Design and locate equipment repair shops, stationary refueling sites, or other facilities to minimize the potential and impacts of hazardous material spills on Government land.

Before beginning any work, submit a Hazardous Spill Plan. List actions to be taken in the event of a spill. Incorporate preventive measures to be taken, such as the location of mobile refueling facilities, storage and handling of hazardous materials, and similar information.

Describe how the contractor will comply with the following three methods to minimize fuel/oil leakage from construction equipment into the stream channel. Include the following:

i. Clean all equipment used for in-water work so that it is free of external oil, grease, dirt and mud, and repair leaks, prior to arriving at the project site. All equipment will be inspected by the Contracting Officer’s Representative before unloading at site.

Correct any leaks or accumulations of grease before entering the lake or areas that drain directly to the lake or wetlands.

ii. Fuel and service equipment used for in-water or riparian work (including chainsaws and other hand power tools) in an established staging area (site-specifically recommended by CO). When not in use, store vehicles in the designated staging area.

The staging area should be in an area that will not deliver fuel, oil, etc., to adjacent waterways.

iii. Oil-absorbing floating booms, and other equipment such as pads and absorbent “peanuts” appropriate for the size of the in-water work activities, shall be available on site during all phases of construction. Pads and straw bales to anchor booms may be necessary. Place booms in a location that facilitates an immediate response to potential petroleum leakage.

Immediately notify the CO of all hazardous material spills. Provide a written narrative report form no later than 24 hours after the initial report, and include the following:

• Description of the item spilled (including identity, quantity, manifest number, and other identifying information).

• Whether amount spilled is EPA- or State-reportable, and if so whether it was reported, and to whom. Follow Federal and State of Montana regulations regarding spills. Report any spills resulting in a detectable sheen on water to the EPA National Response Center (1-800-424-8802). Report any spills over 25 gallons to the Montana DEQ (1-800-457- 0568), and initiate cleanup within 24 hours of the spill.

• Exact time and location of spill including a description of the area involved.

• Containment procedures.

• Summary of any communications the Contractor had with news media, Federal, State and local regulatory agencies and officials, or Forest Service officials.

• Description of clean-up procedures employed or to be employed at the site, including final disposition and disposal location of spill residue.

• When available, provide copies of all spill-related clean-up and closure documentation and correspondence from regulatory agencies.

The Contractor is solely responsible for all spills or leaks that occur during the performance of this contract. Clean up spills or leaks to the satisfaction of the CO and in a manner that complies with Federal, state, and local laws and regulations.
