About this file

This document is a sole source justification and approval for a federal contract award. The contract was awarded to Specialty Chemical Corp for $673,178.05 on September 30, 2020. The requirement was for 250 Epoxy Deck Kit Part 2s and 300 complete Epoxy Deck Kits to allow sailors to install flooring in designated areas of ships. The kits contain epoxy resins, primers, underlayment, tools, and manuals. Training and technical oversight by Specialty Chemical Corp is also included to ensure safe and proper installation. The sole source justification cited that while individual kit items are commercially available, only Specialty Chemical Corp can provide the approved combination of products, training, and oversight required by Navy standards. Market research found no other qualified sources. The price per unit was determined fair and reasonable based on previous contract pricing.

4. Basis for Sole Source

a. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C.

1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:

Unusual and compelling urgency Exclusive licensing agreements Industrial mobilization Brand Name (Note approval level requirements are applicable only to this portion FAR

13.501(2) Other:

b. Reason for Authority Cited:

NAVSEA created a program that allows sailors to install decking material in areas of the ship including passage ways, offices, and mess decks. The program is intended to save the Navy money and time by allowing ship forces to install the decking as opposed to hiring contractors to perform the work. NAVSEA worked with Specialty Chemical Corp to supply a cosmetic polymeric decking material that contained epoxy resin to meet MIL-PRF-32584 Performance Specification for Deck Covering Material. The program was established five years ago and the kits were previously contracted through the Naval Surface Warfare Center (NSWC).

While some of the individual parts of the kits are available on the open market, the sole source to Specialty Chemical Corp is required for the combination of product, training, and technical oversite included with each purchase. NSWC-PD has validated Specialty Chemical Corps training content and procedures adhere to NAVSEA Standard Item (NSI) 009-26 Deck Covering Requirements, and Naval Ship Technical Manual (NSTM) 634, Deck Coverings. The training and technical oversite enables sailors to install the decking material correctly without injuring themselves or causing damage or material failure.

5. Efforts to Obtain Competition:

The Contracting Officer will publish the notices required by FAR 5.201.

6. Actions to Increase Competition:

The kits are being sourced from the approved vendor under the program established by NAVSEA.

MARMC and NAVSEA will provide notice via the government point of entry for companies to have the opportunity of becoming qualified providers. Contractors may contact NAVSEA in Norfolk to apply for qualification in order to be listed under NSI 009-26, NSTM 634, and MIL-PRF-32584 standard.

7. Market Research:

The combination of the individual items of the kits are available to the general public and are of a type customarily combined and sold in combination to the public and meet the requirements of the definition of Commercial Item(1)(i) under FAR 2.101. Additionally, the kits have been purchased under contract as commercial items. For these reasons the kit meets the definition Commercial Item (4) under FAR 2.101 and DFARS 212.102(a)(ii)(A).

A search of the UNICOR and Ability-One websites produced no results for the Epoxy Kit Part 2 using the NSN provided. An internet search was conducted for other kits that included the approved materials, training, and oversite were not found.

Based on the market research it is determined that the requirement can be procured commercially from Specialty Chemical Corp. The award will be for a firm fixed-priced supply type purchase order to Specialty Chemical Corp based on a sole source justification under FAR 13.5. The award will be made using FAR Part 12 and Subpart 13.5.

8. Actions to Remove Barriers to Future Competition For the reasons set forth in Paragraph 6, if another source is approved by MARMC and NAVSEA in accordance with NSI 009-26, NSTM 634, and MIL-PRF-32584 requirements, Naval Supply Fleet Logistics Center Puget Sound will solicit future requirements on a competitive basis in accordance to FAR.

All contractors approved by MARMC and NAVSEA will be able to compete on future requirement.

9. Any Other facts supporting the use of other than full and open competition.
