FAR 13.5 Simplified Procedures for One Source Purchase Order No. 1240BD24P0002

1. Identification of the agency and the contracting activity.

USDA Forest Service (USFS), Mt. Baker-Snoqualmie National Forest (MBS) 2930 Wetmore Ave Suite 3A, Everett WA 98201 Supervisor’s Office Excess Property Disposal (1st floor, 3rd floor, 4th floor)

2. Description of supply or service required to meet the agency’s needs.

The MBS is in process of relocating to a new supervisor’s office and is in need of excess property disposal service. The new office remodeling and property transfer work are covered and led by the General Services Administration (GSA). The contract excluded any property disposal work. Furnishings remaining after the move is executed, not claimed by other agencies or sold through the federal excess property process, must be removed from the premises. Service needed will include dismantling of system furniture (cubicles); removal/recycling of file cabinets, tables, chairs, desk risers, map cabinets; broken monitors; general debris related to relocation (e.g.

binders, folders, outdated supplies, etc.). Office spaces on the first, third and fourth floors must be fully vacated by December 30, 2023.

3. The rationale or circumstances for limiting competition.

The MBS must move from a building leased from the City of Everett (The City) to a new location in Everett, WA.

The new location will be in a building remodeled by a private vendor. The USFS leases the current office from the City. The GSA has procured the lease of the new office for the USFS.

The USFS lease has been extended due to delays in completing the new office. The City has given the USFS notice that all furnishings in the office must be removed no later than December 30, 2023. There is no opportunity to extend the lease, in fact, the USFS will face monetary damages in the amount of $1200 per day or $36,000 per month if the office is not vacated by the deadline. This amount is unplanned in the region’s budget and likely would be funded by owned building funding which impacts additional Forest Service facilities. There will also be additional consequences due to there being no current delegation or authorization to extend the lease, and The City has indicated it is not supportive of any more extensions.

GSA has awarded a contract to move personal property and selected furnishings to the new office. The contract excluded all disposal related work and has assigned the work to be contracted via a separate contract by the Forest Service. The current timeline estimates the move to take place November 27 – December 29, 2023, but delays in furniture delivery may delay the move leaving very little time during the Christmas holiday season to execute a contract to remove excess property. Due to the short turnaround time and the uncertainty with the further timeline delays based on GSA construction schedule, the USFS is unable to secure a separate contract for this property disposal. On-Demand Services, LLC holds the GSA contract for moving the USFS. They have been cleared by The City to be in the building and will have elevator and floor protection in place and be fully mobilized. Normal competitive procurement processes cannot ensure property removal by December 30. At present we do not know the volume to be removed (dependent on excess property process) or the dates when removal can take place (depending on the GSA’s construction schedule at the new location). In addition, due to the contractor being already on site, there will be a substantial cost savings in mobilization, move and disposal activity coordination, and productivity increase due to familiarity with the work site.

Based on the above authority and justification it is hereby deemed that only one source is reasonably available to meet this expedited requirement. Service will be solicited directly from On-Demand Services, LLC. Single source selection can help ensure the forest will meet lease requirement. In addition, would result in cost savings of $30,000 (previous attempt through GSA prior to work being transferred to the USFS was $30,000 higher than current government estimate) to the government due to reduced need for mobilization of a new contractor, reduced cost in floor/wall/elevator protection measures, and improved production due to contractor’s familiarity with the project.

4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.

General market research was conducted with local relocation companies. Result indicate for dissassembly of system furniture alone and the disposal (50 workstations), the cost to government is around $10,000. This price did not include additional recycling of 147 rolling cabinets, 67 lateral cabinets and racks, 8 office suite, 20 tables and 100 chairs, other wood cabinets/storages and general relocation debris (files, folders, outdated supplies). This additional market research was not conducted in consideration of cost to contractors for quote. In addition, this project is unlikely to be successful with open market competition due to the restricted timeline and the uncertainty of performance period.
