COR may observe the Contractor's inspection(s) at any time and shall have unlimited access to the records.

When elements of the QCP change – such as scheduled daily times of performance or personnel performing work, Contractor shall provide an updated addendum to QCP to the Contracting Officer for review and approval. This update shall not change the performance requirements of this Contract.

COMMUNICATION PLAN

The Contractor shall include a Communication Plan as part of the Quality Control Plan. The plan shall include the Contractor and their designated representative contact information and method(s) of contact between the Government and Contractor.

GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN (QASP)

Government inspections and tests are for the sole benefit of the Government and does not relieve the Contractor of the responsibility for providing adequate quality control measures; constitute or imply acceptance; or affect the continuing rights of the Government after acceptance of the completed work.

Quality Assurance Surveillance Plan consists of two parts:

1. Visual inspections for compliance with included Performance Standards and other contract requirements. The Government will perform random visual inspections the day after services are rendered. Inspections will be documented in a written inspection report or daily diary.

2. Satisfaction with Contractor performance: CO shall investigate validity of complaints regarding Contractor performance under this contract. Complaints - valid or not - will be documented in a written inspection report or daily diary.

When sub-standard performance is observed or valid complaints received, the Contractor and/or Contractor’s Designated

Representative shall be notified in writing through the issuance of Notice of Non-Compliance.

The contractor shall correct unsatisfactory performance within the next cleaning cycle at no cost to the government. Continued failure to perform satisfactorily by the Contractor may cause a termination for default of the Contractor’s right to proceed.

More than two (2) customer complaints or incomplete cleanings, verified by the CO as valid, per calendar month will equal minus 1% of monthly payment. Rework of unacceptable work will be permitted if the schedule allows. If the unacceptable work is not reworked and accepted, a 1% deduction in payment will be assessed and additional more stringent inspections will be performed. If a complete day of cleaning is missed, an 8% deduction will be made for that month. Full payment will be made for acceptable work.

BIO-PREFERRED PERFORMANCE REQUIREMENTS

Required Service - Ensure the mandatory purchasing of biobased products.

Task - ALL

Performance Indicator – Quantitative Factor

Performance Standard - Contractor compliance with FSIRA, EO 13423, and FAR

Surveillance Methodology – 100% Inspection

AQL – 100%

Deduction – 1% deduction off the monthly invoice for failure to comply with biobased product use. More than 2 deductions during the year will result in a 3% decrease on all future invoices for Non Compliance of biobased product use. This could ultimately lead to a Termination for Default for Non Compliance with the contract requirements and will reflect on the Contractor’s Performance

Evaluation.

CONTRACTOR RESPONSIBILITIES

The Contractor shall:

1. Be responsible to make the management and operations decisions to meet the quality standards required under this contract.

2. Use innovation, technology and other means and methods to develop and perform the most efficient cleaning services for the building.

3. Implement an effective Quality Control Plan (QCP).

4. Provide work schedules and provide other pertinent information as required by the Contract.

5. Reduce the environmental impacts of work performed under this contract by using, to the maximum extent, environmentally sound practices, processes, and products.

Designated on-site representative or Supervisor(s): Contractor, or designee, shall be available and onsite at all times when the contract work is in progress. Contractor shall designate the on-site representative in writing.

Communication: The Contractor shall furnish the Contracting Officer with contact information for land line, cell phone, and email if available.

Clothing/ Uniforms/PPE: All employees shall wear clothing that is neat, clean, and in good repair. Clothing must have a company logo or employee name for identifiable purposes. The Contractor shall provide all employees with proper Personal Protection

Equipment (PPEs) and safety training as required by Federal, State and local regulations.

Sign-in/out: Contractor and employees shall sign-in when reporting for duty and sign out when leaving at the end of the workday.

SECTION H – Special Contract Requirements

452.237-74 Key Personnel. (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: Supervisor

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting

Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph

(c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph

(c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer.

Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions.

The contract will be modified to reflect any approved changes of key personnel.

SAFETY

Contractor shall provide a written, job-specific safety plan identifying and addressing site specific hazards including mitigation measures for review and approval at the pre-work meeting.

Safety hazards inherent to janitorial work includes but is not limited to slips and falls, exposure to cleaning chemicals and solvents, hand or eye injuries, and electrical hazards from use of electrical-powered equipment that could lead to minor and even serious injury or loss of life for the contractor and contractor employees. Contractor or contractor employees shall follow standard Safety and

Security requirement such as notify law enforcement/Dial 911 when unauthorized or suspicious person(s) are seen on premises or break-in suspected. If Fire Alarm goes off, exit building; call 911, and then call COR. For other alarms, call COR. Contractor is responsible for awareness of and compliance with all safety requirements of cleaning products proposed for use.

SECURITY

The government may require additional screening for security measures of the Contractor and any employee of the Contractor’s firm.

Screening and record searches may require additional information to be provided to the Government upon request. Failure to provide the information requested by the Government within a reasonable time frame may result in termination of the Contractor’s right to proceed.

(e) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24 and Federal Information Processing Standards Publication (FIPS PUB) Number 201.

(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:

(e) When no longer needed for contract performance.

(2) Upon completion of the Contractor employee’s employment.

(3) Upon contract completion or termination.

€ The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.

(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor’s employees are required to have routine physical access to a Federally-controlled facility and/or routine access http://www.acquisition.gov/far

It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.

AGAR 452.204-71 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR EMPLOYEES (MAR 2006)

(a) The contractor shall comply with the personal identity verification (PIV) policies and procedures established by the Department of

Agriculture (USDA) Directives 3800 series. AGAR Advisory No. 81, Page 4 of 7.

(b) Should the results of the PIV process require the exclusion of a contractor’s employee, the Contracting Officer will notify the contractor in writing.

€ The contractor must appoint a representative to manage this activity and to maintain a list of employees eligible for a USDA PIV ID

Badge required for performance of the work.

(d) The responsibility of maintaining a sufficient workforce remains with the contractor. Employees may be barred by the Government from performance of work should they be found ineligible or to have lost eligibility for a USDA PIV ID Badge. Failure to maintain a sufficient workforce of employees eligible for a USDA PIV ID Badge may be grounds for termination of the contract.

€ The contractor shall insert this clause in all subcontracts when the subcontractor is required to have routine physical access to a

Federally-controlled facility and/or routine access to a Federally-controlled information system.

(f) The PIV Sponsor for this contract is the Contracting Officer representative (COR), unless otherwise specified in this contract. The

PIV Sponsor will be available to receive contractor identity information from Monday through Friday, 8:00am to 4:30pm at the

Umatilla National Forest Supervisor’s Office. The Government shall notify the contractor if there is a change in the PIV Sponsor, the office address, or the office hours for registration.

52.217-8 Option to Extend Services. (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting

Officer may exercise the option by written notice to the Contractor within 5 calendar days of contract expiration.

52.217-9 Option to Extend the Term of the Contract. (MAR 2000)

(e) The Government may extend the term of this contract by written notice to the Contractor within 5 calendar days;

provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

€ The total duration of this contract, including the exercise of any options under this clause, shall not exceed 3 months.

52.222-42 Statement of Equivalent Rates for Federal Hires. (MAY 2014)

In compliance with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor (29 CFR part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C. 5341 or 5332.

52.222-43 Fair Labor Standards Act and Service Contract Labor Standards-Price Adjustment (Multiple Year and Option

Contracts). (AUG 2018)

(a) This clause applies to both contracts subject to area prevailing wage determinations and contracts subject to collective bargaining agreements.

(b) The Contractor warrants that the prices in this contract do not include any allowance for any contingency to cover increased costs for which adjustment is provided under this clause.

(c) The wage determination, issued under the Service Contract Labor Standards statute, (41 U.S.C. chapter 67), by the

Administrator, Wage and Hour Division, U.S. Department of Labor, current on the anniversary date of a multiple year contract or the beginning of each renewal option period, shall apply to this contract. If no such determination has been made applicable to this contract, then the Federal minimum wage as established by section 6(a)(1) of the Fair Labor Standards Act of1938, as amended, (29

U.S.C. 206) current on the anniversary date of a multiple year contract or the beginning of each renewal option period, shall apply to this contract.

(d) The contract price, contract unit price labor rates, or fixed hourly labor rates will be adjusted to reflect the Contractor’s actual increase or decrease in applicable wages and fringe benefits to the extent that the increase is made to comply with or the decrease is voluntarily made by the Contractor as a result of:

(1) The Department of Labor wage determination applicable on the anniversary date of the multiple year contract, or at the beginning of the renewal option period. For example, the prior year wage determination required a minimum wage rate of $4.00 per hour. The Contractor chose to pay $4.10. The new wage determination increases the minimum rate to $4.50 per hour. Even if the

Contractor voluntarily increases the rate to $4.75 per hour, the allowable price adjustment is $.40 per hour;

(2) An increased or decreased wage determination otherwise applied to the contract by operation of law; or

(3) An amendment to the Fair Labor Standards Act of1938 that is enacted after award of this contract, affects the minimum wage, and becomes applicable to this contract under law.

(e) Any adjustment will be limited to increases or decreases in wages and fringe benefits as described in paragraph (d) of this clause, and the accompanying increases or decreases in social security and unemployment taxes and workers’ compensation insurance, but shall not otherwise include any amount for general and administrative costs, overhead, or profit.

(f) The Contractor shall notify the Contracting Officer of any increase claimed under this clause within 30 days after receiving a new wage determination unless this notification period is extended in writing by the Contracting Officer. The Contractor shall promptly notify the Contracting Officer of any decrease under this clause, but nothing in the clause shall preclude the Government from asserting a claim within the period permitted by law. The notice shall contain a statement of the amount claimed and the change in fixed hourly rates (if this is a time-and-materials or labor-hour contract), and any relevant supporting data, including payroll records, that the Contracting Officer may reasonably require. Upon agreement of the parties, the contract price, contract unit price labor rates, or fixed hourly rates shall be modified in writing. The Contractor shall continue performance pending agreement on or determination of any such adjustment and its effective date.

(g) The Contracting Officer or an authorized representative shall have access to and the right to examine any directly pertinent books, documents, papers and records of the Contractor until the expiration of 3 years after final payment under the contract.

52.223-2 Affirmative Procurement of Biobased Products Under Service and Construction Contracts. (SEP 2013)

(e) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States

Department of Agriculture (USDA)-designated items unless-

(e) The product cannot be acquired-

(e) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3€). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(e) Spacecraft system and launch support equipment.

(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(b) Information about this requirement and these products is available at http://www.biopreferred.gov.

€ In the performance of this contract, the Contractor shall-

(e) Report to http://www.sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any USDA-designated biobased products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30; and

(2) Submit this report no later than-

(e) October 31 of each year during contract performance; and

(ii) At the end of contract performance.

52.232-19 Availability of Funds for the Next Fiscal Year. (APR 1984)

Funds are not presently available for performance under this contract beyond 5/31/2018. The Government’s obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond 5/31/2018, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.

52.237-2 Protection of Government Buildings, Equipment, and Vegetation. (APR 1984)

The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor’s failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.
