FOR OTHER THAN FULL AND OPEN COMPETITION

2. Description of the Action Being Approved:
This is a sole source action submitted for approval to award a sole source Firm Fixed Priced contract for industrial shelters manufactured and sold by Big Top Manufacturing, Inc., in support of NAVSUP Weapon Systems Support (WSS) facilities at Cheatham Annex in Williamsburg, Virginia, and at Yermo Annex in Barstow, California. This requirement will be awarded subject to FAR 13.5 – “Simplified Procedures for Certain Commercial Items.”
3. Description of Supplies/Services:
NAVSUP WSS provides and maintains supply depots for fleet submarine assets in support of
Navy forces ashore and afloat. The instant acquisition is to procure industrial-size shelter structures to store replacement assets in designated areas at both facilities.
The Independent Government Estimate (IGE) for this requirement is $324,635.65, and the required delivery date is 30 November 2021. Big Top manufactures industrial sized protective shelters that are relocatable and constructed from flame-retardant and weather-resistant fabric and welded steel frames. Big Top is the only manufacturer capable of providing shelters in the shapes, dimensions, and kitting configurations to incorporate successfully into the required space and array of storage structures at each facility.
4. Identification of Statutory Authority:
The statutory authority permitting other than Full and Open Competition under the test program for certain commercial items is section 41 U.S. Code Section 1901, as implemented by FAR 13.501(a). As identified in paragraph 5, there is only one industrial shelter manfuacturer able to
2 Source Selection Information – See FAR 2.101 and 3.104 provide the necessary items satisfactorily and no other vendor will satisfy the agency’s minimum requirements. Big Top products meet the full range of capabilities required by NAVSUP WSS.
5. Rationale Justifying Use of Cited Statutory Authority:
The required Big Top shelters are currently in use in the NAVSUP WSS facilities at Cheatham
Annex and Yermo Annex, with lift kitting designed to ensure safe and stable movement of the shelters. Material handling equipment at each location is configured to lift the structures using the manufacturer’s lift kit in order to move the assets in and out of the shelters without damaging the shelters or assets. Material handling equipment operators in each location possess the required training to maintain and maneuver the shelters safely according to the manufacturer’s handling guidelines. NAVSUP WSS would have to purchase additional handling equipment and retrain personnel in order to support and maintain a different product to obtain a full range of required capabilities. This would significantly impact cost and schedule of NAVSUP WSS’s mission.
This is a follow-on contract for the continued deployment of highly specialized equipment, including major components thereof. It is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. The original requirement was competed with only one acceptable offer that met all specifications.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
The synopsis required by FAR 5.201 will be published on the Government-wide point of entry as intent to negotiate on a sole source basis to Big Top Manufacturing, Inc.
7. Determination of Fair and Reasonable Cost:
The Procuring Contracting Officer will make a determination of fair and reasonableness of price based upon price analysis in accordance with FAR 13.106-3.
8. Actions to Remove Barriers to Future Competition:
For the reason set forth in Paragraph 5, the Government has no plans at this time to compete future contracts for the types of supplies detailed in this document. If another potential source emerges, the Government will assess whether competition for future requirements is feasible. All future requirements will be researched on a case by case basis.
