Justification for Other than Full and Open Competition Simplified Acquisition Threshold

6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available:

7. The use of Bearing Sleeve (Oil Feed Bushings) are required for maintenance of Escher Wyss controllable pitch propeller (CPP) oil distribution box onboard the 270 WMEC class cutters. OEM parts for the CPP system have been previously utilized and are proved to be effective during repair of the CPP system. Without the bearing sleeves the hydraulic oil can leak past the bushing surface and cause a failure to the propeller pitch system thereby severely diminishing the vessels maneuverability.

Failure of the propeller system would cause the loss of the vessel’s mission.

8. When Coast Guard purchased the original equipment there were no requirements for manufacturer’s drawings, detailed parts lists, design or testing procedures. OEM is the only know manufacturer that has the techniques, design specifications, testing, quality assurance capability, and documentation necessary to manufacture these parts as used onboard Coast Guard Cutters.

9. COR will continue to conduct market research with a focus on locating vendors that are able to meet requirements, however without technical data described above obtaining full and open competition will be very difficult. The Coast Guard cannot require any vendor to release proprietary information.
