About this file

This document is a sole source justification for a firm-fixed-price contract to Rix Industries and Curtiss-Wright for low pressure air compressor maintenance on a Navy vessel. The requirement is for 5,000-hour maintenance on the LPACs during the ship's availability, as two of the three units must be fully functional to meet minimum operational needs. Market research found no other companies qualified to perform this work besides Rix and Curtiss-Wright. A contract was subsequently awarded to Curtiss-Wright Electro-Mechanical Corporation for $628,603.78 on May 31, 2023 under solicitation N0040623C0019 for the LPAC repair and maintenance. The sole source justification cites the LPACs' design as a Navy-owned model manufactured by Rix and Curtiss-Wright, who have demonstrated capability to perform the maintenance as long as programmable logic controllers are not involved.

4. Basis for Sole Source

a. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:

Unusual and compelling urgency Exclusive licensing agreements Industrial mobilization

Brand Name (Note approval level requirements are applicable only to this portion

FAR 13.501(2)

Other: Implemented by FAR 13.501(a).

b. Reason for Authority Cited:

The LPACs on this DDG are Star-200 models, which are a Navy owned design manufactured by RIX Industries and Curtiss-Wright. Both RIX and Curtiss Wright have demonstrated the capability to perform this 5000-hour maintenance requirement as long as their respective Programmable Logic Controller (PLC) is not involved in the scope. This requirement has no PLC work involved and as such; both companies are capable of performing. Naval Sea Systems Command (NAVSEA) Letter 05Z/211, states RIX and Curtiss-Wright are both qualified sources to perform work on these units.

COMPACFLT Type Commander (TYCOM) tasked this requirement for the 5,000-hour maintenance of the LPAC units for accomplishment during the ship’s availability. The ship will need two of its three LPACS fully functional to meet minimum operational requirement. Delay on the LPACS repair could significantly impact availability duration and ship underway schedule.

5. Efforts to Obtain Competition:

A search of both the Unicor and AbilityOne websites using the search phrase “Low Pressure Air Compressor” was conducted on 15 February 2023. Neither site produced any viable results.

6. Actions to Increase Competition:

The Contracting Officer will publish the notices required by FAR 5.201.

7. Market Research:

Market research shows no other companies besides RIX and Curtiss-Wright have been deemed responsible to quote this type of LPAC maintenance. Similar requirements have been procured previously under contracts; N0040622C0020 and N0040622C0030 as commercial FFP Supply type contracts. For that reason in accordance with DFARS 212.102(a)(ii)(B)(2) these supplies are determined commercial in nature.

8. Actions to Remove Barriers to Future Competition For the reasons set forth in Paragraph 4, Fleet Logistics Center Puget Sound (FLC PS) has no plans at this time to compete future contracts for the types of supplies/services covered by this

For Official Use Only document. If another potential source emerges, FLC PS will assess whether competition for future requirements is feasible.

9. Any Other facts supporting the use of other than full and open competition.
