Project Establishment of a service contract is to ensure that SCIEX QTRAP instrument systems undergo preventative maintenance and is, when necessary, repaired in a timely manner to be fully operational to maintain required sample throughput and turnaround time for sample results.

General Information

1.0 Scope of Work

The FSIS Western and Eastern Laboratories perform regulatory testing and confirmation for antibiotics and drug residue in meat animal tissue. Four QTRAP 6500+ mass spectrometers were purchased from the SCIEX Corporation and are utilized for this application. These mass spectrometers are dual platform instruments that can operate as triple stage detectors and as an ion trap.

The objective for the purchase of the service contract is to ensure that all QTRAP instruments undergo preventative maintenance and are, when necessary, repaired in a timely manner to be fully operational in order to maintain required sample throughput and turnaround time for sample results.

2.0 Background

The Food Safety and Inspection Service (FSIS), a public health regulatory agency of the U.S. Department of Agricultural (USDA), protects consumers by ensuring that meat, poultry, and egg products are safe, wholesome, and accurately labeled. The National Residue Program (NRP) is developed by FSIS and implemented by Office of Public Health Science (OPHS) in support of public health function in relation to chemical residues. The NRP has domestic and import sampling plans which generate nationwide data to document prevalence of food contaminants. The NRP also supports enforcement regulatory work and select exploratory projects.

These services shall include:

- Hardware Telephone Support during normal business hours

- Access to StatusScope™ on compatible models

- Guaranteed 2 business day onsite response time for remedial repairs

- Hardware Telephone Support during normal business hours

- Access to StatusScope™ on compatible models

PC: Software Plus Plan Prioritized software phone and online support

- Troubleshooting for software malfunctions and corrective action on the latest versions of software

- Delivery of full upgrades to latest software versions for all entitled SCIEX software

- Delivery of updates to latest software versions for all covered SCIEX software

NOTE: Limited changes could be made to the listing of equipment that needs to be maintained. If changes need to occur the Government will contact the contractor and discuss pricing for the new equipment. In addition, some pieces of equipment may be removed from the list each year depending on whether they are obsolete or not in use any longer.

(a) Hours of Service:

Maintenance/repair services shall be provided during normal working hours, 8:00am to 4:00pm PST, Monday through Friday, excluding Federal Holidays. After hours and weekend support shall be provided at no extra cost.

(b) On-site service calls and travel times are unlimited. On-site call maintenance to include all labor, travel and replacement parts that are no considered consumables. If the required part is not in stock or available, a representative will place an order with the supplier and request next business day delivery. Repairs shall be made in accordance with manufacturer specifications.

(c) Invoicing shall be completed quarterly in arrears.

(d) The COTR will act, on-site, as the technical point of contact for the Government, initiate service calls, and perform acceptance of equipment after maintenance and repairs. The COTR’s authority is limited to technical issues and he/she is not authorized to make contractual decisions. The authority to resolve monetary issues and contractual interpretation is the responsibility of the Contracting Officer.

(e) The contractor will guarantee only their trained and certified employees, sub- contractors, agents or other authorized labor of the contractor are to perform work on the equipment listed in this Statement of Work.

The contractor shall demonstrate said training and certification by providing a recent (within 1 year) copy of training and/or certification documentation to the COTR prior to commencing work. The COTR may reject employees, subcontractors, agents or other authorized labor of the contractor if they do not meet the training or certification documentation requirements

(f) Parts and materials used for repairs/maintenance shall be new and meet manufacturer specifications. The contractor shall maintain an adequate inventory of spare parts to accommodate the repair of equipment within time limits specified in paragraph 4 above. The contractor shall pay charges to ship replacement or repaired equipment to the customer. The contractor shall also pay shipping charges for the return of equipment to the contractor.

(g) The equipment shall be fully operational according to laboratory methodology and serviceable after completion of maintenance and repairs. Prior to leaving the area, the contractor shall demonstrate to the COTR or designated representative that the equipment is operational. The COTR or designated representative will certify the equipment is performing satisfactorily.

(h) The contractor will support any equipment listed in the solicitation that becomes legacy equipment and out-of-support instruments on a best effort basis.

Security Requirements:

The contractor shall provide the COTR with information on the names of all employees who will require access to the facility in order to perform work on equipment, including approximate date and time of arrival. This should be provided at least 24 hours in advance of work being performed. All employees provided by contractor must have valid picture identification before being allowed onto the premises.

4.0 Government Furnished

The government furnishes the guidelines for service visits.

5.0 Deliverables / Schedule

Service is provided during normal business hours (8:00 AM – 4:00 PM, Monday – Friday). The scope of the work is listed above. The service contract will be for a period of one year.

6.0 Travel

7.0 Contractor’s Key Personnel

The contractor will guarantee only their trained and certified employees, sub- contractors, agents or other authorized labor of the contractor are to perform work on the equipment listed in this Statement of Work. The contractor shall demonstrate said training and certification by providing a recent (within 1 year) copy of training and/or certification documentation to the COTR prior to commencing work. The COTR may reject employees, subcontractors, agents or other authorized labor of the contractor if they do not meet the training or certification documentation requirements

8.0 Security Requirements

The contractor shall provide the COR with information on the names of all employees who will require access to the facility in order to perform work on equipment, including approximate date and time of arrival. This shall be provided at least 24 hours in advance of work being performed or as mutually agreed upon by contractor and COR or designee representative. All employees provided by contractor must have valid driver’s license or state photo identification before being allowed onto the premises.

10.0 Section 508 – Electronic and Information Technology Standards

(a) This SOW is subject to Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d) as amended by the Workforce Investment Act of 1998 (P.L. 105-220). Specifically, subsection 508(a)(1) requires that when the Federal Government procures Information and Communications Technology (ICT)1, the ICT must allow

Federal employees and members of the public with disabilities comparable access to and use of information and data provided to Federal employees and members of the public without disabilities.

(b) The ICT accessibility standards as 36 CFR Part 1194 were developed by the Architectural and Transportation Barriers Compliance Board (also known as the Access Board) and apply to contracts, task orders, and indefinite quantity contracts on or after June 25, 2001.

(c) Each Information and Communications Technology (ICT) product or service furnished under this contract shall comply with the Information and Communications Technology Accessibility Standards (36 CFR 1194), as specified in the contract, at a minimum. If the Contracting Officer determines any furnished product or service is not in compliance with the contract, the Contracting Officer will promptly inform the Contractor in writing.

The Contractor shall, without charge to the Government, repair or replace the non-compliant products or services within a period of time specified by the Government in writing. If such repair or replacement is not completed within the time specified, the Government shall have the following recourses:

1) Cancellation of the contract, delivery, or task order, purchase, or line item without termination liabilities;

or

2) In the case of custom Information and Communications Technology (ICT) being developed by a contractor for the Government, the Government shall have the right to have any necessary changes made or repairs performed by itself or by another firm for the non-compliant ICT, with the contractor liable for reimbursement to the Government for any expenses incurred thereby.

(d) The contractor must ensure that all ICT products and services that are less than fully compliant with the accessibility standards are provided pursuant to extensive market research and are the most current compliant products or services available to satisfy the contract requirements.

(e) For every ICT product or service accepted under this contract by the Government that does not comply with 36 CFR 1194, the contractor shall, at the discretion of the Government, make every effort to replace or upgrade it with a compliant equivalent product or service, if commercially available and cost neutral, on either a contract specified refresh cycle for the product or service, or on a contract effective option/renewal date, whichever shall occur first.

Section 508 Compliance The vendor shall comply with the standards, policies, and procedures below. In the event of conflicts between the referenced documents and this SOW, the SOW shall take precedence.

All web content or communications materials produced, regardless of format (text, audio, video, etc.), must conform to the applicable Section 508 standards to allow Federal employees and members of the public with disabilities comparable access to and use of information and data provided to Federal employees and members of the public without disabilities. All contractors (including sub-contractors) and consultants responsible for preparing or posting content must comply with the applicable Section 508 accessibility standards and, where applicable, those set forth in the referenced policy or standards document above. Remediation of any materials that do not comply with the applicable provisions of 36 CFR Part 1194 as set forth in the SOW shall be the responsibility of the contractor or consultant.

All Information and Communications Technology (ICT) subject to the 36 CFR 1194 standards will have a Section 508 usability and acceptance test where Section 508 compliance will be validated. This test must be administered by a Federal Section 508 Testing Center.

All maintenance for Information and Communications Technology that requires upgrades, modifications, installations, and purchases will adhere to the Section 508 standards and 36 CFR 1194.
